<section section-type="section-one" id="H6374EC68BD6D4858AF611FD1018CEF00" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Prescription Drug Price Negotiation Act</short-title></quote>.</text></section> 
<section id="H3E3758A7A6B94A45AD3EA02C2DC00321"><enum>2.</enum><header>Availability of prescription drugs from participating manufacturers at negotiated prices</header> 
<subsection id="HBE1F2127E742448788E6299C99DF3430"><enum>(a)</enum><header>In general</header><text>Each participating manufacturer of a covered outpatient drug shall make available for purchase by any qualified Federal health care provider, by each pharmacy, and by each provider of services, physician, practitioner, and supplier under the medicare program such covered outpatient drug in the amount described in subsection (b) at the price described in subsection (c).</text></subsection> 
<subsection id="H50F1026479C94E4A9DA18B2F1EF75209"><enum>(b)</enum><header>Description of amount of drugs</header><text>The amount of a covered outpatient drug that a participating manufacturer shall make available for purchase under subsection (a) is the sum of—</text> 
<paragraph id="H298427F345D84CB4AB811EDBD9426D09"><enum>(1)</enum><text>an amount equal to the aggregate amount of the covered outpatient drug dispensed by pharmacies to Medicare beneficiaries; and</text></paragraph> 
<paragraph id="H2AC5CB529BF6462684EF669581B11ECA"><enum>(2)</enum><text>an amount equal to the aggregate amount of the covered outpatient drug dispensed through qualified Federal health care providers.</text></paragraph></subsection> 
<subsection id="H78B8732C1BAE43CA991DACDA3D7100DE"><enum>(c)</enum><header>Description of price</header> 
<paragraph id="HC85DD9FCD2424846AB1B01E596F4867"><enum>(1)</enum><header>In general</header><text>The price at which a participating manufacturer shall make a covered outpatient drug available for purchase under subsection (a) is a price that the Secretary, in conjunction with the Secretary of Defense and the Secretary of Veterans Affairs, negotiate with the manufacturer.</text></paragraph> 
<paragraph id="HA5E7A2F26EB24857005772D7283ABB9"><enum>(2)</enum><header>Promotion of breakthrough drugs</header> 
<subparagraph id="HFA39D72B7BAD4CF4894F7CE1A996C2B"><enum>(A)</enum><header>In general</header><text>In conducting negotiations with participating manufacturers under paragraph (1), the Secretary shall take into account the goal of promoting the development of breakthrough drugs.</text></subparagraph> 
<subparagraph id="HC6788933C91A458C8D72BC25EB20F31B"><enum>(B)</enum><header>Definition</header><text>For purposes of this paragraph, a drug is a <quote>breakthrough drug</quote> if the Secretary determines it is a new product that will make a significant and major improvement by reducing physical or mental illness, reducing mortality, or reducing disability, and that no other product is available to enrollees that achieves similar results for the same condition.</text></subparagraph></paragraph></subsection> 
<subsection id="H19CE8DB9556D405093764EF202714D00"><enum>(d)</enum><header>Enforcement</header><text>The United States shall debar a manufacturer of drugs or biologicals that does not comply with the provisions of this Act.</text></subsection> 
<subsection id="HB48DDE965CFE48A39F9761DC022145DC"><enum>(e)</enum><header>Dispute resolution mechanism</header><text>The Secretary shall establish a mechanism (such as an ombudsman) for the resolution of disputes between Medicare beneficiaries and prescription drug resellers and drug manufacturers in order to protect such beneficiaries and to ensure that—</text> 
<paragraph id="HBC14486CF03C4DA090A03FA8BD40507B"><enum>(1)</enum><text>prescription drug resellers are not artifically increasing prices charged to Medicare beneficiaries (above those negotiated under subsection (c)) in places where there is less competition (such as in rural areas); and</text></paragraph> 
<paragraph id="HFC8E6D8449B24C29AB9460B038E19E08"><enum>(2)</enum><text>such resellers are not colluding on prices in areas with more potential significant competition.</text></paragraph></subsection></section> 
<section id="H0F7C4239CDE34D64B113A48392ED10BC"><enum>3.</enum><header>Administration</header><text display-inline="no-display-inline">The Secretary shall issue such regulations as may be necessary to implement this Act.</text></section> 
<section id="H5EFBA40CC7F5489F9C70BB1B0039FA8B"><enum>4.</enum><header>Reports to Congress regarding effectiveness of Act</header> 
<subsection id="H8C668D37B3B6429BBEBECEEDB948109"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of the enactment of this Act, and annually thereafter, the Secretary shall report to the Congress regarding the effectiveness of this Act in—</text> 
<paragraph id="H159B52E8A65B497BAEC781F7373C72AE"><enum>(1)</enum><text>protecting Medicare beneficiaries from discriminatory pricing by drug manufacturers, and</text></paragraph> 
<paragraph id="HADC0925C1BB341D8AC77713E8FFF0823"><enum>(2)</enum><text>making prescription drugs available to Medicare beneficiaries at substantially reduced prices.</text></paragraph></subsection> 
<subsection id="HE4B58EB360594793AB6D5FC1F4395DDE"><enum>(b)</enum><header>Consultation</header><text>In preparing such reports, the Secretary shall consult with public health experts, affected industries, organizations representing consumers and older Americans, and other interested persons.</text></subsection> 
<subsection id="HE90D9166E984467696AECBC05821634"><enum>(c)</enum><header>Recommendations</header><text>The Secretary shall include in such reports any recommendations the Secretary considers appropriate for changes in this Act to further reduce the cost of covered outpatient drugs to Medicare beneficiaries.</text></subsection></section> 
<section id="H1CC3FE88BA724343B9EF75598EAA2D9D"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H28A0955803D54B58A2501DFD6E5233E"><enum>(1)</enum><header>Provider of services</header><text>The term <term>provider of services</term> has the meaning given that term in section 1861(u) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(u)</external-xref>).</text></paragraph> 
<paragraph id="HD82BBC1DFDF543108792F2A9F689D7F"><enum>(2)</enum><header>Physician</header><text>The term <term>physician</term> has the meaning given that term in section 1861(r) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(r)</external-xref>).</text></paragraph> 
<paragraph id="HB5D8DEC6B89245748500FE6355F2EAB"><enum>(3)</enum><header>Practitioner</header><text>The term <term>practitioner</term> has the meaning given that term in section 1842(b)(18)(C) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395u">42 U.S.C. 1395u(b)(18)(C)</external-xref>).</text></paragraph> 
<paragraph id="H0A8E1F7D696D4BDFAA6142D353074E68"><enum>(4)</enum><header>Supplier</header><text>The term <term>supplier</term> has the meaning given that term under section 1842(o) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395u">42 U.S.C. 1395u(o)</external-xref>).</text></paragraph> 
<paragraph id="HAD7C0E36DB6C44968182BC3B613CAB4F"><enum>(5)</enum><header>Covered outpatient drug</header><text>The term <term>covered outpatient drug</term> has the meaning given that term in section 1927(k)(2) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-8">42 U.S.C. 1396r–8(k)(2)</external-xref>).</text></paragraph> 
<paragraph id="H21A86EEDE53040F2A84DA4F4DF91A6FD"><enum>(6)</enum><header>Debar</header><text>The term <term>debar</term> means to exclude, pursuant to established administrative procedures, from Government contracting and subcontracting for a specified period of time commensurate with the seriousness of the failure or offense or the inadequacy of performance.</text></paragraph> 
<paragraph id="HD96F33461A7A45E4A24F1E782BD0F03F"><enum>(7)</enum><header>Medicare beneficiary</header><text>The term <term>Medicare beneficiary</term> means an individual entitled to benefits under part A of title XVIII of the <act-name parsable-cite="SSA">Social Security Act</act-name> or enrolled under part B of such title, or both.</text></paragraph> 
<paragraph id="H5B6F187560884EB3977BA88137EB6D50"><enum>(8)</enum><header>Participating manufacturer</header><text>The term <term>participating manufacturer</term> means any manufacturer of drugs or biologicals that, on or after the date of the enactment of this title, enters into a contract or agreement with the United States for the sale or distribution of covered outpatient drugs to the United States.</text></paragraph> 
<paragraph id="H4B17C79D986143C684714245007E355C"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph></section> 
<section id="H4A77193BAADC4AFEBF5077CD6285D2BB"><enum>6.</enum><header>Effective date</header><text display-inline="no-display-inline">The Secretary shall implement this Act as expeditiously as practicable and in a manner consistent with the obligations of the United States.</text></section> 
<section id="H618763D49DE144310098F8BD16062A1"><enum>7.</enum><header>Conforming amendment</header><text display-inline="no-display-inline">Section 1860D–11 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-111">42 U.S.C. 1395w–111</external-xref>) is amended by striking subsection (i) (relating to noninterference).</text></section>
