<official-title>To amend the Internal Revenue Code of 1986 to extend and expand the deduction for certain expenses of elementary and secondary school teachers.</official-title>

<section id="H99D92680C8C043B3BA5D5B22184E6E5D" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Deduction for certain expenses of elementary and secondary school teachers</header> 
<subsection id="H9A56E991ABB24060B04D6D48E801BD0"><enum>(a)</enum><header>In general</header><text>Subparagraph (D) of <external-xref legal-doc="usc" parsable-cite="usc/26/62">section 62(a)(2)</external-xref> of the Internal Revenue Code of 1986 (relating to certain expenses of elementary and secondary school teachers) is amended to read as follows:</text> 
<quoted-block style="OLC" id="H0B33506ED81648AA92852EFF93301B00" display-inline="no-display-inline"> 
<subparagraph id="H734CDAF8FE1544E2A2471392123DB79B"><enum>(D)</enum><header>Certain expenses of elementary and secondary school teachers</header><text>In the case of taxable years beginning before 2015, the deductions allowed by section 162 which consist of expenses, not in excess of the applicable amount, paid or incurred by an eligible educator in connection with books, supplies (other than nonathletic supplies for courses of instruction in health or physical education), computer equipment (including related software and services) and other equipment, and supplementary materials used by the eligible educator in the classroom.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HFCDA918922E4449B812810DB3F3C55EC"><enum>(b)</enum><header>Definitions</header><text>Subsection (d) of section 62 of such Code (relating to definition; special rules) is amended to read as follows:</text>

<subsection id="H1130981EA2774C628B36BCAB80CC3668"><enum>(d)</enum><header>Definitions</header><text>For purposes of subsection (a)(2)(D) and this subsection—</text> 
<paragraph id="H17372BA6D53340C20091C8984B72F0C7"><enum>(1)</enum><header>Applicable amount</header><text>The term <quote>applicable amount</quote> means—</text> 
<subparagraph id="H011DE20E65104D7496D1D372DAE4DB5"><enum>(A)</enum><text>$500 in the case of a full-time educator, and</text></subparagraph> 
<subparagraph id="HCE3865E57C4B4D999489FA7EA8E5EB91"><enum>(B)</enum><text>$250 in any other case.</text></subparagraph></paragraph> 
<paragraph id="H652CFC6E3730486E9240D9BCA7005570"><enum>(2)</enum><header>Eligible educator</header><text>The term <quote>eligible educator</quote> means, with respect to any taxable year, an individual who is—</text> 
<subparagraph id="H08A727240E8E402383175389CC2BB59C"><enum>(A)</enum><text>a kindergarten through grade 12 teacher, instructor, counselor, principal, or aide in a school for at least 450 hours during a school year which ends during such taxable year, or</text></subparagraph> 
<subparagraph id="H97670B728D9644918B0723EA1C3DA269"><enum>(B)</enum><text>a teacher, instructor, counselor, or aid in a preschool program for at least 450 hours during the taxable year.</text></subparagraph></paragraph> 
<paragraph id="H1376FCB937D4447FA9D34C94E7D2D91"><enum>(3)</enum><header>Full-time educator</header><text>The term <quote>full-time educator</quote> means, with respect to any taxable year, an individual who for such taxable year satisfies the requirements of subparagraph (A) or (B) of paragraph (2) applied by substituting <quote>900 hours</quote> for <quote>450 hours</quote> therein.</text></paragraph> 
<paragraph id="HE2C61AE5C41E42F9BA2C0898DB183E2B"><enum>(4)</enum><header>School</header><text>The term <quote>school</quote> means any school which provides elementary education or secondary education (kindergarten through grade 12), as determined under State law.</text></paragraph> 
<paragraph id="H71AC1911C31043AD8C13945425DEE92B"><enum>(5)</enum><header>Preschool program</header><text>The term <quote>preschool program</quote> means any program for providing preschool which—</text> 
<subparagraph id="H80AE5D01158E48408FFA0299599F56EC"><enum>(A)</enum><text>receives funds for carrying out preschool programs pursuant to—</text> 
<clause id="HEA555EDB287C41A39E85C2A5D4789113"><enum>(i)</enum><text>part A of title I of the Elementary and Secondary Education Act of 1965, or</text></clause> 
<clause id="H34FA4FDA60E048F5B13D41ECA28C3DDE"><enum>(ii)</enum><text>subpart 2 of part B of title I of such Act, or</text></clause></subparagraph> 
<subparagraph id="H581BE256A13B4519AEC572E149E3ACB8"><enum>(B)</enum><text>is accredited as a preschool under State law.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC99F69024AB04F1FAA3C50CEA22771D8"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years ending after the date of the enactment of this Act.</text></subsection></section>
