<official-title>To require full funding of part A of title I of the Elementary and Secondary Education Act of 1965, as amended by the No Child Left Behind Act of 2001.</official-title>

<section section-type="section-one" id="H04C9E48A2535461E984B60BAE3743E7C" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keeping Our Promises to America’s Children Act of 2005</short-title></quote>.</text></section>
<section id="HA804A312143F401EAA6DCB61C346CCD3"><enum>2.</enum><header>Moratorium on compliance with adequate yearly progress requirements that are not fully funded</header>
<subsection id="HB119D38BF0E540859D93918E5CC2F74"><enum>(a)</enum><header>In general</header><text>If, for a fiscal year, appropriations for a program, project, or activity under part A of title I of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311 et seq.</external-xref>), as amended by the No Child Left Behind Act of 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/107/110">Public Law 107–110</external-xref>; 115 Stat. 1425), are less than the amount authorized by law to be appropriated for the program, project, or activity for that fiscal year and, by reason of the insufficient appropriation, a recipient of funds under that part receives inadequate funding—</text>
<paragraph id="HFC878DEE6D034101854D0062123494F7"><enum>(1)</enum><text>the recipient may, as determined appropriate by the recipient, defer the commencement of, suspend, or modify the administration of, the functions of the recipient under subsections (b), (c), (e), (f), and (g) of section 1116 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6316">20 U.S.C. 6316(b)</external-xref>, (c), (e), (f), and (g)) with respect to the program, project, or activity; and</text></paragraph>
<paragraph id="H506F0C2D76A74B31B92B106CF593DCF7"><enum>(2)</enum><text>the Secretary of Education shall ensure that no penalty, sanction, condition, denial of waiver, reduction of support, or other negative consequence otherwise applicable under part A of title I of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311 et seq.</external-xref>) shall apply to the recipient because of action taken by the recipient under paragraph (1).</text></paragraph></subsection>
<subsection id="HA863B63F44DC4E58AAC79D5B9E1DB0EA"><enum>(b)</enum><header>Definitions</header><text>As used in this section:</text>
<paragraph id="HC5D8EB564DD442CAB8A2099201D8D62B"><enum>(1)</enum><header>Recipient of funds</header><text>The term <term>recipient of funds</term> means, with respect to part A of title I of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311 et seq.</external-xref>), a local educational agency or a State educational agency that is a recipient funds under that part.</text></paragraph>
<paragraph id="HD8AB4AD9A92D4C2A9486D9FE9DC34CC6"><enum>(2)</enum><header>Inadequate funding</header><text>The term <term>inadequate funding</term> means, with respect to a local educational agency or a State educational agency, funding in an amount that is less than the amount the recipient would have received if the amount authorized by law for the program, project, or activity involved had been appropriated in full.</text></paragraph>
<paragraph id="HEF3230E89663429EBDED00F16561E168"><enum>(3)</enum><header>Local educational agency and State educational agency</header><text>The terms <term>local educational agency</term> and <term>State educational agency</term> have the meanings given those terms in section 9101(26) and section 9101(41), respectively, of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801(26)</external-xref> and 7801(41)).</text></paragraph></subsection></section>
