<section id="H64D48F7A0E8F41A59740F9AD9306AFC3" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Idaho Land Enhancement Act</short-title></quote>.</text></section> 
<section id="H0395C3BB3DD84FABB43D76E133CE2085"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H7985B0611C8444A68C6455C916B27225"><enum>(1)</enum><header>Agreement</header><text>The term <term>Agreement</term> means the agreement executed in 2005, entitled <quote>Agreement to Initiate, Boise Foothills—Northern Idaho Land Exchange</quote>, and entered into by—</text> 
<subparagraph id="H1D2FACACDF074B67B97B43EE4DE67FA0"><enum>(A)</enum><text>the Bureau of Land Management;</text></subparagraph> 
<subparagraph id="H3F73E47AB3E543AF886492D7C1D3E1AE"><enum>(B)</enum><text>the Forest Service;</text></subparagraph> 
<subparagraph id="HD67A2FE75E004EA1A3EAF28FAEFC17F2"><enum>(C)</enum><text>the State; and</text></subparagraph> 
<subparagraph id="HE94CA13FADE9456C9EB81D91313F54FA"><enum>(D)</enum><text>the City.</text></subparagraph></paragraph> 
<paragraph id="HCB5403EA167F40D0B5769583A85CA8A4"><enum>(2)</enum><header>Bureau of land management land</header><text>The term <term>Bureau of Land Management land</term> means the approximately 605 acres of land administered by the Bureau of Land Management (including all appurtenances to the land) that is proposed to be acquired by the State, as depicted in exhibit A2 of the Agreement.</text></paragraph> 
<paragraph id="HD43CAE97312446E385C11C7C565C01B5"><enum>(3)</enum><header>Board</header><text>The term <term>Board</term> means the Idaho State Board of Land Commissioners.</text></paragraph> 
<paragraph id="H70880D612879425AA57483AA9ECFE7D"><enum>(4)</enum><header>City</header><text>The term <term>city</term> means the city of Boise, Idaho.</text></paragraph> 
<paragraph id="H7C60FCF8689A412CAD92829EBC36BCF"><enum>(5)</enum><header>Federal land</header><text>The term <term>Federal land</term> means the Bureau of Land Management land and the National Forest System land.</text></paragraph> 
<paragraph id="H23949C43A339477AB1387383666644CD"><enum>(6)</enum><header>National forest system land</header><text>The term <term>National Forest System land</term> means the approximately 7,220 acres of land (including all appurtenances to the land) that is—</text> 
<subparagraph id="HEDFA2F2AECB44AE4BB386B7667B09BAC"><enum>(A)</enum><text>administered by the Secretary of Agriculture in the Idaho Panhandle National Forests and the Clearwater National Forest;</text></subparagraph> 
<subparagraph id="HA00236B126E946F397946C9EB0F0D7E8"><enum>(B)</enum><text>proposed to be acquired by the State; and</text></subparagraph> 
<subparagraph id="HD05931EDC63743DD9DFD37A0547E1EAB"><enum>(C)</enum><text>depicted in exhibit A2 of the Agreement.</text></subparagraph></paragraph> 
<paragraph id="HC452108169CD4D309986CA9A9E5BA80"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph> 
<paragraph id="HBD5B4E41A60E4F80B72611C5DD3574D"><enum>(8)</enum><header>State</header><text>The term <term>State</term> means the State of Idaho, Department of Lands.</text></paragraph> 
<paragraph id="H7445D8523FBB42FFB88C919CEC10E100"><enum>(9)</enum><header>State land</header><text>The term <term>State land</term> means the approximately 11,085 acres of land (including all appurtenances to the land) administered by the State that are proposed to be acquired by the United States, as depicted in exhibit A1 of the Agreement.</text></paragraph></section> 
<section id="H3360F7D6266D4C2D8333BB4BD3F1F255"><enum>3.</enum><header>Land exchange</header> 
<subsection id="H4F55989BF49E407FA49586A6ECA044B2"><enum>(a)</enum><header>In general</header><text>In accordance with the Agreement and this Act, if the State offers to convey the State land to the United States, the Secretary and the Secretary of Agriculture shall—</text> 
<paragraph id="H3598CD6447294A808D617EFA27575200"><enum>(1)</enum><text>accept the offer; and</text></paragraph> 
<paragraph id="HC2AD3A5018B14C93A5FCB20C59587EC"><enum>(2)</enum><text>on receipt of title to the State land, simultaneously convey to the State the Federal land.</text></paragraph></subsection> 
<subsection id="H83D0FEAF5238439EB17E049488806103"><enum>(b)</enum><header>Additional agreements</header><text>The Secretary and the Secretary of Agriculture may enter into any additional agreements that the Secretary and the Secretary of Agriculture determine to be necessary or appropriate to supplement the Agreement, including agreements that—</text> 
<paragraph id="H5CFF344873834A9CB7057278B16EE41C"><enum>(1)</enum><text>provide legal descriptions of the Federal land and State land (including any interests in the Federal land and State land) to be exchanged under this Act;</text></paragraph> 
<paragraph id="HA19679DC1821456990FA5800DDB72051"><enum>(2)</enum><text>identify all reserved and outstanding interests in the Federal land and State land;</text></paragraph> 
<paragraph id="HE0731A880B2F4D5DB700D83CA445FF00"><enum>(3)</enum><text>stipulate any cash equalization payments required; and</text></paragraph> 
<paragraph id="HD7B446CB546C4D76A13F487FC3AD3300"><enum>(4)</enum><text>specify any other terms and conditions that are necessary to complete the land exchange.</text></paragraph></subsection> 
<subsection id="H1EE40E1A294E4362987844F8A69431E"><enum>(c)</enum><header>Valid existing rights</header><text>The conveyance of the Federal land and State land shall be subject to—</text> 
<paragraph id="H9381615437F547729CE99D9E106508A5"><enum>(1)</enum><text>all valid existing rights; and</text></paragraph> 
<paragraph id="H28F7A23D42A94814A71FF8C98D2DD8F"><enum>(2)</enum><text>any other reservations, terms, and conditions agreed to by the Secretary, the Secretary of Agriculture, and the Board.</text></paragraph></subsection> 
<subsection id="HBE7F6A3BD2D0412F9F2403D5C1FE8300"><enum>(d)</enum><header>Equal value exchange</header> 
<paragraph id="H94E5A89C02574B87843834C667B68865"><enum>(1)</enum><header>In general</header><text>The value of the Federal land and State land to be exchanged under this Act—</text> 
<subparagraph id="HFDE87C66BFCE429289673CC97428C009"><enum>(A)</enum><text>shall be equal; or</text></subparagraph> 
<subparagraph id="HD5D930D8A3EF464C9EBDB8F0E3D9D7B0"><enum>(B)</enum><text>shall be made equal in accordance with subsection (e).</text></subparagraph></paragraph> 
<paragraph id="HA3CED65B3BEA488483B5FED26D26614F"><enum>(2)</enum><header>Appraisals</header> 
<subparagraph id="H179BBC71FECB42A29478AA65A6DC2E8"><enum>(A)</enum><header>In general</header><text>The value of the Federal land and State land shall be determined in accordance with appraisals conducted in accordance with—</text> 
<clause id="HC227E9AD6C29437FB719B3E962D5CA00"><enum>(i)</enum><text>the Uniform Appraisal Standards for Federal Land Acquisitions; and</text></clause> 
<clause id="HE07F3C94C3964D65AEAE7D4E2C067389"><enum>(ii)</enum><text>any appraisal instructions of the Secretary and the Secretary of Agriculture,</text></clause></subparagraph> 
<subparagraph id="H0E4C235ABBE04153ADB34947AE6E3CD"><enum>(B)</enum><header>Approval</header><text>Any appraisal conducted under subparagraph (A) shall be reviewed and approved by—</text> 
<clause id="H49FA23B592BB4430B5B07740FFD70555"><enum>(i)</enum><text>the Secretary and the Secretary of Agriculture; or</text></clause> 
<clause id="H4AA803979B6841F291E3624ECD7EBB1C"><enum>(ii)</enum><text>an interdepartmental appraisal review team established jointly by the Secretary and the Secretary of Agriculture.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H6B5F86AAE33B408185B26D6D8B78A3A7"><enum>(e)</enum><header>Cash equalization</header> 
<paragraph id="HC51B9A18255445389412BD436DFD6500"><enum>(1)</enum><header>In general</header><text>If the value of the Federal land and State land is not equal, the value may be equalized by the payment of cash to the United States or to the State, as appropriate, in accordance with section 206(b) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716(b)</external-xref>).</text></paragraph> 
<paragraph id="H3A0402F15789420EABDCCFD924AC00E8"><enum>(2)</enum><header>Disposition and use of proceeds</header> 
<subparagraph id="HD9319E1977714E7E8F3CE6AB70781CF5"><enum>(A)</enum><header>Disposition of proceeds</header><text>Any cash equalization payments received by the United States under paragraph (1) shall be deposited in the fund established under <external-xref legal-doc="public-law" parsable-cite="pl/90/171">Public Law 90–171</external-xref> (commonly known as the <quote>Sisk Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/484a">16 U.S.C. 484a</external-xref>).</text></subparagraph> 
<subparagraph id="HF3591A8B65C04EE79CC3A888CC502E3"><enum>(B)</enum><header>Use of proceeds</header><text>Amounts deposited under paragraph (2) shall be available to the Secretary of Agriculture, without further appropriation and until expended, for the acquisition of land and interests in land for addition to the National Forest System in the State.</text></subparagraph></paragraph></subsection> 
<subsection id="H931C58839AD74ACB8FDA1034019DEFA"><enum>(f)</enum><header>Rights-of-way</header><text>As specified in the Agreement—</text> 
<paragraph id="H830A88F0E57A4E10B3C5AD68854CF8"><enum>(1)</enum><text>the Secretary of Agriculture, under the authority of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>), shall convey to the State any easements or other rights-of-way to National Forest System land that are appropriate to provide access to the Federal land acquired by the State under this Act; and</text></paragraph> 
<paragraph id="H331B8142925A4BCB8654F0CFB75683C2"><enum>(2)</enum><text>the State shall convey to the United States any easements or other rights-of-way to land owned by the State that are agreed to by the Secretary of Agriculture and the State.</text></paragraph></subsection> 
<subsection id="HBEEB2BA10B634571838983797FB0A945"><enum>(g)</enum><header>Costs</header><text>The City, either directly or through a collection agreement with the Secretary and the Secretary of Agriculture, shall pay the administrative costs associated with the conveyance of the Federal land and State land, including the costs of any field inspections, environmental analyses, appraisals, title examinations, and deed and patent preparations.</text></subsection></section> 
<section id="HD9D3D65DA53C4DB59EE20071FAB97C79"><enum>4.</enum><header>Management of Federal land</header> 
<subsection id="H13AA990B358548D89200B82E768EE119"><enum>(a)</enum><header>Transfer of administrative jurisdiction</header> 
<paragraph id="HD3AFFC97896447CD8E93AF0091D8B5A5"><enum>(1)</enum><header>In general</header><text>There is transferred from the Secretary to the Secretary of Agriculture administrative jurisdiction over the land described in paragraph (2).</text></paragraph> 
<paragraph id="H9ED597E113EB4C718C83214587F0E3BD"><enum>(2)</enum><header>Description of land</header><text>The land referred to in paragraph (1) is the approximately 2,111 acres of Bureau of Land Management land located in Shoshone County, Idaho, as generally depicted in exhibit A3 of the Agreement.</text></paragraph> 
<paragraph id="H788201146567451FA693B7F3F6C12C2B"><enum>(3)</enum><header>Management</header> 
<subparagraph id="H275752B7A4F74A4D8C453406D5F39782"><enum>(A)</enum><header>In general</header><text>On transfer of administrative jurisdiction over the land to the Secretary of Agriculture under paragraph (1), the land shall be managed by the Secretary of Agriculture in accordance with the laws (including regulations) applicable to the National Forest System.</text></subparagraph> 
<subparagraph id="H28ACB63BEBDF48139E9C87F61CDDCA00"><enum>(B)</enum><header>Wilderness study areas</header><text>Any land designated as a Wilderness Study Area that is transferred to the Secretary of Agriculture under paragraph (1) shall be managed in a manner that preserves the suitability of land for designation as wilderness until Congress determines otherwise.</text></subparagraph></paragraph></subsection> 
<subsection id="HFBB9CA3F171E49369FC998F8491D8BD2"><enum>(b)</enum><header>Additions to the national forest system</header><text>The Secretary of Agriculture shall administer any State land conveyed to the United States under this Act for administration by the Secretary of Agriculture in accordance with—</text> 
<paragraph id="H1589260174E949D590ECBB6E696C5967"><enum>(1)</enum><text>the Act of March 1, 1911 (commonly known as the <quote>Weeks Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/480">16 U.S.C. 480 et seq.</external-xref>); and</text></paragraph> 
<paragraph id="H234BAFB3EA2944F78698597166F426E4"><enum>(2)</enum><text>any laws (including regulations) applicable to the National Forest System.</text></paragraph></subsection> 
<subsection id="HCD37449854524C9F88C100EA04CE00AC"><enum>(c)</enum><header>Land To be managed by the secretary</header><text>The Secretary shall administer any State land conveyed to the United States under this Act for administration by the Secretary as acquired land in accordance with—</text> 
<paragraph id="HDCE1A96C0C8244A38BF945F387FF07CA"><enum>(1)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); and</text></paragraph> 
<paragraph id="H106D8EED00474000910000379EFF71BA"><enum>(2)</enum><text>other applicable laws.</text></paragraph></subsection> 
<subsection id="H8780440D8993448FA9E7A63F00C112BE"><enum>(d)</enum><header>Land and resource management plans</header> 
<paragraph id="HF5222F0866414A9CA4D1FB92DC74D365"><enum>(1)</enum><header>In general</header><text>Acquisition by the United States of the State land under this Act shall not require a revision or amendment to the applicable land and resource management plan of the Forest Service or the Bureau of Land Management.</text></paragraph> 
<paragraph id="H4566AF84DFA7430FA5A27F495448CAA3"><enum>(2)</enum><header>Renewal</header><text>When a land and resource management plan of the Forest Service or the Bureau of Land Management, as appropriate, is renewed, the plan shall take into account the State land acquired under this Act.</text></paragraph> 
<paragraph id="HC54C16BB52CB487F94C0A67620500078"><enum>(3)</enum><header>Management</header><text>Pending completion of the land and resource management plan renewal process under paragraph (2), the Secretary and the Secretary of Agriculture shall manage the acquired State land in accordance with the standards and guidelines in the applicable land and resource management plans for adjacent land managed by the Secretary and the Secretary of Agriculture.</text></paragraph></subsection> 
<subsection id="HFD5407578A9642168E7202E5A5BD88B0"><enum>(e)</enum><header>National forest boundaries</header><text>For purposes of section 7 of the Land and Water Conservation Fund Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/16/460l-9">16 U.S.C. 460l–9</external-xref>), the boundaries of the Idaho Panhandle National Forest and Clearwater National Forest, as modified by the exchange authorized by this Act, shall be considered to be the boundaries of the Idaho Panhandle National Forest and Clearwater National Forest as of January 1, 1965.</text></subsection></section> 
<section id="H57FDD43AEF5F4E0C9784665714A5B0E5"><enum>5.</enum><header>Miscellaneous provisions</header> 
<subsection id="H05BEC82ACBE344F0BC86DF93BAE0C62"><enum>(a)</enum><header>Legal descriptions</header><text>The Secretary, the Secretary of Agriculture, and the Board may modify the descriptions of land specified in the Agreement to—</text> 
<paragraph id="H3171C37EC54E4D7095F3B44F82F2B7A"><enum>(1)</enum><text>correct errors;</text></paragraph> 
<paragraph id="H29EED6B121FB46BB0089E9EF99F8F1D"><enum>(2)</enum><text>make minor adjustments to the parcels based on a survey or other means; or</text></paragraph> 
<paragraph id="HB7967FB4462144D0ACAACE2B7878B8E"><enum>(3)</enum><text>reconfigure the parcels to facilitate the land exchange.</text></paragraph></subsection> 
<subsection id="H0B30974A37E44E380043080004160007"><enum>(b)</enum><header>Maps</header><text>If there is a discrepancy between a map, acreage estimate, and written legal description of the Federal land or State land, the written legal description shall prevail.</text></subsection> 
<subsection id="H4E625FAABEF943499CF18FDC07AD8CDF"><enum>(c)</enum><header>Revocation of orders</header><text>Subject to valid existing rights, any public land orders withdrawing any of the Federal land from appropriation or disposal under the public land laws are revoked to the extent necessary to permit disposal of the Federal land.</text></subsection> 
<subsection id="HB350783235BC41D9A1348700F7A759DD"><enum>(d)</enum><header>Withdrawals</header> 
<paragraph id="H6446E33BCEC1417797E951941591F86E"><enum>(1)</enum><header>Federal land</header><text>Subject to valid existing rights, pending completion of the land exchange, the Federal land is withdrawn from—</text> 
<subparagraph id="H669FF65482B04AA59278EF22BFD894A1"><enum>(A)</enum><text>all forms of location, entry, and patent under the mining and public land laws; and</text></subparagraph> 
<subparagraph id="HF62DF3F170E5492FAEFB434D5989CBC0"><enum>(B)</enum><text>disposition under the mineral leasing laws and the Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1001">30 U.S.C. 1001 et seq.</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="H5961DF89E1634F16B859084F4300DEFA"><enum>(2)</enum><header>State land</header><text>Subject to valid existing rights, the land transferred to the Secretary of Agriculture under section 4(a) and, on acquisition by the United States, the State land, are withdrawn from—</text> 
<subparagraph id="HADA8304F415B47ABBE4D93F0FDBD577"><enum>(A)</enum><text>all forms of location, entry, and patent under the mining and public land laws; and</text></subparagraph> 
<subparagraph id="H75DEFA259EE240BE9C6B6BAE37F27B5D"><enum>(B)</enum><text>disposition under the mineral leasing laws and the Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1001">30 U.S.C. 1001 et seq.</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="H1C728B5C8A64423D8183286D43E7B5AB"><enum>(3)</enum><header>Effect</header><text>Nothing in this section precludes the Secretary or the Secretary of Agriculture from using common varieties of mineral materials for construction and maintenance of Federal roads and facilities on the State land acquired under this Act and any adjacent Federal land.</text></paragraph></subsection> 
<subsection id="HDE393AE0376E413783F753D4A762742C"><enum>(e)</enum><header>Congressional finding on need for additional analysis</header><text>Congress finds that—</text> 
<paragraph id="HD28F288483C04A2FADDDFBBCB0EA6EB9"><enum>(1)</enum><text>the Forest Service and the Bureau of Land Management have conducted adequate analyses and reviews of the environmental impacts of the exchange authorized under section 3(a); and</text></paragraph> 
<paragraph id="HE846CCABE4C5403A871D8ECBCA6C47C8"><enum>(2)</enum><text>no further administrative or environmental analyses or examination shall be required to carry out any activities authorized under this Act.</text></paragraph></subsection></section>
