<official-title>To amend the Internal Revenue Code of 1986 to expand and enhance the HOPE and Lifetime Learning Credits, and to amend the Higher Education Act of 1965 to provide loan forgiveness opportunities for public service employees.</official-title>

<section id="HCABE5D1EFDEB4B07B164ECFC19477CD1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>College Access and Affordability Act</short-title></quote>.</text></section> 
<section id="H2CEA855F5A7A4F44BCE546A4CF94913" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Expansion of Hope and Lifetime Learning credits</header> 
<subsection id="HEEFD7654C73F49EC9B002CDD3CB7F613"><enum>(a)</enum><header>Increase in per student limitation for Hope Scholarship Credit</header> 
<paragraph id="HAC460349B2444DDAB89B1009B126B625"><enum>(1)</enum><header>In general</header><text>Subparagraph (B) of <external-xref legal-doc="usc" parsable-cite="usc/26/25A">section 25A(b)(1)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>the applicable limit</quote> and inserting <quote>$4,000</quote>.</text></paragraph> 
<paragraph id="H90C0EE722BFF42AEAA4BD1E3F942B2A"><enum>(2)</enum><header>Inflation adjustment</header><text>Paragraph (1) of section 25A(h) of such Code is amended by redesignating subparagraph (B) as subparagraph (C) and by inserting after subparagraph (A) the following new subparagraph:</text>

<subparagraph id="H43C9D1BC43B0409184534CAFA7A42E01"><enum>(B)</enum><header>$4,000 amount</header><text display-inline="yes-display-inline">In the case of a taxable year beginning after 2005, the $4,000 amount contained in subsection (b)(1)(B) shall be increased by an amount equal to—</text>

<clause id="H9BEF5E143138405CB2E136CF4D33578"><enum>(ii)</enum><text>the cost-of-living adjustment determined under section 1(f)(3) for the calendar year in which the taxable year begins, determined by substituting <quote>calendar year 2004</quote> for <quote>calendar year 1992</quote> in subparagraph (B) thereof.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H8916D99842DD4D3FB6C031B1C81C58EE"><enum>(3)</enum><header>Conforming amendment</header><text>Subsection (b) of section 25A of such Code is amended by striking paragraph (4).</text></paragraph></subsection> 
<subsection id="HC3560512264C4244897308B5D9A771CA"><enum>(b)</enum><header>Increase in gross income limitation </header> 
<paragraph id="HE9CDAEC153D14717A114005469A8B9C7"><enum>(1)</enum><header>In general</header><text>Clause (ii) of section 25A(d)(2)(A) of such Code is amended by striking <quote>$40,000 ($80,000</quote> and inserting <quote>$58,000 (twice such amount</quote>.</text></paragraph> 
<paragraph id="HE83C7A0EFC8B42DD9E3F9E44CA3145B7"><enum>(2)</enum><header>Inflation adjustment</header><text>Subparagraph (A) of section 25A(h)(2) of such Code is amended to read as follows:</text>

<subparagraph id="H8E0912A89D744D1B86B0B1CA473D6305"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a taxable year beginning after 2005, the $58,000 amount in subsection (d)(2) shall be increased by an amount equal to—</text> 
<clause id="H5AD5BA9AC5A04258B23809CCCEC00A6"><enum>(i)</enum><text>such dollar amount, multiplied by</text></clause> 
<clause id="H0106A9FA72D34290B0F516F92F245BD"><enum>(ii)</enum><text>the cost-of-living adjustment determined under section 1(f)(3) for the calendar year in which the taxable year begins, determined by substituting <quote>calendar year 2004</quote> for <quote>calendar year 1992</quote> in subparagraph (B) thereof.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H8088FC5D4E1B45A18F74EBFF15C68E02"><enum>(c)</enum><header>Hope Scholarship credit available for 4 years</header><text>Paragraph (2) of section 25A(b) of such Code is amended by striking <quote>2</quote> each place it appears in subparagraphs (A) and (C) and inserting <quote>4</quote>.</text></subsection> 
<subsection id="HA3C01EB84F0D42068B360648237EB149"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2004.</text></subsection></section>
<section id="H559E975FB11848AFA4002F7BC2382FE0" section-type="subsequent-section"><enum>3.</enum><header>Loan forgiveness for public service employees</header><text display-inline="no-display-inline">Section 428K (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-11">20 U.S.C. 1078–11</external-xref>) is amended to read as follows:</text>

<section id="H06AB3487E01C48B2B469952D0679A4DD"><enum>428K.</enum><header>Loan forgiveness for public service employees</header> 
<subsection id="H874C96F207754F5FB6D4CD31A6D635EE"><enum>(a)</enum><header>Purposes</header><text>The purposes of this section are—</text> 
<paragraph id="HD3F68A83963F41DCA77998284BDA5F6C"><enum>(1)</enum><text>to reduce the burden of student debt, particularly for Americans who dedicate their careers to meeting certain urgent national needs; and</text></paragraph> 
<paragraph id="H1CAFF4F365624C4C969C31FC71B5571D"><enum>(2)</enum><text>to attract more excellent individuals into important public service careers.</text></paragraph></subsection> 
<subsection id="H822CBCAA2AB442BAB33623605271C2EE"><enum>(b)</enum><header>Loan forgiveness</header> 
<paragraph id="H330A184D5A7140E2B332259CA7E31752"><enum>(1)</enum><header>In general</header><text>The Secretary shall assume the obligation to repay, pursuant to subsection (c), a loan made under section 428 or 428H, a Federal Direct Stafford Loan or Federal Direct Unsubsidized Stafford Loan, a Federal Direct Consolidation Loan, or a Federal Perkins Loan for any new borrower after the date of enactment of the Higher Education Amendments of 1998, who—</text> 
<subparagraph id="HCEF526B3D67043C7AEA958EF7F8FED6"><enum>(A)</enum><text>is employed full time in a qualified public service position described in paragraph (2); and</text></subparagraph> 
<subparagraph id="H035E06B3053943B4B2D5B9B29C37004C"><enum>(B)</enum><text>is not in default on a loan for which the borrower seeks forgiveness.</text></subparagraph></paragraph> 
<paragraph id="H797649CBCB8B478F80FC598FD1838BC"><enum>(2)</enum><header>Qualified public service positions</header><text>For purposes of this section, an individual shall be treated as employed in a qualified public service position if the individual is any of the following:</text> 
<subparagraph id="H8C41AFE60609448BA56C693EB7E3F23B"><enum>(A)</enum><header>Highly qualified teachers of mathematics, science, and bilingual and special education and in low-income communities</header><text>An individual who—</text> 
<clause id="H945CD26281094655B98F5B3F3D78D97D"><enum>(i)</enum><text>is highly qualified as such term is defined in section 9101 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name>; and</text></clause> 
<clause id="H2FD2842FFC8148908FD49F40BE6C13D2"><enum>(ii)</enum> 
<subclause display-inline="yes-display-inline" id="H73C6E6141B8C4B7DB5511985E9D22CE4"><enum>(I)</enum><text>has obtained employment as a teacher for service in a public or nonprofit private elementary or secondary school which is in the school district of a local educational agency which is eligible in such year for assistance pursuant to title I of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name>, and which for the purpose of this paragraph and for that year has been determined by the Secretary (pursuant to regulations and after consultation with the State educational agency of the State in which the school is located) to be a school in which the enrollment of children counted under section 1113(a)(5) of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> exceeds 40 percent of the total enrollment of that school; or</text></subclause> 
<subclause indent="clause" id="H1C6324C88AE44D06ABF6BFF00000B23D"><enum>(II)</enum><text>has obtained employment as a full-time teacher of mathematics, science, or bilingual or special education.</text></subclause></clause></subparagraph> 
<subparagraph id="H60025DB1F6A346DDB737C53C859E3DC5"><enum>(B)</enum><header>First responders in low-income communities</header><text>An individual who, as determined by the Secretary of Education by regulation—</text> 
<clause id="H2041B6FDCE874485009221182F56CD93"><enum>(i)</enum><text>has obtained employment as a firefighter, police officer, or emergency medical technician; and</text></clause> 
<clause id="H205D4B9BED4E48D79711B525BD7744B9"><enum>(ii)</enum><text>serves a low-income community.</text></clause></subparagraph>
<subparagraph id="H3CFF250F8425431DAB905D58C922C573"><enum>(C)</enum><header>Nurses in low income communities</header><text>An individual who is an eligible nurse and has obtained employment—</text> 
<clause id="HBDDAFA80DDD94A1F9592D7EF175E5B05"><enum>(i)</enum> 
<subclause display-inline="yes-display-inline" id="HFD208A340A2647E1839C8DF753318B49"><enum>(I)</enum><text>in a clinical setting; or</text></subclause> 
<subclause indent="clause" id="H2A4C951C429F417BAA6B9FAA6CB3759D"><enum>(II)</enum><text>as a member of the nursing faculty at an accredited school of nursing (as those terms are defined in section 801 of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/296">42 U.S.C. 296</external-xref>)); and</text></subclause> </clause> 
<clause id="H781FEE1B3ABE4C5991D1BDDA97B1B275"><enum>(ii)</enum><text>serves a low-income or needy community.</text></clause></subparagraph> 
<subparagraph id="H241A022B278F470B8D2C23C1C8059492"><enum>(D)</enum><header>Child welfare workers</header><text>An individual who—</text> 
<clause id="HC9C209CBF61C47A58DBABD6F8236E698"><enum>(i)</enum><text>has completed a degree in social work or related field with a focus on serving children and families (as determined in accordance with regulations prescribed by the Secretary); and</text></clause> 
<clause id="H752A84C30324457781C0E49FDBE92B7B"><enum>(ii)</enum><text>has obtained employment in public or private child welfare services.</text></clause></subparagraph> </paragraph></subsection> 
<subsection id="HD1E1BD14CFF04C079D9E0004EAA888F2"><enum>(c)</enum><header>Loan repayment</header> 
<paragraph id="HC31D7892B3FF459F8D605CB71CBE0068"><enum>(1)</enum><header>In general</header><text>The Secretary shall assume the obligation to repay a total of not more than $20,000 of principal and interest as follows:</text> 
<subparagraph id="H28923197ABE84FE89B1CFE97C8C08E99"><enum>(A)</enum><text>after each of the first or second years of service by an individual in a qualified public service position, 15 percent of the total amount of principal and interest of the loans described in subsection (b)(1) to such individual that are outstanding immediately preceding such first year of such service;</text></subparagraph> 
<subparagraph id="H5C29A5021929451F91C2DED98FB6229"><enum>(B)</enum><text>after each of the third or fourth years of such service, 20 percent of such total amount; and</text></subparagraph> 
<subparagraph id="HA559695C099F4E4A93A43B0735CC4631"><enum>(C)</enum><text>after the fifth year of such service, 30 percent of such total amount.</text></subparagraph></paragraph> 
<paragraph id="HCB942483962242D7BEF3209E34C18945"><enum>(2)</enum><header>Treatment of consolidation loans</header><text>A loan amount for a loan made under section 428C or for a Federal Direct Consolidation Loan may be a qualified loan amount for the purposes of this subsection only to the extent that such loan amount was used to repay a loan described in subsection (b)(1) for a borrower who meets the requirements of subsection (b), as determined in accordance with regulations prescribed by the Secretary.</text></paragraph> 
<paragraph id="HDFDE01E2FD5D4A5CBBBC798EEFA1A8F1"><enum>(3)</enum><header>Construction</header><text>Nothing in this section shall be construed to authorize the refunding of any repayment of a loan made under section 428 or 428H, a Federal Direct Stafford Loan or Federal Direct Unsubsidized Stafford Loan, a Federal Direct Loan, or a Federal Perkins Loan.</text></paragraph> 
<paragraph id="HF7E2EE5BA8DF4A9187A17820BC8BEA1C"><enum>(4)</enum><header>Interest</header><text>If a portion of a loan is repaid by the Secretary under this section for any year, the proportionate amount of interest on such loan that accrues for such year shall be repaid by the Secretary.</text></paragraph> 
<paragraph id="H4DC979DC855840968531A049A2E9FF"><enum>(5)</enum><header>Ineligibility of national service award recipients</header><text>No student borrower may, for the same service, receive a benefit under both this section and subtitle D of title I of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12601">42 U.S.C. 12601 et seq.</external-xref>).</text></paragraph> 
<paragraph id="H0E087D9817F747C5BB4F235521CD76E1"><enum>(6)</enum><header>Ineligibility for double benefits</header><text>No borrower may receive a reduction of loan obligations under both this section and section 428J or 460.</text></paragraph> 
<paragraph id="H9802470894AE49BE9083BABDF3AF8FB8"><enum>(7)</enum><header>Continued eligibility of teachers</header><text>Any teacher who performs service in a school that—</text> 
<subparagraph id="H2426C9014A7948EEBAA4B9A8DF4D8ECD"><enum>(A)</enum><text>meets the requirements of subsection (b)(2)(A)(ii)(I) in any year during such service; and</text></subparagraph> 
<subparagraph id="H8A5F9E7EBDF64D2D9675A56981AD493D"><enum>(B)</enum><text>in a subsequent year fails to meet the requirements of such subsection, may continue to teach in such school and shall be eligible for loan forgiveness pursuant to subsection (b).</text></subparagraph></paragraph></subsection> 
<subsection id="H250738ADA475410092EC483E209F9C50"><enum>(d)</enum><header>Repayment to eligible lenders and holders</header><text>The Secretary shall pay to each eligible lender or holder for each fiscal year an amount equal to the aggregate amount of the lender’s or holder’s loans that are subject to repayment pursuant to this section for such year.</text></subsection> 
<subsection id="H76A7D374968F406E9DD68FB9DB9637B"><enum>(e)</enum><header>Application for repayment</header> 
<paragraph id="H5DAE231A6DBD4D72986F1589ABDB6317"><enum>(1)</enum><header>In general</header><text>Each eligible individual desiring loan repayment under this section shall submit a complete and accurate application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph> 
<paragraph id="H5503B065ED61459396663C5559695527"><enum>(2)</enum><header>Conditions</header><text>An eligible individual may apply for loan repayment under this section after completing each of the consecutive years of qualifying service described in subsection (c)(1). The borrower may elect to receive forbearance while engaged in qualifying service described in subsection (c)(1) unless the borrower is in deferment while so engaged.</text></paragraph></subsection> 
<subsection id="HA10A36BFD21E47B98CB036F98D43D8C8"><enum>(f)</enum><header>Regulations</header><text>The Secretary is authorized to prescribe such regulations as may be necessary to carry out the provisions of this section.</text></subsection> 
<subsection id="H3A042BC3618041D3A38FE668129481F3"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H0A2CD045202C46BE95F807C68C39B794"><enum>(1)</enum><header>Child welfare services</header><text>The term <term>child welfare services</term> has the meaning given the term in section 425 of the <act-name parsable-cite="SSA">Social Security Act</act-name>.</text></paragraph> 
<paragraph id="HD5EE7FC9B09C4588AB54E93046001787"><enum>(2)</enum><header>Degree</header><text>The term <term>degree</term> means an associate’s or bachelor’s degree awarded by an institution of higher education.</text></paragraph> 
<paragraph id="HE75BCCCF78B44ED7AF8F17337B3D9B93"><enum>(3)</enum><header>Eligible nurse</header><text>The term <term>eligible nurse</term> means a nurse who meets all of the following:</text> 
<subparagraph id="H22DD608A54E942B19958A451833666DC"><enum>(A)</enum><text>The nurse graduated from—</text> 
<clause id="HC329F51EAF8D48A8A33B00D102128FC"><enum>(i)</enum><text>an accredited school of nursing (as those terms are defined in section 801 of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/296">42 U.S.C. 296</external-xref>));</text></clause> 
<clause id="HFBCF07EF5A0147029FD5D800FDE97DAA"><enum>(ii)</enum><text>a nursing center; or</text></clause> 
<clause id="HD44179724130483BB030C3D16F00D7BA"><enum>(iii)</enum><text>an academic health center that provides nurse training.</text></clause></subparagraph> 
<subparagraph id="H7E05B151F9BF4DCA9586FD97AE0318C9"><enum>(B)</enum><text>The nurse holds a valid and unrestricted license to practice nursing in the State in which the nurse practices in a clinical setting.</text></subparagraph> 
<subparagraph id="HC3B0269711024712B1F26560B600CC1E"><enum>(C)</enum><text>The nurse holds 1 or more of the following:</text> 
<clause id="H6F2197F5A2334A70B1D19E13CFFB7DA5"><enum>(i)</enum><text>A graduate degree in nursing, or an equivalent degree.</text></clause> 
<clause id="H6BF30A958E0F4531B5F2269D52AE7195"><enum>(ii)</enum><text>A nursing degree from a collegiate school of nursing (as defined in section 801 of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/296">42 U.S.C. 296</external-xref>)).</text></clause> 
<clause id="H6AB2E9188E454977B74BA106AE39135F"><enum>(iii)</enum><text>A nursing degree from an associate degree school of nursing (as defined in section 801 of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/296">42 U.S.C. 296</external-xref>)).</text></clause> 
<clause id="H00AFCF0DF87445A4AB511BF4F7939EE8"><enum>(iv)</enum><text>A nursing degree from a diploma school of nursing (as defined in section 801 of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/296">42 U.S.C. 296</external-xref>)).</text></clause></subparagraph></paragraph> 
<paragraph id="H7AE83EB776324DF895B1E21732A392FB"><enum>(4)</enum><header>Low-income community</header><text>In this subsection, the term <term>low-income community</term> means a community in which 70 percent of households earn less than 85 percent of the State median household income.</text></paragraph> 
<paragraph id="H54CF2C6DAC2C4620853FBBC4B3AB44D1"><enum>(5)</enum><header>Year</header><text>The term <term>year</term>, where applied to service as a teacher (or service as a member of an accredited school of nursing (as those terms are defined in section 801 of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/296">42 U.S.C. 296</external-xref>))), means an academic year as defined by the Secretary.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
