<official-title>To amend title I of the Employee Retirement Income Security Act of 1974 and the Internal Revenue Code of 1986 to make improvements in benefit accrual standards.</official-title>

<section id="HE0BC99104D484C4CAEE6E4084BD23FB5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pension Preservation and Portability Act of 2005</short-title></quote>.</text> </section> 
<section id="HE04D954A77D547709329E0E0AA6D6FE1" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header>Improvements in benefit accrual standards</header> 
<subsection id="HF4D64BE6A03941BE8133585B84961B8C"><enum>(a)</enum><header>Amendments to the Employee Retirement Income Security Act of 1974</header> 
<paragraph id="H543FF686AB954C03B0B16DA5BBE4DDC"><enum>(1)</enum><header>Rules relating to reduction in accrued benefits because of attainment of any age</header><text>Section 204(b)(1)(H) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1054">29 U.S.C. 1054(b)(1)(H)</external-xref>) is amended by adding at the end the following new clauses:</text> 
<quoted-block style="traditional" display-inline="no-display-inline" id="H0E53CB51F99F4CC984C3781343D54367"> 
<clause id="H8DAF5F4D77404119A21E7FA67FA25B7" indent="up3"><enum>(vii)</enum> 
<subclause id="H1AC774403E6E41EF9BCB766760EFAAFB" display-inline="yes-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">A plan complies with clause (i) if a participant’s entire accrued benefit, as determined as of any date under the formula for determining benefits as set forth in the text of the plan documents, would be equal to or greater than that of any similarly situated, younger individual. </text></subclause> 
<subclause id="HB1F4E36E19384142AE6D60C4EC835ED" indent="up1"><enum>(II)</enum><text>For purposes of this clause, an individual is similarly situated to a participant if such individual is identical to such participant in every respect (including period of service, compensation, position, date of hire, work history, and any other respect) except for age.</text></subclause> 
<subclause id="H96AC7ECB53B14D588E5C3719315EEDF2" indent="up1" commented="no"><enum>(III)</enum><text display-inline="yes-display-inline">In determining the entire accrued benefit for purposes of this clause, the subsidized portion of any early retirement benefit (including any early retirement subsidy that is fully or partially included or reflected in an employee’s opening balance or other transition benefits) shall be disregarded.</text></subclause></clause> 
<clause id="HD557ED779F5A4794A4DEF900B3D1C927" indent="up3" display-inline="no-display-inline"><enum>(viii)</enum><text display-inline="yes-display-inline">A plan shall not be treated as failing to meet the requirements of this subparagraph solely because the plan provides allowable offsets against those benefits under the plan which are attributable to employer contributions, based on benefits which are provided under title II of the Social Security Act, the Railroad Retirement Act of 1974, or under any retirement program for officers or employees of the Federal Government or of the government of any State or political subdivision thereof. For purposes of this clause, allowable offsets based on such benefits consist of offsets equal to all or part of the actual benefit payment amounts, reasonable projections or estimations of such benefit payment amounts, or actuarial equivalents of such actual benefit payment amounts, projections, or estimations (determined on the basis of reasonable actuarial assumptions).</text> </clause> 
<clause id="H869E97922AC4437392962CEF4750423C" indent="up3" display-inline="no-display-inline"><enum>(ix)</enum><text>A plan shall not be treated as failing to meet the requirements of this subparagraph solely because the plan provides a disparity in contributions or benefits with respect to which the requirements of <external-xref legal-doc="usc" parsable-cite="usc/26/401">section 401(l)</external-xref> of the Internal Revenue Code of 1986 are met.</text></clause> 
<clause id="H143AF1EA292143EAAD8CA62322AACB29" indent="up3"><enum>(x)</enum> 
<subclause id="HB7CE7D7F62A2419793009C41B03EA8CA" display-inline="yes-display-inline"><enum>(I)</enum><text>A plan shall not be treated as failing to meet the requirements of this subparagraph solely because the plan provides for pre-retirement indexing of accrued benefits under the plan.</text></subclause> 
<subclause id="H9D5B9EA1D8CC4027B502C1BED469CC4C" indent="up1"><enum>(II)</enum><text>For purposes of this clause, the term <term>pre-retirement indexing</term> means, in connection with an accrued benefit, the periodic adjustment of the accrued benefit by means of the application of a recognized index or methodology so as to protect the economic value of the benefit against inflation prior to distribution.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HE4B3913E72B54C819163BC629D00F8E1"><enum>(2)</enum><header>Determinations of accrued benefit as balance of benefit account</header><text>Section 203 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1053">29 U.S.C. 1053</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="HFC794E1695844FDAA2F908899B55B289"><enum>(f)</enum> 
<paragraph id="HBB1A9973CDC74280A6DB54DA0426A0C8" display-inline="yes-display-inline"><enum>(1)</enum><text>A defined benefit plan under which the accrued benefit payable under the plan upon distribution (or any portion thereof) is expressed as the balance of an account maintained for the participant shall not be treated as failing to meet the requirements of subsection (a)(2) and section 205(g) solely because of the amount actually made available for such distribution under the terms of the plan, in any case in which—</text> 
<subparagraph id="HEDC8C33AD39C4064A82ED98CEFDD004E" indent="up1"><enum>(A)</enum><text>the applicable interest rate that would be required to discount the participant’s accrued benefit projected under the terms of the plan to normal retirement age to a present value equal to the amount actually made available for distribution under the plan is not greater than</text></subparagraph> 
<subparagraph id="H8E978D4A79594A719B6F2936CE3F6881" indent="up1"><enum>(B)</enum><text>a market rate of return.</text></subparagraph></paragraph> 
<paragraph id="H5338ABC488654459886E9884FCDEAD70" indent="up1"><enum>(2)</enum><text>The Secretary of the Treasury may provide by regulation for rules governing the calculation of a market rate of return for purposes of paragraph (1) and for permissible methods of crediting interest to the account (including variable interest rates) resulting in effective rates of return meeting the requirements of paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HD2629B137EC14999818560DA955D24BF"><enum>(b)</enum><header>Amendments to the Internal Revenue Code of 1986</header> 
<paragraph id="H2BB58C3A836742DC9249718B8577EBC5"><enum>(1)</enum><header>Rules relating to reduction in accrued benefits because of attainment of any age</header><text>Subparagraph (H) of <external-xref legal-doc="usc" parsable-cite="usc/26/411">section 411(b)(1)</external-xref> of the Internal Revenue Code of 1986 (relating to continued accrual beyond normal retirement age) is amended—</text> 
<subparagraph id="H8D458DCB508A4AA780C0E4822950F7B8"><enum>(A)</enum><text>by striking the heading and inserting the following: <quote><header-in-text level="subparagraph" style="OLC">Rules relating to reduction in accrued benefits because of attainment of any age.—</header-in-text></quote>; and</text></subparagraph> 
<subparagraph id="HE3B6F25AD8E14B01A09CD6A715D9065D"><enum>(B)</enum><text>by adding at the end the following:</text>

<clause id="H53250B4B09E640F5A246A800AE8FC7B"><enum>(vi)</enum><header>Comparison to similarly situated, younger individuals</header> 
<subclause id="HAC07C6C33B144B508B6D1515B2BC304F" display-inline="no-display-inline"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">A plan shall not be treated as failing to meet the requirements of clause (i) if, as of any applicable date, a participant’s entire accrued benefit, as determined under the formula for determining benefits as set forth in the text of the plan documents, would be equal to or greater than that of any similarly situated, younger individual.</text></subclause> 
<subclause id="HE03F0028B5FB4689B51DB35B44E2C29E"><enum>(II)</enum><header>Similarly situated individual</header><text>For purposes of this clause, an individual is similarly situated to a participant if such individual is identical to such participant in every respect (including period of service, compensation, position, date of hire, work history, and any other respect) except for age.</text></subclause> 
<subclause id="H14F277DE716F4E48A158C78560B9D1B0" commented="no"><enum>(III)</enum><header>Subsidized portion of early retirement benefit disregarded</header><text>In determining the entire accrued benefit for purposes of this clause, the subsidized portion of any early retirement benefit shall be disregarded.</text></subclause></clause> 
<clause id="H03D71CC7B6B84896BA1EAB7C1768E9C" display-inline="no-display-inline"><enum>(vii)</enum><header>Allowable offsets</header><text>A plan shall not be treated as failing to meet the requirements of this subparagraph solely because the plan provides allowable offsets against those benefits under the plan which are attributable to employer contributions, based on benefits which are provided—</text> 
<subclause id="H4B326E859F0545DD912310204DD01B04"><enum>(I)</enum><text>under title II of the Social Security Act, the Railroad Retirement Act of 1974, or under any retirement program for officers or employees of the Federal Government or of the government of any State or political subdivision thereof, or</text></subclause> 
<subclause id="H1FBF41C53FA1411C830229455466CA28"><enum>(II)</enum><text>under another defined benefit plan which meets the requirements of this subparagraph or a defined contribution plan which meets the requirements of paragraph (2), if such offset is determined under a formula which does not provide for the commencement of, or any increase in, the offset upon the attainment of any specified age of the participant.</text></subclause><continuation-text continuation-text-level="clause">For purposes of this clause, allowable offsets based on such benefits consist of offsets equal to the actual benefit payment amounts, reasonable projections or estimations of such benefit payment amounts, or actuarial equivalents of such actual benefit payment amounts, projections, or estimations (determined on the basis of reasonable actuarial assumptions).</continuation-text></clause> 
<clause id="H1687E36C23654F67A26B27C5F7085065" display-inline="no-display-inline"><enum>(viii)</enum><header>Compliance with rules permitting disparity in plan contributions or benefits</header><text>A plan shall not be treated as failing to meet the requirements of this subparagraph solely because the plan provides a disparity in contributions or benefits with respect to which the requirements of section 401(l) are met.</text></clause> 
<clause id="H72543E4D9DE94DC68EA685CDC9577F77"><enum>(ix)</enum><header>Pre-retirement indexing</header> 
<subclause id="H5002065B4B344D17AF5F6333BCFD5FE7" display-inline="no-display-inline"><enum>(I)</enum><header>In general</header><text>A plan shall not be treated as failing to meet the requirements of this subparagraph solely because the plan provides for pre-retirement indexing of accrued benefits under the plan.</text></subclause> 
<subclause id="H27925B7063064DAAA2017D79005150A3"><enum>(II)</enum><header>Definition</header><text>For purposes of this clause, the term <term>pre-retirement indexing</term> means, in connection with an accrued benefit, the periodic adjustment of the accrued benefit by means of the application of a recognized index or methodology so as to protect the economic value of the benefit against inflation prior to distribution.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HFCDE87836B23437D0091B5D9D83E4B5" display-inline="no-display-inline"><enum>(2)</enum><header>Determinations of accrued benefit as balance of benefit account</header><text>Subsection (a) of section 411 of such Code (relating to minimum vesting standards) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H60C5AD47944B42C788E749733661644"><enum>(13)</enum><header>Maintenance of nonforfeitability of benefits expressed as account balance</header> 
<subparagraph id="H11DC262BF04043D2B9AC939FF4C0F0DD"><enum>(A)</enum><header>In general</header><text>A defined benefit plan under which the accrued benefit payable under the plan upon distribution (or any portion thereof) is expressed as the balance of an account maintained for the participant shall not be treated as failing to meet the requirements of paragraph (2) or 417(e) solely because of the amount actually made available for such distribution under the terms of the plan, in any case in which—</text> 
<clause id="HB559185C4012471796D846245E697197"><enum>(i)</enum><text>the applicable interest rate that would be required to discount the participant’s accrued benefit projected under the terms of the plan to normal retirement age to a present value equal to the amount actually made available for distribution under the plan is not greater than</text></clause> 
<clause id="H7357F255FC4C4CB4B22675ACCB00664D"><enum>(ii)</enum><text>a market rate of return.</text></clause></subparagraph> 
<subparagraph id="H296B46237CC541FAA7E7747538EED9B"><enum>(B)</enum><header>Regulations</header><text>The Secretary may provide by regulation for rules governing the calculation of a market rate of return for purposes of subparagraph (A) and for permissible methods of crediting interest to the account (including variable interest rates) resulting in effective rates of return meeting the requirements of subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H3E318948BFB645E5889BA28340C929BA"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to plan years beginning before, on, or after the date of the enactment of this Act.</text></subsection></section>
