<official-title>To amend the Civil Rights Act of 1964 and the Fair Housing Act to prohibit discrimination on the basis of affectional or sexual orientation, and for other purposes.</official-title>

<section id="HF9EC45DBCF514293908F15BDD637FEFA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Civil Rights Amendments Act of 2005</short-title></quote>.</text></section> 
<section id="H029CE39E37744ADC95A91F1431B8BA07"><enum>2.</enum><header>Amendments to civil rights act of 1964</header> 
<subsection id="HA5F4B8DEBDB842E7893D234544B600C4"><enum>(a)</enum><header>Public accommodations</header> 
<paragraph id="H77ACE79038894927A8A5E2A34573722B" display-inline="yes-display-inline"><enum>(1)</enum><text>Section 201(a) of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000a">42 U.S.C. 2000a(a)</external-xref>) is amended by striking <quote>religion,</quote> and inserting <quote>religion, affectional or sexual orientation,</quote>.</text></paragraph> </subsection>
<subsection id="HA4575D0F349E473B91D1BFD8846344EA"><enum>(2)</enum><text>Section 202 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000a-1">42 U.S.C. 2000a–1</external-xref>) is amended by striking <quote>religion,</quote> and inserting <quote>religion, affectional or sexual orientation.</quote>.</text></subsection> 
<subsection id="H70A7B5E25F20408D98D522E12B00BB00"><enum>(b)</enum><header>Public facilities</header><text>Section 301(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000b">42 U.S.C. 2000b(a)</external-xref>) is amended by striking <quote>religion,</quote> and inserting <quote>religion, affectional or sexual orientation,</quote>.</text></subsection> 
<subsection id="H9BF67141914441CFA1788B889DEA6B34"><enum>(c)</enum><header>Federally assisted programs</header><text>Section 601 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d</external-xref>) is amended by striking <quote>color,</quote> and inserting <quote>color, affectional or sexual orientation,</quote>.</text></subsection>

<paragraph id="HD592CE77E6514157AE768895EF2EBFEF" display-inline="yes-display-inline"><enum>(1)</enum><text>Sections 703(a), 703(b), 703(c), 703(d), 703(e), 703(h), 703(j), 704(b), 706(g), and 717(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-2">42 U.S.C. 2000e–2(a)</external-xref>, 2000e–2(b), 2000e–2(c), 2000e–2(d), 2000e–(e), 2000e–2(h), 2000e–2(j), 2000e–3(b), 2000e–5(g), and 2000e–16(a)) are amended by striking <quote>sex,</quote> each place it appears and inserting <quote>sex, affectional or sexual orientation,</quote>.</text></paragraph> </subsection>
<subsection id="HFB670FED814143A8826EC0DF7E70A800"><enum>(2)</enum><text>Section 717(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-16">42 U.S.C. 2000e–16(c)</external-xref>) is amended by striking <quote>sex</quote> and inserting <quote>sex, affectional or sexual orientation,</quote>.</text></subsection>
<subsection id="H75BBF100B76544A8B118C6465EBB03CE"><enum>(3)</enum><text>Section 703(h) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-2">42 U.S.C. 2000e–2(h)</external-xref>) is amended by striking <quote>sex</quote> the first place it appears and inserting <quote>sex, affectional or sexual orientation,</quote>.</text></subsection>
<subsection id="H5FBBFB83A90944B19D005BA5B25C8641"><enum>(4)</enum><text>The heading of section 703 of such Act is amended by striking <quote>sex,</quote> and inserting <quote>sex, affectional or sexual orientation,</quote>.</text></subsection> 
<subsection id="HBA4F51C0D4474635844792B32801A076"><enum>(e)</enum><header>Intervention by Attorney General in civil rights cases</header><text>Section 902 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000h-2">42 U.S.C. 2000h–2</external-xref>) is amended by striking <quote>sex</quote> and inserting <quote>sex, affectional or sexual orientation,</quote>.</text></subsection> 
<subsection id="HF3FC0B04A732438392B975BC36C5499C"><enum>(6f</enum><header>Definition; rules of interpretation</header><text>Title XI of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000h">42 U.S.C. 2000h et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section id="H01AF1EDAC1F74EA7BB3DDCE7AFC382"><enum>1107.</enum><header>Affectional or sexual orientation</header> 
<subsection id="H25C4317397754E4EABCBB79C1886E683" display-inline="yes-display-inline"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of titles II, III, VI, VII, and IX of this Act, the term <quote>affectional or sexual orientation</quote> means male or female homosexuality, heterosexuality, and bisexuality by orientation or practice, by and between consenting adults.</text></subsection> 
<subsection id="H0088D2ECCCDF4B9EA84E34DD178E0045"><enum>(c)</enum><header>Rules of interpretation</header> 
<paragraph id="HBE0A08B734B8492BAC558566BA43F776" display-inline="yes-display-inline"><enum>(1)</enum><text>Nothing in this Act shall be construed to permit or require—</text> 
<subparagraph id="H82819197806E4D879C627CE7FF90CA11"><enum>(A)</enum><text>that a finding of discrimination on the basis of affectional or sexual orientation be based on any statistical differences in the incidence of persons of a particular affectional or sexual orientation in the general population as opposed to the incidence of such persons in the activity concerned; or</text></subparagraph> 
<subparagraph id="HDFFF27CFDBC446D29B572D485DB284E"><enum>(B)</enum><text>the use of any quota as a remedy for discrimination on the basis of affectional or sexual orientation.</text></subparagraph></paragraph> 
<paragraph id="H64A689F7011047D79462FF0079A13D40"><enum>(2)</enum><text>Nothing in this Act shall be construed to require any person to disclose a personal affectional or sexual orientation.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

<subsection id="H8DB3E4B76F2249179CEE2F0066B58DC4"><enum>(a)</enum><header>Housing sale and rental, residential real-estate-related transactions, and brokerage services</header> 
<paragraph id="HCDBC67B442124D85B8B5DE546100A61F" display-inline="yes-display-inline"><enum>(1)</enum><text>Section 804 of the Civil Rights Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3604">42 U.S.C. 3604</external-xref>) is amended by striking <quote>religion,</quote> each place it appears and inserting <quote>religion, affectional and sexual orientation (as such term is defined in section 802(p)),</quote>.</text></paragraph> </subsection>
<subsection id="HC9655ECF2DDC48BBB0B2432F852D3CA3"><enum>(2)</enum><text>Section 805 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3605">42 U.S.C. 3605</external-xref>) is amended by striking <quote>religion,</quote> each place it appears and inserting <quote>religion, affectional or sexual orientation (as such term is defined in section 802(p)),</quote>.</text></subsection>
<subsection id="HA4536007F07941B19800FAD874FCFE7D"><enum>(3)</enum><text>Section 806 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3606">42 U.S.C. 3606</external-xref>) is amended by striking <quote>religion,</quote> and inserting <quote>religion, affectional or sexual orientation (as such term is defined in section 802(p)),</quote>.</text></subsection> 
<subsection id="HB6D644548C024D29B3D0A22975AB87D2"><enum>(b)</enum><header>Prevention of intimidation</header><text>Section 901 of the Civil Rights Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3631">42 U.S.C. 3631</external-xref>) is amended by striking <quote>religion,</quote> each place it appears and inserting <quote>religion, affectional or sexual orientation (as such term is defined in section 802(p)),</quote>.</text></subsection> 
<subsection id="H92F85F2C2DC241D5A2D9F48200288932"><enum>(c)</enum><header>Definition</header><text>Section 802 of the Civil Rights Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3602">42 U.S.C. 3602</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="HDE73B53121964B31AA2090857742A9D"><enum>(p)</enum><text><quote>Affectional or sexual orientation</quote> means male or female homosexuality, heterosexuality, and bisexuality by orientation or practice, by and between consenting adults.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H150DDCED1BE640C8BC5EAF00AD2BB800"><enum>(d)</enum><header>Rules of interpretation</header> 
<paragraph id="H33DF7414220F4114BB91627728000000" display-inline="yes-display-inline"><enum>(1)</enum><text>Title VIII of the Civil Rights Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601 et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section id="HA7666188F0AA426F86498E14B175A093"><enum>821.</enum><header>Rules of interpretation regarding affectional or sexual orientation</header> 
<subsection id="HFBB554CBA1334589976F0099AB9F1C43" display-inline="yes-display-inline"><enum>(a)</enum><header>Findings of discrimination; quotas</header><text>Nothing in this Act shall be construed to permit or require—</text> 
<paragraph id="H4C1ECBF1F3CA4E209195ADA7B40100CB"><enum>(1)</enum><text>that a finding of discrimination on the basis of affectional or sexual orientation be based on any statistical differences in the incidence of persons of a particular affectional or sexual orientation in the general population as opposed to the incidence of such persons in the activity concerned; or</text></paragraph> 
<paragraph id="H510280A4BEBE4010813E9F2996FE8F01"><enum>(2)</enum><text>the use of any quota as a remedy for discrimination on the basis of affectional or sexual orientation.</text></paragraph></subsection> 
<subsection id="HE420BE0982FF411D80DCB474D5F05738"><enum>(b)</enum><header>Protection of privacy rights</header><text>Nothing in this Act shall be construed to require any person to disclose a personal affectional or sexual orientation.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HDBC3F299B36D4C908B76A6A855F74518"><enum>(2)</enum><text>Title IX of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3631">42 U.S.C. 3631 et seq.</external-xref>) is amended by adding at the end the following new section:</text>
