<official-title>To amend the Federal Water Pollution Control Act to authorize appropriations for State water pollution control revolving funds, and for other purposes.</official-title>

<section section-type="section-one" id="H7C2E78C96D654D05AC8343ADE64941AF" display-inline="no-display-inline"><enum>1.</enum><header>Short title; amendment of <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name></header> 
<subsection id="H02CAF8291C3D4D0FA659C0C3DE218308"><enum>(a)</enum><header>In general</header><text>This Act may be cited as the <quote><short-title>Clean Water Infrastructure Financing Act of 2005</short-title></quote>.</text></subsection> 
<subsection id="H966655C0048B40FB89003847A1D6D645"><enum>(b)</enum><header>Amendment of <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name></header><text>Except as otherwise expressly provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>).</text></subsection></section> 
<section id="HDB30BE6DE3734A5690A1B81910F0DA22"><enum>2.</enum><header>General authority for capitalization grants</header><text display-inline="no-display-inline">Section 601(a) (<external-xref legal-doc="usc" parsable-cite="usc/33/1381">33 U.S.C. 1381(a)</external-xref>) is amended by striking <quote>(1) for construction</quote> and all that follows through the period and inserting <quote>to accomplish the purposes of this Act.</quote>.</text></section> 
<section id="HD493EDD6E185412A9608B00DAE4CDAE"><enum>3.</enum><header>Capitalization grants agreements</header> 
<subsection id="H655D90C65BD143DA8EAABDFF04E8B6CD"><enum>(a)</enum><header>Requirements for construction of treatment works</header><text>Section 602(b)(6) (<external-xref legal-doc="usc" parsable-cite="usc/33/1382">33 U.S.C. 1382(b)(6)</external-xref>) is amended to read as follows:</text> 
<quoted-block id="H735A82EDEC9E426580F3B4FA6D6288DF"> 
<paragraph id="H1924CB4E3F06433ABB24A2F11FA5F697"><enum>(6)</enum><text>treatment works eligible under section 603(c)(1) of this Act constructed in whole or in part with funds made available by a State water pollution control revolving fund under this title and section 205(m) of this Act will meet the requirements of section 513 of this Act in the same manner as treatment works constructed with assistance under title II of this Act;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H86814C61C6324F5E85A0B24BB445C34"><enum>(b)</enum><header>Architectural and engineering contracts</header><text>Section 602(b) (<external-xref legal-doc="usc" parsable-cite="usc/33/1382">33 U.S.C. 1382(b)</external-xref>) is amended—</text> 
<paragraph id="HF8128A21B781480DA09E8748E45891FB"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (9);</text></paragraph> 
<paragraph id="H3A11D6E743C14CD1AD256B446259D3AC"><enum>(2)</enum><text>by striking the period at the end of paragraph (10) and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H99EDF4D9C32E4C77AB368DEB2642A761"><enum>(3)</enum><text>by adding at the end the following:</text>

<paragraph id="H16E3AC2829AC487C8C4300626CB0A812"><enum>(11)</enum><text>the State will require that each contract and subcontract for program management, construction management, planning studies, feasibility studies, architectural services, preliminary engineering, design, engineering, surveying, mapping, and related services entered into using amounts from the fund will be awarded in the same way that a contract for architectural and engineering services is awarded under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/11">chapter 11</external-xref> of title 40, United States Code, or an equivalent qualifications-based requirement prescribed by the State, except that such an award shall not be construed as conferring a proprietary interest upon the United States.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HEF65EAFECB954DAD900082AD8E6B659C"><enum>(c)</enum><header>Guidance for small systems</header><text>Section 602 (<external-xref legal-doc="usc" parsable-cite="usc/33/1382">33 U.S.C. 1382</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H72D5D33789B6433783BAC0ED01684B00"><enum>(c)</enum><header>Guidance for small systems</header> 
<paragraph id="H97107E628D834C1A8831B55626C6F3CF"><enum>(1)</enum><header>Simplified procedures</header><text>Not later than 1 year after the date of enactment of this subsection, the Administrator shall assist the States in establishing simplified procedures for small systems to obtain assistance under this title.</text></paragraph> 
<paragraph id="H70F7C30B75274C1FA8A2AC0098B75D00"><enum>(2)</enum><header>Publication of manual</header><text>Not later than 1 year after the date of enactment of this subsection, and after providing notice and opportunity for public comment, the Administrator shall publish a manual to assist small systems in obtaining assistance under this title and publish in the Federal Register notice of the availability of the manual.</text></paragraph> 
<paragraph id="HF0B83401DFA24477BD8368166CBEFD50"><enum>(3)</enum><header>Small system defined</header><text>For purposes of this title, the term <term>small system</term> means a system for which a municipality or intermunicipal, interstate, or State agency seeks assistance under this title and which serves a population of 10,000 or less.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

<subsection id="H57F75954515C43D7A376642557370014"><enum>(a)</enum><header>Activities eligible for assistance</header><text>Section 603(c) (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(c)</external-xref>) is amended to read as follows:</text>

<subsection id="H8966152647B5401C8B5B42DBC8932829"><enum>(c)</enum><header>Activities eligible for assistance</header> 
<paragraph id="HF29F6E159B184313BEE027423914E789"><enum>(1)</enum><header>In general</header><text>The amounts of funds available to each State water pollution control revolving fund shall be used only for providing financial assistance to activities that have as a principal benefit the improvement or protection of water quality of navigable waters to a municipality, intermunicipal agency, interstate agency, State agency, or other person. Such activities may include the following:</text> 
<subparagraph id="HE23FECE8E6CB4F55BF3F7237D5002017"><enum>(A)</enum><text>Construction of a publicly owned treatment works.</text></subparagraph> 
<subparagraph id="HB0BF96BFEF004CF7957ED3A9153C444B"><enum>(B)</enum><text>Implementation of lake protection programs and projects under section 314.</text></subparagraph> 
<subparagraph id="H622208CDF3C24FAD8BAB87E5CCD306B"><enum>(C)</enum><text>Implementation of a management program under section 319.</text></subparagraph> 
<subparagraph id="H25231BB06D5D4E5C855DA1B401ED36C8"><enum>(D)</enum><text>Implementation of a conservation and management plan under section 320.</text></subparagraph> 
<subparagraph id="H454CF3E3DDB441138C013170EC2759FC"><enum>(E)</enum><text>Restoration or protection of publicly or privately owned riparian areas, including acquisition of property rights.</text></subparagraph> 
<subparagraph id="HA44AA54F5F7145BF8F28B0CB645CC5F"><enum>(F)</enum><text>Implementation of measures to promote beneficial reuse of wastewater.</text></subparagraph> 
<subparagraph id="H13FE079613A94725A7C2EBE58500789B"><enum>(G)</enum><text>Development and implementation of plans by a public recipient to prevent water pollution.</text></subparagraph> 
<subparagraph id="H443347BFE8234BBF80FA1B2056AD55E6"><enum>(H)</enum><text>Acquisition of lands necessary to meet any mitigation requirements related to construction of a publicly owned treatment works.</text></subparagraph> 
<subparagraph id="HD0A138EEF5EF409B91B9E94B00538477"><enum>(I)</enum><text>Implementation of measures to enhance the security of publicly owned treatment works.</text></subparagraph> 
<subparagraph id="HD7620E3AC38C428DAA13C944B27C7129"><enum>(J)</enum><text>Replacement and rehabilitation of treatment works to intercept, transport, control, or treat municipal combined sewer overflows and sanitary sewer overflows.</text></subparagraph></paragraph> 
<paragraph id="H9BE4688747BE42948C190800A6B88C28"><enum>(2)</enum><header>Fund amounts</header><text>The water pollution control revolving fund of a State shall be established, maintained, and credited with repayments, and the fund balance shall be available in perpetuity for providing financial assistance described in paragraph (1). Fees charged by a State to recipients of such assistance may be deposited in the fund for the sole purpose of financing the cost of administration of this title.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H24B6ED318AD1407FBC605B09640085D9"><enum>(b)</enum><header>Loan guarantees</header><text>Section 603(d)(5) (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(d)(5)</external-xref>) is amended to read as follows:</text>

<paragraph id="HD3378C1965414B89A3E1B2B7C1A5D11E"><enum>(5)</enum><text>to provide loan guarantees for—</text> 
<subparagraph id="H41CA24D5AD4548BAAB00DB2956D21E0"><enum>(A)</enum><text>similar revolving funds established by municipalities or intermunicipal agencies; and</text></subparagraph> 
<subparagraph id="H0586CDF9EFC5475B992444C8F2837F00"><enum>(B)</enum><text>developing and implementing innovative technologies.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H9508CFB355984BAD8432493BFD00C411"><enum>(c)</enum><header>Administrative expenses</header><text>Section 603(d)(7) (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(d)(7)</external-xref>) is amended by inserting before the period at the end the following: <quote>or $400,000 per year or <fraction>1/2</fraction> percent per year of the current valuation of such fund, whichever is greater, plus the amount of any fees collected by the State for such purpose under subsection (c)(2)</quote>.</text></subsection> 
<subsection id="H29E5D239C23A4C0AAAB9A5DC04A8002F"><enum>(d)</enum><header>Technical and planning assistance for small systems</header><text>Section 603(d) (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(d)</external-xref>) is amended—</text> 
<paragraph id="H1F5C9DFD996649A5A117C6338372D24D"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (6);</text></paragraph> 
<paragraph id="H5EF0C822C8644FD2A7700885BAD8B4A1"><enum>(2)</enum><text>by striking the period at the end of paragraph (7) and inserting a semicolon; and</text></paragraph> 
<paragraph id="HF6FE2CD075164283942CFD85FDAC14F"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H2E7548EB30D24799ACC18F2631CB700"> 
<paragraph id="H0D51C847B7444072BBD9A7E19796A7CF"><enum>(8)</enum><text>to provide to small systems technical and planning assistance and assistance in financial management, user fee analysis, budgeting, capital improvement planning, facility operation and maintenance, repair schedules, and other activities to improve wastewater treatment plant operations, except that such amounts shall not exceed 2 percent of all grant awards to such fund under this title; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H054ACA6F04D3499DB0C4C9507A376C7"><enum>(e)</enum><header>Grants to financially distressed communities</header><text>Section 603(d) (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(d)</external-xref>) is further amended by adding at the end the following:</text>

<paragraph id="H4AFD9B9FF7884637B3437241AAAA4698"><enum>(9)</enum><text>to make grants to financially distressed communities in the State in the amounts specified in subsection (i).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H29868AF9675E4C4D9FAB9EF0CAFE8672"><enum>(f)</enum><header>Consistency with planning requirements</header><text>Section 603(f) (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(f)</external-xref>) is amended by striking <quote>is consistent</quote> and inserting <quote>is not inconsistent</quote>.</text></subsection> 
<subsection id="H34ED8B07720F45DE86C3BA2124F90921"><enum>(g)</enum><header>Construction assistance</header><text>Section 603(g) (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(g)</external-xref>) is amended to read as follows:</text>

<subsection id="H389E89B3DC3A496B86B57F5D21619843"><enum>(g)</enum><header>Construction assistance</header> 
<paragraph id="H646F199F27214DEE98B65E3BF7F6D346"><enum>(1)</enum><header>Priority list requirement</header><text>The State may provide financial assistance from its water pollution control revolving fund with respect to a project for construction of a publicly owned treatment works only if such project is on the State’s priority list under section 216 of this Act without regard to the rank of such project on the State’s priority list.</text></paragraph> 
<paragraph id="HE64C77D3C58E420BAA9FABC50587FBD"><enum>(2)</enum><header>Eligibility of certain treatment works</header><text>A treatment works shall be treated as a publicly owned treatment works for purposes of subsection (c) if the treatment works, without regard to ownership, would be considered a publicly owned treatment works and is principally treating municipal waste water or domestic sewage.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1CC0A5B9E3E648918583FCA59F2E42AA"><enum>(h)</enum><header>Financially distressed communities</header><text>Section 603 is amended by adding at the end the following:</text>

<subsection id="HAF4E31575D5E4C2780E9FEAB846D7561"><enum>(i)</enum><header>Financially distressed communities</header> 
<paragraph id="H72E255513B2841089C7506B3BAC2DE36"><enum>(1)</enum><header>Grants</header> 
<subparagraph id="H42F40FB8F8C4424F80FD48DEFEF88500"><enum>(A)</enum><header>In general</header><text>In any fiscal year in which the Administrator has available for obligation more than $1,400,000,000 for the purposes of this title, a State shall make grants to financially distressed communities in the State in an amount equal to 25 percent of the difference between—</text> 
<clause id="H8B81541DD43741D28D5C0098A548C0A0"><enum>(i)</enum><text>the total amount that would have been allotted to the State under section 604 for such fiscal year if the amount available to the Administrator for obligation under this title for such fiscal year had been equal to $1,400,000,000; and</text></clause> 
<clause id="H65ED39C44F1A45D8BE424437E4B15FB"><enum>(ii)</enum><text>the total amount allotted to the State under section 604 for such fiscal year.</text></clause></subparagraph> 
<subparagraph id="H393F16CB8AE042D495DEDD93EE90655"><enum>(B)</enum><header>Period of availability</header><text>Notwithstanding section 604(c), amounts to be used by a State under this paragraph for making grants to financially distressed communities shall remain available to the State until expended.</text></subparagraph> 
<subparagraph id="HE6049704FD1847239561EF407CCDBBD6"><enum>(C)</enum><header>Certification</header><text>A State may make a grant to a financially distressed community under this paragraph only if the community certifies to the State that the amounts of the grant will be used to improve water quality.</text></subparagraph></paragraph> 
<paragraph id="H25BB622680934B69B2117F58236BEBB2"><enum>(2)</enum><header>Priority for loans</header><text>A State may give priority to a financially distressed community in making loans from its water pollution control revolving fund.</text></paragraph> 
<paragraph id="H023941DA31CF41518745411791809EA7"><enum>(3)</enum><header>Financially distressed community defined</header><text>In this section, the term <term>financially distressed community</term> means any community that meets affordability criteria established by the State in which the treatment works is located, if such criteria are developed after public review and comment.</text></paragraph> 
<paragraph id="H0A44F969B53043F8AE37863C97F8F707"><enum>(4)</enum><header>Information to assist States</header><text>The Administrator may publish information to assist States in establishing affordability criteria under paragraph (3).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HADDA4191B2C443D3A8D8A711316800F7"><enum>5.</enum><header>Asset management</header><text display-inline="no-display-inline">Title VI (<external-xref legal-doc="usc" parsable-cite="usc/33/1381">33 U.S.C. 1381 et seq.</external-xref>) is amended—</text> 
<paragraph id="HC887170C543F485AB1ECFB2E30DCCEB7"><enum>(1)</enum><text>by redesignating section 607 as section 608; and</text></paragraph> 
<paragraph id="HFEFB8ACEA35545FC8491D343EC293BFE"><enum>(2)</enum><text>by inserting after section 606 the following:</text>

<section id="H7246FE7A4B5941798049CE523728B79"><enum>607.</enum><header>Asset management</header> 
<subsection id="H5A03364EB8FA4ECAA64835A54143EE1"><enum>(a)</enum><header>In general</header><text>The Administrator shall provide technical and financial assistance to owners and operators of publicly-owned treatment works for the following activities:</text> 
<paragraph id="H4D13DF931C514D17BFB00007DA700A0"><enum>(1)</enum><text>Performing an inventory of critical treatment works assets.</text></paragraph> 
<paragraph id="HC9ED24F01ABB46B6B901535E4EF649B6"><enum>(2)</enum><text>Evaluating the condition and performance of inventoried assets or asset groupings.</text></paragraph> 
<paragraph id="H03296D728F324BA79DDF55F96257E3CE"><enum>(3)</enum><text>Developing a plan for maintaining, repairing, and replacing treatment works and for funding such activities.</text></paragraph></subsection> 
<subsection id="H70AF90A750324BE08B00EF5DCE179D47"><enum>(b)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $10,000,000 for each of fiscal years 2006 through 2010. Such sums shall remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H838C5B552E734E81BBF501D42D9EE6D9"><enum>6.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 608, as redesignated by section 5 of this Act, is amended by striking paragraphs (1) through (5) and inserting the following:</text>

<paragraph id="H2B169B8E49A44F29A2BFB3FA894C12E9"><enum>(4)</enum><text>$6,000,000,000 for fiscal year 2009; and</text></paragraph> 
<paragraph id="HF0D619C2F08E451B963900D64830C644"><enum>(5)</enum><text>$7,000,000,000 for fiscal year 2010.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
