<legis-type>A BILL</legis-type> 
<official-title>To amend the Internal Revenue Code of 1986 to rename the low-income housing credit the affordable housing credit and to increase the per capita amount allowed in the determination of the State housing credit ceiling.</official-title>

<section id="HFDB9C549CEB14BA8BB54E4483F3F12E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Affordable Housing Tax Credit Enhancement Act of 2005</short-title></quote>.</text></section> 
<section id="HB650513EBA4A49BCA1D9309EDDC67E3D" section-type="subsequent-section"><enum>2.</enum><header>Increase in per capita amount allowed in the determination of the State housing credit ceiling; credit renamed affordable housing credit</header> 
<subsection id="H48860248F8714EE69DBE5DEE4B5ED7E1"><enum>(a)</enum><header>In general</header><text>Subclause (I) of <external-xref legal-doc="usc" parsable-cite="usc/26/42">section 42(h)(3)(C)(ii)</external-xref> of the Internal Revenue Code of 1986 (relating to state housing credit ceiling) is amended by striking <quote>$1.75 ($1.50 for 2001)</quote> and inserting <quote>$3.70</quote>.</text></subsection> 
<subsection id="HDC3A5EE9886943ADACC08FE6FDA838B6"><enum>(b)</enum><header>Conforming amendment to inflation adjustment</header><text>Subparagraph (H) of section 42(h)(3) of such Code (relating to cost-of-living adjustment) is amended—</text> 
<paragraph id="HEA9F1A3B51DC464ABE308CF036A1F38D"><enum>(1)</enum><text>in clause (i)—</text> 
<subparagraph id="H30C58DF7940B476E9C1C199808A3A6BD"><enum>(A)</enum><text>by striking <quote>2002</quote> and inserting <quote>2006</quote>,</text></subparagraph> 
<subparagraph id="H6A079C01C4DC46B1827B2F80B75C6D7C"><enum>(B)</enum><text>by striking <quote>$1.75</quote> and inserting <quote>$3.70</quote>, and</text></subparagraph> 
<subparagraph id="H3EBD8DF6A73D46BAAF4B71731D6C13B5"><enum>(C)</enum><text>by striking <quote>calendar year 2001</quote> and inserting <quote>calendar year 2005</quote>, and</text></subparagraph></paragraph> 
<paragraph id="HF7D21E94B6384E3F86F95575AA3D7900"><enum>(2)</enum><text>in subclause (II) of clause (ii) by striking <quote>$1.75</quote> and inserting <quote>$3.70</quote>.</text></paragraph></subsection> 
<subsection id="H30BB4D36FD214EBCB22C9E5D099490C0"><enum>(c)</enum><header>Credit renamed affordable housing credit</header> 
<paragraph id="H2BEEBBB7CE1E43F2B0D7B0AE8B00C5CD"><enum>(1)</enum><text>The following provisions of such Code are each amended by striking <quote>low-income housing credit</quote> and inserting <quote>affordable housing credit</quote>:</text> 
<subparagraph id="HD6EFB3AF31774432A001000076204259"><enum>(A)</enum><text>Section 38(b)(5).</text></subparagraph> 
<subparagraph id="H0A75CC80C08C478CBDD5E6CA72DB3394"><enum>(B)</enum><text>Section 42(a).</text></subparagraph> 
<subparagraph id="H4895564F64D8482B9EFD7DA0ACE02E82"><enum>(C)</enum><text display-inline="yes-display-inline">Subsections (a)(7) and (d)(5) of section 772.</text></subparagraph></paragraph> 
<paragraph id="H7F31BFA7B4984A2A922D3913E76DE902"><enum>(2)</enum><text>The heading for section 42 of such Code is amended to read as follows:</text>

<paragraph id="H2E038F2383A043F9B38200168E6ED56C"><enum>(4)</enum><text display-inline="yes-display-inline">The headings for paragraphs (3)(D) and (6)(B) of section 469(i) of such Code are both amended by striking <quote><header-in-text level="subparagraph" style="OLC">low-income housing credit</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">affordable housing credit</header-in-text></quote>.</text></paragraph></subsection> 
<subsection id="H8907F0DE0E164B2CB307AF1F3110E733"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2005.</text> </subsection></section>
