<section section-type="section-one" id="H6B66A41A97164BFEA4657F54C4303487" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Self-Authorized Secret Searches Act</short-title></quote>.</text></section> 
<section id="HA8541E134C574B48A300D2E188171260"><enum>2.</enum><header>Procedural protections for national security letters</header> 
<subsection id="H7B4A7C5E27DF4D82822CED9BD20082D7"><enum>(a)</enum><header>Standard</header> 
<paragraph id="H7A383BCDA5D34438A8EE9180F200C67C"><enum>(1)</enum><header>Title 18</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2709">Section 2709(b)</external-xref> of title 18, United States Code, is amended—</text> 
<subparagraph id="H04D4133E06EE4E51AE6263EC3779C4BA"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>and there are specific and articulable facts giving reason to believe that the name, address, length of service, and toll billing records sought pertain to a foreign power or agent of a foreign power</quote> after <quote>clandestine intelligence activities</quote>; and</text></subparagraph> 
<subparagraph id="H42F9AF9CDDEA47D3B8EA36C73EA2B64"><enum>(B)</enum><text>in paragraph (2), by striking <quote>, provided that such an investigation</quote> and all that follows and inserting</text> 
<quoted-block display-inline="yes-display-inline" id="H3D748754B84D46F98215F167A2692025"><text display-inline="yes-display-inline">and there are specific and articulable facts giving reason to believe that communications facilities registered in the name of the person or entity have been used, through the services of such provider, in communication with—</text> 
<subparagraph id="HF5890A3903A1449EB018851409237500"><enum>(A)</enum><text>an individual who is engaging or has engaged in international terrorism or clandestine intelligence activities that involve or may involve a violation of the criminal statutes of the United States; or</text></subparagraph> 
<subparagraph id="H55E1031A774C4DEC88C856499B42D574"><enum>(B)</enum><text>a foreign power or an agent of a foreign power,</text><continuation-text continuation-text-level="paragraph">subject to the requirement that such investigation of a United States person may not be conducted solely upon the basis of activities protected by the first amendment to the Constitution of the United States.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H6BD568FA86B647549292C5EFC84C5097"><enum>(2)</enum><header>Financial institutions</header><text>Section 1114(a)(5)(A) of the <act-name parsable-cite="RFPA78">Right to Financial Privacy Act of 1978</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/3414">12 U.S.C. 3414(a)(5)(A)</external-xref>) is amended by inserting <quote>and there are specific and articulable facts giving reason to believe that the records sought pertain to a foreign power or agent of a foreign power</quote> after <quote>clandestine intelligence activities</quote>.</text></paragraph> 
<paragraph id="HC519EC2E72E54C76924B5BAD4100FF25"><enum>(3)</enum><header>Consumer reporting agency</header> 
<subparagraph id="HDAFB6024A74B451EBFC425C915D2D120"><enum>(A)</enum><header>In general</header><text>Section 626 of the <act-name parsable-cite="FCRA">Fair Credit Reporting Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/1681u">15 U.S.C. 1681u</external-xref>) is amended—</text> 
<clause id="H06A3990B3A0C438E8C7C6BD3532D8400"><enum>(i)</enum><text>in the second sentence of subsection (a), by inserting <quote>and there are specific and articulable facts giving reason to believe that the information sought pertains to a foreign power or agent of a foreign power</quote> after <quote>clandestine intelligence activities</quote>;</text></clause> 
<clause id="H3FC1248F0CC944E8B2681194A6BF7496"><enum>(ii)</enum><text>in the second sentence of subsection (b), by inserting <quote>and there are specific and articulable facts giving reason to believe that the consumer is a foreign power or an agent of a foreign power or has been, or is about to be, in contact with a foreign power or an agent of a foreign power</quote> after <quote>clandestine intelligence activities</quote>; and</text></clause> 
<clause id="H9777E514338A42819E1FADCECE2B8B9C"><enum>(iii)</enum><text>in the first sentence of subsection (c), by inserting <quote>and there are specific and articulable facts giving reason to believe that the consumer report sought pertains to a foreign power or agent of a foreign power</quote> after <quote>clandestine intelligence activities</quote>.</text></clause></subparagraph> 
<subparagraph id="H143CB94EF57E4422A0FC91C5BB637EC7"><enum>(B)</enum><header>Government agencies</header><text>Section 627(a) of the <act-name parsable-cite="FCRA">Fair Credit Reporting Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/1681v">15 U.S.C. 1681v(a)</external-xref>) is amended by inserting <quote>and there are specific and articulable facts giving reason to believe that the information sought pertains to a foreign power or agent of a foreign power</quote> after <quote>necessary for the agency’s conduct or such investigation, activity or analysis</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H74B2526EFFA74860B3F5652D5E4D0774"><enum>(b)</enum><header>Requirements</header> 
<paragraph id="H1166E6322B9A4E818485E2E4E9D59C8F"><enum>(1)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/2709">Section 2709(b)</external-xref> of title 18, United States Code, as amended by subsection (a)(1) is amended—</text> 
<subparagraph id="HA804C7798FB14ED6BC7F00E8BE523BD6"><enum>(A)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively;</text></subparagraph> 
<subparagraph id="H83C7110F6BAE402B82AEE384124DD011"><enum>(B)</enum><text>by striking <quote>The Director of the Federal Bureau of Investigation</quote> and inserting the following:</text>

<paragraph id="HECFD47FE86034364BEF8ADD4D7DB0238"><enum>(1)</enum><header>In general</header><text>The Director of the Federal Bureau of Investigation</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H2D27810682DC45C78562DCDB170079A9"><enum>(C)</enum><text>by adding after paragraph (1), as amended by subparagraph (B), the following new paragraph:</text>

<paragraph indent="up1" id="HB112817BBC4B45D88E1E1D50EEFEFE"><enum>(2)</enum><header>Limitation</header><text>A request under this subsection shall not—</text> 
<subparagraph id="HED4A0401339945969B75182465C58900"><enum>(A)</enum><text>contain any requirement which would be held to be unreasonable if contained in a subpoena duces tecum issued by a court of the United States in aid of a grand jury investigation of espionage or international terrorism; or</text></subparagraph> 
<subparagraph id="H2A83EBBB992742C5A39BD0D3F940EAA5"><enum>(B)</enum><text>require the production of any documentary evidence which would be privileged from disclosure if demanded by a subpoena duces tecum issued by a court of the United States in aid of a grand jury investigation of espionage or international terrorism.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="H7052518F80E54D99A2982136E1FA5308"><enum>(3)</enum><header>Notice</header><text>A request under this subsection shall provide notice of the recipient’s right to file a petition under subsection (e) and explain the procedures for doing so.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HCED5AC40F0CB4F80BE95B7C4C913001F"><enum>(2)</enum><header>Request for information from financial institutions</header><text>Section 1114(a)(5)(A) of the <act-name parsable-cite="RFPA78">Right to Financial Privacy Act of 1978</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/3414">12 U.S.C. 3414(a)(5)(A)</external-xref>), as amended by subsection (a)(2), is amended—</text> 
<subparagraph id="HF0FD0F76D1D74D358600EC3BA9754BC"><enum>(A)</enum><text>by striking <quote>(5)(A) Financial institutions</quote> and inserting </text> 
<quoted-block style="OLC" id="H53714F4BFBAA4B30AC15829E0289995C" display-inline="yes-display-inline"><text display-inline="yes-display-inline">(5) <header-in-text level="paragraph" style="OLC">Request for financial records</header-in-text>.—</text> 
<subparagraph id="H57B50133439C412CACB6D4A6ABBC26E9"><enum>(A)</enum><header>Compliance</header> 
<clause id="HDA05F9795BBC48759DDAB96FBB5CC558"><enum>(i)</enum><header>In general</header><text>Financial institutions</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H5F63FE218B9447DF00AB8C5F606B3E22"><enum>(B)</enum><text>by inserting after clause (i) (as so redesignated by subparagraph (A) of this paragraph) the following new clauses:</text>

<clause id="HD651E69494C3458DA02FC55742B99363"><enum>(ii)</enum><header>Limitation</header><text>A request under this subsection shall not—</text> 
<subclause id="H3D98452E27BD4F3AB8314C9C4801EA9"><enum>(I)</enum><text>contain any requirement which would be held to be unreasonable if contained in a subpoena duces tecum issued by a court of the United States in aid of a grand jury investigation of espionage or international terrorism; or</text></subclause> 
<subclause id="HFE6C1C3047EC4B1DA0A211BAF8AB9734"><enum>(II)</enum><text>require the production of any documentary evidence which would be privileged from disclosure if demanded by a subpoena duces tecum issued by a court of the United States in aid of a grand jury investigation of espionage or international terrorism.</text></subclause></clause> 
<clause id="HDC9E213572724F60A1FF52E0F6DF97CE"><enum>(iii)</enum><header>Notice of rights</header><text>A request under this subsection shall provide notice of the recipient’s right to file a petition under subparagraph (E) of this paragraph and explain the procedures for doing so.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HFF7B2A989B2B4B6F9FB7D4C7B3A9EB58"><enum>(3)</enum><header>Request for information from consumer reporting agencies</header><text>Section 626 of the <act-name parsable-cite="FCRA">Fair Credit Reporting Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/1681u">15 U.S.C. 1681u</external-xref>) is amended by adding at the end the following new subsection:</text>

<paragraph id="H5BD37C3687184ECFB933ECD9D87DA263"><enum>(1)</enum><header>In general</header><text>A request under this section shall not—</text> 
<subparagraph id="HF84F111347534877A23463454C006652"><enum>(A)</enum><text>contain any requirement which would be held to be unreasonable if contained in a subpoena duces tecum issued by a court of the United States in aid of a grand jury investigation of espionage or international terrorism; or</text></subparagraph> 
<subparagraph id="HE3D0C49F83CE4B21898661CA00049D1E"><enum>(B)</enum><text>require the production of any documentary evidence which would be privileged from disclosure if demanded by a subpoena duces tecum issued by a court of the United States in aid of a grand jury investigation of espionage or international terrorism.</text></subparagraph></paragraph> 
<paragraph id="HD9F1D161214E45999526E658A2B5755E"><enum>(2)</enum><header>Notice of rights</header><text>A request under this section shall provide notice of the recipient’s right to file a petition under subsection (o) and explain the procedures for doing so.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H31410FC0EAF141E99E2DE5C6A8E6CF0"><enum>(4)</enum><header>Request for information from consumer reporting agencies by governmental agencies</header><text>Section 627(b) of the <act-name parsable-cite="FCRA">Fair Credit Reporting Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/1681v">15 U.S.C. 1681v(b)</external-xref>) is amended—</text> 
<subparagraph id="H4D6DEDE8961743CEAB59E30829B6944D"><enum>(A)</enum><text>by striking <quote><header-in-text level="subsection" style="OLC">Form of certification.—</header-in-text>The certification described</quote> and inserting ; and</text> 
<quoted-block style="OLC" id="HF84A653E6E4B4B5E00B7F19654D3995F" display-inline="yes-display-inline"><text display-inline="yes-display-inline"><header-in-text level="subsection" style="OLC">Form of certification.—</header-in-text></text>

<subparagraph id="H66DF5D7E76A8419287681CC111DB8BF6"><enum>(B)</enum><text>require the production of any documentary evidence which would be privileged from disclosure if demanded by a subpoena duces tecum issued by a court of the United States in aid of a grand jury investigation of espionage or international terrorism.</text></subparagraph></paragraph> 
<paragraph id="HD5EF3EFDA61545ECBAD58391A5009578"><enum>(3)</enum><header>Notice of rights</header><text>A request under this subsection must provide notice of the recipient’s right to file a petition under subsection (f) and explain the procedures for doing so.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="H00626564505C4854B356E9EEBFFACA00"><enum>(c)</enum><header>Nondisclosure</header> 
<paragraph id="HD21D0A956D2B4A7596E05BC5EAAF419B"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2709">Section 2709(c)</external-xref> of title 18, United States Code, is amended to read as follows:</text> 
<quoted-block id="HDCEF719746D34D068BD4134983409C40"> 
<subsection id="HDDB76A7BC9874AB8A612B5077B863569"><enum>(c)</enum><header>Prohibition of certain disclosure</header> 
<paragraph id="HC766B06EDD8E4BD10000005284BB7B36"><enum>(1)</enum><header>In general</header><text>No wire or electronic communication service provider, or officer, employee, or agent thereof, shall disclose to any person that the Federal Bureau of Investigation has sought or obtained access to information or records under this section for 90 days after receipt of such request from the Bureau.</text></paragraph> 
<paragraph id="H054E9B487E774912B7432642E2E98CFA"><enum>(2)</enum><header>Exception</header><text>A wire or electronic communication service provider, or officer, employee, or agent thereof, who receives an order under this subsection may disclose that the Federal Bureau of Investigation has sought or obtained access to information or records under this section to—</text> 
<subparagraph id="HE104694367BC42C998C76CFF006FB0E4"><enum>(A)</enum><text>those persons to whom disclosure is necessary in order to comply with an order under this section; or</text></subparagraph> 
<subparagraph id="H1CF13E69CB9040B9B42FBEEF7D4BB8FF"><enum>(B)</enum><text>an attorney in order to obtain legal advice regarding such order.</text></subparagraph></paragraph> 
<paragraph id="H65188278465A49DAB1C9199ED4C3DF9E"><enum>(3)</enum><header>Extension</header><text>The Director of the Federal Bureau of Investigation, or the Director’s designee in a position not lower than Deputy Assistant Director at Bureau headquarters or a Special Agent in Charge of a Bureau field office designated by the Director, may apply for an order prohibiting disclosure that the Federal Bureau of Investigation has sought or obtained access to information or records under this section for an additional 180 days.</text></paragraph> 
<paragraph id="H1016B5DD5EF745B2A1E6BB94297EEEA7"><enum>(4)</enum><header>Jurisdiction</header><text>An application for an order pursuant to this subsection shall be filed in the district court of the United States in any district within which the authorized investigation that is the basis for a request pursuant to this section is being conducted.</text></paragraph> 
<paragraph id="H4351CC6C7F7E4CCE9420C84CDD0809CF"><enum>(5)</enum><header>Application contents</header><text>An application for an order pursuant to this subsection must state specific and articulable facts giving the applicant reason to believe that disclosure that the Federal Bureau of Investigation has sought or obtained access to information or records under this section will result in—</text> 
<subparagraph id="H3B189221A6C7487395AE59E7DE9D1BF1"><enum>(A)</enum><text>endangering the life or physical safety of any person;</text></subparagraph> 
<subparagraph id="H3BB5A870B094453083F5BA62255B0116"><enum>(B)</enum><text>flight from prosecution;</text></subparagraph> 
<subparagraph id="H90861C1F39564F98BB05BECC0A4A298"><enum>(C)</enum><text>destruction of or tampering with evidence;</text></subparagraph> 
<subparagraph id="HE59EC100941D47380000768D0306F634"><enum>(D)</enum><text>intimidation of potential witnesses; or</text></subparagraph> 
<subparagraph id="H0E032B0C75B94F3194B105E8E07545E1"><enum>(E)</enum><text>otherwise seriously endangering the national security of the United States by alerting a target, a target’s associates, or the foreign power of which the target is an agent, of the Government’s interest in the target.</text></subparagraph></paragraph> 
<paragraph id="H3627D48C2E49425DA0A9725C5D7B238"><enum>(6)</enum><header>Standard</header><text>The court may issue an ex parte order pursuant to this subsection if the court determines there is reason to believe that disclosure that the Federal Bureau of Investigation has sought or obtained access to information or records under this section will result in—</text> 
<subparagraph id="HD62559265C524E419402BE60093F1645"><enum>(A)</enum><text>endangering the life or physical safety of any person;</text></subparagraph> 
<subparagraph id="H9D181088F90C4A4B859F3C69DB898F48"><enum>(B)</enum><text>flight from prosecution;</text></subparagraph> 
<subparagraph id="H6D50DE1C3F1D4F7C94AC48C99738DA"><enum>(C)</enum><text>destruction of or tampering with evidence;</text></subparagraph> 
<subparagraph id="HEA8D6125D7EB42E0A129B67122AAFE2F"><enum>(D)</enum><text>intimidation of potential witnesses; or</text></subparagraph> 
<subparagraph id="H6807FCB4317A4F2BB1841EBA676CDFD"><enum>(E)</enum><text>otherwise seriously endangering the national security of the United States by alerting a target, a target’s associates, or the foreign power of which the target is an agent, of the Government’s interest in the target.</text></subparagraph></paragraph> 
<paragraph id="H66FA6A5229DB4FD6AD5D95602DB544B4"><enum>(7)</enum><header>Renewal</header><text>An order under this subsection may be renewed for additional periods of up to 180 days upon another application meeting the requirements of paragraph (5) and a determination by the court that the circumstances described in paragraph (6) continue to exist.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HF5ABF0F81FBF4CB9881375E4296250E7"><enum>(2)</enum><header>Financial institutions</header><text>Section 1114(a)(5)(D) of the <act-name parsable-cite="RFPA78">Right to Financial Privacy Act of 1978</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/3414">12 U.S.C. 3414(a)(5)(D)</external-xref>) is amended to read as follows:</text>

<subparagraph id="H089B2C8010FA4971A7EFE65F008398D0"><enum>(D)</enum><header>Nondisclosure</header> 
<clause id="H2399AB45D8A2435B8879EA4D84BE4634"><enum>(i)</enum><header>In general</header><text>No financial institution, or officer, employee, or agent of such institution, shall disclose to any person that the Federal Bureau of Investigation has sought or obtained access to a customer’s or entity’s financial records under this paragraph for 90 days after receipt of such request from the Bureau.</text></clause> 
<clause id="HFA1CBFA9E7F64A5BB28D33899E6EACAD"><enum>(ii)</enum><header>Exception</header><text>A financial institution, or officer, employee, or agent of such institution, who receives an order under this subparagraph may disclose that the Federal Bureau of Investigation has sought or obtained access to a customer’s or entity’s financial records to—</text> 
<subclause id="H8E07B96E4E0A4A989BB1AEA9AF51056C"><enum>(I)</enum><text>those persons to whom disclosure is necessary in order to comply with a request under this subparagraph; or</text></subclause> 
<subclause id="HBFA526E5B2E14339B454CE64D0C7C422"><enum>(II)</enum><text>an attorney in order to obtain legal advice regarding such request.</text></subclause></clause> 
<clause id="HCA9169BEB1CE43EA00DCE2083CFC5530" display-inline="no-display-inline"><enum>(iii)</enum><header>Extension</header><text>The Director of the Federal Bureau of Investigation, or the Director’s designee in a position not lower than Deputy Assistant Director at Bureau headquarters or a Special Agent in Charge of a Bureau field office designated by the Director, may apply for an order prohibiting disclosure that the Federal Bureau of Investigation has sought or obtained access to a customer’s or entity’s financial records under this paragraph for an additional 180 days.</text></clause>

<clause id="H3BD9139192D84AAE9F9EE6DD70BF18EB"><enum>(v)</enum><header>Application contents</header><text>An application for an order pursuant to this subparagraph must state specific and articulable facts giving the applicant reason to believe that disclosure that the Federal Bureau of Investigation has sought or obtained access to a customer’s or entity’s financial records under this paragraph will result in—</text> 
<subclause id="H2724D79AB63144D3B3AC7D7F00064803"><enum>(I)</enum><text>endangering the life or physical safety of any person;</text></subclause>

<subclause id="HA5238CA324BB45538D7D86E00CECC1"><enum>(III)</enum><text>destruction of or tampering with evidence;</text></subclause>

<subclause id="H4005F486068E49119196E505E4E8BE46"><enum>(V)</enum><text>otherwise seriously endangering the national security of the United States by alerting a target, a target’s associates, or the foreign power of which the target is an agent, of the Government’s interest in the target.</text></subclause></clause> 
<clause id="HDE192AF30A0945B89C79D33801D8EB9F" display-inline="no-display-inline"><enum>(vi)</enum><header>Standard</header><text>The court may issue an ex parte order pursuant to this subparagraph if the court determines there is reason to believe that disclosure that the Federal Bureau of Investigation has sought or obtained access to a customer’s or entity’s financial records under this paragraph will result in—</text>

<clause id="H95C4F7F2195E4747925BDB29C7D6AC1C" display-inline="no-display-inline"><enum>(vii)</enum><header>Renewal</header><text>An order under this subparagraph may be renewed for additional periods of up to 180 days upon another application meeting the requirements of clause (v) and a determination by the court that the circumstances described in clause (vi) of this subparagraph continue to exist.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HB1766C1702684AB3AA39C450EF795E4F"><enum>(3)</enum><header>Consumer reporting agencies</header><text>Section 626(d) of the <act-name parsable-cite="FCRA">Fair Credit Reporting Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/1681u">15 U.S.C. 1681u(d)</external-xref>) is amended to read as follows:</text>

<paragraph id="H26A2B41CA5D145E6A7D1F7E39E389F70"><enum>(1)</enum><header>In general</header><text>No consumer reporting agency, or officer, employee, or agent of a consumer reporting agency, shall disclose to any person that the Federal Bureau of Investigation has sought or obtained the identity of financial institutions or a consumer report respecting any consumer under subsection (a), (b), or (c) for 90 days after receipt of a request or order under this section, and no consumer reporting agency, or officer, employee, or agent of a consumer reporting agency, shall include in any consumer report any information that would indicate that the Federal Bureau of Investigation has sought or obtained such information or a consumer report.</text></paragraph> 
<paragraph id="H66752B51632C41ECBCE672E7FE47C687"><enum>(2)</enum><header>Exception</header><text>A consumer reporting agency or officer, employee, or agent of a consumer reporting agency who receives an order under this subsection may disclose that the Federal Bureau of Investigation has sought or obtained the identity of financial institutions or a consumer report respecting any consumer to—</text> 
<subparagraph id="HE30B8D326E64466000B700302DE0076F"><enum>(A)</enum><text>those officers, employees, or agents of a consumer reporting agency necessary to fulfill the requirement to disclose information to the Federal Bureau of Investigation under this section; or</text></subparagraph> 
<subparagraph id="HAAA8FA3CF1EA4EB1B79D63C29E7DF060"><enum>(B)</enum><text>an attorney in order to obtain legal advice regarding such requirement.</text></subparagraph></paragraph> 
<paragraph id="H547C5F24C8D341A68725DC660893BBF4"><enum>(3)</enum><header>Extension</header><text>The Director of the Federal Bureau of Investigation, or the Director’s designee in a position not lower than Deputy Assistant Director at Bureau headquarters or a Special Agent in Charge of a Bureau field office designated by the Director, may apply for an order prohibiting disclosure that the Federal Bureau of Investigation has sought or obtained access to information or records under subsection (a), (b), or (c) for an additional 180 days.</text></paragraph>

<paragraph id="H6639961109AE4A1E96BD184B73E437A7"><enum>(4)</enum><header>Consumer reporting agencies reporting to governmental agencies</header><text>Section 627(c) of the <act-name parsable-cite="FCRA">Fair Credit Reporting Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/1681v">15 U.S.C. 1681v(c)</external-xref>) is amended to read as follows:</text>

<subparagraph id="H20185A494D32424D99334079959CCFE0"><enum>(A)</enum><text>those officers, employees, or agents of a consumer reporting agency necessary to fulfill the requirement to disclose information to the Federal Bureau of Investigation under this section; or</text></subparagraph> 
<subparagraph id="H7447266B93B14B2285FB30A401D78323"><enum>(B)</enum><text>an attorney in order to obtain legal advice regarding such requirement.</text></subparagraph></paragraph> 
<paragraph id="H0E43F35286D1448BBC737642294E3CE1"><enum>(3)</enum><header>Extension</header><text>The supervisory official or officer who signs a certification under subsection (b) may apply in any district court of the United States for an order prohibiting disclosure that a government agency has sought or obtained access to information under subsection (a) for an additional 180 days.</text></paragraph> 
<paragraph id="HBB707EEF22CF408D8C8D91E9E435DD86"><enum>(4)</enum><header>Application contents</header><text>An application for an order pursuant to this subsection must state specific and articulable facts giving the applicant reason to believe that disclosure that a government agency has sought or obtained access to information under subsection (a) will result in—</text>

Such petition shall specify each ground upon which the petitioner relies in seeking relief, and may be based upon any failure of the nondisclosure requirement to comply with the provisions of this section or upon any constitutional or other legal right or privilege of such person.</text></subparagraph> 
<subparagraph id="HBF7F4A0F99584ED981AC8BE8D7AA9BA6"><enum>(B)</enum><header>Standard</header><text>The court shall set aside the nondisclosure requirement unless the court determines that there is a reason to believe that disclosure of the request under subsection (b) will result in—</text>

<paragraph id="H451FB48EDA9345BA8614CBAC082C3E84"><enum>(3)</enum><header>Disclosure</header><text>In making determinations under this subsection, the court shall disclose to the petitioner, the counsel of the petitioner, or both, under the procedures and standards provided in the Classified Information Procedures Act (18 U.S.C. App.), portions of the application, order, or other related materials unless the court finds that such disclosure would not assist in determining any legal or factual issue pertinent to the case.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H16A7E79CBFB9456994DB01955F1B8955"><enum>(2)</enum><header>Financial record requests</header><text>Section 1114(a)(5) of the <act-name parsable-cite="RFPA78">Right to Financial Privacy Act of 1978</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/3414">12 U.S.C. 3414(a)(5)</external-xref>) is amended by inserting after subparagraph (D) (as amended by subsection (c)(2) of this section) the following new subparagraph:</text>

<subclause id="H3B97AC40A198453CBB7F5FD86CB9C5C7"><enum>(II)</enum><header>Standard</header><text>The court shall set aside the nondisclosure requirement unless the court determines that there is a reason to believe that disclosure of the request under subparagraph (A) will result in—</text>

<clause id="H71F3538E34B148078636C22660C555B"><enum>(iv)</enum><text>intimidation of potential witnesses; or</text></clause> 
<clause id="HB6E2A5126CCF489390B98BAFC02B3EA"><enum>(v)</enum><text>otherwise seriously endangering the national security of the United States by alerting a target, a target’s associates, or the foreign power of which the target is an agent, of the Government’s interest in the target.</text></clause></subparagraph></paragraph> 
<paragraph id="HB5ADB8C3F27249C2BED6853746296CA0"><enum>(3)</enum><header>Disclosure</header><text>In making determinations under this subsection, the court shall disclose to the petitioner, the counsel of the petitioner, or both, under the procedures and standards provided in the Classified Information Procedures Act (18 U.S.C. App.), portions of the application, order, or other related materials unless the court finds that such disclosure would not assist in determining any legal or factual issue pertinent to the case.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H0C165335C24A4985BED36A9AB4C8300"><enum>(4)</enum><header>Consumer report requests by governmental agencies</header><text>Section 627 of the <act-name parsable-cite="FCRA">Fair Credit Reporting Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/1681v">15 U.S.C. 1681v</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block act-name="Fair Credit Reporting Act" id="H4B7512A939B44FE59551B398AD15AAEB"> 
<subsection id="HB6FFF34F36174289A7DE27E99DA6C8E7"><enum>(f)</enum><header>Judicial review</header> 
<paragraph id="HDB1FC16B9059484BB5B70920BE22E5F4"><enum>(1)</enum><header>In general</header><text>Not later than 20 days after any person receives a request pursuant to subsection (a), or at any time before the return date specified in the request, whichever period is shorter, such person may file, in the district court of the United States for the judicial district within which such person resides, is found, or transacts business, a petition for the court to modify or set aside the request. The time allowed for compliance with the request in whole or in part as deemed proper and ordered by the court shall not run during the pendency of the petition in the court. The petition shall specify each ground upon which the petitioner relies in seeking the relief, and may be based upon any failure of the request to comply with the provisions of this section or upon any constitutional or other legal right or privilege of the petitioner.</text></paragraph> 
<paragraph id="HF42EF612835F4447A80037DFC589C622"><enum>(2)</enum><header>Nondisclosure</header> 
<subparagraph id="HBE34D10E4B1A45BD972C6CF0618FD6D1"><enum>(A)</enum><header>In general</header><text>A person prohibited from disclosing information under subsection (c) may file, in the district court of the United States for the judicial district within which the recipient resides, is found, or transacts business, a petition for the court to set aside the nondisclosure requirement. The petition shall specify each ground upon which the petitioner relies in seeking the relief, and may be based upon any failure of the nondisclosure requirement to comply with the provisions of this section or upon any constitutional or other legal right or privilege of the petitioner.</text></subparagraph> 
<subparagraph id="HF00B7F09B3D74A4DA9CB4ED9F16B2F1"><enum>(B)</enum><header>Standard</header><text>The court shall set aside the nondisclosure requirement unless the court determines that there is a reason to believe that disclosure of the request under subsection (a) will result in—</text> 
<clause id="H6573397C646D4D028CDA1898BB096651"><enum>(i)</enum><text>endangering the life or physical safety of any person;</text></clause> 
<clause id="HF821AD52F3584760A2D19EB1DBB29DDF"><enum>(ii)</enum><text>flight from prosecution;</text></clause> 
<clause id="H332FDC7A74104B059B7E7808EA2F05BF"><enum>(iii)</enum><text>destruction of or tampering with evidence;</text></clause> 
<clause id="H6D2E79381ABF4017AF55D410D71CDFD4"><enum>(iv)</enum><text>intimidation of potential witnesses; or</text></clause> 
<clause id="H25853C83D3CA4BA4B44F8DF38133D05F"><enum>(v)</enum><text>otherwise seriously endangering the national security of the United States by alerting a target, a target’s associates, or the foreign power of which the target is an agent, of the Government’s interest in the target.</text></clause></subparagraph></paragraph>

<paragraph id="H4D9992AD8EC94EB29B8F18B2894500A1"><enum>(2)</enum><header>Disclosure for law enforcement purposes</header><text>No information acquired pursuant to this section shall be disclosed for law enforcement purposes unless such disclosure is accompanied by a statement that such information, or any information derived therefrom, may only be used in a criminal proceeding with the advance authorization of the Attorney General.</text></paragraph> 
<paragraph id="H272FD24E74B14C44AB62E1FB4BCE400"><enum>(3)</enum><header>Notification of intended disclosure by the United States</header><text>Whenever the United States intends to enter into evidence or otherwise use or disclose in any trial, hearing, or other proceeding in or before any court, department, officer, agency, regulatory body, or other authority of the United States against an aggrieved person any information obtained or derived from a request pursuant to this section, the United States shall, before the trial, hearing, or other proceeding or at a reasonable time before an effort to so disclose or so use this information or submit it in evidence, notify the aggrieved person and the court or other authority in which the information is to be disclosed or used that the United States intends to so disclose or so use such information.</text></paragraph> 
<paragraph id="HEB33C1A0482449A0A39DE1FA61F852E9"><enum>(4)</enum><header>Notification of intended disclosure by State or political subdivision</header><text>Whenever any State or political subdivision thereof intends to enter into evidence or otherwise use or disclose in any trial, hearing, or other proceeding in or before any court, department, officer, agency, regulatory body, or other authority of the State or political subdivision thereof against an aggrieved person any information obtained or derived from a request pursuant to this section, the State or political subdivision thereof shall notify the aggrieved person, the court or other authority in which the information is to be disclosed or used, and the Attorney General that the State or political subdivision thereof intends to so disclose or so use such information.</text></paragraph> 
<paragraph id="H6EE5B1565C2E41AC82FCAC9FB4E01C3E"><enum>(5)</enum><header>Motion to suppress</header> 
<subparagraph id="H141FCF541FF24D288758156F12F181C"><enum>(A)</enum><header>In general</header><text>Any aggrieved person against whom evidence obtained or derived from a request pursuant to this section is to be, or has been, introduced or otherwise used or disclosed in any trial, hearing, or other proceeding in or before any court, department, officer, agency, regulatory body, or other authority of the United States, or a State or political subdivision thereof, may move to suppress the evidence obtained or derived from the request, as the case may be, on the grounds that—</text> 
<clause id="HD9A26460BA1044AC9E5C16F3C597B9B1"><enum>(i)</enum><text>the information was acquired in violation of the Constitution or laws of the United States; or</text></clause> 
<clause id="H8BBB498784FD452AACDBD0F678D85DF0"><enum>(ii)</enum><text>the request was not in conformity with the requirements of this section.</text></clause></subparagraph> 
<subparagraph id="HA94F0EC534AE4DFBA128759C5200FAD"><enum>(B)</enum><header>Timing</header><text>A motion under subparagraph (A) shall be made before the trial, hearing, or other proceeding unless there was no opportunity to make such a motion or the aggrieved person concerned was not aware of the grounds of the motion.</text></subparagraph></paragraph> 
<paragraph id="H3A65AC4A650A491F9FBD45621B63EE00"><enum>(6)</enum><header>Judicial review</header> 
<subparagraph id="HF4A737BBC48B4EB3A4C51D991301711"><enum>(A)</enum><header>In general</header><text>Whenever—</text> 
<clause id="H885B98573EBD48BBB8001BAE71E344DC"><enum>(i)</enum><text>a court or other authority is notified pursuant to paragraph (3) or (4);</text></clause> 
<clause id="HEB2555E4106F4B4F9D1F37CDE6DC13D"><enum>(ii)</enum><text>a motion is made pursuant to paragraph (5); or</text></clause> 
<clause id="H6AE443AA6BED473D8D05F61448A401F0"><enum>(iii)</enum><text>any motion or request is made by an aggrieved person pursuant to any other statute or rule of the United States or any State before any court or other authority of the United States or any State to—</text> 
<subclause id="H2B09FAB0130B4D289150346F66C77ED2"><enum>(I)</enum><text>discover or obtain materials relating to a request issued pursuant to this section; or</text></subclause> 
<subclause id="H0563000969824164A722F84798DBB7F8"><enum>(II)</enum><text>discover, obtain, or suppress evidence or information obtained or derived from a request issued pursuant to this section;</text></subclause></clause><continuation-text continuation-text-level="subparagraph">the United States district court or, where the motion is made before another authority, the United States district court in the same district as the authority shall, notwithstanding any other provision of law and if the Attorney General files an affidavit under oath that disclosure would harm the national security of the United States, review in camera the materials as may be necessary to determine whether the request was lawful.</continuation-text></subparagraph> 
<subparagraph id="H0889BD906A0242F5008224E3D05C0042"><enum>(B)</enum><header>Disclosure</header><text>In making a determination under subparagraph (A), unless the court finds that such disclosure would not assist in determining any legal or factual issue pertinent to the case, the court shall disclose to the aggrieved person, the counsel of the aggrieved person, or both, under the procedures and standards provided in the Classified Information Procedures Act (18 U.S.C. App.), portions of the application, order, or other related materials, or evidence or information obtained or derived from the order.</text></subparagraph></paragraph> 
<paragraph id="HBC673053A779469E8789EF1B00F36E09"><enum>(7)</enum><header>Effect of determination of lawfulness</header> 
<subparagraph id="H18F6E4CF982E4D05BE6B051EF8B00016"><enum>(A)</enum><header>Unlawful orders</header><text>If the United States district court determines pursuant to paragraph (6) that the request was not in compliance with the Constitution or laws of the United States, the court may, in accordance with the requirements of law, suppress the evidence which was unlawfully obtained or derived from the request or otherwise grant the motion of the aggrieved person.</text></subparagraph> 
<subparagraph id="H867081E4CDEB42E4A01F72A86F966679"><enum>(B)</enum><header>Lawful orders</header><text>If the court determines that the request was lawful, it may deny the motion of the aggrieved person except to the extent that due process requires discovery or disclosure.</text></subparagraph></paragraph> 
<paragraph id="H251B4A37118A4B64BF24134286C1A010"><enum>(8)</enum><header>Binding final orders</header><text>Orders granting motions or requests under paragraph (6), decisions under this section that a request was not lawful, and orders of the United States district court requiring review or granting disclosure of applications, orders, or other related materials shall be final orders and binding upon all courts of the United States and the several States except a United States court of appeals or the Supreme Court.</text></paragraph></subsection> 
<subsection id="HD08F85C300AE40358487E3CEFBA9F7D"><enum>(g)</enum><header>Definitions</header><text>As used in this section—</text> 
<paragraph id="H6AF4706F8DA7436FA4B8DAB8DE994DCC"><enum>(1)</enum><text>the term <term>agent of a foreign power</term> has the meaning given such term by section 101(b) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801(b)</external-xref>);</text></paragraph> 
<paragraph id="H7B6C12316106440381DF47EF6BB14BB9"><enum>(2)</enum><text>the term <term>aggrieved person</term> means a person whose name, address, length of service, or local or long distance toll records were sought or obtained under this section; and</text></paragraph> 
<paragraph id="H843A0D56B6A849528CE00420ACA75D00"><enum>(3)</enum><text>the term <term>foreign power</term> has the meaning given such term by section 101(a) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801(a)</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H5D3316C5A1D2482BA58850FF7B7E54F6"><enum>(2)</enum><header>Financial records</header><text>Section 1114 of the <act-name parsable-cite="RFPA78">Right to Financial Privacy Act of 1978</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/3414">12 U.S.C. 3414</external-xref>) is amended by inserting after subsection (b) the following new subsection:</text>

<paragraph id="H54E4F5F2943F451BA815D770B3CD6560"><enum>(5)</enum><header>Motion to suppress</header> 
<subparagraph id="H320AA59B56274AC6BC1EDDCFAAAFF34F"><enum>(A)</enum><header>In general</header><text>Any aggrieved person against whom evidence obtained or derived from a request pursuant to this section is to be, or has been, introduced or otherwise used or disclosed in any trial, hearing, or other proceeding in or before any court, department, officer, agency, regulatory body, or other authority of the United States, or a State or political subdivision thereof, may move to suppress the evidence obtained or derived from the request, as the case may be, on the grounds that—</text>

<clause id="H085B5514E06548D09918B68EDC8D5EF1"><enum>(i)</enum><text>a court or other authority is notified pursuant to paragraph (3) or (4);</text></clause> 
<clause id="H3BB488E08BDE49B4898B54759E714F00"><enum>(ii)</enum><text>a motion is made pursuant to paragraph (5); or</text></clause> 
<clause id="H71F24006F4F84FCDBEC2A86768458E00"><enum>(iii)</enum><text>any motion or request is made by an aggrieved person pursuant to any other statute or rule of the United States or any State before any court or other authority of the United States or any State to—</text> 
<subclause id="H40AF5142BACF4F6CA0B0060E79440B"><enum>(I)</enum><text>discover or obtain materials relating to a request issued pursuant to this section; or</text></subclause>

<subparagraph id="HE49599AD678D4936A5E8137766E8FD51"><enum>(A)</enum><header>In general</header><text>Any aggrieved person against whom evidence obtained or derived from a request or an order pursuant to this section is to be, or has been, introduced or otherwise used or disclosed in any trial, hearing, or other proceeding in or before any court, department, officer, agency, regulatory body, or other authority of the United States, or a State or political subdivision thereof, may move to suppress the evidence obtained or derived from the request or the order, as the case may be, on the grounds that—</text> 
<clause id="H235072B72C25491EA44952481756132E"><enum>(i)</enum><text>the information was acquired in violation of the Constitution or laws of the United States; or</text></clause> 
<clause id="H1A0DAF969B7C4AB8B31EDCEF9E4278DC"><enum>(ii)</enum><text>the request or the order was not in conformity with the requirements of this section.</text></clause></subparagraph> 
<subparagraph id="HECF44C9B40B8459E96CDFC04DC14F6E4"><enum>(B)</enum><header>Timing</header><text>A motion to suppress under subparagraph (A) shall be made before the trial, hearing, or other proceeding unless there was no opportunity to make such a motion or the aggrieved person concerned was not aware of the grounds of the motion.</text></subparagraph></paragraph> 
<paragraph id="H43E9F1789DE24456A2A6055D223F288B"><enum>(6)</enum><header>Judicial review</header> 
<subparagraph id="HA1D7F961D36A419CA1E76FB5B07465B"><enum>(A)</enum><header>In general</header><text>Whenever—</text> 
<clause id="H6E124C6A85D34A79002875F8C2C90609"><enum>(i)</enum><text>a court or other authority is notified pursuant to paragraph (3) or (4);</text></clause> 
<clause id="HD18F6152F5B047F5A0F28CC6D1EACC98"><enum>(ii)</enum><text>a motion is made pursuant to paragraph (5); or</text></clause> 
<clause id="H315B755BEC5E40A69843D800DB208A"><enum>(iii)</enum><text>any motion or request is made by an aggrieved person pursuant to any other statute or rule of the United States or any State before any court or other authority of the United States or any State to—</text> 
<subclause id="H1E2481A438BC45B295A0728915FB43E"><enum>(I)</enum><text>discover or obtain materials relating to a request or an order issued pursuant to this section; or</text></subclause> 
<subclause id="H8D28548ACD2F4DA8B34E9ECE67C5E665"><enum>(II)</enum><text>discover, obtain, or suppress evidence or information obtained or derived from a request or an order issued pursuant to this section;</text></subclause></clause><continuation-text continuation-text-level="subparagraph">the United States district court or, where the motion is made before another authority, the United States district court in the same district as the authority shall, notwithstanding any other provision of law and if the Attorney General files an affidavit under oath that disclosure would harm the national security of the United States, review in camera the materials as may be necessary to determine whether the request or the order was lawful.</continuation-text></subparagraph> 
<subparagraph id="HE77F95737C7C49C49F53D562E079B7D4"><enum>(B)</enum><header>Disclosure</header><text>In making a determination under subparagraph (A), unless the court finds that such disclosure would not assist in determining any legal or factual issue pertinent to the case, the court shall disclose to the aggrieved person, the counsel of the aggrieved person, or both, under the procedures and standards provided in the Classified Information Procedures Act (18 U.S.C. App.), portions of the application, order, or other related materials, or evidence or information obtained or derived from the order.</text></subparagraph></paragraph> 
<paragraph id="H6FBCB2DADB00413AA8A55D48A9E409D"><enum>(7)</enum><header>Effect of determination of lawfulness</header> 
<subparagraph id="H522A2531BAED4122A4EC94C23EE445F8"><enum>(A)</enum><header>In general</header><text>If the United States district court determines pursuant to paragraph (6) that the request or the order was not in compliance with the Constitution or laws of the United States, the court may, in accordance with the requirements of law, suppress the evidence which was unlawfully obtained or derived from the request or the order or otherwise grant the motion of the aggrieved person.</text></subparagraph> 
<subparagraph id="HDD40A06312AE4AE300163BCFE47183B5"><enum>(B)</enum><header>Exception</header><text>If the court determines that the request or the order was lawful, it may deny the motion of the aggrieved person except to the extent that due process requires discovery or disclosure.</text></subparagraph></paragraph> 
<paragraph id="HCBC8530F34424F9E92C72CF12D9BCDCB"><enum>(8)</enum><header>Binding final orders</header><text>Orders granting motions or requests under paragraph (6), decisions under this section that a request was not lawful, and orders of the United States district court requiring review or granting disclosure of applications, orders, or other related materials shall be final orders and binding upon all courts of the United States and the several States except a United States Court of Appeals or the Supreme Court.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H3FB30B3A9408468B8979035EB9D75283"><enum>(4)</enum><header>Consumer reports requested by governmental agencies</header><text>Section 627 of the <act-name parsable-cite="FCRA">Fair Credit Reporting Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/1681v">15 U.S.C. 1681v</external-xref>) is amended by inserting after subsection (f) (as added by subsection (d)(4) of this section) the following new subsection:</text>

<subsection id="H7874BDEB9B094BAD8FBF40A04300B234"><enum>(g)</enum><header>Use of information</header><text>Any information acquired from a request pursuant to this section concerning any United States person may be used and disclosed by Federal officers and employees, a State, or a political subdivision of a State without the consent of the United States person only in accordance with the procedures established under section 626(p).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H6A72664AD87D413187A3F48CA4DBDF3E"><enum>(f)</enum><header>Definitions</header> 
<paragraph id="HFEF08D0546A741E882C586CF571FC0AB"><enum>(1)</enum><header>Financial record requests</header><text>Section 1101 of the <act-name parsable-cite="RFPA78">Right to Financial Privacy Act of 1978</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/3401">12 U.S.C. 3401</external-xref>) is amended—</text> 
<subparagraph id="HCCB52EE080A443BB8CCE885FDCC6EF42"><enum>(A)</enum><text>in paragraph (7), by striking <quote>and</quote> at the end after the semicolon;</text></subparagraph> 
<subparagraph id="HD547D6D051A44EAEA529D12C09D561E7"><enum>(B)</enum><text>in paragraph (8), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph>
