<section id="H6C73ABBC28DC4973B750701437A28BD8" section-type="section-one"><enum>1.</enum><header>Retail sales of cigarette products</header> 
<subsection id="HAEA21156BD6D46299D6192EAB361B571"><enum>(a)</enum><header>Product placement</header><text display-inline="yes-display-inline">It shall be unlawful for any person engaged in the retail sales of cigarette products to place cigarette products in the general merchandise areas of a retail sales facility and within reach of customers. All cigarette products sold at retail must be placed under or behind a counter where they may be accessible only to a salesperson.</text></subsection> 
<subsection id="H840E4F38D5AF48299897DE968D75D304"><enum>(b)</enum><header>Enforcement</header> 
<paragraph id="HC33DB3D620BD4A2C8949B39345E8D755"><enum>(1)</enum><header>Unfair and Deceptive Act or Practice</header><text>A violation of this Act shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>). </text></paragraph> 
<paragraph id="H4A079254B2D34EF19166502778084295"><enum>(2)</enum><header>Enforcement Authority</header><text>The Federal Trade Commission shall enforce this Act in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text> </paragraph></subsection></section>
