<official-title>To reestablish the Office of Noise Abatement and Control in the Environmental Protection Agency, and for other purposes.</official-title>

<section id="HFF74CE97100A43969CB850550015AB94" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Quiet Communities Act of 2005</short-title></quote>.</text></section> 
<section id="H15A4094249184DF6BE93E874A040DE3D"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="HEDEB065FC7AD43A99175E1983B671143"><enum>(1)</enum><text>Approximately 28,000,000 Americans are afflicted with some hearing loss and it has been estimated that 10,000,000 of these impairments are at least partially attributable to damage from exposure to noise.</text></paragraph> 
<paragraph id="HCE5FF1030BF3454F8631DFD4B89429C1"><enum>(2)</enum><text>For millions of Americans, noise from aircraft, vehicular traffic, and a variety of other sources is a constant source of torment. Millions of Americans are exposed to noise levels that can lead to sleep loss, psychological and physiological damage, and work disruption.</text></paragraph> 
<paragraph id="H715B88AA5E34493792BDD2990049E495"><enum>(3)</enum><text>Chronic exposure to noise has been linked to increased risk of cardiovascular disorders, learning deficits in children, stress, and diminished quality of life.</text></paragraph> 
<paragraph id="H63CA4292C9AA40DFB4F4F3533CAA38C8"><enum>(4)</enum><text>Excessive noise leading to sleep deprivation and task interruptions can result in untold costs on society in diminished worker productivity.</text></paragraph> 
<paragraph id="H643FC7E7886E4215B76E84AACAF3901B"><enum>(5)</enum><text>Pursuant to authorities granted under the <act-name parsable-cite="CAA">Clean Air Act</act-name> of 1970, the Noise Control Act of 1972, and the Quiet Communities Act of 1978, the Environmental Protection Agency established an Office of Noise Abatement and Control. Its responsibilities included promulgating noise emission standards, requiring product labeling, facilitating the development of low emission products, coordinating Federal noise reduction programs, assisting State and local abatement efforts, and promoting noise education and research. However, funding for the Office of Noise Abatement and Control was terminated in 1982 and no funds have been provided since.</text></paragraph> 
<paragraph id="H7DD5B9A9935A4908A1263FD77DC81198"><enum>(6)</enum><text>Because the Environmental Protection Agency remains legally responsible for enforcing regulations issued under the Noise Control Act of 1972 even though funding for these activities were terminated, and because the Noise Control Act of 1972 prohibits State and local governments from regulating noise sources in many situations, noise abatement programs across the country lie dormant.</text></paragraph> 
<paragraph id="H1F4FFD240DAA4F00A2AABB9C007F44E"><enum>(7)</enum><text>As population growth and air and vehicular traffic continue to increase, noise pollution is likely to become an even greater problem in the future. The health and welfare of our citizens demands that the Environmental Protection Agency, the lead Federal agency for the protection of public health and welfare, once again assume a role in combating noise pollution.</text></paragraph></section> 
<section id="H2B6B45D7720644DC8180C1E7FA9ECA5D"><enum>3.</enum><header>Reestablishment of Office of Noise Abatement and Control</header> 
<subsection id="HFD0B7F7AF4754F5D905DCC16B2FF8CF8"><enum>(a)</enum><header>Reestablishment</header><text>The Administrator of the Environmental Protection Agency shall reestablish within the Environmental Protection Agency an Office of Noise Abatement and Control.</text></subsection> 
<subsection id="H18AE5B98F7854EA000B5F5F4430DD7C"><enum>(b)</enum><header>Duties</header><text>The responsibilities of the Office shall include the following:</text> 
<paragraph id="HB7EF13A4E64D435590AC33B2DADDA341"><enum>(1)</enum><text>To promote the development of effective State and local noise control programs by providing States with technical assistance and grants to develop the programs, including the purchase of equipment for local communities.</text></paragraph> 
<paragraph id="H9594BA5B7B1D4DC9872FCF6181DB1C45"><enum>(2)</enum><text>To carry out a national noise control research program to assess the impacts of noise from varied noise sources on mental and physical health.</text></paragraph> 
<paragraph id="HF3BA9A6870ED48CD006FB6B4F3FE494C"><enum>(3)</enum><text>To carry out a national noise environmental assessment program to identify trends in noise exposure and response, ambient levels, and compliance data and to determine the effectiveness of noise abatement actions, including actions for areas around major transportation facilities (such as highways, railroad facilities, and airports).</text></paragraph> 
<paragraph id="HECA270074AAF45FFB6C3003B3F57C73D"><enum>(4)</enum><text>To develop and disseminate information and educational materials to the public on the mental and physical effects of noise and the most effective means for noise control through the use of materials for school curricula, volunteer organizations, radio and television programs, publications, and other means.</text></paragraph> 
<paragraph id="H35695D2586A44E2F98001124CED32E00"><enum>(5)</enum><text>To develop educational and training materials and programs, including national and regional workshops, to support State and local noise abatement and control programs.</text></paragraph> 
<paragraph id="HAC55923B876D4BD19CE2005319E4DADD"><enum>(6)</enum><text>To establish regional technical assistance centers which use the capabilities of university and private organizations to assist State and local noise control programs.</text></paragraph> 
<paragraph id="HD5115E439C664A05B21DC572772204FD"><enum>(7)</enum><text>To undertake an assessment of the effectiveness of the Noise Control Act of 1972.</text></paragraph></subsection> 
<subsection id="H1C2EB5CF8AC64EA6A2C25B30DFAAA8B4"><enum>(c)</enum><header>Preferred approaches</header><text>In carrying out its duties under this section, the Office shall emphasize noise abatement approaches that rely on local and State activities, market incentives, and coordination with other public and private agencies.</text></subsection> 
<subsection id="HDB864BB424DC4DE88DFE00C81EA7D88F"><enum>(d)</enum><header>Study</header> 
<paragraph id="HFB254F2831734DC8BDBFB5C483182086"><enum>(1)</enum><header>In general</header><text>Using funds made available to the Office, the Administrator shall carry out a study of airport noise. The Administrator shall carry out the study by entering into contracts or other agreements with independent scientists with expertise in noise measurements, noise effects, and noise abatement techniques.</text></paragraph> 
<paragraph id="H2DB4E240BD544D68AD430581AB409743"><enum>(2)</enum><header>Contents</header><text>The study shall examine the selection of noise measurement methodologies by the Federal Aviation Administration, the threshold of noise at which health impacts are felt, and the effectiveness of noise abatement programs at airports around the Nation.</text></paragraph> 
<paragraph id="HDFCE26EAFC634E30A03E625F9B10309D"><enum>(3)</enum><header>Report</header><text>Not later than 24 months after the date of enactment of this Act, the Administrator shall transmit to Congress a report on the results of the study, together with specific recommendations on new measures that can be implemented to mitigate the impact of aircraft noise on surrounding communities.</text></paragraph></subsection></section> 
<section id="H519084D7118B43619FAB33E3AEE0424"><enum>4.</enum><header>Grants under quiet communities program</header><text display-inline="no-display-inline">Section 14(c)(1) of the Noise Control Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/42/4913">42 U.S.C. 4913(c)(1)</external-xref>) is amended—</text> 
<paragraph id="H08A118536E6048F29E7840CDA7414413"><enum>(1)</enum><text>by striking <quote>and,</quote> at the end of subparagraph (C); and</text></paragraph> 
<paragraph id="H54FAE334087A47CBB31E4C3EE79E1289"><enum>(2)</enum><text>by adding at the end the following:</text>

<subparagraph id="H27BD52312B23473800041C882FC1CBD9"><enum>(E)</enum><text>establishing and implementing training programs on use of noise abatement equipment; and</text></subparagraph> 
<subparagraph id="H756D08A221A143F8B07DD7ADFBE27735"><enum>(F)</enum><text>implementing noise abatement plans;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H29A0FDFA467E4B3382573E1081115216"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated for each of fiscal years 2007 through 2011 $21,000,000 for activities of the Office of Noise Abatement and Control reestablished under section 3.</text></section>
