<legis-type>AN ACT</legis-type> 
<official-title display="yes">To require the Secretary of the Treasury to mint coins in commemoration of the bicentennial of the birth of Abraham Lincoln.</official-title>

<section id="HD91F8C42EE8441419DAB75E8934743A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Abraham Lincoln Commemorative Coin Act</short-title></quote>. </text> </section> 
<section id="HEE4598D2F19D4AA2915086BB0126388B"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text> 
<paragraph id="H97EE84DC3559439DA9237D01BA9058C0"><enum>(1)</enum><text display-inline="yes-display-inline">Abraham Lincoln, the 16th President, was one of the Nation's greatest leaders, demonstrating true courage during the Civil War, one of the greatest crises in the Nation's history. </text></paragraph> 
<paragraph id="H3CF37D52E8E24576B225BB585E7C3913"><enum>(2)</enum><text>Born of humble roots in present-day LaRue County, Kentucky, on February 12, 1809, Abraham Lincoln rose to the Presidency through a combination of honesty, integrity, intelligence, and commitment to the United States. </text></paragraph> 
<paragraph id="H6D9772C1771543CFADCE94EE85FE899D"><enum>(3)</enum><text>With the belief that all men were created equal, Abraham Lincoln led the effort to free all slaves in the United States. </text></paragraph> 
<paragraph id="HD6300155C28840579C7D979B89234500"><enum>(4)</enum><text>Abraham Lincoln had a generous heart, with malice toward none and with charity for all. </text></paragraph> 
<paragraph id="H823A2D285B154D9A9DCDDE1DB7543444"><enum>(5)</enum><text>Abraham Lincoln gave the ultimate sacrifice for his country, dying from an assassin's bullet on April 15, 1865. </text></paragraph> 
<paragraph id="H6F06B972BEB9457B96317DA3042DD056"><enum>(6)</enum><text>The year 2009 will be the bicentennial anniversary of the birth of Abraham Lincoln. </text></paragraph> 
<paragraph id="HC628ED6B56524E559B9D954E1823CD00"><enum>(7)</enum><text>The Abraham Lincoln Bicentennial Commission has been charged by Congress with planning the celebration of Lincoln’s bicentennial. </text></paragraph> 
<paragraph id="H04C9EA033D4A45CF001C556006001E19"><enum>(8)</enum><text>The proceeds from a commemorative coin will help fund the celebration and the continued study of the life of Lincoln.</text></paragraph></section> 
<section id="H7629FB10230D4A5FAA75400083EF49BC"><enum>3.</enum><header>Coin specifications</header> 
<subsection id="H7B762AEBE08A4906836E5B3B266012D0"><enum>(a)</enum><header>$1 Silver Coins</header><text>The Secretary of the Treasury (hereafter in this Act referred to as the <quote>Secretary</quote>) shall mint and issue not more than 500,000 $1 coins, which shall—</text> 
<paragraph id="H98B7100F222841C3BB65DDA1B1E4954B"><enum>(1)</enum><text>weigh 26.73 grams;</text></paragraph> 
<paragraph id="H76F641CB0129488AB213017772A80450"><enum>(2)</enum><text>have a diameter of 1.500 inches; and</text></paragraph> 
<paragraph id="H839248E396DF4CC8B56DAC37925E6B01"><enum>(3)</enum><text>contain 90 percent silver and 10 percent copper.</text></paragraph></subsection> 
<subsection id="HB03ED2B7F5964CBC9DE600B5AB2CCB40"><enum>(b)</enum><header>Legal tender</header><text>The coins minted under this Act shall be legal tender, as provided in <external-xref legal-doc="usc" parsable-cite="usc/31/5103">section 5103</external-xref> of title 31, United States Code.</text></subsection> 
<subsection id="HC7F8173DC851481B9700C560D4E4EAD4"><enum>(c)</enum><header>Numismatic items</header><text>All coins minted under this Act shall be considered to be numismatic items.</text></subsection></section> 
<section id="H6D28F7AC931F476285AA4986F6F1BC73"><enum>4.</enum><header>Design of coins</header> 
<subsection id="H5EEA5A120C254F2E862DDEF2D89EC9F1"><enum>(a)</enum><header>Design requirements</header> 
<paragraph id="H328F5E08F5254B54A33EDB57F5A4C7E5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The design of the coins minted under this Act shall be emblematic of the life and legacy of President Abraham Lincoln.</text></paragraph> 
<paragraph id="H2D111D93759B403EA9361D77B2FFA73"><enum>(2)</enum><header>Designation and inscriptions</header><text>On each coin minted under this Act there shall be—</text> 
<subparagraph id="HCF4EFB330BE64A1F9EEC6254E23F71DA"><enum>(A)</enum><text>a designation of the value of the coin;</text></subparagraph> 
<subparagraph id="H1C57648683794493956C4FBFAD2C8C5B"><enum>(B)</enum><text>an inscription of the year <quote>2009</quote>; and</text></subparagraph> 
<subparagraph id="HAA42C9171F7544AB9178F8ED28850968"><enum>(C)</enum><text>inscriptions of the words <quote>Liberty</quote>, <quote>In God We Trust</quote>, <quote>United States of America</quote>, and <quote>E Pluribus Unum</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H3D256D5D88EB4F73B324405F1C5BE416"><enum>(b)</enum><header>Selection</header><text>The design for the coins minted under this Act shall be—</text> 
<paragraph id="H5DDA67F1CF0F489E9031409446AE0403"><enum>(1)</enum><text display-inline="yes-display-inline">selected by the Secretary after consultation with the Commission of Fine Arts and the Abraham Lincoln Bicentennial Commission; and</text></paragraph> 
<paragraph id="H50B14A179F954EB8A12C74459E005BD0"><enum>(2)</enum><text>reviewed by the Citizens Coinage Advisory Committee.</text></paragraph></subsection></section> 
<section id="HCD0230992E6640A58B38A48BB9205EC0"><enum>5.</enum><header>Issuance of coins</header> 
<subsection id="H2701FE601AC74FD7BD129383F986AB14"><enum>(a)</enum><header>Quality of coins</header><text>Coins minted under this Act shall be issued in uncirculated and proof qualities.</text></subsection> 
<subsection id="HCAD42F0D131B45B5949CE51F10D6B2E6"><enum>(b)</enum><header>Mint facility</header><text>Only 1 facility of the United States Mint may be used to strike any particular quality of the coins minted under this Act.</text></subsection> 
<subsection id="H7E3C0332914340F083DFDF9DDBB570CD"><enum>(c)</enum><header>Period for issuance</header><text>The Secretary may issue coins minted under this Act only during the 1-year period beginning on January 1, 2009.</text></subsection></section> 
<section id="H3579B0A1EC3743B39B277B86E393E9D"><enum>6.</enum><header>Sale of coins</header> 
<subsection id="H61F498D93622401692A6571268533B06"><enum>(a)</enum><header>Sale price</header><text>The coins issued under this Act shall be sold by the Secretary at a price equal to the sum of—</text> 
<paragraph id="H19BEE715CCE04EC788BD82294EA03C87"><enum>(1)</enum><text>the face value of the coins;</text></paragraph> 
<paragraph id="HACC6DE84DDF349CABCC55F24A5EFF76"><enum>(2)</enum><text>the surcharge provided in section 7(a) with respect to such coins; and</text></paragraph> 
<paragraph id="H32B24A6650B647EDAC5571DACB659E9E"><enum>(3)</enum><text>the cost of designing and issuing the coins (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping).</text></paragraph></subsection> 
<subsection id="H4817DDEE3A0F4FF99C87FC205149E4B3"><enum>(b)</enum><header>Bulk sales</header><text>The Secretary shall make bulk sales of the coins issued under this Act at a reasonable discount.</text></subsection> 
<subsection id="H98C210CA4CD445A28937B83F019DE35"><enum>(c)</enum><header>Prepaid orders</header> 
<paragraph id="HB5AFBD8295BE43BBAB93A1FF32B1704B"><enum>(1)</enum><header>In general</header><text>The Secretary shall accept prepaid orders for the coins minted under this Act before the issuance of such coins.</text></paragraph> 
<paragraph id="HD35A3A45679948879336CF26E90078FC"><enum>(2)</enum><header>Discount</header><text>Sale prices with respect to prepaid orders under paragraph (1) shall be at a reasonable discount.</text></paragraph></subsection></section> 
<section id="HABC86C5E44BB41508283532EA0321B17"><enum>7.</enum><header>Surcharges</header> 
<subsection id="H69E5B1592EC149E4B800144866073C23"><enum>(a)</enum><header>In general</header><text>All sales of coins issued under this Act shall include a surcharge of $10 per coin.</text></subsection> 
<subsection id="H608020C15EDE47B8A8D7F9C0667081D4"><enum>(b)</enum><header>Distribution</header><text display-inline="yes-display-inline">Subject to section 5134(f)(1), title 31, United States Code, all surcharges received by the Secretary from the sale of coins issued under this Act shall be promptly paid by the Secretary to the Abraham Lincoln Bicentennial Commission to further the work of the Commission.</text></subsection> 
<subsection id="HA0A492ED8C15417AB966B8C714438776"><enum>(c)</enum><header>Audits</header><text display-inline="yes-display-inline">The Abraham Lincoln Bicentennial Commission shall be subject to the audit requirements of <external-xref legal-doc="usc" parsable-cite="usc/31/5134">section 5134(f)(2)</external-xref> of title 31, United States Code.</text></subsection> 
<subsection id="H580FE5D2E08549D28331F487D0AF19CF"><enum>(d)</enum><header>Limitation</header><text>Notwithstanding subsection (a), no surcharge may be included with respect to the issuance under this Act of any coin during a calendar year if, as of the time of such issuance, the issuance of such coin would result in the number of commemorative coin programs issued during such year to exceed the annual 2 commemorative coin program issuance limitation under <external-xref legal-doc="usc" parsable-cite="usc/31/5112">section 5112(m)(1)</external-xref> of title 31, United States Code (as in effect on the date of the enactment of this Act). The Secretary of the Treasury may issue guidance to carry out this subsection.</text></subsection></section>
