<section section-type="section-one" id="HB3DB4CAA022840C7BA3C24B2D1A57FA4" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>United States Patent and Trademark Fee Modernization Act of 2005</short-title></quote>.</text></section> 
<section id="H953004A126BF45C29C70830094933D03"><enum>2.</enum><header>Fees for patent services</header> 
<subsection id="HAD516B6EABC840E699412DC2904E9544"><enum>(a)</enum><header>General patent fees</header><text><external-xref legal-doc="usc" parsable-cite="usc/35/41">Section 41(a)</external-xref> of title 35, United States Code, is amended to read as follows:</text>

<subsection id="H306C42F53BA24D4E9C038826DC648BF0"><enum>(a)</enum><header>General fees</header><text>The Director shall charge the following fees:</text> 
<paragraph id="H17EF5DBA0039414B9FE1B4AC83DE3503"><enum>(1)</enum><header>Filing and basic national fees</header> 
<subparagraph id="HD339F6DFA0834F60B5CB014C897E7665"><enum>(A)</enum><text>On filing each application for an original patent, except for design, plant, or provisional applications, $300.</text></subparagraph> 
<subparagraph id="HA5BB43C7816D4C34AD8C001816F5E13E"><enum>(B)</enum><text>On filing each application for an original design patent, $200.</text></subparagraph> 
<subparagraph id="H6CC84DAFCF334216AD33DF657B9744C4"><enum>(C)</enum><text>On filing each application for an original plant patent, $200.</text></subparagraph> 
<subparagraph id="HDFF93EE559B74162B1AB6EB7C863F66C"><enum>(D)</enum><text>On filing each provisional application for an original patent, $200.</text></subparagraph> 
<subparagraph id="H116A4864E588490CAFB42E6DF4359600"><enum>(E)</enum><text>On filing each application for the reissue of a patent, $300.</text></subparagraph> 
<subparagraph id="HD8A0C4A633D74D85970094B3534BF48E"><enum>(F)</enum><text>The basic national fee for each international application filed under the treaty defined in <external-xref legal-doc="usc" parsable-cite="usc/35/351">section 351(a)</external-xref> of this title entering the national stage under <external-xref legal-doc="usc" parsable-cite="usc/35/371">section 371</external-xref> of this title, $300.</text></subparagraph> 
<subparagraph id="H75FC7F645BC443B300514DD8B0D5DA0"><enum>(G)</enum><text>In addition, excluding any sequence listing or computer program listing filed in an electronic medium as prescribed by the Director, for any application the specification and drawings of which exceed 100 sheets of paper (or equivalent as prescribed by the Director if filed in an electronic medium), $250 for each additional 50 sheets of paper (or equivalent as prescribed by the Director if filed in an electronic medium) or fraction thereof.</text></subparagraph></paragraph> 
<paragraph id="H8CDAC9403F3C4038006174CFE7CF5DC7"><enum>(2)</enum><header>Excess claims fees</header><text>In addition to the fee specified in paragraph (1)—</text> 
<subparagraph id="H1817F15E9B904969BC6BCC00969B8549"><enum>(A)</enum><text>on filing or on presentation at any other time, $200 for each claim in independent form in excess of 3;</text></subparagraph> 
<subparagraph id="H7391F45105B24DB18EBEC7F21BF5CD74"><enum>(B)</enum><text>on filing or on presentation at any other time, $50 for each claim (whether dependent or independent) in excess of 20; and</text></subparagraph> 
<subparagraph id="H6826A35BE9BC4FD285714DDCB8A3D5D6"><enum>(C)</enum><text>for each application containing a multiple dependent claim, $360.</text></subparagraph><continuation-text continuation-text-level="paragraph">For the purpose of computing fees under this paragraph, a multiple dependent claim referred to in <external-xref legal-doc="usc" parsable-cite="usc/35/112">section 112</external-xref> of this title or any claim depending therefrom shall be considered as separate dependent claims in accordance with the number of claims to which reference is made. The Director may by regulation provide for a refund of any part of the fee specified in this paragraph for any claim that is canceled before an examination on the merits, as prescribed by the Director, has been made of the application under <external-xref legal-doc="usc" parsable-cite="usc/35/131">section 131</external-xref> of this title. Errors in payment of the additional fees under this paragraph may be rectified in accordance with regulations prescribed by the Director.</continuation-text></paragraph> 
<paragraph id="H8CBC5C3ECF964226BDC2A1267C57EA97"><enum>(3)</enum><header>Examination fees</header> 
<subparagraph id="HAEEBE4E874D043D893E59629AF001F96"><enum>(A)</enum><text>For examination of each application for an original patent, except for design, plant, provisional, or international applications, $200.</text></subparagraph> 
<subparagraph id="H1E1428A456CF4B4EBAFF6B2612A10074"><enum>(B)</enum><text>For examination of each application for an original design patent, $130.</text></subparagraph> 
<subparagraph id="H1720785A870543A791A6CA88A9DCA512"><enum>(C)</enum><text>For examination of each application for an original plant patent, $160.</text></subparagraph> 
<subparagraph id="H2C3F71B917E440A89C8DDD468788D20"><enum>(D)</enum><text>For examination of the national stage of each international application, $200.</text></subparagraph> 
<subparagraph id="H745E5615EF5F4278B2382023C5403F49"><enum>(E)</enum><text>For examination of each application for the reissue of a patent, $600.</text></subparagraph><continuation-text continuation-text-level="paragraph">The provisions of <external-xref legal-doc="usc" parsable-cite="usc/35/111">section 111(a)(3)</external-xref> of this title relating to the payment of the fee for filing the application shall apply to the payment of the fee specified in this paragraph with respect to an application filed under <external-xref legal-doc="usc" parsable-cite="usc/35/111">section 111(a)</external-xref> of this title. The provisions of <external-xref legal-doc="usc" parsable-cite="usc/35/371">section 371(d)</external-xref> of this title relating to the payment of the national fee shall apply to the payment of the fee specified in this paragraph with respect to an international application. The Director may by regulation provide for a refund of any part of the fee specified in this paragraph for any applicant who files a written declaration of express abandonment as prescribed by the Director before an examination has been made of the application under <external-xref legal-doc="usc" parsable-cite="usc/35/131">section 131</external-xref> of this title, and for any applicant who provides a search report that meets the conditions prescribed by the Director.</continuation-text></paragraph> 
<paragraph id="H24E0D36977C14E1A8E0376E72C2BF3D1"><enum>(4)</enum><header>Issue fees</header> 
<subparagraph id="HD298726FA17E42E1BAB5B003C0E0F7B"><enum>(A)</enum><text>For issuing each original patent, except for design or plant patents, $1,400.</text></subparagraph> 
<subparagraph id="H03FFDEBCBD224C6D00E53BEB7BED611E"><enum>(B)</enum><text>For issuing each original design patent, $800.</text></subparagraph> 
<subparagraph id="HB355CB163BCE4CBA00C4433D7374CE3"><enum>(C)</enum><text>For issuing each original plant patent, $1,100.</text></subparagraph> 
<subparagraph id="H7B33C6690D7B45C5A17619CA7C35FCB5"><enum>(D)</enum><text>For issuing each reissue patent, $1,400.</text></subparagraph></paragraph> 
<paragraph id="HCFACC402BF624570BA552100999FB71"><enum>(5)</enum><header>Disclaimer fee</header><text>On filing each disclaimer, $130.</text></paragraph> 
<paragraph id="H6A152114A9464637866164D837F54E75"><enum>(6)</enum><header>Appeal fees</header> 
<subparagraph id="H0171E9BC81AD413482CCEB4EFEBF97EA"><enum>(A)</enum><text>On filing an appeal from the examiner to the Board of Patent Appeals and Interferences, $500.</text></subparagraph> 
<subparagraph id="H0E3081488F124F4E84EF4C15577034C"><enum>(B)</enum><text>In addition, on filing a brief in support of the appeal, $500, and on requesting an oral hearing in the appeal before the Board of Patent Appeals and Interferences, $1,000.</text></subparagraph></paragraph> 
<paragraph id="HB6516F128A034DDEA2D007002818C6F"><enum>(7)</enum><header>Revival fees</header><text>On filing each petition for the revival of an unintentionally abandoned application for a patent, for the unintentionally delayed payment of the fee for issuing each patent, or for an unintentionally delayed response by the patent owner in any reexamination proceeding, $1,500, unless the petition is filed under <external-xref legal-doc="usc" parsable-cite="usc/35/133">section 133</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/35/151">151</external-xref> of this title, in which case the fee shall be $500.</text></paragraph> 
<paragraph id="H6249AFBE8DC94233001035283D5F00E5"><enum>(8)</enum><header>Extension fees</header><text>For petitions for 1-month extensions of time to take actions required by the Director in an application—</text> 
<subparagraph id="H09C6AFF0819B43329152B4C97C99FD09"><enum>(A)</enum><text>on filing a first petition, $120;</text></subparagraph> 
<subparagraph id="H85F967A8CB7D47CFAC425052003D252D"><enum>(B)</enum><text>on filing a second petition, $330; and</text></subparagraph> 
<subparagraph id="H48E1AE49356B46C5A273986E1BA74D38"><enum>(C)</enum><text>on filing a third or subsequent petition, $570.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2F6BFFB48E9C40ACA54EDFB65BABE00"><enum>(b)</enum><header>Patent maintenance fees</header><text><external-xref legal-doc="usc" parsable-cite="usc/35/41">Section 41(b)</external-xref> of title 35, United States Code, is amended to read as follows:</text>

<subsection id="H799C2B8FC95E415688666B5C8036F207"><enum>(b)</enum><header>Maintenance fees</header><text>The Director shall charge the following fees for maintaining in force all patents based on applications filed on or after December 12, 1980:</text> 
<paragraph id="H91659073717A4DC9A1DD3200E9B93503"><enum>(1)</enum><text>3 years and 6 months after grant, $900.</text></paragraph> 
<paragraph id="HD88D67C4E82B4BADBCEE73C2725035CD"><enum>(2)</enum><text>7 years and 6 months after grant, $2,300.</text></paragraph> 
<paragraph id="HF8E47F92640A484EAC431DB86E98D05D"><enum>(3)</enum><text>11 years and 6 months after grant, $3,800.</text></paragraph><continuation-text continuation-text-level="subsection">Unless payment of the applicable maintenance fee is received in the United States Patent and Trademark Office on or before the date the fee is due or within a grace period of 6 months thereafter, the patent will expire as of the end of such grace period. The Director may require the payment of a surcharge as a condition of accepting within such 6-month grace period the payment of an applicable maintenance fee. No fee may be established for maintaining a design or plant patent in force.</continuation-text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HFBC3C42FCE55463BBE7318D4D846ED02"><enum>(c)</enum><header>Patent search fees</header><text><external-xref legal-doc="usc" parsable-cite="usc/35/41">Section 41(d)</external-xref> of title 35, United States Code, is amended to read as follows:</text>

<subsection id="H3881E16CA3F1480E9C8CAAFBD2A9D9A6"><enum>(d)</enum><header>Patent search and other fees</header> 
<paragraph id="H4F3B1726C52E488EAC9CA176602EE29E"><enum>(1)</enum><header>Patent search fees</header> 
<subparagraph display-inline="yes-display-inline" id="HB94B56A0052E464DB58230C4BEEB6648"><enum>(A)</enum><text>The Director shall charge a fee for the search of each application for a patent, except for provisional applications. The Director shall establish the fees charged under this paragraph to recover an amount not to exceed the estimated average cost to the Office of searching applications for patent either by acquiring a search report from a qualified search authority, or by causing a search by Office personnel to be made, of each application for patent. For the 3-year period beginning on December 8, 2004, the fee for a search by a qualified search authority of a patent application described in clause (i), (iv), or (v) of subparagraph (B) may not exceed $500, of a patent application described in clause (ii) of subparagraph (B) may not exceed $100, and of a patent application described in clause (iii) of subparagraph (B) may not exceed $300. The Director may not increase any such fee by more than 20 percent in each of the next 3 1-year periods, and the Director may not increase any such fee thereafter.</text></subparagraph> 
<subparagraph indent="paragraph" id="HF8C93A003DE746F2BF55076D19E7879"><enum>(B)</enum><text>For purposes of determining the fees to be established under this paragraph, the cost to the Office of causing a search of an application to be made by Office personnel shall be deemed to be—</text> 
<clause indent="subparagraph" id="H089DF33FF4AA449EBEAF59A59FE530DF"><enum>(i)</enum><text>$500 for each application for an original patent, except for design, plant, provisional, or international applications;</text></clause> 
<clause indent="subparagraph" id="HFB49E6C8B4FE42BE95E15E2D12EF9F"><enum>(ii)</enum><text>$100 for each application for an original design patent;</text></clause> 
<clause indent="subparagraph" id="HF0134ECB58784F4CA7CE63E6E5550193"><enum>(iii)</enum><text>$300 for each application for an original plant patent;</text></clause> 
<clause indent="subparagraph" id="H6595B77F530446B79086B08E009EBD00"><enum>(iv)</enum><text>$500 for the national stage of each international application; and</text></clause> 
<clause indent="subparagraph" id="H89A22AF389DF412D81FF00B1E914EACD"><enum>(v)</enum><text>$500 for each application for the reissue of a patent.</text></clause></subparagraph> 
<subparagraph indent="paragraph" id="H81ACC93A89CF4DEABFBD8D69BCCB9DA4"><enum>(C)</enum><text>The provisions of <external-xref legal-doc="usc" parsable-cite="usc/35/111">section 111(a)(3)</external-xref> of this title relating to the payment of the fee for filing the application shall apply to the payment of the fee specified in this paragraph with respect to an application filed under <external-xref legal-doc="usc" parsable-cite="usc/35/111">section 111(a)</external-xref> of this title. The provisions of <external-xref legal-doc="usc" parsable-cite="usc/35/371">section 371(d)</external-xref> of this title relating to the payment of the national fee shall apply to the payment of the fee specified in this paragraph with respect to an international application.</text></subparagraph> 
<subparagraph indent="paragraph" id="H3974820D58454480B6757EF567EA182B"><enum>(D)</enum><text>The Director may by regulation provide for a refund of any part of the fee specified in this paragraph for any applicant who files a written declaration of express abandonment as prescribed by the Director before an examination has been made of the application under <external-xref legal-doc="usc" parsable-cite="usc/35/131">section 131</external-xref> of this title, and for any applicant who provides a search report that meets the conditions prescribed by the Director.</text></subparagraph> 
<subparagraph indent="paragraph" id="H4008C911886B4132AA2C97D9482086FA"><enum>(E)</enum><text>For purposes of subparagraph (A), a <quote>qualified search authority</quote> may not include a commercial entity unless—</text> 
<clause indent="subparagraph" id="H10D4459B0A6E47698C2DD14370EB8963"><enum>(i)</enum><text>the Director conducts a pilot program of limited scope, conducted over a period of not more than 18 months, which demonstrates that searches by commercial entities of the available prior art relating to the subject matter of inventions claimed in patent applications—</text> 
<subclause indent="clause" id="HBA913A0D91054B9AABC3F7A0DD1320A3"><enum>(I)</enum><text>are accurate; and</text></subclause> 
<subclause indent="clause" id="H5251DB87765242D2B6A0B783F597D8AC"><enum>(II)</enum><text>meet or exceed the standards of searches conducted by and used by the Patent and Trademark Office during the patent examination process;</text></subclause></clause> 
<clause indent="subparagraph" id="H6546CEA578674D68A100D345594D5D32"><enum>(ii)</enum><text>the Director submits a report on the results of the pilot program to the Congress and the Patent Public Advisory Committee that includes—</text> 
<subclause indent="clause" id="H9032A8935901418886E91C1B9FA627F7"><enum>(I)</enum><text>a description of the scope and duration of the pilot program;</text></subclause> 
<subclause indent="clause" id="H0DEA704723314C3789E5825E2CD34402"><enum>(II)</enum><text>the identity of each commercial entity participating in the pilot program;</text></subclause> 
<subclause indent="clause" id="HF5A2C3A2F7504AE597072E4B57C2D471"><enum>(III)</enum><text>an explanation of the methodology used to evaluate the accuracy and quality of the search reports; and</text></subclause> 
<subclause indent="clause" id="HF978F48034B54E43A43BCB63B1C09E5"><enum>(IV)</enum><text>an assessment of the effects that the pilot program, as compared to searches conducted by the Patent and Trademark Office, had and will have on—</text> 
<item indent="subclause" id="H121006BA5C804FE383D514123F00DCDB"><enum>(aa)</enum><text>patentability determinations;</text></item> 
<item indent="subclause" id="HF14C1023E1AA4E23ACF5797532DEE200"><enum>(bb)</enum><text>productivity of the Patent and Trademark Office;</text></item> 
<item indent="subclause" id="H179715E643E6436A9049F9B1E18C82B9"><enum>(cc)</enum><text>costs to the Patent and Trademark Office;</text></item> 
<item indent="subclause" id="H8CC1D80B48E24201B1A312A26F61ACAD"><enum>(dd)</enum><text>costs to patent applicants; and</text></item> 
<item indent="subclause" id="H4C994980CFAB4F25A346C5569B71E7E"><enum>(ee)</enum><text>other relevant factors;</text></item></subclause></clause> 
<clause indent="subparagraph" id="H6173B52EAF9049C5A9F5BB775623E49"><enum>(iii)</enum><text>the Patent Public Advisory Committee reviews and analyzes the Director’s report under clause (ii) and the results of the pilot program and submits a separate report on its analysis to the Director and the Congress that includes—</text> 
<subclause indent="clause" id="H3823AF32AE774D829F988437BC91AE5F"><enum>(I)</enum><text>an independent evaluation of the effects that the pilot program, as compared to searches conducted by the Patent and Trademark Office, had and will have on the factors set forth in clause (ii)(IV); and</text></subclause> 
<subclause indent="clause" id="H69FC1CAFBC254744BCB6957CC604BB55"><enum>(II)</enum><text>an analysis of the reasonableness, appropriateness, and effectiveness of the methods used in the pilot program to make the evaluations required under clause (ii)(IV); and</text></subclause></clause> 
<clause indent="subparagraph" id="H1D6DE188579D4A228BFD8CB5DA9EE45F"><enum>(iv)</enum><text>the Congress does not, during the 1-year period beginning on the date on which the Patent Public Advisory Committee submits its report to the Congress under clause (iii), enact a law prohibiting searches by commercial entities of the available prior art relating to the subject matter of inventions claimed in patent applications.</text></clause></subparagraph> 
<subparagraph indent="paragraph" id="H27E029DE98824F22AFAFD48317A7AFBE"><enum>(F)</enum><text>The Director shall require that any search by a qualified search authority that is a commercial entity is conducted in the United States by persons that—</text> 
<clause indent="subparagraph" id="HB0C97C681B1742B8ABC174157F5C6838"><enum>(i)</enum><text>if individuals, are United States citizens; and</text></clause> 
<clause indent="subparagraph" id="H33C11A6770EF4B2D9ED3553EE237DB38"><enum>(ii)</enum><text>if business concerns, are organized under the laws of the United States or any State and employ United States citizens to perform the searches.</text></clause></subparagraph> 
<subparagraph indent="paragraph" id="H575E9F96FF384145B2C585EBBFCF827"><enum>(G)</enum><text>A search of an application that is the subject of a secrecy order under section 181 or otherwise involves classified information may only be conducted by Office personnel.</text></subparagraph> 
<subparagraph indent="paragraph" id="HEE3EB706DAA54E82B4412741F91F8860"><enum>(H)</enum><text>A qualified search authority that is a commercial entity may not conduct a search of a patent application if the entity has any direct or indirect financial interest in any patent or in any pending or imminent application for patent filed or to be filed in the Patent and Trademark Office.</text></subparagraph></paragraph> 
<paragraph id="HC4B9CB2CFFD04DBF9F203D1811163224"><enum>(2)</enum><header>Other fees</header><text>The Director shall establish fees for all other processing, services, or materials relating to patents not specified in this section to recover the estimated average cost to the Office of such processing, services, or materials, except that the Director shall charge the following fees for the following services:</text> 
<subparagraph id="HFD86A0C753204E8ABAAD77F3E00294F"><enum>(A)</enum><text>For recording a document affecting title, $40 per property.</text></subparagraph> 
<subparagraph id="HA19E7C2858274190B08D14005201765E"><enum>(B)</enum><text>For each photocopy, $.25 per page.</text></subparagraph> 
<subparagraph id="H24EEC6CA2DB14F3582D56291B3E741D"><enum>(C)</enum><text>For each black and white copy of a patent, $3.</text></subparagraph><continuation-text continuation-text-level="paragraph">The yearly fee for providing a library specified in <external-xref legal-doc="usc" parsable-cite="usc/35/12">section 12</external-xref> of this title with uncertified printed copies of the specifications and drawings for all patents in that year shall be $50.</continuation-text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDCB9FB3E33CB4357B4C8B9D6C8DBBC5"><enum>(d)</enum><header>Adjustments</header> 
<paragraph id="H6A7E592B875E41419E2BBAD6CBB5E211"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/35/41">Section 41(f)</external-xref> of title 35, United States Code, shall apply to the fees established under the amendments made by this section, beginning in fiscal year 2006.</text></paragraph>

<subsection id="H8610D27C3B414DF390CC5BA0A45E3998"><enum>(e)</enum><header>Fees for small entities</header><text><external-xref legal-doc="usc" parsable-cite="usc/35/41">Section 41(h)</external-xref> of title 35, United States Code, is amended—</text> 
<paragraph id="HE6F0789009344BA3B4B3006F33DE5126"><enum>(1)</enum><text>in paragraph (1), by striking <quote>Fees charged under subsection (a) or (b)</quote> and inserting <quote>Subject to paragraph (3), fees charged under subsections (a), (b), and (d)(1)</quote>; and</text></paragraph> 
<paragraph id="HF6DCB33FB15B42FCB2F7EA92A27D00DE"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph indent="subsection" id="H19C040AC7AA74A1B8CADA88B9D4B3F11"><enum>(3)</enum><text>The fee charged under subsection (a)(1)(A) shall be reduced by 75 percent with respect to its application to any entity to which paragraph (1) applies, if the application is filed by electronic means as prescribed by the Director.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H267226FF48694FD8AE20135F88F58D40"><enum>(f)</enum><header>Size standards for small entities</header> 
<paragraph id="HF2B604CFAA4B422AB0809245B8F93AE"><enum>(1)</enum><header>Study</header><text>The Director, in conjunction with the Administrator of the Small Business Administration and the Chief Counsel for Advocacy of the Small Business Administration, shall conduct a study on the effect of patent fees on the ability of small entity inventors to file patent applications. Such study shall examine whether a separate category of reduced patent fees is necessary to ensure adequate development of new technology by small entity inventors.</text></paragraph> 
<paragraph id="H6EF9E8400BEB42A68DEAC3397D7EAEB5"><enum>(2)</enum><header>Report</header><text>The Director shall, not later than 6 months after the date of the enactment of this Act, submit a report on the results of the study under paragraph (1) to the Committee on the Judiciary and the Committee on Small Business of the House of Representatives and the Committee on the Judiciary and the Committee on Small Business and Entrepreneurship of the Senate.</text></paragraph></subsection> 
<subsection id="H74A61404FE15412C8C705B46DC925C6C"><enum>(g)</enum><header>Conforming amendments</header>

<section id="H57B1A012AE494A4F9CEAD4008373E52"><enum>3.</enum><header>Adjustment of trademark fees</header> 
<subsection id="HEFD036C28A1E45359288E87615599682"><enum>(a)</enum><header>Fee for filing application</header><text>The fee under section 31(a) of the Trademark Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/15/1113">15 U.S.C. 1113(a)</external-xref>) for filing an electronic application for the registration of a trademark shall be $325. If the trademark application is filed on paper, the fee shall be $375. The Director may reduce the fee for filing an electronic application for the registration of a trademark to $275 for any applicant who prosecutes the application through electronic means under such conditions as may be prescribed by the Director. Beginning in fiscal year 2006, the provisions of the second and third sentences of section 31(a) of the Trademark Act of 1946 shall apply to the fees established under this section.</text></subsection> 
<subsection id="H8A1985FE13D74B14B59FF1C12547F060"><enum>(b)</enum><header>Reference to Trademark Act of 1946</header><text>For purposes of this section, the <quote>Trademark Act of 1946</quote> refers to the Act entitled <quote>An Act to provide for the registration and protection of trademarks used in commerce, to carry out the provisions of certain international conventions, and for other purposes.</quote>, approved July 5, 1946 (<external-xref legal-doc="usc" parsable-cite="usc/15/1051">15 U.S.C. 1051 et seq.</external-xref>).</text></subsection></section> 
<section id="H8E828F0B7FFD4B60BD8732B559A95B56"><enum>4.</enum><header>Correction of erroneous naming of officer</header> 
<subsection id="HA1472FDF1E15438E863261B3CFD2DACF"><enum>(a)</enum><header>Correction</header><text>Section 13203(a) of the 21st Century Department of Justice Appropriations Authorization Act (<external-xref legal-doc="public-law" parsable-cite="pl/107/273">Public Law 107–273</external-xref>; 116 Stat. 1902) is amended—</text> 
<paragraph id="H0B3A476379584C7BA93C16C576A5F1D7"><enum>(1)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection">Commissioner</header-in-text></quote> and inserting <quote><header-in-text level="subsection">Director</header-in-text></quote>; and</text></paragraph>

<section id="HC19AB25FF3F04F50A597BC65B6CB50A3"><enum>5.</enum><header>Patent and trademark funding</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/35/42">Section 42(c)</external-xref> of title 35, United States Code, is amended—</text> 
<paragraph id="H13F268E724FB4782B28634A5AF5CFB25"><enum>(1)</enum><text>by striking <quote>(c)</quote> and inserting <quote>(c)(1)</quote>; and</text></paragraph> 
<paragraph id="H34ACA33EA78942CAA45306C81D196CCB"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph indent="subsection" id="H1B18841E0DE44E50AF0300B401C2594D"><enum>(2)</enum><text>There is established in the Treasury a Patent and Trademark Fee Reserve Fund. If fee collections by the Patent and Trademark Office for a fiscal year exceed the amount appropriated to the Office for that fiscal year, fees collected in excess of the appropriated amount shall be deposited in the Patent and Trademark Fee Reserve Fund. After the end of each fiscal year, the Director shall make a finding as to whether the fees collected for that fiscal year exceed the amount appropriated to the Patent and Trademark Office for that fiscal year. If the amount collected exceeds the amount appropriated, the Director shall, if the Director determines that there are sufficient funds in the Reserve Fund, make payments from the Reserve Fund to persons who paid patent or trademark fees during that fiscal year. The Director shall by regulation determine which persons receive such payments and the amount of such payments, except that such payments in the aggregate shall equal the amount of funds deposited in the Reserve Fund during that fiscal year, less the cost of administering the provisions of this paragraph.</text></paragraph><after-quoted-block></after-quoted-block></quoted-block></paragraph></section> 
<section id="H34449EE919A4490A800277931BB2D837"><enum>6.</enum><header>Repeal of patent and trademark fee provisions of the consolidated appropriations act, 2005</header><text display-inline="no-display-inline">Title VIII of division B of the Consolidated Appropriations Act, 2005 (<external-xref legal-doc="usc" parsable-cite="usc/35/41">35 U.S.C. 41</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/108/447">Public Law 108–447</external-xref>; 118 Stat. 2924) is repealed.</text></section> 
<section id="H4B8846F8ABBA4CF5BA9172E715C54900"><enum>7.</enum><header>Effective date, applicability, and transitional provision</header> 
<subsection id="H99B4F1D866864D3AAD9745D259C508B8"><enum>(a)</enum><header>Effective date</header><text>Except as otherwise provided in this Act and this section, this Act and the amendments made by this Act shall take effect as of December 8, 2004.</text></subsection> 
<subsection id="HDBEEFCF764DA4CF6B6A9E7309EAA91E2"><enum>(b)</enum><header>Applicability</header> 
<paragraph id="HE8C6E03BD85C479C9409EB24329E359E"><enum>(1)</enum> 
<subparagraph display-inline="yes-display-inline" id="HF5E8DD9AAD5D42A2ABD12319A06BE45B"><enum>(A)</enum><text>Except as provided in subparagraphs (B) and (C), the amendments made by section 2 shall apply to all patents, whenever granted, and to all patent applications pending on or filed after the effective date set forth in subsection (a) of this section.</text></subparagraph> 
<subparagraph indent="paragraph" id="HDE58BEEEA52F4A15AB17E088D2C632D2"><enum>(B)</enum> 
<clause display-inline="yes-display-inline" id="HB052A8C5CA9F402DB01C00CE1950CADE"><enum>(i)</enum><text>Except as provided in clause (ii), sections 41(a)(1), 41(a)(3), and 41(d)(1) of title 35, United States Code, as amended by this Act, shall apply only to—</text> 
<subclause indent="subparagraph" id="HE817B2F846BE4BD0AA4710496D57E086"><enum>(I)</enum><text>applications for patents filed under <external-xref legal-doc="usc" parsable-cite="usc/35/111">section 111(a)</external-xref> of title 35, United States Code, on or after the effective date set forth in subsection (a) of this section, and</text></subclause> 
<subclause indent="subparagraph" id="HD8D0FA531B0B45B48D98001DE0E20031"><enum>(II)</enum><text>international applications entering the national stage under <external-xref legal-doc="usc" parsable-cite="usc/35/371">section 371</external-xref> of title 35, United States Code, for which the basic national fee specified in <external-xref legal-doc="usc" parsable-cite="usc/35/41">section 41</external-xref> of title 35, United States Code, was not paid before the effective date set forth in subsection (a) of this section.</text></subclause></clause> 
<clause indent="paragraph" id="H4611BC27E0184BE9A5272F1C1753C2E"><enum>(ii)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/35/41">Section 41(a)(1)(D)</external-xref> of title 35, United States Code as amended by this Act, shall apply only to applications for patent filed under <external-xref legal-doc="usc" parsable-cite="usc/35/111">section 111(b)</external-xref> of title 35, United States Code, before, on, or after the effective date set forth in subsection (a) of this section in which the filing fee specified in <external-xref legal-doc="usc" parsable-cite="usc/35/41">section 41</external-xref> of title 35, United States Code, was not paid before the effective date set forth in subsection (a) of this section.</text></clause></subparagraph> 
<subparagraph indent="paragraph" id="H8F96DACD25124EE5A8E9005D829BED7F"><enum>(C)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/35/41">Section 41(a)(2)</external-xref> of title 35, United States Code, as amended by this Act, shall apply only to the extent that the number of excess claims, after giving effect to any cancellation of claims, is in excess of the number of claims for which the excess claims fee specified in <external-xref legal-doc="usc" parsable-cite="usc/35/41">section 41</external-xref> of title 35, United States Code, was paid before the effective date set forth in subsection (a) of this section.</text></subparagraph></paragraph> 
<paragraph id="H9F0BACC4A6B248F500D47FD4452ED616"><enum>(2)</enum><text>The amendments made by section 3 shall apply to all applications for the registration of a trademark filed or amended on or after the effective date set forth in subsection (a) of this section.</text></paragraph></subsection> 
<subsection id="H4983B51076174D1AB8D82C7B373BD4F"><enum>(c)</enum><header>Transitional provisions</header> 
<paragraph id="H31F140F8DB134A6E9000009F7278D882"><enum>(1)</enum><header>Search fees</header><text>During the period beginning on the effective date set forth in subsection (a) of this section and ending on the date on which the Director establishes search fees under the authority provided in <external-xref legal-doc="usc" parsable-cite="usc/35/41">section 41(d)(1)</external-xref> of title 35, United States Code, the Director shall charge—</text> 
<subparagraph id="HE21595A1926A4E598B28DA0007D4FF6D"><enum>(A)</enum><text>for the search of each application for an original patent, except for design, plant, provisional, or international application, $500;</text></subparagraph> 
<subparagraph id="H5AE9803367EF467D892174008CE26780"><enum>(B)</enum><text>for the search of each application for an original design patent, $100;</text></subparagraph> 
<subparagraph id="HB4978B9EB65B457D9EE8DEECA2E94B8"><enum>(C)</enum><text>for the search of each application for an original plant patent, $300;</text></subparagraph> 
<subparagraph id="H6E68CB9F81144103B70058DA40C7CD8E"><enum>(D)</enum><text>for the search of the national stage of each international application, $500; and</text></subparagraph> 
<subparagraph id="HBA296CA00AD148008F6049C48709053B"><enum>(E)</enum><text>for the search of each application for the reissue of a patent, $500.</text></subparagraph></paragraph> 
<paragraph id="HF391752ED0BB4BAE9563E406DC821DDF"><enum>(2)</enum><header>Timing of fees</header><text>The provisions of <external-xref legal-doc="usc" parsable-cite="usc/35/111">section 111(a)(3)</external-xref> of title 35, United States Code, relating to the payment of the fee for filing the application shall apply to the payment of the fee specified in paragraph (1) with respect to an application filed under <external-xref legal-doc="usc" parsable-cite="usc/35/111">section 111(a)</external-xref> of title 35, United States Code. The provisions of <external-xref legal-doc="usc" parsable-cite="usc/35/371">section 371(d)</external-xref> of title 35, United States Code, relating to the payment of the national fee shall apply to the payment of the fee specified in paragraph (1) with respect to an international application.</text></paragraph> 
<paragraph id="HD5A9D339ED734A39009667EFABFDA4BC"><enum>(3)</enum><header>Refunds</header><text>The Director may by regulation provide for a refund of any part of the fee specified in paragraph (1) for any applicant who files a written declaration of express abandonment as prescribed by the Director before an examination has been made of the application under <external-xref legal-doc="usc" parsable-cite="usc/35/131">section 131</external-xref> of title 35, United States Code, and for any applicant who provides a search report that meets the conditions prescribed by the Director.</text></paragraph></subsection> </section> 
<section id="H20289585BF114A26A619F70313D9CB8F"><enum>8.</enum><header>Definition</header><text display-inline="no-display-inline">In this Act, the term <quote>Director</quote> means the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office.</text></section> 
<section id="HF175E2B8569F401580E830B68C508DD0"><enum>9.</enum><header>Clerical amendment</header><text display-inline="no-display-inline">Subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/35/311">section 311</external-xref> of title 35, United States Code, is amended by aligning the text with the text of subsection (a) of such section.</text></section>
