<official-title>To amend the Fair Labor Standards Act of 1938 to reform the provisions relating to child labor, and for other purposes.</official-title>

<section section-type="section-one" id="H63550028F86A46A38B81FECD04B5EAF5" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Youth Worker Protection Act</short-title></quote>.</text></section> 
<title id="H0911CBDBE27F4DA0ADCEDE90C85466B7"><enum>I</enum><header>Amendments to Fair Labor Standards Act of 1938</header> 
<section id="H4F42132EFA2047F08B146C94F9B34BEA"><enum>101.</enum><header>Amendments to Fair Labor Standards Act of 1938 to add a title relating to employment of minors</header> 
<subsection id="H7C56FCB7C3CD452D9416004F007C9656"><enum>(a)</enum><header>New title</header><text>The Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) is amended by adding at the end the following new title:</text>

<title id="HED34B117FDAD4FE9803649F18E05408B"><enum>II</enum><header>Employment of minors</header> 
<section id="H4805983B2BE844DF98801E15CF3F1078"><enum>201.</enum><header>Requirements for employment of minors</header><text display-inline="no-display-inline">An employer may employ a minor only if the following requirements are met:</text> 
<paragraph id="HF4AB5EF6C0794CA7A43140A32DA2B3BE"><enum>(1)</enum><text>The minor is at least 14 years old or, if younger than 14 years old, is otherwise permitted to work under this Act.</text></paragraph> 
<paragraph id="H60AD5C1442044F50A948D699BA596DEC"><enum>(2)</enum><text>The minor is employed in accordance with this Act and in accordance with any other Federal, State, or local law that provides greater protection to minors.</text></paragraph> 
<paragraph id="HC6BAA8407B4B40F0B9DF86A8DD22FE00"><enum>(3)</enum><text>The minor has a work permit under section 203.</text></paragraph> 
<paragraph id="HB7AB42C704DB4011A21176466B6E4F8F"><enum>(4)</enum><text>In the case of a minor who is between the ages of 16 and 18 years, the employment is not in an occupation that is particularly hazardous for the employment of children between those ages or detrimental to their health or well-being, within the meaning of section 3(l)(2).</text></paragraph></section> 
<section id="HB0AA769728194F538466BA7E08C74EC7"><enum>202.</enum><header>Federal and State responsibilities</header> 
<subsection id="H06B37ABE116B4A6B95F15FFAE40622D3"><enum>(a)</enum><header>Federal responsibilities</header><text>The Secretary shall carry out Federal responsibilities under this title.</text></subsection> 
<subsection id="H2E3E4543956444DB95905FEE00009354"><enum>(b)</enum><header>Designated State agency</header><text>Each State shall designate a State agency to be the issuing authority for work permits under this title and to carry out other State responsibilities under this title.</text></subsection></section> 
<section id="H6FDDFEE25F0A48BE924EB270355383C"><enum>203.</enum><header>Work permit</header> 
<subsection id="H709AA052650D4962AAC9883B86C545B"><enum>(a)</enum><header>Model form and application</header><text>The Secretary shall prescribe a unified model form that contains both the work permit required by section 201 and the application for the permit.</text></subsection> 
<subsection id="H83408BCB1CC74A91830048AC9605F5F"><enum>(b)</enum><header>Contents</header><text>The model form shall provide for the following information:</text> 
<paragraph id="H2FFD8A9D8158497BAA04114CBC70E7A5"><enum>(1)</enum><text>Name, date of birth, gender, racial or ethnic background, and contact information of the minor.</text></paragraph> 
<paragraph id="H9E71F2FD7CD74D29B814E3BFAB233942"><enum>(2)</enum><text>Name, contact information, and consent of a parent of the minor.</text></paragraph> 
<paragraph id="H28C3395AB0BA4A708912AAD3460835FF"><enum>(3)</enum><text>In the case of a school-age minor, a certification by a school official that the official has informed the minor of school attendance requirements and has given the minor a written summary of those requirements.</text></paragraph> 
<paragraph id="HDA2EC68371FE4A7C9530C6351E2AB1C"><enum>(4)</enum><text>Name, contact information, and type of business of the employer.</text></paragraph> 
<paragraph id="H97BADB9FB5BD41AF8D55D8C704999C00"><enum>(5)</enum><text>Type of work.</text></paragraph> 
<paragraph id="HFA3EA0617E324CAB92565C9B34B400D7"><enum>(6)</enum><text>Summary of age limitations and other legal requirements for employment of minors.</text></paragraph> 
<paragraph id="HCE7F5B6960834DE400B8E1F476D7FC5E"><enum>(7)</enum><text>Name and contact information of the designated State agency.</text></paragraph></subsection> 
<subsection id="HFD57D381B12F4518B619C0346FDEB74D"><enum>(c)</enum><header>State modification</header><text>The designated State agency, in consultation with the Secretary, may modify the model form to improve clarity or information content, or to improve the implementation of this title in conjunction with related provisions of State law.</text></subsection> 
<subsection id="HBDC0FB5E1CF1476482C55EAEE00A4DC"><enum>(d)</enum><header>Duration of permit</header><text>A work permit issued under this section shall expire on the earliest of—</text> 
<paragraph id="H655DBF22500A488C83051000B13807C9"><enum>(1)</enum><text>the expiration date specified in the permit;</text></paragraph> 
<paragraph id="H2A00C593271240C88521894192DDFA88"><enum>(2)</enum><text>1 year after the date of issuance of the permit;</text></paragraph> 
<paragraph id="HBBE6222026384BBFA6A08106E2EFE8"><enum>(3)</enum><text>the end of the employment for which the permit is issued; or</text></paragraph> 
<paragraph id="HFB3CB59AEE4142B5B25D680759005DBA"><enum>(4)</enum><text>a change in school districts by the minor.</text></paragraph></subsection> 
<subsection id="H1E6CE4270CE24EACB0E3F71772DFDA7F"><enum>(e)</enum><header>School certification for work permit issued while school not in session</header><text>A work permit that is issued when school is not in session shall be subject to certification under subsection (b)(3) not later than 30 days after school resumes. If the minor does not obtain certification during that period, the permit shall be suspended until the certification is obtained. As used in this subsection, the term <term>in session</term> has the meaning given that term under the law applicable to the school district in which the minor involved lives.</text></subsection> 
<subsection id="H44CED5EA7CDF456A95AB0722A5F8C95"><enum>(f)</enum><header>Revocation of work permit and appeal</header> 
<paragraph id="HC7C3C82CB1424B61A3DC83D6D54BFE22"><enum>(1)</enum><header>Revocation</header><text>The designated State agency may, after notice and an opportunity to respond, revoke a work permit, if the agency finds either of the following:</text> 
<subparagraph id="HE13B7E70EEEF4ED08BD3B97644426D64"><enum>(A)</enum><text>The minor is not in compliance with school attendance requirements.</text></subparagraph> 
<subparagraph id="H9B56C3EC29E24473AFAAE659078652D7"><enum>(B)</enum><text>The minor is adversely affected by the employment involved.</text></subparagraph></paragraph> 
<paragraph id="H4281CEBE9FE0427DB279E4FD7569A614"><enum>(2)</enum><header>Appeal</header><text>A minor (or the parent of a minor) or an employer may appeal a decision under paragraph (1), in accordance with applicable law.</text></paragraph></subsection></section> 
<section id="H0D625E30E9FC46288EB1A4164D55648D"><enum>204.</enum><header>Working-hour restrictions for minors</header> 
<subsection id="HAB24A2FB4F974D739D61B8A91FCE45B3"><enum>(a)</enum><header>School-Age minors</header><text>An employer may not permit a school-age minor to work during school hours.</text></subsection> 
<subsection id="H50D04F512BEF46F2BC03E265FE1DE8F"><enum>(b)</enum><header>Minors 16 or 17 years of age</header><text>An employer may not permit a minor who is 16 or 17 years of age—</text> 
<paragraph id="HB7BFF15365F34563A19F8C1416B3DA8"><enum>(1)</enum><text>to work before 7 a.m. on any day;</text></paragraph> 
<paragraph id="H8A4229482FF44F13A4805F6425367F64"><enum>(2)</enum><text>to work later than 10 p.m. on a day before a school day or later than 11 p.m. on any other day;</text></paragraph> 
<paragraph id="H3F7217F2E2414DFAAA3B8CEBDA8B9166"><enum>(3)</enum><text>to work more than 4 hours on a school day or more than 8 hours on any other day;</text></paragraph> 
<paragraph id="HDC63DFE1279941F497BE635C392400CA"><enum>(4)</enum><text>to work more than 20 hours during a week in which school is in session or more than 40 hours during any other week; or</text></paragraph> 
<paragraph id="H6EE0D58E711F4D229E9642CE10D7FB80"><enum>(5)</enum><text>to work on more than 6 consecutive days.</text></paragraph></subsection> 
<subsection id="HD307E0991CC3491A890122A9C7F359CE"><enum>(c)</enum><header>Minors 14 or 15 years of age</header><text>An employer may not permit a minor who is 14 or 15 years of age—</text> 
<paragraph id="H5F838782CDFB428F8FF13B7100C97CD5"><enum>(1)</enum><text>to work before 7 a.m. on any day;</text></paragraph> 
<paragraph id="H0AD1EB5E93E14D08A8ACE33F84A9C09D"><enum>(2)</enum><text>to work later than 7 p.m. on any day, except that during summer vacation periods (or during corresponding vacation periods for year-round schools) the latest hour for work under this paragraph shall be 9 p.m.;</text></paragraph> 
<paragraph id="H7B2EE677D3EE4504899C688B5E009E00"><enum>(3)</enum><text>to work more than 3 hours on a school day or more than 6 hours on any other day;</text></paragraph> 
<paragraph id="H1456BF54AA804F12A1CD9B9CCE88E3AF"><enum>(4)</enum><text>to work more than 15 hours during a week in which school is in session or more than 30 hours during any other week; or</text></paragraph> 
<paragraph id="H66C13C297F2C4EB2A41C1369E0DBB84D"><enum>(5)</enum><text>to work on more than 5 consecutive days.</text></paragraph></subsection> 
<subsection id="HD9ED50861E054A59B98CBC4FB45C43C4"><enum>(d)</enum><header>Definitions</header><text>As used in this section, the terms <term>school hours</term>, <term>school day</term>, and <term>in session</term>, respectively, have the meanings given those terms under the law applicable to the school district in which the minor involved lives.</text></subsection></section> 
<section id="HBE973A007A2B47AF8EAFB90E14765CE"><enum>205.</enum><header>Notification of serious work-related injuries</header> 
<subsection id="H412B3484F8FB4E6CBDD956A7FC1D5FC0"><enum>(a)</enum><header>In general</header><text>If a minor sustains a serious work-related injury, each person specified in subsection (b) shall so notify the designated State agency, which shall inform each parent of the minor of the injury.</text></subsection> 
<subsection id="H6C1FC0E7D2264195A70873F4E8A087F0"><enum>(b)</enum><header>Persons specified</header><text>The persons referred to in subsection (a) are:</text> 
<paragraph id="H77498F3BDED04458AA2089B62E1EBAF6"><enum>(1)</enum><text>The employer of the minor.</text></paragraph> 
<paragraph id="H0DF5DC3EFF4449C2BD112D4100487BBA"><enum>(2)</enum><text>If medical attention is given to the minor, an appropriate medical professional who is responsible for that medical attention.</text></paragraph> 
<paragraph id="HC918396360BC4F1E95C0046DAB45A743"><enum>(3)</enum><text>If the injury is the subject of investigation by a law enforcement agency, an appropriate employee of that agency.</text></paragraph> 
<paragraph id="H0EF49A6EE646403C9941FB6DDB406C92"><enum>(4)</enum><text>If the minor attends school and is absent for more than 3 days because of the injury, an appropriate employee of the school.</text></paragraph></subsection> 
<subsection id="H336BB4A2A08A41B681203F2800003E8F"><enum>(c)</enum><header>Definition</header><text>As used in this section, the term <term>serious work-related injury</term> means, with respect to a minor, a work-related injury that results in—</text> 
<paragraph id="HDB5024DE1F164D5D9C118BAD646F283F"><enum>(1)</enum><text>the death of the minor;</text></paragraph> 
<paragraph id="H9FF0CF1EA6E24E84AA61B4969CC17E9"><enum>(2)</enum><text>medical attention for the minor; or</text></paragraph> 
<paragraph id="H650C957F4B094E7BA1199664138972F2"><enum>(3)</enum><text>investigation by a law enforcement agency.</text></paragraph></subsection></section> 
<section id="H6AAA35CB096442A4A3EDAB090489AEF0"><enum>206.</enum><header>Data compilation, retention, and reporting by designated State agency</header> 
<subsection id="H52CCE95CA36844449700A153FD741FFF"><enum>(a)</enum><header>Data compilation and retention</header><text>The designated State agency shall compile, on a continuing basis, and retain, for not less than 7 years, the following:</text> 
<paragraph id="HCF990FB3F1DE4DFCBDA81E87A8A71D87"><enum>(1)</enum><text>Statistical data derived from the work permits under section 203.</text></paragraph> 
<paragraph id="HE243F917FF4246F1A9022B69019DE245"><enum>(2)</enum><text>Statistical data relating to injuries for which notification is required under section 205.</text></paragraph></subsection> 
<subsection id="HBE702B5C0C254218AB62EF8CCAA8749C"><enum>(b)</enum><header>Annual reports</header><text>The designated State agency shall report annually to the Secretary of Labor, at such time and in such manner as the Secretary may require—</text> 
<paragraph id="HE6555E51F2DF4CDD9BCE3E86BC4FD735"><enum>(1)</enum><text>statistical data referred to in subsection (a); and</text></paragraph> 
<paragraph id="HA5E149BBD035460B921B49777D6DC7A7"><enum>(2)</enum><text>information relating to the activities and number of work-hours devoted by State and local government employees (including contractors) to the administration and enforcement of child labor laws in the State.</text></paragraph></subsection></section> 
<section id="H61DD3C233AE943F2B1FC6BB783DA14D9"><enum>207.</enum><header>Prohibition of youth peddling</header><text display-inline="no-display-inline">No employer may employ a minor in youth peddling.</text></section> 
<section id="HAAD4DD1B35AC427EAB5BBFE1BFF45BE4"><enum>208.</enum><header>Enforcement</header> 
<subsection id="H9F9536F38B8E40D4B762A2E1B8E3F587"><enum>(a)</enum><header>Civil action for bodily injury, illness, or death</header> 
<paragraph id="H94BAE8F81594405DA6C39C7216143FFC"><enum>(1)</enum><header>In general</header><text>A minor who suffers bodily injury, illness, or death as a result of a violation of this title may bring a civil action against the violator. The civil action may be brought in an appropriate Federal court (without regard to the amount in controversy) or in an appropriate State court.</text></paragraph> 
<paragraph id="HDF10D115B50D4D0FAF680169EFDC0284"><enum>(2)</enum><header>Relief</header><text>In a civil action under this subsection, the court—</text> 
<subparagraph id="HC3363380571A436CBBD9813A02FE9E6"><enum>(A)</enum><text>may grant appropriate legal or equitable relief; and</text></subparagraph> 
<subparagraph id="HABE4030A549646D291F7D851B727058"><enum>(B)</enum><text>shall order the defendant to pay to a prevailing plaintiff appropriate amounts for attorney fees and costs.</text></subparagraph></paragraph> 
<paragraph id="H6B3F34F8FC43450C90F3BE86BA9B878F"><enum>(3)</enum><header>Relation to State workers’ compensation</header><text>In awarding relief under this subsection, the court may take into consideration any payment for the bodily injury, illness, or death under State workers’ compensation law. If so provided by State law, any amount awarded under this subsection may be offset against State workers’ compensation payments for the bodily injury, illness, or death.</text></paragraph></subsection> 
<subsection id="H439ADCF009FF4B9DB181C589642F9C08"><enum>(b)</enum><header>Public disclosure of violations</header><text>In the case of any final determination that a violation of this title has occurred, the Secretary shall, not later than 30 days after the date of the determination, publish in the Federal Register and on the web page of the Department of Labor the following:</text> 
<paragraph id="H2CDC78882EF44CF900FBBE4CE66F1059"><enum>(1)</enum><text>The name of the violator, including any business name and any other name by which the violator is known publicly.</text></paragraph> 
<paragraph id="HB09C1DC53B21408F9832B08D53027E4D"><enum>(2)</enum><text>The address of the location at which the violation occurred.</text></paragraph> 
<paragraph id="HF0D9AC942B3E49ECB904A254D622C62B"><enum>(3)</enum><text>A description of the facts underlying the violation.</text></paragraph> 
<paragraph id="H402037B85DC04E1CAA5729ECBF72008F"><enum>(4)</enum><text>A statement of the penalty imposed.</text></paragraph></subsection> 
<subsection id="H19789D3960FB4689AAE3E8A87477DA4E"><enum>(c)</enum><header>Civil penalties</header><text>Any person who violates this title, or any regulation under this title, shall be subject to a civil penalty of not less than $500 and not more than $15,000 for each employee who is the subject of the violation, except that—</text> 
<paragraph id="H59A6163C4331426189792BE21613B67E"><enum>(1)</enum><text>in the case of a violation that results in serious injury or death, the civil penalty shall be not less than $15,000 and not more than $50,000; and</text></paragraph> 
<paragraph id="HC83243580A934332B601C68B116C0000"><enum>(2)</enum><text>in the case of a willful or repeat violation, the civil penalty shall be not less than $15,000 and not more than $100,000.</text></paragraph></subsection> 
<subsection id="H9973E08022A6427DBD327C73D49101A8"><enum>(d)</enum><header>Criminal penalties</header><text>Whoever violates this title shall be imprisoned not more than 3 years or fined under title 18, United States Code, or both, except that in the case of a second or subsequent offence, the penalty shall be imprisonment of not less than 3 years and not more than 5 years and a fine under title 18, United States Code, or both.</text></subsection></section> 
<section id="HDAA63970AC4E4CC6A7A56B2770F92552"><enum>209.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this title:</text> 
<paragraph id="HF89BEB4DFCBD4CA7AF7F3EAC007B1E77"><enum>(1)</enum><text>The term <term>designated State agency</term> means an agency designated under section 202(b).</text></paragraph> 
<paragraph id="H28EEEAE5DF634D9D8480002926398998"><enum>(2)</enum><text>The term <term>minor</term> means an individual who is under the age of 18 years.</text></paragraph> 
<paragraph id="HDAA49F910D2343EFA4BE3C33DD1AEF3"><enum>(3)</enum><text>The term <term>parent</term> includes, with respect to a minor, a legal guardian and any person standing in loco parentis.</text></paragraph> 
<paragraph id="H3B1B802F07674E7F91EA0047DD007B71"><enum>(4)</enum><text>The term <term>school-age minor</term> means a minor who, as determined under the law applicable to the school district in which the minor lives, has not earned a high school diploma or other document of equivalent or greater status.</text></paragraph></section></title><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H5B00B922CFA84333AFA94BD6A9D103E8"><enum>(b)</enum><header>Clerical amendment</header><text>The Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) is amended by inserting before section 2 the following new title heading:</text>

<title id="HDB43DB4FBD9C48CABA68521790D2719D"><enum>I</enum><header>Fair labor standards</header></title><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H5A279BC6F640406896025F8700221014"><enum>102.</enum><header>Amendment to Fair Labor Standards Act of 1938 to provide minimum age parity for child labor in agricultural and nonagricultural employment</header><text display-inline="no-display-inline">Section 13(c) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(c)</external-xref>) is amended—</text> 
<paragraph id="HE63F35F131BC43BAB1D8A2BB34A5C30"><enum>(1)</enum><text>in paragraph (1)(A)—</text> 
<subparagraph id="H5EAA49EC1A924E35A2CAD912E981D4BA"><enum>(A)</enum><text>by striking <quote>twelve years of age and (i)</quote> and inserting <quote>fourteen years of age and</quote>; and</text></subparagraph> 
<subparagraph id="H9EAC802FEA55426D9EC2B524C99F5ECB"><enum>(B)</enum><text>by striking <quote>(ii) </quote> and all that follows through <quote>section 6(a)(5),</quote>;</text></subparagraph></paragraph> 
<paragraph id="H850298B38DED467E999834E78805216E"><enum>(2)</enum><text>by striking subparagraph (B); and</text></paragraph>

<section id="H2EFBAC000671497F8DBA2462AEC9FCED"><enum>105.</enum><header>Amendment to Fair Labor Standards Act of 1938 to eliminate a child labor exception for scrap paper balers and paper box compactors</header><text display-inline="no-display-inline">The Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) is amended—</text> 
<paragraph id="H9FE9507FCA944F08B110A132DEA1A16F"><enum>(1)</enum><text>by striking paragraph (5) of section 13(c) (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(c)(5)</external-xref>); and</text></paragraph>

<section id="HD81C6001203D4DBF9C57863006939F7B"><enum>106.</enum><header>Amendment to Fair Labor Standards Act of 1938 to include youth peddling</header> 
<subsection id="H26523CB913314AF9BD00FC102CB7056"><enum>(a)</enum><header>Finding</header><text>The second sentence of section 2(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/202">29 U.S.C. 202(a)</external-xref>) is amended by striking <quote>affects</quote> and inserting the following: <quote>and the employment of persons under the age of 18 years in youth peddling affect</quote>.</text></subsection> 
<subsection id="HBBFDA88205084FF88DB0472C5F1BD63"><enum>(b)</enum><header>Definitions</header><text>Section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>) is amended by adding at the end the following new subsections:</text> 
<quoted-block id="H1FEC833D3E864703945BB16B75AF37A0"> 
<subsection id="HEC23BA0502994FE4BF59B68666AC004B"><enum>(z)</enum><text><quote>Youth peddling</quote> means sale of goods or services by a minor in a public place (including any street corner, roadway median, sports facility, performing arts facility, or public transportation station), at the residence of the customer, at the place of business of the customer, or from a vehicle, except that such term does not include—</text> 
<paragraph id="H630319F1FA6748DE9FA5FAECB3014298"><enum>(1)</enum><text>newspaper delivery to a customer at the residence of the customer or at the place of business of the customer;</text></paragraph> 
<paragraph id="H97AE154A6CD148EE96A0DB7B64BE2600"><enum>(2)</enum><text>sale of goods or services at a fixed retail location; or</text></paragraph> 
<paragraph id="HB12E373E9CDF49229557B0FC03D5158C"><enum>(3)</enum><text>sale of goods or services on behalf of an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986 and is exempt from taxation under section 501(a) of such Code, if the minor is a volunteer and does not receive compensation for the sale.</text></paragraph></subsection> 
<subsection id="HFAB8A6D054C84F31A7CCF8C9753DB9FC"><enum>(aa)</enum><text><quote>Minor</quote> means an individual who is under the age of 18 years.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></title> 
<title id="H78F70BA4ABBE42D1A8FAE332F38D7D9E"><enum>II</enum><header>Miscellaneous provisions</header> 
<section id="H43EBED566B8140509641EB33CD44E808"><enum>201.</enum><header>Hazardous Occupations rule based on NIOSH report</header> 
<subsection id="H7097B36A08364FCBAC86EB0854AD9425"><enum>(a)</enum><header>In general</header><text>Not later than 24 months after the date of the enactment of this section, the Secretary of Labor shall promulgate a rule, under <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code, to carry out this section.</text></subsection> 
<subsection id="H0C663A5A856A4D78B39139673C4C5483"><enum>(b)</enum><header>Scope of rule</header><text>The rule referred to in subsection (a) shall provide that, in the application and enforcement of the child labor provisions of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>), any occupation specified in subsection (c) is particularly hazardous for the employment of children between the ages of 16 and 18 years or detrimental to their health or well-being, within the meaning of section 3(l)(2) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(l)(2)</external-xref>).</text></subsection> 
<subsection id="H9DA48892849043C085978983F008CC28"><enum>(c)</enum><header>Occupations specified</header><text>The occupations referred to in subsection (b) are—</text> 
<paragraph id="H7873DACB17434BF2A3ED8DE0FD5D3313"><enum>(1)</enum><text>the occupations that are the subjects of recommendations pertaining to current hazardous orders, as stated in part IV of the report entitled <quote>National Institute for Occupational Safety and Health (NIOSH) Recommendations to the U.S. Department of Labor for Changes to Hazardous Orders</quote>, dated May 3, 2002; and</text></paragraph> 
<paragraph id="HC7C2971FCBCA43CBA9F81FA9EC00EAAD"><enum>(2)</enum><text>the occupations that are the subjects of recommendations for new hazardous orders, as stated in part V of that report.</text></paragraph></subsection> 
<subsection id="HEEA9725DD9F34BE4B37E71AB3F5520B3"><enum>(d)</enum><header>Rule consistency with NIOSH recommendations</header><text>With respect to each occupation, the rule shall impose requirements that are consistent with the parts IV and V recommendations in the NIOSH report, except that—</text> 
<paragraph id="H60F93CE3A9A14C9F84FE21195DBC6F7D"><enum>(1)</enum><text>in the case of the part IV recommendation HO 10 for Non-Agricultural Occupations, the rule may not provide for employment of children between the ages of 16 and 18 years in the operation of power-driven meat and food slicers in the wholesale, retail, or services industry;</text></paragraph> 
<paragraph id="HA0510DB599A54721836D8E28BC096466"><enum>(2)</enum><text>the rule may not allow for the operation of counter-top models of power-driven bakery machines, as proposed in the part IV recommendation HO 11 for Non-Agricultural Occupations; and</text></paragraph> 
<paragraph id="HCF974C1512C1415C9DB12B7C36A7629F"><enum>(3)</enum><text>in the case of the part IV recommendation HO 1 for Agricultural Occupations, the rule may not provide for employment of children between the ages of 14 and 15 years as tractor operators.</text></paragraph></subsection></section> 
<section id="H564151BBB7D840D68272B6874C44982B"><enum>202.</enum><header>Periodic review of restricted occupation and hazardous occupation Orders</header> 
<subsection id="HA5EAF1B3CCBF4C62902480A5FB5B6180"><enum>(a)</enum><header>In general</header><text>At appropriate intervals, but in no case less than once during each five-year period, the Secretary of Labor shall conduct a comprehensive review of Restricted Occupation Orders and Hazardous Occupation Orders to assure that such Orders are current and effective in light of changes in science and technology, data on occupational injuries, and other relevant factors.</text></subsection> 
<subsection id="HDAC5686BE10E49F5B7F470568B2001C6"><enum>(b)</enum><header>Rules</header><text>At the end of each review referred to in subsection (a), the Secretary shall promulgate rules, under <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code, to effect necessary changes in Restricted Occupation Orders and Hazardous Occupation Orders.</text></subsection> 
<subsection id="HD02DDCE7489F4005A2A17B78BD6E5F24"><enum>(c)</enum><header>Timing</header><text>The first five-year period referred to in subsection (a) is the five-year period beginning with the year in which this section is enacted.</text></subsection></section> 
<section id="H13CAF1E5B5AC49718248A12BF0445BFC"><enum>203.</enum><header>Rule to prohibit employment of minors in certain activities</header> 
<subsection id="H7C8278F61FC44046A241AECF8F20E35"><enum>(a)</enum><header>In general</header><text>Not later than 24 months after the date of the enactment of this section, the Secretary of Labor shall promulgate a rule, under <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code, to prohibit employment of minors in the following activities:</text> 
<paragraph id="H1DD53955D3ED4E579FF616D08C6653C6"><enum>(1)</enum><text>Seafood processing.</text></paragraph> 
<paragraph id="HE610483FD35A4B08B57C323481823680"><enum>(2)</enum><text>Employment requiring a minor to handle or dispose of oil or other liquids from fryers.</text></paragraph></subsection> 
<subsection id="H857BD1F81DDD47FA8B7C16485595589B"><enum>(b)</enum><header>Definition</header><text>As used in this section, the term <term>minor</term> means an individual who is under the age of 18 years.</text></subsection></section> 
<section id="HC8DD7F3AE46845238B00C0AD49A7AEC5"><enum>204.</enum><header>Review of health and safety data; rules</header> 
<subsection id="H6DC7D97E066340959D7B00ED58FCEF8"><enum>(a)</enum><header>Review</header><text>Not later than 36 months after the date of the enactment of this section, the Secretary of Labor shall complete a review of health and safety data on the employment of minors in the following activities:</text> 
<paragraph id="HAF48CD3D9F074198003B2D86EEBF8E1D"><enum>(1)</enum><text>Repetitive bending, stooping, twisting, and squatting.</text></paragraph> 
<paragraph id="HBAFD484C4D29429089E9A13F130059E9"><enum>(2)</enum><text>Lifting of heavy objects and unwieldy objects.</text></paragraph> 
<paragraph id="H45A1E54D2E0D48B99C2CFDE6DD03442F"><enum>(3)</enum><text>Working alone or late at night in retail establishments where there is direct contact with the public and cash is handled.</text></paragraph> 
<paragraph id="H7099891D004E4CEE8329C3B67D71AFE2"><enum>(4)</enum><text>Work in the entertainment industry that is detrimental to the health, safety, education, or well-being of minors.</text></paragraph></subsection> 
<subsection id="H0E231010A2904F3496F58F22957CF521"><enum>(b)</enum><header>Rules</header><text>Upon completion of the review under subsection (a), the Secretary shall submit to the Congress a report of the review, together with appropriate rules under <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code. The effective date of the rules shall be not earlier than 12 months after the date on which congressional review begins under <external-xref legal-doc="usc" parsable-cite="usc/5/801">section 801</external-xref> of title 5, United States Code.</text></subsection> 
<subsection id="H13D6B63053E24D6EA61B58070020CC6C"><enum>(c)</enum><header>Definition</header><text>As used in this section, the term <term>minor</term> means means an individual who is under the age of 18 years.</text></subsection></section></title> 
<title id="HA1D155F7DE544889B65CACF5B158500"><enum>III</enum><header>Effective dates</header> 
<section id="H71A2811E886F4A588200048274FF89B0"><enum>301.</enum><header>Effective date</header><text display-inline="no-display-inline">The provisions of this Act shall take effect on the date of the enactment of this Act, except that section 101 of this Act shall take effect on the first day of the 12th month after the month in which this Act is enacted.</text></section></title>
