<official-title>To expand the use of DNA for the identification and prosecution of sex offenders, and for other purposes.</official-title>

<section id="HD561D251F2FC46D89729D57445D039B7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>DNA Fingerprinting Act of 2005</short-title></quote>.</text></section> 
<section id="H2AA7E104434247F4B406C2102918AA66"><enum>2.</enum><header>Expanding use of DNA to identify and prosecute sex offenders</header> 
<subsection id="HAD7275B8D63149B3AD251D54E6EE3253"><enum>(a)</enum><header>Expansion of National DNA index system</header><text>Section 210304 of the DNA Identification Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/14132">42 U.S.C. 14132</external-xref>) is amended—</text> 
<paragraph id="HA35142F30B414BB6995BFAB959AC1F88"><enum>(1)</enum><text>in subsection (a)(1)(C), by striking <quote>, provided</quote> and all that follows through <quote>System</quote>; and</text></paragraph> 
<paragraph id="HC1496DDAA10E4C309C46FF27BF1F5BF2"><enum>(2)</enum><text>by striking subsections (d) and (e).</text></paragraph></subsection> 
<subsection id="H3021D86B8DA14F0F997B8600A5322320"><enum>(b)</enum><header>DNA sample collection from persons arrested or detained under Federal authority</header> 
<paragraph id="HFDAFD00A0D814EEE89CE969C17612211"><enum>(1)</enum><header>In general</header><text>Section 3 of the DNA Analysis Backlog Elimination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/14135a">42 U.S.C. 14135a</external-xref>) is amended—</text> 
<subparagraph id="HD5FA4AAE1D1E4140857DC8ABA057F329"><enum>(A)</enum><text>in subsection (a)—</text> 
<clause id="H8B71D3692F4A4298BB8F15BBD7B798A8"><enum>(i)</enum><text>in paragraph (1), by striking <quote>The Director</quote> and inserting the following:</text>

<subparagraph id="H53197C15D3034CCE8F42FF9219972BE7"><enum>(A)</enum><text>The Attorney General may, as provided by the Attorney General by regulation, collect DNA samples from individuals who are arrested or detained under the authority of the United States. The Attorney General may delegate this function within the Department of Justice as provided in <external-xref legal-doc="usc" parsable-cite="usc/28/510">section 510</external-xref> of title 28, United States Code, and may also authorize and direct any other agency of the United States that arrests or detains individuals or supervises individuals facing charges to carry out any function and exercise any power of the Attorney General under this section.</text></subparagraph> 
<subparagraph id="H9E747CA5BE97416DB97C001622015CC2"><enum>(B)</enum><text>The Director</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause> 
<clause id="H9D9D0AB0D60840519B92595F5EA8351"><enum>(ii)</enum><text>in paragraphs (3) and (4), by striking <quote>Director of the Bureau of Prisons</quote> each place it appears and inserting <quote>Attorney General, the Director of the Bureau of Prisons,</quote>; and</text></clause></subparagraph> 
<subparagraph id="H437414A8BA114AC699BF6C5F2BEDB13"><enum>(B)</enum><text>in subsection (b), by striking <quote>Director of the Bureau of Prisons</quote> and inserting <quote>Attorney General, the Director of the Bureau of Prisons,</quote>.</text></subparagraph></paragraph> 
<paragraph id="H7DE3A0949CD74F4C810834311FBCF03"><enum>(2)</enum><header>Conforming amendment</header><text>Subsections (b) and (c)(1)(A) of <external-xref legal-doc="usc" parsable-cite="usc/18/3142">section 3142</external-xref> of title 18, United States Code, are each amended by inserting <quote>and subject to the condition that the person cooperate in the collection of a DNA sample from the person if the collection of such a sample is authorized pursuant to section 3 of the DNA Analysis Backlog Elimination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/14135a">42 U.S.C. 14135a</external-xref>)</quote> after <quote>period of release</quote>.</text></paragraph></subsection> 
<subsection id="H627A73998E074F688DB14FCCA1009E25"><enum>(c)</enum><header>Tolling of statute of limitations in sexual abuse cases</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3297">Section 3297</external-xref> of title 18, United States Code, is amended by striking <quote>except for a felony offense under chapter 109A,</quote>.</text></subsection></section>
