<official-title>To direct the Secretary of Health and Human Services to establish a demonstration project for the use of an Internet-based form for submission of certain claims under the Medicare Program.</official-title>

<section section-type="section-one" id="H2D0EC6E7BBBB46F70085B9117008588F" display-inline="no-display-inline"><enum>1.</enum><header>Medicare Internet-based claims submission demonstration project</header> 
<subsection id="HA9AA2DE240A7491A0016118413FA6D88"><enum>(a)</enum><header>Establishment of demonstration project</header><text>The Secretary of Health and Human Services shall implement a demonstration project (in this section referred to as the <quote>project</quote>) to provide for the use of the Internet for the electronic submission of claims by providers of services under the medicare program for which the HCFA-1500 claim form is utilized. The Secretary may carry out the project directly or through a third-party contractor.</text></subsection> 
<subsection id="H648FB3F90FF0485DAC2D8700E7F9439"><enum>(b)</enum><header>Prompt payment of claims</header> 
<paragraph id="H8E74B36BC61E4568910465DEF5C16BB3"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), for each clean claim that is submitted electronically by a provider of services under the project, the Secretary shall make payment to the provider of services for the claim by not later than 30 days after receipt of the claim.</text></paragraph> 
<paragraph id="H7D63BBA7FC684E5E94F6447103B51881"><enum>(2)</enum><header>Exceptions for fraud</header><text>Payment shall not be made if the Secretary determines the claim is fraudulent, in part or in whole. In promulgating regulations to carry out the project, the Secretary shall provide examples of fraudulent or otherwise deficient claims for which payment would not be made under the medicare program or through the project.</text></paragraph></subsection> 
<subsection id="H98697E962623484D99123EF395671E7C"><enum>(c)</enum><header>Designation of medicare payment areas covered by project</header><text>The Secretary shall designate medicare payment areas located in the New England or mid-Atlantic areas as areas in which the project under this section will be conducted.</text></subsection> 
<subsection id="HD21D139A28C3446882B8A56200DAFA67"><enum>(d)</enum><header>Consultation</header><text>Before implementing the project under this section, the Secretary shall consult with affected parties on—</text> 
<paragraph id="H43C9025EE0884DBDB7252B2B00AEC000"><enum>(1)</enum><text>the design of the project, including requirements for electronic signatures;</text></paragraph> 
<paragraph id="H0081CB0CE60D4A4800B7AC73072956FC"><enum>(2)</enum><text>the selection criteria for the third-party contractor; and</text></paragraph> 
<paragraph id="HB00D2CE4CF7B43C0A6BF4B251ED1CB3F"><enum>(3)</enum><text>the establishment of performance standards, as described in subsection (e).</text></paragraph></subsection> 
<subsection id="H8CC6447F57834DD7BC6008C2CDFB998B"><enum>(e)</enum><header>Performance standards</header> 
<paragraph id="HB5ECE154F7C044C2ACDDE2320186E9B3"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish performance standards for the accuracy and timeliness of claims filing, processing, and payment functions performed under the project.</text></paragraph> 
<paragraph id="H88AE60F05ACF43B599D130EFC26E87D"><enum>(2)</enum><header>Noncompliance</header><text>In the event that a third-party contractor (if any) is not in substantial compliance with the performance standards established under paragraph (1), such claims filing, processing, and payment functions shall be performed by the Secretary unless the Secretary contracts with another third-party contractor.</text></paragraph></subsection> 
<subsection id="H01DA4228981C4AD085BA68B4E8E3A604"><enum>(f)</enum><header>Confidentiality of information</header> 
<paragraph id="H9D3573F33A8E4ED2B18C6E17DB451D70"><enum>(1)</enum><header>Compliance with hipaa rules</header><text>The Secretary shall ensure that a third-party contractor participating under the project shall protect the confidentiality of individually identifiable health information consistent with the standards for the privacy of such information promulgated by the Secretary under the <act-name parsable-cite="HIPAA">Health Insurance Portability and Accountability Act of 1996</act-name>, or any subsequent comprehensive and more protective set of confidentiality standards enacted into law or promulgated by the Secretary.</text></paragraph> 
<paragraph id="HD449958F801C43F5B1B4923D113B0056"><enum>(2)</enum><header>Prohibition on sale of individually identifiable health information</header><text>A third-party contractor participating under the project may not sell any individually identifiable health information collected under the project.</text></paragraph></subsection> 
<subsection id="H404C8BDEC78F4A02B01F69193B1DFE1B"><enum>(g)</enum><header>Report to Congress</header><text>The Secretary shall periodically submit reports to the Congress providing—</text> 
<paragraph id="H5D45F334467B47A3A54BE119CEF18D97"><enum>(1)</enum><text>analysis of the overall effectiveness of the project;</text></paragraph> 
<paragraph id="HDC2230A48FA741E6BF3F255798C0D6A6"><enum>(2)</enum><text>findings with respect to—</text> 
<subparagraph id="H5CE8C8D503B04CE897EFD91EAD9E1EE3"><enum>(A)</enum><text>increase or reduction in funds lost to fraud, abuse, misuse, mistakes, and any other factor the Secretary determines to be appropriate; and</text></subparagraph> 
<subparagraph id="HB934733F2F804E2A81EECBC0061D153"><enum>(B)</enum><text>changes in efficiency in processing claims submitted by electronic means compared with claims not submitted electronically; and</text></subparagraph></paragraph> 
<paragraph id="H26DD6EC16A09440F9794BE8CC3272531"><enum>(3)</enum><text>recommendations on—</text> 
<subparagraph id="H2890538BCEB44C87BE7F69D8174B7E02"><enum>(A)</enum><text>continuation of the project; and</text></subparagraph> 
<subparagraph id="H52875B4BF25A4BA3A672E889F6B23A5"><enum>(B)</enum><text>extension or expansion of the use of Internet-based electronic claims submission under the medicare program.</text></subparagraph></paragraph></subsection> 
<subsection id="HC68BD7169B2D4388A99659009DD2247B"><enum>(h)</enum><header>Waiver authority</header><text>The Secretary shall waive compliance with the requirements of title XVIII of the <act-name parsable-cite="SSA">Social Security Act</act-name> to such extent and for such period as the Secretary determines is necessary to conduct the project.</text></subsection> 
<subsection id="H69FFABF75AF143D281BA1724CE8DFA96"><enum>(i)</enum><header>Duration</header><text>A demonstration project under this section shall be conducted for a 3-year period.</text></subsection> 
<subsection id="H0B96896A52D046CDA6482DBCD07C532C"><enum>(j)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H4EC4116C743A4711993F9C3B62A916F3"><enum>(1)</enum><text>The term <term>medicare program</term> means the health insurance program established under title XVIII of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>).</text></paragraph> 
<paragraph id="H892511CED8344A81B1E253A66C9F9CFA"><enum>(2)</enum><text>The term <term>provider of service</term> has the meaning given that term in section 1861(u) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(u)</external-xref>), and includes a physician (as defined in section 1861(r) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(r)</external-xref>).</text></paragraph> 
<paragraph id="H44FECE6AA1644BEB949F34286F81E9D5"><enum>(3)</enum><text>The term <term>clean claim</term> has the meaning given that term in section 1816(c)(2)(B)(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395h">42 U.S.C. 1395h(c)(2)(B)(i)</external-xref>).</text></paragraph></subsection></section>
