<official-title>To assure equitable treatment of fertility and impotence in health care coverage under group health plans, health insurance coverage, and health plans under the Federal employees’ health benefits program.</official-title>

<section section-type="section-one" id="HC5A372285ED641E69D1FF32C53D34B7E" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Equity in Fertility Coverage Act of 2005</short-title></quote>.</text></section> 
<section id="H8E2887AAFC86484EAE7786B57F3EFCAD"><enum>2.</enum><header>Equity in provision of prescription drug coverage</header> 
<subsection id="H72A674A4209E42F7A0BF90B29803BD5"><enum>(a)</enum><header>Group health plans</header> 
<paragraph id="HAF3D47B3F1D44B6CBD2CC526C9799F90"><enum>(1)</enum><header><act-name parsable-cite="PHSA">Public Health Service Act</act-name> amendments</header> 
<subparagraph display-inline="yes-display-inline" id="H544A8C2ADFD14865BE73005F99FF53E2"><enum>(A)</enum><text>Subpart 2 of part A of title XXVII of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> is amended by adding at the end the following new section:</text> 
<quoted-block act-name="Public Health Service Act" id="H20F9DE2240DC4CEE85EBCAF3EB2C7B42"> 
<section id="H6870FBCE56C749F2AE4D2480EC1307EE"><enum>2707.</enum><header>Equity in fertility coverage</header> 
<subsection id="HE76FBB1A918D444BA05ED3E2E0F6C4FE"><enum>(a)</enum><header>In general</header><text>A group health plan, and a health insurance issuer offering group health insurance coverage, that provides for coverage of impotency medications such as viagra shall also provide coverage of fertility treatments.</text></subsection> 
<subsection id="HE40160A09D1445B584C6DC2C69B28041"><enum>(b)</enum><header>Construction</header><text>Nothing in this section shall be construed as preventing a plan or issuer from—</text> 
<paragraph id="HF468A4D5BD83426D839430CC1B2B001F"><enum>(1)</enum><text>restricting the drugs for which benefits are provided under the plan or health insurance coverage, or</text></paragraph> 
<paragraph id="H8C4702153DAC4DF28633F2ACFA397BA3"><enum>(2)</enum><text>imposing a limitation on the amount of benefits provided with respect to such coverage or the cost-sharing that may be imposed with respect to such coverage,</text></paragraph><continuation-text continuation-text-level="subsection">so long as such restrictions and limitations are consistent with subsection (a).</continuation-text></subsection> 
<subsection id="HEE51984520664380A9998E174E41F93E"><enum>(c)</enum><header>Notice</header><text>A group health plan under this part shall comply with the notice requirement under section 714(c) of the <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of 1974</act-name> with respect to the requirements of this section as if such section applied to such plan.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> 
<subparagraph indent="up1" id="H2966CEC77FBA415EB7009CFF6BE51CA2"><enum>(B)</enum><text>Section 2723(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-23">42 U.S.C. 300gg–23(c)</external-xref>) is amended by striking <quote>section 2704</quote> and inserting <quote>sections 2704 and 2707</quote>.</text></subparagraph></paragraph> 
<paragraph id="HB94C49E85CC347998444D19B78764EA2"><enum>(2)</enum><header>ERISA amendments</header> 
<subparagraph display-inline="yes-display-inline" id="H0FB8F8C0AF6C4AD29398A11BB0CC17E6"><enum>(A)</enum><text>Subpart B of part 7 of subtitle B of title I of the <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of 1974</act-name> is amended by adding at the end the following new section:</text>

<section id="H6A358B8336FE4D9C9EA4582414009983"><enum>714.</enum><header>Equity in fertility coverage</header> 
<subsection id="HA07DDF873274440790F32B798839CEC2"><enum>(a)</enum><header>In general</header><text>A group health plan, and a health insurance issuer offering group health insurance coverage, that provides for coverage of impotency medications such as viagra shall also provide coverage of fertility treatments.</text></subsection> 
<subsection id="HB02A4725D69E45B094511425C9EF81E6"><enum>(b)</enum><header>Construction</header><text>Nothing in this section shall be construed as preventing a plan or issuer from—</text> 
<paragraph id="H66FAE9F45F114A0D8626C13E4B3BA61B"><enum>(1)</enum><text>restricting the drugs for which benefits are provided under the plan or health insurance coverage, or</text></paragraph> 
<paragraph id="H085C708B3428419483B644DC3E8ED488"><enum>(2)</enum><text>imposing a limitation on the amount of benefits provided with respect to such coverage or the cost-sharing that may be imposed with respect to such coverage,</text></paragraph><continuation-text continuation-text-level="subsection">so long as such restrictions and limitations are consistent with subsection (a).</continuation-text></subsection> 
<subsection id="H50390DD4675E46FC81A329E3A4F32EEA"><enum>(c)</enum><header>Notice under group health plan</header><text>The imposition of the requirements of this section shall be treated as a material modification in the terms of the plan described in section 102(a)(1), for purposes of assuring notice of such requirements under the plan; except that the summary description required to be provided under the last sentence of section 104(b)(1) with respect to such modification shall be provided by not later than 60 days after the first day of the first plan year in which such requirements apply.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> 
<subparagraph indent="up1" id="HBB7C65C6AA36477C9E6D4829908EB8FC"><enum>(B)</enum><text>Section 731(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1191">29 U.S.C. 1191(c)</external-xref>) is amended by striking <quote>section 711</quote> and inserting <quote>sections 711 and 714</quote>.</text></subparagraph> 
<subparagraph indent="up1" id="H436AC920F798459AB1F598B7618CCAA5"><enum>(C)</enum><text>Section 732(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1191a">29 U.S.C. 1191a(a)</external-xref>) is amended by striking <quote>section 711</quote> and inserting <quote>sections 711 and 714</quote>.</text></subparagraph> 
<subparagraph indent="up1" id="HDCE33C71DC954D2A81E0D242F93B0092"><enum>(D)</enum><text>The table of contents in section 1 of such Act is amended by inserting after the item relating to section 713 the following new item:</text>

<subsection id="HF602C4E766B14788B1C2DC3444491972"><enum>(b)</enum><header>Individual health insurance</header> 
<paragraph display-inline="yes-display-inline" id="H3740104BC1FD4E3792B0C572F82FCE92"><enum>(1)</enum><text>Part B of title XXVII of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> is amended by inserting after section 2752 the following new section:</text>

<section id="H2D105B48B62E403E9195011E5C8D59E"><enum>2753.</enum><header>Equity in fertility coverage</header> 
<subsection id="H597BB0CFD1F543D8801B13D6DF29848F"><enum>(a)</enum><header>In general</header><text>The provisions of section 2707 (other than subsection (c)) shall apply to health insurance coverage offered by a health insurance issuer in the individual market in the same manner as it applies to health insurance coverage offered by a health insurance issuer in connection with a group health plan in the small or large group market.</text></subsection> 
<subsection id="HDF82B9D4B64B4CB0A820FB78B79EF24F"><enum>(b)</enum><header>Notice</header><text>A health insurance issuer under this part shall comply with the notice requirement under section 714(c) of the <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of 1974</act-name> with respect to the requirements referred to in subsection (a) as if such section applied to such issuer and such issuer were a group health plan.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph indent="up1" id="H602F11D0F1DB4E37BC00209769690016"><enum>(2)</enum><text>Section 2762(b)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-62">42 U.S.C. 300gg–62(b)(2)</external-xref>) is amended by striking <quote>section 2751</quote> and inserting <quote>sections 2751 and 2753</quote>.</text></paragraph></subsection> 
<subsection id="H3C8E046D8DBE49D3B4CF5CAD8B25F81F"><enum>(c)</enum><header>FEHBP</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8902">Section 8902</external-xref> of title 5, United States Code, is amended by adding at the end the following the following new subsection:</text>

<subsection id="H8AE4BB47D7784E3CBBB308C897FB62B2"><enum>(p)</enum><text>A contract may not be made or a plan approved which does not comply with the requirements of section 2753 of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name>.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB47B3562E71748CCBE162B45FC04BDA8"><enum>(d)</enum><header>Effective dates</header> 
<paragraph display-inline="yes-display-inline" id="H5EFA4BD95E9440469DC038B557EEDD1C"><enum>(1)</enum><text>The amendments made by subsection (a) shall apply with respect to group health plans for plan years beginning on or after January 1, 2006.</text></paragraph> 
<paragraph indent="up1" id="H2EBD170F9DD340049CA2E9FE5E06BE84"><enum>(2)</enum><text>The amendments made by subsection (b) shall apply with respect to health insurance coverage offered, sold, issued, renewed, in effect, or operated in the individual market on or after January 1, 2006.</text></paragraph> 
<paragraph indent="up1" id="HCFDA282E53104F98895F4F8100B94D1F"><enum>(3)</enum><text>The amendment made by subsection (c) shall apply with respect to contracts for periods beginning on and after January 1, 2006.</text></paragraph></subsection> 
<subsection id="H2DD03DDE63E24B01B3BC93BDA53FB"><enum>(e)</enum><header>Coordinated regulations</header><text>Section 104(1) of <act-name parsable-cite="HIPAA">Health Insurance Portability and Accountability Act of 1996</act-name> is amended by striking <quote>this subtitle (and the amendments made by this subtitle and section 401)</quote> and inserting <quote>the provisions of part 7 of subtitle B of title I of the <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of 1974</act-name>, and the provisions of parts A and C of title XXVII of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name></quote>.</text></subsection></section>
