<section id="H5CD03965D38C412B88E4221BDD9E647C"><enum>101.</enum><header>Codification of sanctions</header> 
<subsection id="H2057DF315D9D407E9B426D4343F07021"><enum>(a)</enum><header>Codification of sanctions</header><text>United States sanctions, controls, and regulations with respect to Iran imposed pursuant to Executive Order No. 12957, sections 1(b) through (1)(g) and sections (2) through (6) of Executive Order No. 12959, and sections 2 and 3 of Executive Order No. 13059 (relating to exports and certain other transactions with Iran) as in effect on January 1, 2006, shall remain in effect until the President certifies to the Committee on International Relations of the House of Representatives and the Committee on Foreign Relations of the Senate that the Government of Iran has verifiably dismantled its weapons of mass destruction programs.</text></subsection> 
<subsection id="H68E9FE38BDAE4BCBB6E722DFEE06259B"><enum>(b)</enum><header>No effect on other sanctions relating to support for acts of international terrorism</header><text>Subsection (a) shall have no effect on United States sanctions, controls, and regulations relating to a determination under section 6(j)(1)(A) of the <act-name parsable-cite="EAA79">Export Administration Act of 1979</act-name> (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2405">50 U.S.C. App. 2405(j)(1)(A)</external-xref>), section 620A(a) of the <act-name parsable-cite="FAA61">Foreign Assistance Act of 1961</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371(a)</external-xref>), or section 40(d) of the <act-name parsable-cite="AECA">Arms Export Control Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780(d)</external-xref>) relating to support for acts of international terrorism by the Government of Iran, as in effect on January 1, 2006.</text></subsection></section> 
<section id="H8E7C2546B19649009D338074BAFA8BB4" display-inline="no-display-inline" section-type="subsequent-section"><enum>102.</enum><header>Liability of parent companies for violations of sanctions by foreign entities</header> 
<subsection id="H662D24AC1C244EC3ADFECF7D97C4E600"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In any case in which an entity engages in an act outside the United States which, if committed in the United States or by a United States person, would violate Executive Order No. 12959 of May 6, 1995, Executive Order No. 13059 of August 19, 1997, or any other prohibition on transactions with respect to Iran that is imposed under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) and if that entity was created or availed of for the purpose of engaging in such an act, the parent company of that entity shall be subject to the penalties for such violation to the same extent as if the parent company had engaged in that act.</text></subsection> 
<subsection id="HA87D6E64DC41411F83F750D1DE630B5"><enum>(b)</enum><header>Definitions</header><text>In this section—</text> 
<paragraph id="H8B9B59030A904C63B7320015A671C2F7"><enum>(1)</enum><text>an entity is a <quote>parent company</quote> of another entity if it owns, directly or indirectly, more than 50 percent of the equity interest in that other entity and is a United States person; and</text></paragraph> 
<paragraph id="HF049817A004C421480C6BD6CA83002F"><enum>(2)</enum><text>the term <quote>entity</quote> means a partnership, association, trust, joint venture, corporation, or other organization.</text></paragraph></subsection></section></title> 
<title id="H7A047BD432BF4502B621D1C721EE7FDA"><enum>II</enum><header>Amendments to the Iran and Libya Sanctions Act of 1996 and other Provisions Related to Investment in Iran</header> 
<section id="HBED3056948D649EFB175449782B3108E"><enum>201.</enum><header>Multilateral regime</header> 
<subsection id="H8469404482464EDAAD28BE78A6CDD500"><enum>(a)</enum><header>Reports to Congress</header><text>Section 4(b) of the Iran and Libya Sanctions Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended to read as follows:</text> 
<quoted-block id="HBA7041F02AFC4D1E00DF89D1C58385E"> 
<subsection id="HECCE0C845F5B45A29CCE2042E9BDE733"><enum>(b)</enum><header>Reports to Congress</header><text>Not later than six months after the date of the enactment of the <short-title>Iran Freedom Support Act</short-title> and every six months thereafter, the President shall submit to the appropriate congressional committees a report regarding specific diplomatic efforts undertaken pursuant to subsection (a), the results of those efforts, and a description of proposed diplomatic efforts pursuant to such subsection. Each report shall include—</text> 
<paragraph id="HF732D9C9566C4143A59CE7A631E4FAED"><enum>(1)</enum><text>a list of the countries that have agreed to undertake measures to further the objectives of section 3 with respect to Iran;</text></paragraph> 
<paragraph id="H4BE2052A90AC4D0EA4FB23B44060A9F5"><enum>(2)</enum><text>a description of those measures, including—</text> 
<subparagraph id="HF71665942CF4463FBEC63B079C9E812"><enum>(A)</enum><text>government actions with respect to public or private entities (or their subsidiaries) located in their territories, that are engaged in Iran;</text></subparagraph> 
<subparagraph id="H13C88BB31184455E91EEEDE70DA5807"><enum>(B)</enum><text>any decisions by the governments of these countries to rescind or continue the provision of credits, guarantees, or other governmental assistance to these entities; and</text></subparagraph> 
<subparagraph id="HD63C294E880640839D772719B46441E9"><enum>(C)</enum><text>actions taken in international fora to further the objectives of section 3;</text></subparagraph></paragraph> 
<paragraph id="H7915114005E943E8BB3C48582FA5892B"><enum>(3)</enum><text>a list of the countries that have not agreed to undertake measures to further the objectives of section 3 with respect to Iran, and the reasons therefor; and</text></paragraph> 
<paragraph id="H11556378987E4CCCAB00768985D0A78B"><enum>(4)</enum><text>a description of any memorandums of understanding, political understandings, or international agreements to which the United States has acceded which affect implementation of this section or section 5(a).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA01A9F7C30E849F0A90419B9CBA320D4"><enum>(b)</enum><header>Waiver</header><text>Section 4(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended to read as follows:</text> 
<quoted-block id="H1298782AFBAE468900AD8EFA73B8CEF2"> 
<subsection id="H8FDB0783F8CF4CE4A2C86FA7F2008F70"><enum>(c)</enum><header>Waiver</header> 
<paragraph id="H39B932278F71435B98839B1C4F85EDF5"><enum>(1)</enum><header>In general</header><text>The President may, on a case by case basis, waive for a period of not more than six months the application of section 5(a) with respect to a national of a country, if the President certifies to the appropriate congressional committees at least 30 days before such waiver is to take effect that—</text> 
<subparagraph id="H0B0C044F625D4C5499EF1F7C1D3CDE98"><enum>(A)</enum><text>such waiver is vital to the national security interests of the United States; and</text></subparagraph> 
<subparagraph id="H68D82296421043FC9C586D98928BC6D9"><enum>(B)</enum><text>the country of the national has undertaken substantial measures to prevent the acquisition and development of weapons of mass destruction by the Government of Iran.</text></subparagraph></paragraph> 
<paragraph id="HB3566F4ECCD44642B7DF7CA06F4CDD2B"><enum>(2)</enum><header>Subsequent renewal of waiver</header><text display-inline="yes-display-inline">If the President determines that, in accordance with paragraph (1), such a waiver is appropriate, the President may, at the conclusion of the period of a waiver under paragraph (1), renew such waiver for subsequent periods of not more than six months each.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA592A105EB414C99A00066287129E9A9"><enum>(c)</enum><header>Investigations</header><text>Section 4 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended by adding at the end the following new subsection:</text>

<subsection id="HD9E3196EFD1D41419C6F38092964339D"><enum>(f)</enum><header>Investigations</header> 
<paragraph id="H5FC25B8A4E994DB9AD622C6335BD9E2D"><enum>(1)</enum><header>In general</header><text>The President shall initiate an investigation into the possible imposition of sanctions against a person upon receipt by the United States of credible information indicating that such person is engaged in activity related to investment in Iran as described in section 5(a).</text></paragraph> 
<paragraph id="H3DF05AF4211141A500E627F3811DC3C7"><enum>(2)</enum><header>Determination and notification</header> 
<subparagraph id="H88D45584B3424A18BAEB00DC98A3E68D"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after an investigation is initiated in accordance with paragraph (1), the President shall determine, pursuant to section 5(a), whether or not to impose sanctions against a person engaged in activity related to investment in Iran as described in such section as a result of such activity and shall notify the appropriate congressional committees of the basis for such determination.</text></subparagraph> 
<subparagraph id="H2F57396EA4F343889E320200EF88399B"><enum>(B)</enum><header>Extension</header><text>If the President is unable to make a determination under subparagraph (A), the President shall notify the appropriate congressional committees and shall extend such investigation for a subsequent period, not to exceed 180 days, after which the President shall make the determination required under such subparagraph and shall notify the appropriate congressional committees of the basis for such determination in accordance with such subparagraph.</text></subparagraph></paragraph> 
<paragraph id="HD9B1E65A48A44CCA82554C82AA1C0046" display-inline="no-display-inline"><enum>(3)</enum><header>Determinations regarding pending investigations</header><text>Not later than 90 days after the date of the enactment of this Act, the President shall, with respect to any investigation that was pending as of January 1, 2006, concerning a person engaged in activity related to investment in Iran as described in section 5(a), determine whether or not to impose sanctions against such person as a result of such activity and shall notify the appropriate congressional committees of the basis for such determination.</text></paragraph> 
<paragraph id="H20DA07623117481E88935604FF19858D"><enum>(4)</enum><header>Publication</header><text display-inline="yes-display-inline">Not later than 10 days after the President notifies the appropriate congressional committees under paragraphs (2) and (3), the President shall ensure publication in the Federal Register of the identification of the persons against which the President has made a determination that the imposition of sanctions is appropriate, together with an explanation for such determination.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H84775F9CF30A46FB00AB00AA0900A01F"><enum>202.</enum><header>Imposition of sanctions</header> 
<subsection id="H006A823D956B43438960C7EF00A2B246"><enum>(a)</enum><header>Sanctions with respect to development of petroleum resources</header><text>Section 5(a) of the Iran and Libya Sanctions Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended—</text> 
<paragraph id="HDF237420810C41188640DE136F336399"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="subsection" style="OLC">to Iran</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">to the Development of Petroleum Resources of Iran</header-in-text></quote>;</text></paragraph> 
<paragraph id="HA1BCBE8A85574E9C00588BBDFA6E7564"><enum>(2)</enum><text>by striking <quote>(6)</quote> and inserting <quote>(5)</quote>; and</text></paragraph> 
<paragraph id="H160C29BA853B4B41BEAAEAB3014E505E"><enum>(3)</enum><text>by striking <quote>with actual knowledge,</quote>.</text></paragraph></subsection> 
<subsection id="HDAD2345FDDF54F2787D9D0E030DD0526"><enum>(b)</enum><header>Sanctions with respect to development of weapons of mass destruction or other military capabilities</header><text>Section 5(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended to read as follows:</text> 
<quoted-block id="HCAEC2226C3F445D8803ED073193900F0"> 
<subsection id="H0C7746568A9A4AACB7AC09D715CC19FE"><enum>(b)</enum><header>Mandatory sanctions with respect to development of weapons of mass destruction or other military capabilities</header><text>Notwithstanding any other provision of law, the President shall impose two or more of the sanctions described in paragraphs (1) through (5) of section 6 if the President determines that a person has, on or after the date of the enactment of this Act, exported, transferred, or otherwise provided to Iran any goods, services, technology, or other items knowing that the provision of such goods, services, technology, or other items would contribute to the ability of Iran to—</text> 
<paragraph id="H02F7F6E2087C43CD813C62872BDF50F7"><enum>(1)</enum><text>acquire or develop chemical, biological, or nuclear weapons or related technologies; or</text></paragraph> 
<paragraph id="H3E505C2F6A384A36B522CC8248B1CE7E"><enum>(2)</enum><text>acquire or develop destabilizing numbers and types of advanced conventional weapons.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H69E6831213834802A44F34BD38C83197"><enum>(c)</enum><header>Persons against which the sanctions are to be imposed</header><text>Section 5(c)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended—</text> 
<paragraph id="HCD629CADF3EE4276AD0414E5208EE0F8"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>, with actual knowledge,</quote> and by striking <quote>or</quote> at the end;</text></paragraph> 
<paragraph id="H01E4BB51E5BC4182AD05592E6676CF90"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>, with actual knowledge,</quote> and by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="HFF19C018546C4FD000EC50791BFB62F8"><enum>(3)</enum><text>by adding after subparagraph (C) the following new subparagraph:</text> 
<quoted-block id="H39CDD3DF8E18464F8B00A7C1D249ABB"> 
<subparagraph id="HFB0A6F19BA0C47579B59DE4F8E5965C7"><enum>(D)</enum><text>is a private or government lender, insurer, underwriter, or guarantor of the person referred to in paragraph (1) if that private or government lender, insurer, underwriter, or guarantor engaged in the activities referred to in paragraph (1).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HB86F5155C0964F8689531CAC4F8EACBF"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to actions taken on or after March 15, 2006.</text></subsection></section> 
<section id="HF10B62EF9A9140CB93D491FF80E78681"><enum>203.</enum><header>Termination of sanctions</header><text display-inline="no-display-inline">Section 8(a) of the Iran and Libya Sanctions Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended—</text> 
<paragraph id="HFADB215C2C684CF9A26F6F5C7453B0EF"><enum>(1)</enum><text>in paragraph (1)(C), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="H54B130B0F449445EA572CAE3968D8590"><enum>(2)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H1911D529ECCB4E8FA2AF9496F47C07F7"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block id="HF1BBBDDAD1E14B4F84254630647797B8"> 
<paragraph id="H05E0D406DEEE41EDBAFF96AF2DD2A327"><enum>(3)</enum><text>poses no significant threat to United States national security, interests, or allies.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H594CFC9B919243BA8D0617D3CAC1DB1C"><enum>204.</enum><header>Sunset</header><text display-inline="no-display-inline">Section 13 of the Iran and Libya Sanctions Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended—</text> 
<paragraph id="H2AC3EEAB044E4E30A96ECD7CB6DB9954"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text>; sunset</header-in-text></quote>;</text></paragraph> 
<paragraph id="H0C1BB557176A4EFBA3BD713137CE00CA"><enum>(2)</enum><text>in subsection (a), by striking the subsection designation and heading; and</text></paragraph> 
<paragraph id="H5E32C1421113487DA7929DC09E150099"><enum>(3)</enum><text>by striking subsection (b).</text></paragraph></section> 
<section id="HD9C121E9E89D4645998B04DB2F98A17"><enum>205.</enum><header>Clarification and expansion of definitions</header> 
<subsection id="HD5567C3B7E3344EFB616B65B37F1C0D9"><enum>(a)</enum><header>Person</header><text>Section 14(14)(B) of the Iran and Libya Sanctions Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended—</text> 
<paragraph id="H011D1403DEB2442EA2006EFC45379174"><enum>(1)</enum><text>by inserting after <quote>trust,</quote> the following: <quote>financial institution, insurer, underwriter, guarantor, any other business organization, including any foreign subsidiaries of the foregoing,</quote>; and</text></paragraph> 
<paragraph id="HB49D200CE11D414EA8C034B98D6E1D24"><enum>(2)</enum><text>by inserting before the semicolon the following: <quote>, such as an export credit agency</quote>.</text></paragraph></subsection> 
<subsection id="HCF12FEFD522A4063B1D17FA511AA5866"><enum>(b)</enum><header>Petroleum resources</header><text>Section 14(15) of the Iran and Libya Sanctions Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended by inserting after <quote>petroleum</quote> the second place it appears, the following: <quote>, petroleum by-products,</quote>.</text></subsection></section> 
<section id="H5C5DA4A2FE744281959D1C9576A18E90" display-inline="no-display-inline" section-type="subsequent-section"><enum>206.</enum><header>United States pension plans</header> 
<subsection id="H0555B7489C884EBEB198BFC886E32103"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> 
<paragraph id="HFD89B2B5394349C7987FC6C06D9EA600"><enum>(1)</enum><text>The United States and the international community face no greater threat to their security than the prospect of rogue regimes who support international terrorism obtaining weapons of mass destruction, and particularly nuclear weapons.</text></paragraph> 
<paragraph id="H2293E36AE2E9460099F596998595596D"><enum>(2)</enum><text>Iran is the leading state sponsor of international terrorism and is close to achieving nuclear weapons capability but has paid no price for nearly twenty years of deception over its nuclear program. Foreign entities that have invested in Iran’s energy sector, despite Iran’s support of international terrorism and its nuclear program, have afforded Iran a free pass while many United States entities have unknowingly invested in those same foreign entities.</text></paragraph> 
<paragraph id="H385D70D05CCD427797522C049168BA06"><enum>(3)</enum><text>United States investors have a great deal at stake in preventing Iran from acquiring nuclear weapons.</text></paragraph> 
<paragraph id="HE29CCA92FABE4F9E8E49DE829151726E"><enum>(4)</enum><text>United States investors can have considerable influence over the commercial decisions of the foreign entities in which they have invested.</text></paragraph></subsection> 
<subsection id="H9930D1D894F041C6BB16F5547329B06C" display-inline="no-display-inline"><enum>(b)</enum><header>Publication in Federal Register</header><text>Not later than six months after the date of the enactment of this Act and every six months thereafter, the Secretary of State shall ensure publication in the Federal Register of a list of all United States and foreign entities that have invested more than $20,000,000 in Iran’s energy sector between August 5, 1996, and the date of such publication. Such list shall include an itemization of individual investments of each such entity, including the dollar value, intended purpose, and current status of each such investment.</text></subsection> 
<subsection id="H7431F67104DD4ACBBE95E3494BA33D7"><enum>(c)</enum><header>Sense of Congress relating to divestiture from Iran</header><text display-inline="yes-display-inline">It is the sense of Congress that, upon publication of a list in the relevant Federal Register under subsection (b), managers of United States Government pension plans or thrift savings plans, managers of pension plans maintained in the private sector by plan sponsors in the United States, and managers of mutual funds sold or distributed in the United States should, to the extent consistent with the legal and fiduciary duties otherwise imposed on them, immediately initiate efforts to divest all investments of such plans or funds in any entity included on the list.</text></subsection> 
<subsection id="H67B9743ED1944274B73BC64031667C18" commented="no"><enum>(d)</enum><header>Sense of Congress relating to prohibition on future investment</header><text display-inline="yes-display-inline">It is the sense of Congress that, upon publication of a list in the relevant Federal Register under subsection (b), there should be, to the extent consistent with the legal and fiduciary duties otherwise imposed on them, no future investment in any entity included on the list by managers of United States Government pension plans or thrift savings plans, managers of pension plans maintained in the private sector by plan sponsors in the United States, and managers of mutual funds sold or distributed in the United States.</text></subsection></section>

<section id="H620BC2E600DA4783BAAB9BAAA352CE7C"><enum>301.</enum><header>Diplomatic efforts</header> 
<subsection id="H8C777E820FAC4FAFB76CE8B448D8ED0"><enum>(a)</enum><header>Sense of Congress relating to United Nations Security Council and the International Atomic Energy Agency</header><text>It is the sense of Congress that the President should instruct the United States Permanent Representative to the United Nations to work to secure support at the United Nations Security Council for a resolution that would impose sanctions on Iran as a result of its repeated breaches of its nuclear nonproliferation obligations, to remain in effect until Iran has verifiably dismantled its weapons of mass destruction programs.</text></subsection> 
<subsection id="H8A1E8E722A2C413681684FCC0210B2B1"><enum>(b)</enum><header>Prohibition on assistance to countries that invest in the energy sector of Iran</header> 
<paragraph id="H2AEA0C8E4AF346E4A66CD1BE48A056"><enum>(1)</enum><header>Withholding of assistance</header><text display-inline="yes-display-inline">If, on or after April 13, 2005, a foreign person (as defined in section 14 of the Iran Sanctions Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note), as renamed pursuant to section 208(g)(1)) or an agency or instrumentality of a foreign government has more than $20,000,000 invested in Iran’s energy sector, the President shall, until the date on which such person or agency or instrumentality of such government terminates such investment, withhold assistance under the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151 et seq.</external-xref>) to the government of the country to which such person owes allegiance or to which control is exercised over such agency or instrumentality.</text></paragraph> 
<paragraph id="H86E9E6C78CE3441EBFB1555CFE7CB4A7"><enum>(2)</enum><header>Waiver</header><text display-inline="yes-display-inline">Assistance prohibited by this section may be furnished to the government of a foreign country described in subsection (a) if the President determines that furnishing such assistance is important to the national security interests of the United States, furthers the goals described in this Act, and, not later that 15 days before obligating such assistance, notifies the Committee on International Relations of the House of Representatives, the Committee on Foreign Relations of the Senate, the Committee on Appropriations of the House of Representatives, and the Committee on Appropriations of the Senate of such determination and submits to such committees a report that includes—</text> 
<subparagraph id="HC3EFAE71DEC84DE3B1A184E518B9F8A8"><enum>(A)</enum><text>a statement of the determination;</text></subparagraph> 
<subparagraph id="H145346FAB7924F659BEA21D8673EBAD1"><enum>(B)</enum><text display-inline="yes-display-inline">a detailed explanation of the assistance to be provided;</text></subparagraph> 
<subparagraph id="H5422AE4FBDC647AB80192F5C897C005E"><enum>(C)</enum><text display-inline="yes-display-inline">the estimated dollar amount of the assistance; and</text></subparagraph> 
<subparagraph id="H67C7FFA9B26B4537AB543BD4A6F8C088"><enum>(D)</enum><text display-inline="yes-display-inline">an explanation of how the assistance furthers United States national security interests.</text></subparagraph></paragraph></subsection></section> 
<section id="H29CE30ED3EE74AC49C32C6146E198400" display-inline="no-display-inline" section-type="subsequent-section"><enum>302.</enum><header>Strengthening the Nuclear Nonproliferation Treaty</header> 
<subsection id="HC9A13563E93B4B308F432EC6A1CB7CF2"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> 
<paragraph id="H81E7E67D282343DC9BA6BE06A393E924"><enum>(1)</enum><text display-inline="yes-display-inline">Article IV of the Treaty on the Non-Proliferation of Nuclear Weapons (commonly referred to as the <quote>Nuclear Nonproliferation Treaty</quote> or <quote>NPT</quote>) states that countries that are parties to the Treaty have the <quote>inalienable right . . . to develop research, production and use of nuclear energy for peaceful purposes without discrimination and in conformity with articles I and II of this Treaty.</quote>. </text></paragraph> 
<paragraph id="H9881D75C0AA84CBA97AF097FA2163E1"><enum>(2)</enum><text>Iran has manipulated Article IV of the Nuclear Nonproliferation Treaty to acquire technologies needed to manufacture nuclear weapons under the guise of developing peaceful nuclear technology. </text></paragraph> 
<paragraph id="HB695DA73D7C54AEB9FF0F74DF55E73B4"><enum>(3)</enum><text>Legal authorities, diplomatic historians, and officials closely involved in the negotiation and ratification of the Nuclear Nonproliferation Treaty state that the Treaty neither recognizes nor protects such a per se right to all nuclear technology, such as enrichment and reprocessing, but rather affirms that the right to the use of peaceful nuclear energy is qualified.</text></paragraph></subsection> 
<subsection id="HA986ABB9FFB2417FB44E24DE962054CB"><enum>(b)</enum><header>Declaration of Congress regarding United States policy to strengthen the Nuclear Nonproliferation Treaty</header><text display-inline="yes-display-inline">Congress declares that it should be the policy of the United States to support diplomatic efforts to end the manipulation of Article IV of the Nuclear Nonproliferation Treaty, as undertaken by Iran, without undermining the Treaty itself.</text></subsection></section></title> 
<title id="HB6BA03A75854412CBD350063069BC700"><enum>IV</enum><header>Democracy in Iran</header> 
<section id="H2EA29BD7C4814994A2D4C16DE7147000"><enum>401.</enum><header>Declaration of Congress regarding United States policy toward Iran</header> 
<subsection id="H3E6DE7D5E9AA4AB793CB026041ED5020"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Congress declares that it should be the policy of the United States to support independent human rights and peaceful pro-democracy forces in Iran.</text></subsection> 
<subsection id="H93A4DA57EC4D4BFB8E21A9CFEEC9EFE0"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in this Act shall be construed as authorizing the use of force against Iran.</text></subsection></section> 
<section id="HEAE8BB95CE614680BF45BFF3F246E559"><enum>402.</enum><header>Assistance to support democracy in Iran</header> 
<subsection id="H2A3889F6C10540DAA384D11BFD7C9DCB"><enum>(a)</enum><header>Authorization</header> 
<paragraph id="H8B15A43845BE4D3DB222E5453BFCC68D"><enum>(1)</enum><header>In general</header><text>The President is authorized to provide financial and political assistance (including the award of grants) to foreign and domestic individuals, organizations, and entities that support democracy and the promotion of democracy in Iran. Such assistance may include the award of grants to eligible independent pro-democracy radio and television broadcasting organizations that broadcast into Iran.</text></paragraph> 
<paragraph id="HCB28ADE408014EE8A4E973E82B63FF4C"><enum>(2)</enum><header>Limitation on assistance</header><text>In accordance with the rule of construction described in subsection (b) of section 401, none of the funds authorized under this section shall be used to support the use of force against Iran.</text></paragraph></subsection> 
<subsection id="HA495864E2C5649C6A9E612B3A833953C"><enum>(b)</enum><header>Eligibility for assistance</header><text>Financial and political assistance under this section may be provided only to an individual, organization, or entity that—</text> 
<paragraph id="H97E2F6D3F62246C787A396C4D45768B0"><enum>(1)</enum><text display-inline="yes-display-inline">officially opposes the use of violence and terrorism and has not been designated as a foreign terrorist organization under section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>) at any time during the preceding four years;</text></paragraph> 
<paragraph id="H14C0F5F54F4E4BF5996E7D31A5AD2C17"><enum>(2)</enum><text>advocates the adherence by Iran to nonproliferation regimes for nuclear, chemical, and biological weapons and materiel;</text></paragraph> 
<paragraph id="H4FF845630CC24B47007F84886D68FFC2"><enum>(3)</enum><text>is dedicated to democratic values and supports the adoption of a democratic form of government in Iran;</text></paragraph> 
<paragraph id="H61FA8420531F42D1B3B21E9F4E495E00"><enum>(4)</enum><text>is dedicated to respect for human rights, including the fundamental equality of women;</text></paragraph> 
<paragraph id="HF19AD50C40874463A51BD47601130010"><enum>(5)</enum><text>works to establish equality of opportunity for people; and</text></paragraph> 
<paragraph id="H7D266B2A0E264E909FCCC05D00F5688"><enum>(6)</enum><text>supports freedom of the press, freedom of speech, freedom of association, and freedom of religion.</text></paragraph></subsection> 
<subsection id="HC0300DE68511465900EAF9007B00EB3E"><enum>(c)</enum><header>Funding</header><text>The President may provide assistance under this section using—</text> 
<paragraph id="H40B6D4AF5A3F4F79A7D7BFDF9F950400"><enum>(1)</enum><text>funds available to the Middle East Partnership Initiative (MEPI), the Broader Middle East and North Africa Initiative, and the Human Rights and Democracy Fund; and</text></paragraph> 
<paragraph id="H64F11953FBA140EEACD815FC75014D1"><enum>(2)</enum><text>amounts made available pursuant to the authorization of appropriations under subsection (g).</text></paragraph></subsection> 
<subsection id="H57D76D3544A94260B53800E91D68AABD"><enum>(d)</enum><header>Notification</header><text>Not later than 15 days before each obligation of assistance under this section, and in accordance with the procedures under section 634A of the <act-name parsable-cite="FAA61">Foreign Assistance Act of 1961</act-name> (22 U.S.C. 2394–l), the President shall notify the Committee on International Relations and the Committee on Appropriations of the House of Representatives and the Committee on Foreign Relations and the Committee on Appropriations of the Senate. Such notification shall include, as practicable, the types of programs supported by such assistance and the recipients of such assistance.</text></subsection> 
<subsection id="HE7CB23F17DBC4ED7BD815BA6AC47C907"><enum>(e)</enum><header>Sense of Congress regarding diplomatic assistance</header><text>It is the sense of Congress that—</text> 
<paragraph id="H17C03E3CFD0642D7999B39C73FBD35DB"><enum>(1)</enum><text>contacts should be expanded with opposition groups in Iran that meet the criteria under subsection (b);</text></paragraph> 
<paragraph id="HFAE2FDF89F45420A8EF98F00B3221E3E"><enum>(2)</enum><text>support for a transition to democracy in Iran should be expressed by United States representatives and officials in all appropriate international fora;</text></paragraph> 
<paragraph id="H31246AB5D730461ABC35E11F00A91FFE"><enum>(3)</enum><text>efforts to bring a halt to the nuclear weapons program of Iran, including steps to end the supply of nuclear components or fuel to Iran, should be intensified, with particular attention focused on the cooperation regarding such program—</text> 
<subparagraph id="H1954C9D886904E40AA47EB0C4B97C7F"><enum>(A)</enum><text>between the Government of Iran and the Government of the Russian Federation; and</text></subparagraph> 
<subparagraph id="HEA5E07A0B60740C1A3D80700E2192BFC"><enum>(B)</enum><text>between the Government of Iran and individuals from China and Pakistan, including the network of Dr. Abdul Qadeer (A. Q.) Khan; and</text></subparagraph></paragraph> 
<paragraph id="HF51C969AD85646E7B8DBDA2FCBDE5C"><enum>(4)</enum><text>officials and representatives of the United States should—</text> 
<subparagraph id="HF2BF350E07304989AFA56ECDFF1D36BA"><enum>(A)</enum><text>strongly and unequivocally support indigenous efforts in Iran calling for free, transparent, and democratic elections; and</text></subparagraph> 
<subparagraph id="H7E22FBA93B834FD080F786A4F61B008F"><enum>(B)</enum><text>draw international attention to violations by the Government of Iran of human rights, freedom of religion, freedom of assembly, and freedom of the press.</text></subparagraph></paragraph></subsection> 
<subsection id="H1C5438BD593347ECB7551EC25F16212C"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Department of State such sums as may be necessary to carry out this section.</text></subsection></section> 
<section id="H037F9725DAF8495BB449117D2F753BDD" display-inline="no-display-inline" section-type="subsequent-section"><enum>403.</enum><header>Waiver of certain export license requirements</header><text display-inline="no-display-inline">The Secretary of State may, in consultation with the Secretary of Commerce, waive the requirement to obtain a license for the export to, or by, any person to whom the Department of State has provided a grant under a program to promote democracy or human rights abroad, any item which is commercially available in the United States without government license or permit, to the extent that such export would be used exclusively for carrying out the purposes of the grant.</text></section></title>
