<official-title>To promote health care coverage parity for individuals engaged in legal use of certain modes of transportation.</official-title>

<section section-type="section-one" id="HCAF6EB17ACDF48D3B81FF04175224B1B" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>HIPAA Recreational Injury Technical Correction Act</short-title></quote>.</text></section> 
<section id="HEB9C0C9ACF504865AAC2E35B29B3F34"><enum>2.</enum><header>Coverage amendments</header> 
<subsection id="H0A7CF2C5633643C2A4006607764B6F92"><enum>(a)</enum><header>ERISA</header><text>Section 702(a)(3) of the <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/29/1182">29 U.S.C. 1182(a)(3)</external-xref>) is amended—</text> 
<paragraph id="HFE17980064574225A9EC5FD6AF13009B"><enum>(1)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC">Construction.—</header-in-text>For</quote> and inserting the following:</text> 
<quoted-block style="OLC" display-inline="yes-display-inline" id="H184C3621290B4B3B983169147D494B9C"><text display-inline="yes-display-inline"><header-in-text level="paragraph" style="OLC">Scope.—</header-in-text></text> 
<subparagraph id="H2646C1DCB9CE46D49E07003CA6D8B1F4"><enum>(A)</enum><header>Waiting periods</header><text>For</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H092372D2247F4B83ADB92EDE2BA09F06"><enum>(2)</enum><text>by adding at the end the following:</text>

<subparagraph id="H00967CED0CF44B50B0D96972AA297CA2"><enum>(B)</enum><header>Limitation on denial of benefits</header><text>Notwithstanding paragraph (2), a group health plan, or a health insurance issuer offering group health insurance coverage in connection with a group health plan, may not deny benefits otherwise provided under the plan or coverage for the treatment of an injury solely because such injury was sustained while engaged in any particular mode of transportation specified in the plan consisting of the use of a motorcycle, snowmobile, all-terrain vehicle, or other similar recreational vehicle or horseback riding. Nothing in this subparagraph shall be construed as—</text> 
<clause id="H77A60064D96343D086569C3200FB3B35"><enum>(i)</enum><text>prohibiting any such plan or issuer from excluding from coverage injuries sustained while engaged in such mode of transportation, if engaging in such mode of transportation, or the particular vehicle itself, is illegal under applicable law, or</text></clause> 
<clause id="H3F612349491E48DC8000F7D8F8E181BE"><enum>(ii)</enum><text>affecting the determination of primary and secondary insurance or subrogation or reimbursement rights between insurance policies.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H48370BAC968D4FB88550D3E0E5009B80"><enum>(b)</enum><header>PHSA</header><text>Section 2702(a)(3) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-1">42 U.S.C. 300gg–1(a)(3)</external-xref>) is amended—</text> 
<paragraph id="H34CCE86E0AF346D4BE6EC3F4255EC6DC"><enum>(1)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC">Construction.—</header-in-text>For</quote> and inserting the following:</text>

<subsection id="H22100C77A44644CCAC0045EE24960413"><enum>(c)</enum><header>Internal Revenue Code</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/9802">Section 9802(a)(3)</external-xref> of the Internal Revenue Code of 1986 is amended—</text> 
<paragraph id="H032B45EDFAAA4BFC8C0592289323E15"><enum>(1)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC">Construction.—</header-in-text>For</quote> and inserting the following:</text>

<subsection id="H1A6B95D66F39430F85A389A529519102"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to injuries occurring during plan years beginning after 90 days after the date of the enactment of this Act.</text></subsection></section>
