<official-title>To amend title 38, United States Code, to enhance the authority of the Department of Veterans Affairs to recover from third parties costs of medical care furnished to veterans and other persons by the Department.</official-title>

<section section-type="section-one" id="H63384BB3C0BF4799B1FFBACD1C756110" display-inline="no-display-inline"><enum>1.</enum><header>Recovery by the Department of Veterans Affairs of costs of certain health care services</header> 
<subsection id="HF5191710D4064AC0A51940A7D35B3C51"><enum>(a)</enum><header>Scope of recovery authority</header><text>Subsection (i) of <external-xref legal-doc="usc" parsable-cite="usc/38/1729">section 1729</external-xref> of title 38, United States Code, is amended—</text> 
<paragraph id="H4D97F0637C7E41CD94CB5DDF1E91CF"><enum>(1)</enum><text>in paragraph (1)(B), by striking clause (i) and redesignating clauses (ii), (iii), and (iv) as clauses (i), (ii), and (iii), respectively; and</text></paragraph> 
<paragraph id="H0745D142A1C94AAEB5013EB01F0755B4"><enum>(2)</enum><text>in paragraph (3)—</text> 
<subparagraph id="H99FEB4AA1A0141D5AD58D0A78BAB771B"><enum>(A)</enum><text>by redesignating subparagraphs (A) through (D) as subparagraphs (B) through (E), respectively; and</text></subparagraph> 
<subparagraph id="H1385B51D0F124FF1B152109C673FCE13"><enum>(B)</enum><text>by inserting before subparagraph (B), as so redesignated, the following new subparagraph (A):</text>

<subparagraph id="HBF6AA7EBF88241F29387117B52084816"><enum>(A)</enum><text>a department or agency of the United States other than the Department;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="HFA2DA200441A4FE0AD5C8402FAD83DB8"><enum>(b)</enum><header>Conforming amendments</header><text>Subsection (a)(1) of such section is amended—</text> 
<paragraph id="HCCC2C964278442BB8BE5D82977C2FB9B"><enum>(1)</enum><text>by inserting <quote>(A)</quote> after <quote>if</quote>;</text></paragraph> 
<paragraph id="HDAAE280CF35F45CC9514F951A84E2FAC"><enum>(2)</enum><text>by inserting <quote>, or (B) the person had incurred a legal liability to pay for such care or services</quote> before the period; and</text></paragraph> 
<paragraph id="H1D86013DD1B745C9876BCD2F8EEC3C3F"><enum>(3)</enum><text>by inserting at the end the following new sentence: <quote>The preceding sentence applies notwithstanding any other provision of law, other than a law enacted after the date of the enactment of this sentence that is expressly stated as an exception or limitation to this section.</quote>.</text></paragraph></subsection> 
<subsection id="H95020D4F85CD46F69B50B800CB10C88D"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply only with respect to care and services furnished under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, on or after the date of the enactment of this Act.</text></subsection></section>
