<official-title>To condition the minimum-wage-exempt status of organized camps under the Fair Labor Standards Act of 1938 on compliance with certain safety standards, and for other purposes.</official-title>

<section id="H13036E705E88496BBA2200A967311B3D" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header> 
<subsection id="H3AF843B9694F4AF3B749C09096262B00"><enum></enum><text>This Act may be cited as the <quote><short-title>Camp Safety Act of 2005</short-title></quote>.</text></subsection></section> 
<section id="H3625390E49554BF092BEF301EBC3B15E"><enum>2.</enum><header>Requirement for organized camps to continue minimum-wage-exempt status</header> 
<subsection id="HD5E72C4698634F1D009D4EC4ECFAC3BA"><enum></enum><text>Section 13(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(a)</external-xref>) is amended—</text> 
<paragraph id="H302CDC503E0649BB894819003ED2F1F1"><enum>(1)</enum><text>in paragraph (3), by inserting <quote>(subject to paragraph (18))</quote> after <quote>organized camp</quote>;</text></paragraph> 
<paragraph id="HE19587364EFD4E438300C2D41CDA8900"><enum>(2)</enum><text>in paragraph (17), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="H2C8B4B988913464889F2A6363B227579"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H3DD5B22853344C9C8EDDC527D4A553AC"><enum>(18)</enum><text>an organized camp under paragraph (3), if such camp—</text> 
<subparagraph id="HEFCCCB497D584C4AB5F6EE483F00DC32"><enum>(A)</enum><text>provides personal health, first aid and medical services, health supervision, and maintenance of camp-related health records for campers;</text></subparagraph> 
<subparagraph id="H179693CB2B784A0FB64006E2D286B5C6"><enum>(B)</enum><text>adheres to standards for food preparation safety that are as protective or more protective than such standards recommended by the Food and Drug Administration;</text></subparagraph> 
<subparagraph id="H2A54826CBB2A48D7953562D394A05866"><enum>(C)</enum><text>adheres to applicable State and local standards regarding—</text> 
<clause id="H9CEBBD7301834D5A9C67DAD58572DE74"><enum>(i)</enum><text>fire and building safety relating to the buildings and the occupants of buildings used by such camp; and</text></clause> 
<clause id="H7EB98E90DB544DD190E6925D01792DC0"><enum>(ii)</enum><text>sanitation relating to camp personnel, buildings, and grounds;</text></clause></subparagraph> 
<subparagraph id="H1BC346659B614AD9B4569862D17CD32F"><enum>(D)</enum><text>reports annually to the Secretary, on a date prescribed by the Secretary, all incidents resulting in death, injury, or illness, other than minor injuries which require only first aid treatment and which do not involve medical treatment, loss of consciousness, restriction of activity or motion, or premature termination of a camper’s term at the camp;</text></subparagraph> 
<subparagraph id="H6606D82C44CA433AA5241485DC92F9C8"><enum>(E)</enum><text>provides access to the Secretary for inspection or investigation of such camp under section 3 of the <short-title>Camp Safety Act of 2005</short-title>;</text></subparagraph> 
<subparagraph id="H70E90A01A0B849AF8328B0CDAFF65EC6"><enum>(F)</enum><text></text> 
<clause id="HA7CE9F2C6EBB487F85CFCBF0EE835F20" display-inline="yes-display-inline"><enum>(i)</enum><text>conducts criminal background checks of all camp employees for convictions under Federal and State laws; </text></clause> 
<clause id="H08C091BE12A24F88ADE8689F81759BB0" indent="subparagraph"><enum>(ii)</enum><text>maintains a record of such checks for at least 6 months after the date of termination of such an employee’s employment; and </text></clause> 
<clause id="HA30647AFCC9F4FA7A8672974009B96D2" indent="subparagraph"><enum>(iii)</enum><text>makes such records available to the Secretary upon the request of the Secretary; and</text></clause></subparagraph> 
<subparagraph id="HA79CEA52930C4E6EA7BB8FAABC28D43"><enum>(G)</enum><text>maintains a ratio of at least 1 lifeguard for every 30 camper swimmers.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H216B7DAA8DA34CC78C265F5B67DDD000"><enum>3.</enum><header>Enforcement by Secretary of Labor</header> 
<subsection id="HE59ADBD653DF474EBC08183F893BBBBA"><enum>(a)</enum><header>In general</header><text>The Secretary of Labor shall monitor and enforce compliance of organized camps subject to section 13(a)(18) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(a)(18)</external-xref>). In monitoring and enforcing such compliance, the Secretary shall—</text> 
<paragraph id="H0A798B0AFCD34917BC18E3883DBBF9B3"><enum>(1)</enum><text>implement a system for the routine reporting of fatalities and serious injuries or illnesses;</text></paragraph> 
<paragraph id="H9D99E7A247704075A781C39E6E6E4EB4"><enum>(2)</enum><text>implement procedures for conducting inspection and verifying information provided to the Secretary by such camps;</text></paragraph> 
<paragraph id="HAC01E6FB9B68492DA8D352F4854D5EEE"><enum>(3)</enum><text>investigate complaints received regarding such camps;</text></paragraph> 
<paragraph id="H8AAAA6B7C02F4D619994D1E93C49721C"><enum>(4)</enum><text>require appropriate training, including knowledge of outdoor camping, for camp inspectors; and</text></paragraph> 
<paragraph id="H7DEC16D69B704D748E9D3576F9DD616D"><enum>(5)</enum><text>compile statistics based on the information in the reports required to be submitted by such camps under section 13(a)(18)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(a)(18)(C)</external-xref>); and</text></paragraph> 
<paragraph id="H217D68733F42490F887CD6A1BA3CFB58"><enum>(6)</enum><text>based at least in part on the statistics compiled under subparagraph (C), determine the areas in which additional safety standards are necessary and prescribe appropriate regulations.</text></paragraph></subsection> 
<subsection id="H012EE8D74CC24E6D944CF5C77EE8FFA2"><enum>(b)</enum><header>Investigative authority</header><text>In monitoring and enforcing compliance under subsection (a), the Secretary of Labor may—</text> 
<paragraph id="HFAE06ECCA41D4A59BAD9410989BEB2B"><enum>(1)</enum><text>enter and inspect such a camp and its records, question the employees of such camp, and investigate facts, conditions, practices, or other matters, to the extent the Secretary deems necessary or appropriate; and</text></paragraph> 
<paragraph id="H4E785CF4CF8C434798595300D34B00C5"><enum>(2)</enum><text>administer oaths and examine witnesses under oath, issue subpoenas, and compel the attendance of witnesses and other relevant records.</text></paragraph></subsection></section> 
<section id="H28BD052BFA874C438B90BF58F217BDD6"><enum>4.</enum><header>Effect on State law</header> 
<subsection id="HC0B7545EF85B4DD186A900CD5D9F3574"><enum>(a)</enum><header>Equal or greater protection under State law</header><text>Section 13(a)(18) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(a)(18)</external-xref>) preempts a State’s laws regarding camp safety, unless the Secretary of Labor determines that such State’s laws provide substantially the same, or greater, protection for campers as such section, but such State’s laws are only preempted to the extent that the Secretary determines that they provide lesser protection for campers than such section.</text></subsection> 
<subsection id="HEF4A721D6216469B8CAA40D98D7C7655"><enum>(b)</enum><header>Judicial review of determination by Secretary</header><text>A State aggrieved by a determination under subsection (a) may bring an action in an appropriate United States district court for review of such determination.</text></subsection> 
<subsection id="HF64EF03E23FA4CEF8DC5BECA1150D74D"><enum>(c)</enum><header>Effect of compliance with equivalent State law</header><text>A person that complies with a State law which the Secretary of Labor has determined under subsection (a) provides substantially the same, or greater, protection for campers as section 13(a)(18) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(a)(18)</external-xref>) shall be deemed to have complied with the requirements of such section.</text></subsection></section>
