<legis-type>A BILL</legis-type> 
<official-title>To amend title III of the Americans with Disabilities Act of 1990 to require, as a precondition to commencing a civil action with respect to a place of public accommodation or a commercial facility, that an opportunity be provided to correct alleged violations.</official-title>

<section id="H691B2EE83C6947E4988C71DBEB4BDD4F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>ADA Notification Act</short-title></quote>.</text></section> 
<section id="HE8CB2F6C74D042F5BDF928361FAA800"><enum>2.</enum><header>Opportunity to correct alleged violations of ADA as precondition to civil actions regarding public accommodations and commercial facilities</header><text display-inline="no-display-inline">Section 308(a)(1) of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12188">42 U.S.C. 12188(a)(1)</external-xref>) is amended—</text> 
<paragraph id="H33F2DD6B063B4EBC00FD976200B64600"><enum>(1)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC"><enum-in-header>(1) </enum-in-header>Availability</header-in-text></quote> and all that follows through <quote>The remedies and procedures set forth</quote> and inserting the following:</text>

<paragraph id="H8056718A66774BCAAE4000FA431C3143"><enum>(1)</enum><header>Availability of remedies and procedures</header> 
<subparagraph id="H5D00E9C1F2214C558BC953086E3E69A2"><enum>(A)</enum><header>In general</header><text>Subject to subparagraphs (B) and (C), the remedies and procedures set forth</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HA8ED983C05024EE580B1BFD883BBC5CA"><enum>(2)</enum><text>by adding at the end the following subparagraphs:</text> 
<quoted-block style="OLC" id="HEDD4ACB6E0AE445989AEF4C2D269A15D" display-inline="no-display-inline"> 
<subparagraph id="H87E3A580082844AE953E9FD17FCE8E2"><enum>(B)</enum><header>Opportunity for correction of alleged violation</header><text>A State or Federal court shall not have jurisdiction in a civil action filed with the court under subparagraph (A), or under a provision of State law that conditions a violation of any of its provisions on a violation of this Act, unless—</text> 
<clause id="H76859B1DD5BC467F9D3F9432631698EA"><enum>(i)</enum><text>before filing the complaint, the plaintiff provided to the defendant written notice of the alleged violation, and the notice was provided by registered mail;</text></clause> 
<clause id="H041A0DDC947840808689E800A076534E"><enum>(ii)</enum><text>the notice identified the specific facts that constitute the alleged violation, including identification of the location at which the violation occurred and the date on which the violation occurred;</text></clause> 
<clause id="H1520B5EDA19840EBA8D6A6285800D1AF"><enum>(iii)</enum><text>90 or more days has elapsed after the date on which such notice was provided;</text></clause> 
<clause id="HCEBACD02BF8D47249BD66C93928E5369"><enum>(iv)</enum><text>the notice informed the defendant that the civil action could not be commenced until the expiration of such 90-day period; and</text></clause> 
<clause id="H0B7D30A8FD4C4D6287AA25E92B1248C"><enum>(v)</enum><text>the complaint states that, as of the date on which the complaint is filed, the defendant has not corrected the alleged violation.</text></clause></subparagraph> 
<subparagraph id="H7CEA5F168B6947568CD80FD8162E973"><enum>(C)</enum><header>Exceptions</header><text>Subparagraph (B) shall not apply to—</text> 
<clause id="H453AA8B79006458DB600B91F3790393F"><enum>(i)</enum><text>civil actions brought under Rule 65 of the Federal Rules of Civil Procedure requesting preliminary injunctive relief or temporary restraining orders; or</text></clause> 
<clause id="H482D8636214C45759B746C2EAD7627EA"><enum>(ii)</enum><text>civil actions brought under State or local court rules requesting preliminary injunctive relief or temporary restraining orders.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
