<official-title>To amend title 39, United States Code, to make cigarettes and certain other tobacco products nonmailable.</official-title>

<section id="HD81281E5D97B45F58B5386DCE67F9600" section-type="section-one"><enum>1.</enum><header>Nonmailability of certain tobacco products</header> 
<subsection id="H8EB9EC18411B4E3A98D14E8E528404B4"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/30">Chapter 30</external-xref> of title 39, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/39/3002a">section 3002a</external-xref> the following:</text>

<section id="H877C467C32A549C4B1B5F23C71F69464"><enum>3002b.</enum><header>Nonmailability of certain tobacco products</header> 
<subsection id="H0337AC49F6DE4FD3B2CE62CED916DAB3"><enum>(a)</enum><header>In general</header><text>Cigarettes, smokeless tobacco, pipe tobacco, and roll-your-own-tobacco—</text> 
<paragraph id="H415AC188B770466D84666811A08F0073"><enum>(1)</enum><text>are nonmailable matter;</text></paragraph> 
<paragraph id="H62645988917945A2A24E3F5D059C9B35"><enum>(2)</enum><text>shall not be—</text> 
<subparagraph id="HD0E15F80FEAD4D36962C5ED5F8DF09E"><enum>(A)</enum><text>deposited in the mails; or</text></subparagraph> 
<subparagraph id="HDA15355E11D74C05A8ACE441D499FEA7"><enum>(B)</enum><text>carried or delivered through the mails; and</text></subparagraph></paragraph> 
<paragraph id="H1ADBD688D7C34321909C34217347F751"><enum>(3)</enum><text>shall be disposed of as the Postal Service directs.</text></paragraph></subsection> 
<subsection id="H92A87091CC914B7387FA90EDB057F56F"><enum>(b)</enum><header>Civil Penalty</header><text>Any person who violates subsection (a)(2)(A) shall be liable to the United States for a civil penalty in an amount not to exceed $100,000 for each violation.</text> </subsection> 
<subsection id="H808283F15E304B1C816CA552D2490032" display-inline="no-display-inline"><enum>(c)</enum><header>Hearings</header><text>The Postal Service may determine that a person has violated subsection (a) only after notice and an opportunity for a hearing. Proceedings under this subsection shall be conducted in accordance with section 3001(m).</text></subsection> 
<subsection id="HAD93C383490F41D292F838CE5F7DC0C3"><enum>(d)</enum><header>Penalty considerations</header><text>In determining the amount of a civil penalty under this section, the Postal Service shall consider—</text> 
<paragraph id="H3164C5B7CFE747068979E79E6651287C"><enum>(1)</enum><text>the nature, circumstances, extent, and gravity of the violation;</text></paragraph> 
<paragraph id="H3BF2C0B2CBA34A72B0F364B959D300CC"><enum>(2)</enum><text>with respect to the violator, the degree of culpability, ability to pay, and any history of prior violations; and</text></paragraph> 
<paragraph id="HC01385A72CC34F689F4BCE1B8C74425C"><enum>(3)</enum><text>such other matters as justice may require.</text></paragraph></subsection> 
<subsection id="H4F15693CDBE5407EAC4FC0A6A26FCB6F" display-inline="no-display-inline"><enum>(e)</enum><header>Civil actions to collect</header><text>A civil action may be brought in an appropriate district court of the United States, in accordance with section 409(d), to collect a civil penalty under this section.</text> </subsection> 
<subsection id="HDF76876C285E4014894707051FFA1107"><enum>(f)</enum><header>Disposition of amounts</header><text>Amounts received in payment of any civil penalties under this section shall be deposited as miscellaneous receipts in the Treasury of the United States.</text></subsection> 
<subsection id="H4BF9E96EF2044C18B3CF12A033D1089C"><enum>(g)</enum><header>Definitions</header><text>For purposes of this section, the terms <quote>cigarette</quote>, <quote>smokeless tobacco</quote>, <quote>pipe tobacco</quote>, and <quote>roll-your-own-tobacco</quote> have the meanings given them by <external-xref legal-doc="usc" parsable-cite="usc/26/5702">section 5702</external-xref> of the Internal Revenue Code of 1986.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H24D006C4B2AF4F90A64F056F0053E29F"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/30">chapter 30</external-xref> of title 39, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/39/3002a">section 3002a</external-xref> the following:</text>

<section id="H48F335F5EDDE42E9822101002B673956"><enum>2.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by section 1 shall take effect 60 days after the date of the enactment of this Act, and shall apply with respect to any mail matter mailed on or after that effective date.</text> </section>
