<official-title>To amend title XVIII of the Social Security Act to provide for coverage, as supplies associated with the injection of insulin, of home needle destruction devices and the disposal of needles and lancets through a sharps-by-mail or similar program under part D of the Medicare Program.</official-title>

<section section-type="section-one" id="HE3619F7F40B347E9B048B24BA1A2EE3F" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Safe Needle Disposal Coverage Act of 2005</short-title></quote>. </text></section> 
<section id="H77CF24245AB84656BC8E2000001C72DE"><enum>2.</enum><header>Coverage of home needle destruction devices and disposal of needles and lancets through a sharps-by-mail or similar program under medicare part D</header> 
<subsection id="H6D2286AD8389475D8C9200CC6E8E04D2"><enum>(a)</enum><header>In general</header><text>Section 1860D–2(e)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-102">42 U.S.C. 1395w–102(e)(1)(B)</external-xref>) is amended by inserting after <quote>regulations of the Secretary</quote> the following: <quote>and including devices approved for home use by the Food and Drug Administration for the safe and effective destruction of needles and the disposal of needles and lancets through a sharps-by-mail or similar program as medically appropriate based on volume of usage</quote>.</text></subsection> 
<subsection id="H5659B5A32FF24FD994671F0492A4F214"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on January 1, 2007.</text></subsection></section>
