<official-title>To amend the Immigration and Nationality Act to render inadmissible and deportable aliens who have participated in criminal street gangs, and for other purposes.</official-title>

<section id="H063570933AE2431CB9D63838011FF7B9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Alien Gang Removal Act of 2005</short-title></quote>.</text></section> 
<section id="HA795D0982A7540E882916DA0F630AC4E"><enum>2.</enum><header> Rendering inadmissible and deportable aliens participating in criminal street gangs</header> 
<subsection id="H179DEA16E7F14BBA893444882D5835A0"><enum>(a)</enum><header>Inadmissible</header><text>Section 212(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(2)</external-xref>) is amended by adding at the end the following:</text>

<subparagraph id="H5A49E13DCC604BB9B8C5FDD5DBD3091"><enum>(J)</enum><header>Criminal street gang participation</header> 
<clause id="HC0EC58D0176A41B985153634293460E1"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Any alien is inadmissible if—</text> 
<subclause id="H952AEBC2832243AE8FF6CDCF5634AE07"><enum>(I) </enum><text>the alien has been removed under section 237(a)(2)(F); or</text></subclause> 
<subclause id="H60F2910DBE8D4E7ABC01D885A396BB86"><enum>(II)</enum><text display-inline="yes-display-inline">the consular officer or the Secretary of Homeland Security knows, or has reasonable ground to believe that the alien—</text> 
<item id="HFB2561C57FB74214BE2726CEDA08EBA2"><enum>(aa)</enum><text display-inline="yes-display-inline">is a member of a criminal street gang and has committed, conspired, or threatened to commit, or seeks to enter the United States to engage solely, principally, or incidentally in, a gang crime or any other unlawful activity; or</text></item> 
<item id="HDFF656E4DC434345B1BBC3F1188D2E"><enum>(bb)</enum><text>is a member of a criminal street gang designated under section 219A.</text> </item></subclause></clause> 
<clause id="H5C4332939A9C4A62AB10B4055C5D0056"><enum>(ii)</enum><header>Definitions</header><text>For purposes of this subparagraph:</text> 
<subclause id="H5135A190D90B4F80A8003942847B0076"><enum>(I)</enum><header>Criminal street gang</header><text display-inline="yes-display-inline">The term ‘criminal street gang’ means a formal or informal group or association of 3 or more individuals, who commit 2 or more gang crimes (one of which is a crime of violence, as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/16">section 16</external-xref> of title 18, United States Code) in 2 or more separate criminal episodes in relation to the group or association.</text></subclause> 
<subclause id="H89707AD9E0B340EC99E3B804426897DD"><enum>(II)</enum><header>Gang crime</header><text display-inline="yes-display-inline">The term <term>gang crime</term> means conduct constituting any Federal or State crime, punishable by imprisonment for one year or more, in any of the following categories:</text> 
<item id="HF33E7F19EFA54B040072A18DA927ABAE"><enum>(aa)</enum><text display-inline="yes-display-inline">A crime of violence (as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/16">section 16</external-xref> of title 18, United States Code) .</text></item> 
<item id="H4A4E0C6BDF974577AA00A2B57511702E"><enum>(bb)</enum><text display-inline="yes-display-inline">A crime involving obstruction of justice, tampering with or retaliating against a witness, victim, or informant, or burglary.</text></item> 
<item id="HC0C2D806321446018CC34DC75D3108C9"><enum>(cc)</enum><text display-inline="yes-display-inline">A crime involving the manufacturing, importing, distributing, possessing with intent to distribute, or otherwise dealing in a controlled substance or listed chemical (as those terms are defined in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>)).</text></item> 
<item id="H7C8283CCA55646D083878D03F520D1D"><enum>(dd)</enum><text display-inline="yes-display-inline">Any conduct punishable under <external-xref legal-doc="usc" parsable-cite="usc/18/844">section 844</external-xref> of title 18, United States Code (relating to explosive materials), subsection (d), (g)(1) (where the underlying conviction is a violent felony (as defined in section 924(e)(2)(B) of such title) or is a serious drug offense (as defined in section 924(e)(2)(A)), (i), (j), (k), (o), (p), (q), (u), or (x) of section 922 of such title (relating to unlawful acts), or subsection (b), (c), (g), (h), (k), (l), (m), or (n) of section 924 of such title (relating to penalties), section 930 of such title (relating to possession of firearms and dangerous weapons in Federal facilities), section 931 of such title (relating to purchase, ownership, or possession of body armor by violent felons), sections 1028 and 1029 of such title (relating to fraud and related activity in connection with identification documents or access devices), section 1952 of such title (relating to interstate and foreign travel or transportation in aid of racketeering enterprises), section 1956 of such title (relating to the laundering of monetary instruments), section 1957 of such title (relating to engaging in monetary transactions in property derived from specified unlawful activity), or sections 2312 through 2315 of such title (relating to interstate transportation of stolen motor vehicles or stolen property).</text></item> 
<item id="H772C64E27864432A811E8FCC307494A8"><enum>(ee)</enum><text display-inline="yes-display-inline">Any conduct punishable under section 274 (relating to bringing in and harboring certain aliens), section 277 (relating to aiding or assisting certain aliens to enter the United States), or section 278 (relating to importation of alien for immoral purpose) of this Act.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC33D32E3C49E4F72B2FE84FE8CFFDF4B"><enum>(b)</enum><header>Deportable</header><text>Section 237(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(2)</external-xref>) is amended by adding at the end the following:</text>

<subparagraph id="HBDF416B638984D969DA14822A7AF8DC3"><enum>(F)</enum><header>Criminal street gang participation</header> 
<clause id="HF7674B4B7CC04B5DB26D41D3CDEA3C14"><enum>(i)</enum><header>In general</header><text>Any alien is deportable who—</text> 
<subclause id="H6A310F21AD3A46A1868CE98DA2883352"><enum>(I)</enum><text>is a member of a criminal street gang and is convicted of committing, or conspiring, threatening, or attempting to commit, a gang crime; or</text></subclause> 
<subclause id="H3DD5100B69BC456ABDB26004CB25986"><enum>(II)</enum><text display-inline="yes-display-inline">is determined by the Secretary of Homeland Security to be a member of a criminal street gang designated under section 219A.</text></subclause> </clause> 
<clause id="H75004C147C3E440FA18DA1BB85EB77FC"><enum>(ii)</enum><header>Definitions</header><text>For purposes of this subparagraph, the terms <term>criminal street gang</term> and <term>gang crime</term> have the meaning given such terms in section 212(a)(2)(J)(ii). </text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8EC91E72F15E438C9BBC281EF3439FA2"><enum>(c)</enum><header>Designation of criminal street gangs</header> 
<paragraph id="H7799F915AC2E43BEA9AB4DD07B54D774"><enum>(1)</enum><header>In general</header><text>Chapter 2 of title II of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1181">8 U.S.C. 1181 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="HC2DAC3A804494B459D5162BB11ACBCC"><enum>219A.</enum><header>Designation of criminal street gangs</header> 
<subsection id="H872ECA72A4FA43BE80575C042B658FCC" display-inline="yes-display-inline"><enum> (a)</enum><header>Designation</header> 
<paragraph id="HB4940017C2E94C0EAAA87FAD634C7D94"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Attorney General is authorized to designate a group or association as a criminal street gang in accordance with this subsection if the Attorney General finds that the group or association meets the criteria described in section 212(a)(2)(J)(ii)(I).</text></paragraph> 
<paragraph id="HEBED0385344344AB909EA7A4E100AE63"><enum>(2)</enum><header>Procedure</header> 
<subparagraph id="HCA4AF235484C43498BE5CC668800991B"><enum>(A)</enum><header>Notice</header> 
<clause id="H8DCE8625021948F585AE7349ED12FBA4"><enum>(i)</enum><header>To congressional leaders</header><text display-inline="yes-display-inline">Seven days before making a designation under this subsection, the Attorney General shall, by classified communication, notify the Speaker and Minority Leader of the House of Representatives, the President pro tempore, Majority Leader, and Minority Leader of the Senate, and the members of the relevant committees of the House of Representatives and the Senate, in writing, of the intent to designate a group or association under this subsection, together with the findings made under paragraph (1) with respect to that group or association, and the factual basis therefor.</text></clause> 
<clause id="H4744F2AE36784C35A47B00F82852B2DD"><enum>(ii)</enum><header>Publication in Federal Register</header><text display-inline="yes-display-inline">The Attorney shall publish the designation in the Federal Register seven days after providing the notification under clause (i).</text></clause></subparagraph> 
<subparagraph id="H66859CB56C8A482E836EE0B8F83D65D4"><enum>(B)</enum><header>Effect of designation</header> 
<clause id="HA293C97B53404CDC9D662C92924D213F"><enum>(i)</enum><text display-inline="yes-display-inline">A designation under this subsection shall take effect upon publication under subparagraph (A)(ii).</text></clause> 
<clause id="HE8808633AAEE4269A7BAC4957344FB8C"><enum>(ii)</enum><text display-inline="yes-display-inline">Any designation under this subsection shall cease to have effect upon an Act of Congress disapproving such designation.</text></clause></subparagraph></paragraph> 
<paragraph id="H8DD2867903BA497295FC11DAF285F100"><enum>(3)</enum><header>Record</header><text>In making a designation under this subsection, the Attorney General shall create an administrative record.</text> </paragraph> 
<paragraph id="HFD81E6C1D4DC4DCDBD3BAC3E63F1F251"><enum>(4)</enum><header>Period of designation</header> 
<subparagraph id="H57A759DFBAC34C2394AD02B6BC147C99"><enum>(A)</enum><header>In general</header><text>A designation under this subsection shall be effective for all purposes until revoked under paragraph (5) or (6) or set aside pursuant to subsection (b).</text></subparagraph> 
<subparagraph id="H4B4CCBEE99934514904D2D873C8E20D2"><enum>(B)</enum><header>Review of designation upon petition</header> 
<clause id="HDFCF34488EC64665A689B9BECE44C70"><enum>(i)</enum><header>In general</header><text>The Attorney General shall review the designation of a criminal street gang under the procedures set forth in clauses (iii) and (iv) if the designated gang or association files a petition for revocation within the petition period described in clause (ii).</text></clause> 
<clause id="HA54B51CEB26D4E39B724EACADDC42E2"><enum>(ii)</enum><header>Petition period</header><text>For purposes of clause (i)—</text> 
<subclause id="H1CBDFCC71D2641BC856713FA2EC52275"><enum>(I)</enum><text>if the designated gang or association has not previously filed a petition for revocation under this subparagraph, the petition period begins 2 years after the date on which the designation was made; or</text></subclause> 
<subclause id="H69BC11AAACAA4128A323C6726AD1265"><enum>(II)</enum><text>if the designated gang or association has previously filed a petition for revocation under this subparagraph, the petition period begins 2 years after the date of the determination made under clause (iv) on that petition.</text></subclause></clause> 
<clause id="HB67717CA6EF645568E6E2124113828E6"><enum>(iii)</enum><header>Procedures</header><text>Any criminal street gang that submits a petition for revocation under this subparagraph must provide evidence in that petition that the relevant circumstances described in paragraph (1) are sufficiently different from the circumstances that were the basis for the designation such that a revocation with respect to the gang is warranted.</text></clause> 
<clause id="H77016A387601410D80000055A9391D24"><enum>(iv)</enum><header>Determination</header> 
<subclause id="H11E85AA17CAC4FE1BD0005AAF07F8919"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after receiving a petition for revocation submitted under this subparagraph, the Attorney General shall make a determination as to such revocation.</text></subclause> 
<subclause id="H481B5ADE35C146AAAFCB26D37360026"><enum>(II)</enum><header>Publication of determination</header><text>A determination made by the Attorney General under this clause shall be published in the Federal Register.</text></subclause> 
<subclause id="HFDB87C55B60045418B769FF26D258FD9"><enum>(III)</enum><header>Procedures</header><text>Any revocation by the Attorney General shall be made in accordance with paragraph (6).</text></subclause></clause></subparagraph> 
<subparagraph id="HDB03D77E991D40FE85DB0017177935C1"><enum>(C)</enum><header>Other review of designation</header> 
<clause id="H1CF1B844D1804E4883AE546DB5E5212"><enum>(i)</enum><header>In general</header><text>If in a 5-year period no review has taken place under subparagraph (B), the Attorney General shall review the designation of the criminal street gang in order to determine whether such designation should be revoked pursuant to paragraph (6).</text></clause> 
<clause id="HE096086EC47B42CC8FDB8E5700E0E1B6"><enum>(ii)</enum><header>Procedures</header><text display-inline="yes-display-inline">If a review does not take place pursuant to subparagraph (B) in response to a petition for revocation that is filed in accordance with that subparagraph, then the review shall be conducted pursuant to procedures established by the Attorney General. The results of such review and the applicable procedures shall not be reviewable in any court.</text></clause> 
<clause id="H7E1B93FC227E4B8BA7C6827F2EBF5B2B"><enum>(iii)</enum><header>Publication of results of review</header><text display-inline="yes-display-inline">The Attorney General shall publish any determination made pursuant to this subparagraph in the Federal Register.</text></clause></subparagraph></paragraph> 
<paragraph id="H6E34943EC8624F8894CA6E1870C17EA0"><enum>(5)</enum><header>Revocation by act of Congress</header><text>The Congress, by an Act of Congress, may block or revoke a designation made under paragraph (1).</text></paragraph> 
<paragraph id="H194D0A2332F74B97895E8261FF515E09"><enum>(6)</enum><header>Revocation based on change in circumstances</header> 
<subparagraph id="HCE5DA3CD0C174B82B89E2E971F5F039B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Attorney General may revoke a designation made under paragraph (1) at any time, and shall revoke a designation upon completion of a review conducted pursuant to subparagraphs (B) and (C) of paragraph (4) if the Attorney General finds that—</text> 
<clause id="H8BA2CE669ACC46D0ABDE6BA6FB16401D"><enum>(i)</enum><text>the circumstances that were the basis for the designation have changed in such a manner as to warrant revocation; or</text></clause> 
<clause id="HE51C0CE10F26459F8DC02546051612CF"><enum>(ii)</enum><text>the national security of the United States warrants a revocation.</text></clause></subparagraph> 
<subparagraph id="H8F942EE256E445B99F00B445AB26DE2D"><enum>(B)</enum><header>Procedure</header><text>The procedural requirements of paragraphs (2) and (3) shall apply to a revocation under this paragraph. Any revocation shall take effect on the date specified in the revocation or upon publication in the Federal Register if no effective date is specified.</text></subparagraph></paragraph> 
<paragraph id="H15A5B0EA5DB543EEB3F5945BFA036604"><enum>(7)</enum><header>Effect of revocation</header><text>The revocation of a designation under paragraph (5) or (6) shall not affect any action or proceeding based on conduct committed prior to the effective date of such revocation.</text></paragraph> 
<paragraph id="HD9D7C5CB31FD4C539F26DC9800577429"><enum>(8)</enum><header>Use of designation in hearing</header><text>If a designation under this subsection has become effective under paragraph (2)(B) an alien in a removal proceeding shall not be permitted to raise any question concerning the validity of the issuance of such designation as a defense or an objection at any hearing.</text></paragraph> </subsection> 
<subsection id="HAF41C5BD370E4DF3A6002C1B008DFD83"><enum>(b)</enum><header>Judicial review of designation</header> 
<paragraph id="H7E6DACDF0AA9448BB11354E18CC983C9"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after publication of the designation in the Federal Register, an group or association designated as a criminal street gang may seek judicial review of the designation in the United States Court of Appeals for the District of Columbia Circuit.</text></paragraph> 
<paragraph id="HEC479D73D0E1463990F700B9A1E7D44"><enum>(2)</enum><header>Basis of review</header><text>Review under this subsection shall be based solely upon the administrative record.</text></paragraph> 
<paragraph id="HEA2CD87540B4446F9CD6EEC68D6BADD"><enum>(3)</enum><header>Scope of review</header><text>The Court shall hold unlawful and set aside a designation the court finds to be—</text> 
<subparagraph id="HB5BCA26ADA9F414D93CC9DB6607F0A0"><enum>(A)</enum><text>arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law;</text></subparagraph> 
<subparagraph id="H3316F18980634FD9B8DA145888A1C71D"><enum>(B)</enum><text>contrary to constitutional right, power, privilege, or immunity;</text></subparagraph> 
<subparagraph id="H574EF79FC4484FA0005E8FD33FDC00B2"><enum>(C)</enum><text>in excess of statutory jurisdiction, authority, or limitation, or short of statutory right;</text></subparagraph> 
<subparagraph id="HEDB11428805E43BBAEF88415076639A"><enum>(D)</enum><text>lacking substantial support in the administrative record taken as a whole; or </text></subparagraph> 
<subparagraph id="H9A5744B53EB24C75A17F8DDEA3E508BB"><enum>(E)</enum><text>not in accord with the procedures required by law.</text></subparagraph></paragraph> 
<paragraph id="H04A62119B7824C6FA5332C3E0083A196"><enum>(4)</enum><header>Judicial review invoked</header><text display-inline="yes-display-inline">The pendency of an action for judicial review of a designation shall not affect the application of this section, unless the court issues a final order setting aside the designation.</text></paragraph> </subsection> 
<subsection id="H513EA38047CA4E7781E424637564ED40"><enum>(c)</enum><header>Relevant committee defined</header><text display-inline="yes-display-inline">As used in this section, the term <term>relevant committees</term> means the Committees on the Judiciary of the House of Representatives and of the Senate.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H6DF6F548D13940A995A7B14D8025CB1"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents for the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) is amended by inserting after the item relating to section 219 the following:</text>

<toc regeneration="no-regeneration"> 
<toc-entry level="section">Sec. 219A. Designation of criminal street gangs</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HD37508909BB348CFB9912FCB3F8D81EC"><enum>3.</enum><header>Mandatory detention of suspected criminal street gang members</header> 
<subsection id="H46DCFA1AFB19414197C47CC1CC83CD45"><enum>(a)</enum><header>In general</header><text>Section 236(c)(1)(D) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226(c)(1)(D)</external-xref>) is amended—</text> 
<paragraph id="H72BEDA0C297B4B56AD08A00370571E88"><enum>(1)</enum><text>by inserting <quote>or 212(a)(2)(J)</quote> after <quote>212(a)(3)(B)</quote>; and</text></paragraph> 
<paragraph id="H8C3FFBE111EA40A19E172C32564DAB38"><enum>(2)</enum><text>by inserting <quote>or 237(a)(2)(F)</quote> before <quote>237(a)(4)(B)</quote>.</text></paragraph> </subsection> 
<subsection id="HAB5F9DEB7B4E41FF92F8A9AB5CE1317D"><enum>(b)</enum><header>Annual report</header><text>Not later than March 1 of each year (beginning 1 year after the date of the enactment of this Act), the Secretary of Homeland Security, after consultation with the appropriate Federal agencies, shall submit a report to the Committees on the Judiciary of the House of Representatives and of the Senate on the number of aliens detained under the amendments made by subsection (a).</text> </subsection></section> 
<section id="H9286C16008D44D4A9000F9A74FCD11E7"><enum>4.</enum><header>Ineligibility from protection from removal and asylum</header> 
<subsection id="HE4A6378FC75F4A9B916F8E2EFDC2B6F1"><enum>(a)</enum><header>Inapplicability of restriction on removal to certain countries</header><text>Section 241(b)(3)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1251">8 U.S.C. 1251(b)(3)(B)</external-xref>) is amended, in the matter preceding clause (i), by inserting <quote>who is described in section 212(a)(2)(J)(i) or section 237(a)(2)(F)(i) or who is</quote> after <quote>to an alien</quote>.</text></subsection> 
<subsection id="HDE9949CED7D045C5A5A211129361713E"><enum>(b)</enum><header>Ineligibility for asylum</header><text>Section 208(b)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(b)(2)(A)</external-xref>) is amended—</text> 
<paragraph id="HE173096A03774282B67D29B69F9B7128"><enum>(1)</enum><text>in clause (v), by striking <quote>or</quote> at the end;</text></paragraph> 
<paragraph id="HEE86E9E35EC149A38523EBB5D11DA21B"><enum>(2)</enum><text>by redesignating clause (vi) as clause (vii); and</text></paragraph> 
<paragraph id="HD6ECFB24AAFD4DD587F90D96E137407"><enum>(3)</enum><text>by inserting after clause (v) the following:</text>

<clause id="H5E93138F588D4A8484433ED5081F2057"><enum>(vi)</enum><text display-inline="yes-display-inline">the alien is described in section 212(a)(2)(J)(i) or section 237(a)(2)(F)(i) (relating to participation in criminal street gangs); or</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H5501DE0A894743D3AA8316E085B5464C"><enum>(c)</enum><header>Denial of review of determination of ineligibility for temporary protected status</header><text>Section 244(c)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254">8 U.S.C. 1254(c)(2)</external-xref>) is amended by adding at the end the following:</text>

<subparagraph id="HC95AC1F6E379491C834CD7EEB3D70E1"><enum>(C)</enum><header>Limitation on judicial review</header><text display-inline="yes-display-inline">There shall be no judicial review of any finding under subparagraph (B) that an alien is in described in section 208(b)(2)(A)(vi).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section>
