<official-title>To authorize the Director of the Centers for Disease Control and Prevention to make grants to local educational agencies to support the purchase or lease and use of vending machines that offer for sale healthy foods and beverages in schools.</official-title>

<section id="H278C727687D642FCB44CCF0405D8E5EF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited at the the <quote>Student Nutrition and Health Act</quote>. </text></section> 
<section section-type="subsequent-section" id="H538BD47D2FC54AA0A2658BE366DEA2D" display-inline="no-display-inline"><enum>2.</enum><header>Grants for procurement and use of qualified vending machines in schools</header> 
<subsection id="H62D4047A552140969E9203D487F478B7"><enum>(a)</enum><header>Grants authorized</header><text>The Director of the Centers for Disease Control and Prevention may make grants to local educational agencies for the purpose of assisting such agencies—</text> 
<paragraph id="H9A80FB1A07AE4C09BE03AA897B1B7B68"><enum>(1)</enum><text>to purchase or lease qualified vending machines for placement in elementary and secondary schools for the use of students of such schools; and</text></paragraph> 
<paragraph id="H8D2F4D57BE4A43CDAD66FF9650F93E7C"><enum>(2)</enum><text>to offset any loss of revenue incurred by the local educational agency as a result of offering for sale healthy foods and beverages in qualified vending machines.</text></paragraph></subsection> 
<subsection id="H51B7B7A07472441494FEEA42C3F54F18"><enum>(b)</enum><header>Removal of other vending machines and use of qualified vending machines</header><text>As a condition for receiving a grant under subsection (a), the local educational agency shall agree—</text> 
<paragraph id="HF870B2FB740E4E0FAFDC532F327BA33C"><enum>(1)</enum><text>to remove any vending machines that offer for sale foods and beverages of minimal nutritional value from each elementary or secondary school under its jurisdiction in which qualified vending machines will be placed using the grant funds; and</text></paragraph> 
<paragraph id="HFAA00D188009499DAD3254019109AEA5"><enum>(2)</enum><text>to use only qualified vending machines in such school for such period as the Director may prescribe.</text></paragraph></subsection> 
<subsection id="H8DC32B7928E34E24834800DB3E001818"><enum>(c)</enum><header>Maximum portion sizes</header><text>As a further condition for receiving a grant under subsection (a), the local educational agency shall ensure that foods and beverages offered for sale in qualified vending machines will be limited to the following maximum portion sizes:</text> 
<paragraph id="H45C2912B05D44009B9FC60964E00C2E5"><enum>(1)</enum><text>One and one-quarter ounces for crackers, popcorn, cereal, trail mix, nuts, seeds, dried fruit, or jerky.</text></paragraph> 
<paragraph id="HF83CA8BEA8BF461AAD39D3A683627D8C"><enum>(2)</enum><text>Two ounces for cereal bars.</text></paragraph> 
<paragraph id="H2D863A1874DD44CB9600D13B7F704BE6"><enum>(3)</enum><text>Three ounces for bakery items, including muffins.</text></paragraph> 
<paragraph id="HFC29A2DC94A6491CA1DF42D9D42D98B"><enum>(4)</enum><text>Three fluid ounces for frozen desserts.</text></paragraph> 
<paragraph id="H0197162E36DB47CEB8737E2F9904C140"><enum>(5)</enum><text>Eight ounces for non-frozen yogurt.</text></paragraph> 
<paragraph id="H12DDCB9962C547519290827DAED9C1C"><enum>(6)</enum><text>Twelve ounces for beverages, excluding water.</text></paragraph> 
<paragraph id="H37A6C11E118441BE8739B5D7D973ADD4"><enum>(7)</enum><text>Entree items and side dishes shall be no larger than the portions of those foods served as part of the Federal school meal program.</text></paragraph></subsection> 
<subsection id="HCB64C3B4EB3E4AB7BB77139C875FA905"><enum>(d)</enum><header>Applications</header><text>To apply for a grant under this section, a local educational agency shall submit an application to the Director at such time, in such manner, and containing such information as the Director may require. A local educational agency may submit a new application for the purpose of applying to receive continuing grants for the purpose described in subsection (a)(2).</text></subsection> 
<subsection id="H1A174567D5C84D6290BB8D36F6847DC0"><enum>(e)</enum><header>Definitions</header><text>In this Act:</text> 
<paragraph id="H10A6C7FD5EDE47ED8C59B69B42221362"><enum>(1)</enum><header>Foods and beverages of minimal nutritional value</header><text>The term <term>foods and beverages of minimal nutritional value</term> means a food or beverage item which provides less than five percent of the Reference Daily Intake (RDI) for protein, vitamin A, vitamin C, niacin, riboflavin, thiamin, calcium, or iron per serving.</text></paragraph> 
<paragraph id="HD8487913295346C7948001FCDD095182"><enum>(2)</enum><header>Healthy foods and beverages</header> 
<subparagraph id="HCC5EE1DA25C94B1DB253EE191F50A8E9"><enum>(A)</enum><text>The term <term>healthy foods and beverages</term> means any food or beverage item that derives—</text> 
<clause id="H035B2F1B294C48CCBF833E63A55CDB9D"><enum>(i)</enum><text>30 percent or less of its total calories from fat;</text></clause> 
<clause id="H51CA9D165A3C40A58B133B0912FC79C3"><enum>(ii)</enum><text>10 percent or less of its total calories from saturated fat and trans fat; and</text></clause> 
<clause id="HAF39313F981F404985DC00BCD3F76F3C"><enum>(iii)</enum><text>35 percent or less of its total calories from sugars, excluding those sugars occurring naturally in fruits, vegetables, and dairy products.</text></clause></subparagraph> 
<subparagraph id="H284DC661FEC84B788B3B9560116D4055"><enum>(B)</enum><text>The term <term>healthy foods and beverages</term> includes nuts, seeds, and flavored fluid milk.</text></subparagraph></paragraph> 
<paragraph id="H088A8BEE06DA4285ACD7585D088D009D"><enum>(3)</enum><header>Local educational agency</header><text>The term <term>local educational agency</term> has the meaning given such term in section 9101 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph> 
<paragraph id="H6D918EA255BE40BFB3EE3EEB32C9CDA"><enum>(4)</enum><header>Qualified vending machine</header><text>The term <term>qualified vending machine</term> means a vending machine that offers for sale only healthy foods or beverages.</text></paragraph> 
<paragraph id="HD29F4673B79C4C7E8523D10338E65D82"><enum>(5)</enum><header>School</header><text>The term <term>school</term> means any elementary school (as defined by section 9101 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)) and any secondary school (as defined by such section).</text></paragraph></subsection> 
<subsection id="H119A556C206F451498037971A8D66300"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Director $100,000,000 for each of the fiscal years 2006 through 2010 to carry out this section. Amounts so appropriated shall remain available until expended.</text></subsection></section>
