<official-title>To amend the Public Lands Corps Act of 1993 to provide for the conduct of projects that protect forests, and for other purposes.</official-title>

<section id="HC21357974CCB44FB9B1B165311768B53" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Lands Corps Healthy Forests Restoration Act of 2005</short-title></quote>.</text></section> 
<section id="HE4F040C7A256410F9013D2BD70ECB6E7"><enum>2.</enum><header>Amendments to the Public Lands Corps Act of 1993</header> 
<subsection id="HA39B27785D6D4DBF8E7379AA66906809"><enum>(a)</enum><header>Definitions</header><text>Section 203 of the Public Lands Corps Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1722">16 U.S.C. 1722</external-xref>) is amended—</text> 
<paragraph id="H18A6C0E8848E4EAAB9009681D6611E4"><enum>(1)</enum><text>by redesignating paragraphs (8), (9), (10), and (11) as paragraphs (9), (10), (11), and (13), respectively;</text></paragraph> 
<paragraph id="HEA22635066C24B9CBEC64EF189A41C24"><enum>(2)</enum><text>by inserting after paragraph (7) the following:</text> 
<quoted-block display-inline="no-display-inline" id="H751306D55F874F698000F5D668A0E259" style="OLC"> 
<paragraph id="H60CFA90648824DEE951D4BA67C079D20"><enum>(8)</enum><header>Priority project</header><text>The term <quote>priority project</quote> means an appropriate conservation project conducted on eligible service lands to further 1 or more of the purposes of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6501">16 U.S.C. 6501 et seq.</external-xref>), as follows:</text> 
<subparagraph id="HB1673601F22640F99243E35679B110B5"><enum>(A)</enum><text>To reduce wildfire risk to a community, municipal water supply, or other at-risk Federal land.</text></subparagraph> 
<subparagraph id="HD5D2F0D4223B49C8A6047D4F4D44308D"><enum>(B)</enum><text>To protect a watershed or address a threat to forest and rangeland health, including catastrophic wildfire.</text></subparagraph> 
<subparagraph id="H6DE2077AFD414262B902BA2B276F45B"><enum>(C)</enum><text>To address the impact of insect or disease infestations or other damaging agents on forest and rangeland health.</text></subparagraph> 
<subparagraph id="H39BD32C39E7D401991A2A2BD04C88A2"><enum>(D)</enum><text>To protect, restore, or enhance forest ecosystem components to—</text> 
<clause id="H9411AF24315A456A8730DC994441FD4"><enum>(i)</enum><text>promote the recovery of threatened or endangered species;</text></clause> 
<clause id="HF8F68F583E6E4BDA98730150DE343F82"><enum>(ii)</enum><text>improve biological diversity; or</text></clause> 
<clause id="HDE8788E483814FFAA4E0D38F21E186D3"><enum>(iii)</enum><text>enhance productivity and carbon sequestration.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H86CAE159C8254263A4A4A1414E61DC29"><enum>(3)</enum><text>by inserting after paragraph (11) (as redesignated by paragraph (1)) the following:</text>

<paragraph id="HA98C6FBCB8CA427DB72426856FAEDCF"><enum>(12)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means—</text> 
<subparagraph id="H665F0B50FA5D427BB1311CED686C5F28"><enum>(A)</enum><text>with respect to National Forest System land, the Secretary of Agriculture; and</text></subparagraph> 
<subparagraph id="H37B5203FEA144D8A97D88CD92000B7B8"><enum>(B)</enum><text>with respect to Indian lands, Hawaiian home lands, or land administered by the Department of the Interior, the Secretary of the Interior.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H3F3787968A414D8C84A4905E4FB7CDAE"><enum>(b)</enum><header>Qualified youth or conservation corps</header><text>Section 204(c) of the Public Lands Corps Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1723">16 U.S.C. 1723(c)</external-xref>) is amended—</text> 
<paragraph id="H70BCCE7CFFA5493F85280300CE644012"><enum>(1)</enum><text>by striking <quote>The Secretary of the Interior and the Secretary of Agriculture are</quote> and inserting the following:</text>

<subparagraph id="HA30B73E3E8E44D73899639BF79C55D60"><enum>(A)</enum><header>In general</header><text>For purposes of entering into contracts and cooperative agreements under paragraph (1), the Secretary may give preference to qualified youth or conservation corps located in a specific area that have a substantial portion of members who are economically, physically, or educationally disadvantaged to carry out projects within the area.</text></subparagraph> 
<subparagraph id="HCF1BCB4E7D4F4EA4B2860166FD621E7"><enum>(B)</enum><header>Priority projects</header><text>In carrying out priority projects in a specific area, the Secretary shall, to the maximum extent practicable, give preference to qualified youth or conservation corps located in that specific area that have a substantial portion of members who are economically, physically, or educationally disadvantaged.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H87AB06118F8345938B96B0C2266C774C"><enum>(c)</enum><header>Conservation projects</header><text>Section 204(d) of the Public Lands Corps Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1723">16 U.S.C. 1723(d)</external-xref>) is amended—</text> 
<paragraph id="H5291C5F788174191A638ED705C80CD63"><enum>(1)</enum><text>in the first sentence—</text> 
<subparagraph id="HEDC2D3F6DABA4CE6915D49A12440D4B7"><enum>(A)</enum><text>by striking <quote>The Secretary of the Interior and the Secretary of Agriculture may each</quote> and inserting the following:</text>

<paragraph id="H82BE7C4FC35F487CBF84EB282D9B15EC"><enum>(3)</enum><header>Disaster prevention or relief projects</header><text>The Secretary may authorize appropriate conservation projects and other appropriate projects to be carried out on Federal, State, local, or private land as part of a Federal disaster prevention or relief effort.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HB1298FE80C394B789792EB00D546FDC0"><enum>(d)</enum><header>Conservation centers and program support</header><text>Section 205 of the Public Lands Corps Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1724">16 U.S.C. 1724</external-xref>) is amended—</text> 
<paragraph id="HC366D3B9B4064FE6BCE542349928DAC0"><enum>(1)</enum><text>by striking the heading and inserting the following:</text>

<paragraph id="H63E3171BBD0E4AFCBCCFCCA26BE4D5D"><enum>(2)</enum><text>by striking subsection (a) and inserting the following:</text>

<subsection id="H1B062FEB27AC47AEB7BB075D7409BA6C"><enum>(a)</enum><header>Establishment and use</header> 
<paragraph id="HB827493C849D481AA47797315C517675"><enum>(1)</enum><header>In general</header><text>The Secretary may establish and use conservation centers owned and operated by the Secretary for—</text> 
<subparagraph id="H4DAC696DB75E46D2BA7800CC00B53890"><enum>(A)</enum><text>use by the Public Lands Corps; and</text></subparagraph> 
<subparagraph id="H489D8892FB9C41FDAC5E45FD4E93A4"><enum>(B)</enum><text>the conduct of appropriate conservation projects under this title.</text></subparagraph></paragraph> 
<paragraph id="HFD3BC2485B2148C6ADC7E5DEE1B47766"><enum>(2)</enum><header>Assistance for conservation centers</header><text>The Secretary may provide to a conservation center established under paragraph (1) any services, facilities, equipment, and supplies that the Secretary determines to be necessary for the conservation center.</text></paragraph> 
<paragraph id="H9A95F28111724BAC86B2966E007321A3"><enum>(3)</enum><header>Standards for conservation centers</header><text>The Secretary shall—</text> 
<subparagraph id="H91B5807F43BE4310B9A2B8DEF141FE78"><enum>(A)</enum><text>establish basic standards of health, nutrition, sanitation, and safety for all conservation centers established under paragraph (1); and</text></subparagraph> 
<subparagraph id="HC997AA084B264185BE91B654F7FFD332"><enum>(B)</enum><text>ensure that the standards established under subparagraph (A) are enforced.</text></subparagraph></paragraph> 
<paragraph id="H5DA4248382E04B5DA53B1DF8666D17C6"><enum>(4)</enum><header>Management</header><text>As the Secretary determines to be appropriate, the Secretary may enter into a contract or other appropriate arrangement with a State or local government agency or private organization to provide for the management of a conservation center.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H1AA03873C799440BA7D9A36035BA4E52"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HE17D579F02394E3400873E82BC99B2AA" style="OLC"> 
<subsection id="H0C804BBA4AAB439B8510E1BF00C86055"><enum>(d)</enum><header>Assistance</header><text>The Secretary may provide any services, facilities, equipment, supplies, technical assistance, oversight, monitoring, or evaluations that are appropriate to carry out this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HADEB445B850A4161A4EA91697C72EBDD"><enum>(e)</enum><header>Living allowances and terms of service</header><text>Section 207 of the Public Lands Corps Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1726">16 U.S.C. 1726</external-xref>) is amended—</text> 
<paragraph id="HE7EA065911FC430BB551F92C8E9BE640"><enum>(1)</enum><text>by striking subsection (a) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H98D787B2DA03490288749695F39F1EE7" style="OLC"> 
<subsection id="HDFF4BEDE20E2449789FD6FBE22FB00F9"><enum>(a)</enum><header>Living allowances</header><text>The Secretary shall provide each participant in the Public Lands Corps and each resource assistant with a living allowance in an amount established by the Secretary.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HECBCF60E26D8422F00AE84569088A17C"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H2219B31BD66E4F9D875C5829C2584D1D" style="OLC"> 
<subsection id="H950B57D2045440EBA3CFF56014D52BE6"><enum>(c)</enum><header>Hiring</header><text>The Secretary may—</text> 
<paragraph id="H4F2423FE247745D8B1E63875332B935B"><enum>(1)</enum><text>grant to a member of the Public Lands Corps credit for time served with the Public Lands Corps, which may be used toward future Federal hiring; and</text></paragraph> 
<paragraph id="HA9351A4E90124DDCA6BD8767E6AAF47B"><enum>(2)</enum><text>provide to a former member of the Public Lands Corps noncompetitive hiring status for a period of not more than 120 days after the date on which the member's service with the Public Lands Corps is complete.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HD5858AA13FF542879E6DDD89CF69205"><enum>(f)</enum><header>Funding</header><text>The Public Lands Corps Act of 1993 is amended—</text> 
<paragraph id="H8C762961D1EA4F95B2B2B917FD87B6BE"><enum>(1)</enum><text>in section 210 (<external-xref legal-doc="usc" parsable-cite="usc/16/1729">16 U.S.C. 1729</external-xref>), by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HFFFE050984E4468E9B19EDAE55789BC0" style="OLC"> 
<subsection id="H0B7D12518FF144EF8B6402F0E72DF6D3"><enum>(c)</enum><header>Other funds</header><text>Amounts appropriated pursuant to the authorization of appropriations under section 211 are in addition to amounts allocated to the Public Lands Corps through other Federal programs or projects.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H55C425C3FCE3486FA1D73E1A4616838"><enum>(2)</enum><text>by inserting after section 210 the following:</text>

<section id="H83820E0883F44DCAA2D1117276F41E9"><enum>211.</enum><header>Authorization of appropriations</header> 
<subsection id="H85B0D1E0C75748138250C8092FFAB08"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this title $15,000,000 for each fiscal year, of which $10,000,000 is authorized to carry out priority projects.</text></subsection> 
<subsection id="H776BD83178174F7CBB12F6CFC0F587EA"><enum>(b)</enum><header>Availability of funds</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, amounts appropriated for any fiscal year to carry out this title shall remain available for obligation and expenditure until the end of the fiscal year following the fiscal year for which the amounts are appropriated.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H4571CEAD27E349529C75BCFBA3F44CB1"><enum>(g)</enum><header>Conforming amendments</header><text>The Public Lands Corps Act of 1993 is amended—</text> 
<paragraph id="H407313E415E240A8BE61E957CA0000BD"><enum>(1)</enum><text>in section 204 (<external-xref legal-doc="usc" parsable-cite="usc/16/1723">16 U.S.C. 1723</external-xref>)—</text> 
<subparagraph id="HDA48CAFA1561479BBC45C83EF2992D21"><enum>(A)</enum><text>in subsection (b)—</text>
