<official-title>To amend the Federal Election Campaign Act of 1971 to provide for public funding for House of Representatives elections, and for other purposes.</official-title>

<section section-type="section-one" id="H0D2D12605E424B2AA300183B56519CD1" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Campaign Financing Act of 2005</short-title></quote>.</text></section> 
<section id="H016C8261D2964F3A8CA25B9B2DC7C7B3"><enum>2.</enum><header>Public funding for House of Representatives elections</header><text display-inline="no-display-inline">The <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name> is amended by adding at the end the following new title:</text> 
<quoted-block act-name="Federal Election Campaign Act of 1971" id="H972FE155CE44493C85D234C6CEECF5AC"> 
<title id="H2E5CF829464F4E9B875D54B9FFB6D85"><enum>V</enum><header>Public funding for House of Representatives elections</header> 
<section id="H2AB0132BE1AD4AF68EB7F2D22B78B5D7"><enum>501.</enum><header>Qualifications for public funding</header><text display-inline="no-display-inline">A House of Representatives candidate qualifies for public funding if, as determined by the Commission—</text> 
<paragraph id="H350DA1465D8543CCB7B9647642778282"><enum>(1)</enum><text>at least 6 weeks before the general election, the candidate obtains the signatures of 3 percent of the registered voters in the congressional district involved; or</text></paragraph> 
<paragraph id="H9F6FE7F21B4B4B2082544546D9223B11"><enum>(2)</enum><text>the candidate is the candidate of a political party, the candidate of which, in the preceding general election, received more than 25 percent of the vote.</text></paragraph></section> 
<section id="H467612F936FF45588BBC14EA6110B8B9"><enum>502.</enum><header>Limitations on contributions to qualifying House of Representatives candidates</header> 
<subsection id="HC205FFECF117450F898CBFB905FF4EFB"><enum>(a)</enum><header>Individual contributions requirement</header><text>A qualifying House of Representatives candidate may not accept contributions other than contributions from individuals that total not more than $100 per individual per election cycle.</text></subsection> 
<subsection id="H177A1B66A2C34C4F82AE8CB213D8E422"><enum>(b)</enum><header>In-state contribution requirement</header><text>With respect to each reporting period for an election, at least 80 percent of the total sum of contributions accepted by a qualifying House of Representatives candidate shall be from the State in which the congressional district involved is located.</text></subsection></section> 
<section id="H3768CB9A8D564AE2B9E0B2547C5600F9"><enum>503.</enum><header>Use of public funding</header> 
<subsection id="H88AF308A3B4E4517AC59B1FDEB631943"><enum>(a)</enum><header>In general</header><text>A qualifying House of Representatives candidate may use public funds only for—</text> 
<paragraph id="H4492DB0F8DF24FFF9E963B3F0051F8E0"><enum>(1)</enum><text>buying time on radio, cable, or television broadcast stations;</text></paragraph> 
<paragraph id="HAB9BAA0E70254FF3B59F5D85C3BC817C"><enum>(2)</enum><text>buying rental space on billboards or other outdoor signs;</text></paragraph> 
<paragraph id="HCA7F69A1D4D8440392FE37787D07D0AF"><enum>(3)</enum><text>buying advertising space in magazines, newspapers, periodicals, and other advertising media, including theaters, the Internet, and the worldwide web;</text></paragraph> 
<paragraph id="H6CE8E4E638134F2FA3A16D9475A229EC"><enum>(4)</enum><text>payment of the cost of producing advertisements for media referred to in paragraphs (1), (2), and (3);</text></paragraph> 
<paragraph id="HC06FDA3717B544698E8CB9D9F0F5D6EB"><enum>(5)</enum><text>procurement of computerized campaign software, voter lists, and other voter contact tools;</text></paragraph> 
<paragraph id="HE334544AE03E460DA86E56B6FF149152"><enum>(6)</enum><text>payment of the cost of printing and mailing campaign literature;</text></paragraph> 
<paragraph id="H2EF44E66FF5D4B620072878E39992200"><enum>(7)</enum><text>payment of the cost of telephone expenses;</text></paragraph> 
<paragraph id="H73729CC0A5234C38A8B056F4566092C8"><enum>(8)</enum><text>payment of legal and accounting costs associated with campaigning;</text></paragraph> 
<paragraph id="HD19B3F2A20A24B1888CD6123F93334E0"><enum>(9)</enum><text>payment of campaign employees’ salaries;</text></paragraph> 
<paragraph id="HA062BFC8B44A476A8E3DF1B8DE2EA3BF"><enum>(10)</enum><text>payment of the cost of campaign office equipment and supplies; and</text></paragraph> 
<paragraph id="H9D2DA1ABFD7B4B3A9F0094F3F85B6024"><enum>(11)</enum><text>payment of incidental expenses of the candidate, such as travel and food.</text></paragraph></subsection> 
<subsection id="H6012101094B34698A1BE093D7E85A9A6"><enum>(b)</enum><header>Specific exclusion</header><text>A qualifying House of Representatives candidate may not use public funds under this title to pay the candidate a salary or personal mortgages.</text></subsection> 
<subsection id="HEE0CE89A29544A8681F89C735303C20"><enum>(c)</enum><header>Calculation of public disbursement</header> 
<paragraph id="H2320481BDCC442BEB404C9FE9C00D3F8"><enum>(1)</enum><header>In general</header><text>A qualifying House of Representatives candidate shall receive public funds closely approximating the cost of procuring 2<fraction>1/2</fraction> hours of television commercial time on local television stations in the district’s media markets.</text></paragraph> 
<paragraph id="H9408DE52C17E4F94B776DE9440E8B7AF"><enum>(2)</enum><header>Criteria for determining amount</header><text>An exact amount of the funds provided to a candidate under this section shall be determined by the Commission, using—</text> 
<subparagraph id="H8B88A009B1364BBCA1C3425300A7693C"><enum>(A)</enum><text>the average cost of a media point per media market, as defined by Arbitron Area of Dominant Influence, for the 4th quarter of the preceding calendar year; and</text></subparagraph> 
<subparagraph id="H26816A08BF9942A2846200AF932FDEF8"><enum>(B)</enum><text>a multiplier of 5,000 media points.</text></subparagraph></paragraph> 
<paragraph id="HE1BB876553534FA096DE71ACE995F8DC"><enum>(3)</enum><header>Use of funds</header><text>The funds provided under this section may be used for any purpose specified in subsection (a).</text></paragraph></subsection> 
<subsection id="HB832C5B830694CC5AD86E206A6C78C1B"><enum>(d)</enum><header>Disbursements</header><text>The Commission shall make disbursements of public funds under this title upon submission of evidence that an eligible expense has been incurred. No disbursement may be made with respect to an expense incurred more than 4 months before the election involved.</text></subsection></section> 
<section id="H31B4BEE511B24EBBB7CE2B0083DD80FB"><enum>504.</enum><header>Maximum amount of public funding</header> 
<subsection id="HF8C40D48EEB34687A50291A386E8E99B"><enum>(a)</enum><header>In general</header><text>The maximum amount of public funding that a qualifying House of Representatives candidate may receive is $750,000.</text></subsection> 
<subsection id="H9D4CA2EB0B6D485D00A81D2E3F58E89B"><enum>(b)</enum><header>Indexing</header><text>The amount under subsection (a) shall be increased as of the beginning of each even-numbered calendar year, based on the increase in the price index determined under section 315(c), except that the base period shall be calendar year 2003.</text></subsection></section> 
<section id="H7760AAA36E8C484B9B70797D8062AD45"><enum>505.</enum><header>Television debate requirement</header><text display-inline="no-display-inline">A qualifying House of Representatives candidate shall be required to participate in at least 2 televised debates, organized by a bipartisan or nonpartisan group, in the congressional district media market.</text></section> 
<section id="H1B630F5231394F77BB4B8190F420C8ED"><enum>506.</enum><header>Requirement for acceptance of advertising by radio and television stations</header> 
<subsection id="HD8E23313879F40129966242F04FB4513"><enum>(a)</enum><header>In general</header><text>Each radio station and each television station shall be—</text> 
<paragraph id="HF33A641C2F0D401BB40942F175FC260"><enum>(1)</enum><text>required to accept orders for advertisements to be paid for under this title until such advertising constitutes 40 percent of the station’s total advertising time; and</text></paragraph> 
<paragraph id="HE5B5C7FD4AAC4359919B18E526396C32"><enum>(2)</enum><text>subject to random periodic examination of advertising charges paid under this title to ensure that such charges are correct.</text></paragraph></subsection> 
<subsection id="HF025225C2B2F4FD38BEA5718A336415D"><enum>(b)</enum><header>Condition of license</header><text>The continuation of an existing license, the renewal of an expiring license, and the issuance of a new license under section 307 of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/47/307">47 U.S.C. 307</external-xref>) shall be conditioned on the agreement by the licensee to abide by the provisions of subsection (a)(1).</text></subsection></section> 
<section id="H8C09AC1D434E4942AD8CD9007600F300"><enum>507.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this title—</text> 
<paragraph id="HFA316615267149E487CEBFB4016B672"><enum>(1)</enum><text>the term <term>House of Representatives candidate</term> means a candidate for the office of Representative in, or Delegate or Resident Commissioner to, the Congress;</text></paragraph> 
<paragraph id="HB7D11095BB784319A3DEF34D0262F518"><enum>(2)</enum><text>the term <term>qualifying House of Representatives candidate</term> means a House of Representatives candidate who qualifies for public funding under this title; and</text></paragraph> 
<paragraph id="HC1031633B95142E9AFCADC8F12C69703"><enum>(3)</enum><text>the term <term>congressional district media market</term> means, with respect to a congressional district, the media market of that district, as determined from the licensing records of the Federal Communications Commission.</text></paragraph></section></title><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HE5236595EAE04D67852BA75E30D7EDE3"><enum>3.</enum><header>Reporting requirements</header> 
<subsection id="H8C40D127C9B24C1ABAF613731765AC48"><enum>(a)</enum><header>Reports by State committees</header><text>Section 304 of the <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/2/434">2 U.S.C. 434</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block act-name="Federal Election Campaign Act of 1971" id="H665EA37B32884E01AB245CDC0040EFEF"> 
<subsection id="H31751CE2F6AC438583908635BCD8F5FC"><enum>(i)</enum><header>Filing of State reports</header><text>In lieu of any report required to be filed by this Act, the Commission may allow a State committee of a political party to file with the Commission a report required to be filed under State law if the Commission determines such reports contain substantially the same information.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H128C9F4D439F48EFA57D08FDDAF82B55"><enum>(b)</enum><header>Other reporting requirements</header> 
<paragraph id="HC5F953BA4A7D4E988326EBD556421F48"><enum>(1)</enum><header>Authorized committees</header><text>Section 304(b)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/434">2 U.S.C. 434(b)(4)</external-xref>) is amended—</text> 
<subparagraph id="HB4D1AF0399034F1EA0A29ECBC8D9F400"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of subparagraph (H);</text></subparagraph> 
<subparagraph id="H8405859992CD491AB00795D4E8244700"><enum>(B)</enum><text>by inserting <quote>and</quote> at the end of subparagraph (I); and</text></subparagraph> 
<subparagraph id="H850C8D8E969E45999D2D7E00C000ACED"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block id="HA67F98393AA441EA908BF382063489F0"> 
<subparagraph id="H1A5700E80E56447FA9C3776C460800DF"><enum>(J)</enum><text>in the case of an authorized committee, disbursements for the primary election, the general election, and any other election in which the candidate participates;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HDACF694A35704401A2B24F9BF0CE31CF"><enum>(2)</enum><header>Names and addresses</header><text>Section 304(b)(5)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/434">2 U.S.C. 434(b)(5)(A)</external-xref>) is amended—</text> 
<subparagraph id="HADACFF71D9A54749AF43B6F9F51F8498"><enum>(A)</enum><text>by striking <quote>within the calendar year</quote>; and</text></subparagraph> 
<subparagraph id="H9A429867117941CD87E7DDB31E002BD2"><enum>(B)</enum><text>by inserting <quote>, and the election to which the operating expenditure relates</quote> after <quote>operating expenditure</quote>.</text></subparagraph></paragraph></subsection></section> 
<section id="H88FF447867964D4A87A67C96E73EBE"><enum>4.</enum><header>Reporting of election activity of persons other than political parties</header><text display-inline="no-display-inline">Section 304 of the <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/2/434">2 U.S.C. 434</external-xref>), as amended by section 3(a), is amended by adding at the end the following new subsection:</text> 
<quoted-block act-name="Federal Election Campaign Act of 1971" id="H101848DA7FB24552ADB0F23CA669F568"> 
<subsection id="HF0384A2782014D6CBCB6F86C1FB32BE8"><enum>(j)</enum><header>Election activity of persons other than political parties</header> 
<paragraph id="H2352A8921442487881A93F34AC8564E4"><enum>(1)</enum><header>Requirement described</header> 
<subparagraph display-inline="yes-display-inline" id="H0E155ACE9C954822A99B5DEC4CC99900"><enum>(A)</enum><text>If any person to which section 323 does not apply makes (or obligates to make) disbursements for Federal election activities (as defined in section 301(20)) in excess of $2,000, such person shall file a statement—</text> 
<clause indent="up1" id="HB2A832B783FC4563B700DEF574F1343"><enum>(i)</enum><text>on or before the date that is 48 hours before the disbursements (or obligations) are made; or</text></clause> 
<clause indent="up1" id="H3F9CC0E383B242BB960296CF9CF45395"><enum>(ii)</enum><text>in the case of disbursements (or obligations) that are required to be made within 14 days of the election, on or before such 14th day.</text></clause></subparagraph> 
<subparagraph indent="up1" id="HB99C773D28094C2E009D0064AD1CB7F"><enum>(B)</enum><text>An additional statement shall be filed each time additional disbursements aggregating $2,000 are made (or obligated to be made) by a person described in subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="H0BCD2FF991E84DA3002B4D6B00005804"><enum>(2)</enum><header>Contents of statement</header><text>Any statement under this section shall be filed with the Secretary of the Senate or the Clerk of the House of Representatives, and the Secretary of State (or equivalent official) of the State involved, as appropriate, and shall contain such information as the Commission shall prescribe, including whether the disbursement is in support of, or in opposition to, 1 or more candidates or any political party. The Secretary of the Senate or Clerk of the House of Representatives shall, as soon as possible (but not later than 24 hours after receipt), transmit a statement to the Commission. Not later than 48 hours after receipt, the Commission shall transmit the statement to—</text> 
<subparagraph id="H8F1530F0E7F7486CB143957388099DEB"><enum>(A)</enum><text>the candidates or political parties involved; or</text></subparagraph> 
<subparagraph id="HC1DCC2C800344A2B90C0E6ADBC00B376"><enum>(B)</enum><text>if the disbursement is not in support of, or in opposition to, a candidate or political party, the State committees of each political party in the State involved.</text></subparagraph></paragraph> 
<paragraph id="HB2ABC681374D4C2AB245BAAD6698EDA9"><enum>(3)</enum><header>Determinations by Commission</header><text>The Commission may make its own determination that disbursements described in paragraph (1) have been made or are obligated to be made. The Commission shall notify the candidates or political parties described in paragraph (2) not later than 24 hours after its determination.</text></paragraph> 
<paragraph id="H88D8EF2AC4C14CF500EF7BD445002363"><enum>(4)</enum><header>Exceptions</header><text>This subsection shall not apply to—</text> 
<subparagraph id="H4DBB468BD4B94B1AA4AB8B6023DA82A"><enum>(A)</enum><text>a candidate or a candidate’s authorized committees; or</text></subparagraph> 
<subparagraph id="HC3B0459184D845258B0876AC03521F77"><enum>(B)</enum><text>an independent expenditure (as defined in section 301(17)).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HD99826634A9C490EA9607E1D6E00F896"><enum>5.</enum><header>Contributions through intermediaries and conduits</header><text display-inline="no-display-inline">Section 315(a)(8) of the <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/2/441a">2 U.S.C. 441a(a)(8)</external-xref>) is amended to read as follows:</text> 
<quoted-block act-name="Federal Election Campaign Act of 1971" id="HBC444BAFADB94292BE71B23949FBE367"> 
<paragraph indent="up1" id="H230F7F79DF7D4F760000C842BB00EB97"><enum>(8)</enum><text>For the purposes of this subsection:</text> 
<subparagraph id="H510D1E0581D244E900EC514DCC4910FD"><enum>(A)</enum><text>Contributions made by a person, either directly or indirectly, to or on behalf of a particular candidate, including contributions that are in any way earmarked or otherwise directed through an intermediary or conduit to a candidate, shall be treated as contributions from the person to the candidate. If a contribution is made to a candidate through an intermediary or conduit, the intermediary or conduit shall report the original source and the intended recipient of the contribution to the Commission and the intended recipient.</text></subparagraph> 
<subparagraph id="HF0FE33B36BED417CA7EF18C97D29E3EA"><enum>(B)</enum><text>Contributions made directly or indirectly by a person to or on behalf of a particular candidate through an intermediary or conduit, including contributions arranged to be made by an intermediary or conduit, shall be treated as contributions from the intermediary or conduit to the candidate if—</text> 
<clause id="HC88799285C2F460F9FE82DF95F508E7"><enum>(i)</enum><text>the contributions made through the intermediary or conduit are in the form of a check or other negotiable instrument made payable to the intermediary or conduit rather than the intended recipient; or</text></clause> 
<clause id="H914EDB4725764486BBF1188C024D7FA9"><enum>(ii)</enum><text>the intermediary or conduit is—</text> 
<subclause id="H66597BA0E7954D658EBE1DB9C186A1DA"><enum>(I)</enum><text>a political committee, a political party, or an officer, employee, or agent of either;</text></subclause> 
<subclause id="H03989A74FD3340069441EC769E0943EF"><enum>(II)</enum><text>a person whose activities are required to be reported under section 4 of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1603">2 U.S.C. 1603</external-xref>), the Foreign Agents Registration Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611 et seq.</external-xref>), or any successor Federal law requiring a person who is a lobbyist or foreign agent to report the activities of such person;</text></subclause> 
<subclause id="H6DD4968B072846F78E00184C6DB5AA86"><enum>(III)</enum><text>a person who is prohibited from making contributions under section 316 or a partnership; or</text></subclause> 
<subclause id="HA29E1449054B4F288B6CF4F9CE7BE1A1"><enum>(IV)</enum><text>an officer, employee, or agent of a person described in subclause (II) or (III) acting on behalf of such person.</text></subclause></clause></subparagraph> 
<subparagraph id="HB2A2BFD4E2A548DBA7675EB4CF09958"><enum>(C)</enum><text>The term <term>contributions arranged to be made</term> includes—</text> 
<clause id="H746EBE61F6A24020AFE5E419D1DEB8B2"><enum>(i)</enum><text>contributions delivered directly or indirectly to a particular candidate or the candidate’s authorized committee or agent by the person who facilitated the contribution; and</text></clause> 
<clause id="HAA2E92CC9DDD456287D8509D68E6105E"><enum>(ii)</enum><text>contributions made directly or indirectly to a particular candidate or the candidate’s authorized committee or agent that are provided at a fundraising event sponsored by an intermediary or conduit described in subparagraph (B).</text></clause></subparagraph> 
<subparagraph id="H09F70C06FED84C53A62056133E955292"><enum>(D)</enum><text>This paragraph shall not prohibit—</text> 
<clause id="HFF515618A7024E18B421BBFBE6F2388F"><enum>(i)</enum><text>fundraising efforts for the benefit of a candidate that are conducted by another candidate or Federal officeholder; or</text></clause> 
<clause id="H46F68D42ECFC41EEAEDE52D834777C31"><enum>(ii)</enum><text>the solicitation by an individual using the individual’s resources and acting in the individual’s own name of contributions from other persons in a manner not described in paragraphs (B) and (C).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H9540C043A09B4DD594C9FF61D63E3DE6"><enum>6.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply with respect to elections occurring after December 31, 2006.</text></section>
