<official-title>To amend the Animal Welfare Act to strengthen the ability of the Secretary of Agriculture to regulate the pet industry.</official-title>

<section id="HC2B667C72B6F4B0AAE37C24F37BC1D5F" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pet Animal Welfare Statute of 2005</short-title></quote>.</text></section> 
<section id="H1B4648B6F730424BBCFCB77C91D591DF"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 2 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2132">7 U.S.C. 2132</external-xref>) is amended—</text> 
<paragraph id="H39D990442AAC40A98CA5CAD4A4BEDE00"><enum>(1)</enum><text>by redesignating subsections (a), (b), (c), (d), (e), (f), (g), (h), (i), (j), (k), (l), (m), (n), and (o) as subsections (k), (o), (c), (p), (m), (e), (a), (f), (j), (b), (g), (h), (l), (d), and (i), respectively and moving the subsections so as to appear in alphabetical order;</text></paragraph> 
<paragraph id="H3D7E8ADCCA3D4CFCA21BABFEDD04AF2E"><enum>(2)</enum><text>in subsection (e) (as redesignated by paragraph (1))—</text> 
<subparagraph id="H6DC8823E7FA949C2ABFC303B0019C4FB"><enum>(A)</enum><text>by striking <quote>or (2) any</quote> and all that follows through <quote>include—</quote> and inserting <quote>(2) any dog for hunting, security, or breeding purposes, or (3) any dog imported from outside the United States, unless the dog is imported by the person for the use and enjoyment of the person, except that this term does not include—</quote>;</text></subparagraph> 
<subparagraph id="HBE91DDD4F5E0418185FDE4E5EB98EC8"><enum>(B)</enum><text>in clause (i), by inserting <quote>, or which sells any dogs imported from outside the United States</quote> before the semicolon; and</text></subparagraph> 
<subparagraph id="H49261960DEB44D988C4BC7A4EDFE79D7"><enum>(C)</enum><text>by striking clause (ii) and inserting the following:</text>

<clause id="H7D0F9E5D016840CDB25C751F00C7AE52"><enum>(ii)</enum><text>any person who, during any calendar year—</text> 
<subclause id="H1540705EDC00485A87A06835E6D4C8BD"><enum>(I)</enum> 
<item commented="no" display-inline="yes-display-inline" id="H9A355E6577F24E428026487352E41DCE"><enum>(aa)</enum><text>sells not more than 25 dogs or cats at wholesale or to the public; or</text></item> 
<item id="HA12FD8FF42B34E45B97F4E1044D3A853" indent="up1"><enum>(bb)</enum><text>does not whelp more than 6 litters of dogs or cats and sells only dogs or cats bred or raised on the premises of the person directly at retail to persons who purchase such animals for their own use and enjoyment and not for resale; and</text></item></subclause> 
<subclause id="H95F0A436D2E44433B3DEFF27CA756F84"><enum>(II)</enum><text>derives not more than $500 gross income from the sale of other animals;</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HD4E787B965404FBDABADB741D24E905B"><enum>(3)</enum><text>by inserting after subsection (m) (as redesignated by subsection (a)) the following:</text>

<subsection id="H1B6F9CCB18B8406EB3B7B551D845B4A7"><enum>(n)</enum><header>Retail pet store</header> 
<paragraph id="HAC928B1DC6FC491FB5EE8099405200A"><enum>(1)</enum><header>In general</header><text>The term <term>retail pet store</term> means a public retail establishment that sells animals commonly kept as pets in households in the United States, including—</text> 
<subparagraph id="HECCE71E7B6274A9E81DB4498B4AADCC1"><enum>(A)</enum><text>dogs;</text></subparagraph> 
<subparagraph id="HF5AD79A1AEBC45958DBB9C5877338B43"><enum>(B)</enum><text>cats;</text></subparagraph> 
<subparagraph id="H39D4EB18B09647D000583BA665DB31EF"><enum>(C)</enum><text>guinea pigs;</text></subparagraph> 
<subparagraph id="H529A0B045A7144BE923149FA615FB097"><enum>(D)</enum><text>rabbits; and</text></subparagraph> 
<subparagraph id="H00651E5236874C3EAFDDCB8DD2F97D2C"><enum>(E)</enum><text>hamsters.</text></subparagraph></paragraph> 
<paragraph id="H989A1E5EC3D94BA58B904FEA45544BA3"><enum>(2)</enum><header>Exclusion</header><text>The term <term>retail pet store</term> does not include—</text> 
<subparagraph id="HF17F2B96045349FD9DF66F69546F977E"><enum>(A)</enum><text>a person breeding animals to sell to the public as pets;</text></subparagraph> 
<subparagraph id="H166D62314F574CF9BDC6E201E7708A8"><enum>(B)</enum><text>a person selling hunting, security, or breeding dogs; or</text></subparagraph> 
<subparagraph id="H7D2F49AF204641C888BD03E99B322572"><enum>(C)</enum><text>a person selling wild animals.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HAB6B6E9CE76D409B9BCE804381274C82"><enum>3.</enum><header>Access to source records for dogs and cats</header><text display-inline="no-display-inline">Section 10 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2140">7 U.S.C. 2140</external-xref>) is amended—</text> 
<paragraph id="HCD9EAAF998254316858DBB2E4D948DBA"><enum>(1)</enum><text display-inline="yes-display-inline">in the first sentence, by inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general</header-in-text>.—</quote> before <quote>Dealers</quote>; and</text></paragraph> 
<paragraph id="H33C4BC0514D4459B9C5D61D517367071"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="H441CA81DAFDB4DDA0026BD87E7384F0"><enum>(b)</enum><header>Access to source records for dogs and cats</header><text>Notwithstanding any other provision of this Act, all dealers and retail pet stores shall prepare, retain, and make available at all reasonable times for inspection and copying by the Secretary, for such reasonable period of time as the Secretary may prescribe, a record of—</text> 
<paragraph id="H35AE5856302B4AE99F00666476F1D39D"><enum>(1)</enum><text>the name and address of the person from whom each dog or cat was purchased or otherwise acquired; and</text></paragraph> 
<paragraph id="HD7A920E4654C48728715FA7E167B00A7"><enum>(2)</enum><text>whether the person from whom each dog or cat was acquired is required to be licensed or registered under this Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H7B742B1C4D5B488199BD986610B7CAE"><enum>4.</enum><header>Extension of temporary suspension period</header><text display-inline="no-display-inline">Section 19(a) of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2149">7 U.S.C. 2149</external-xref>) is amended—</text> 
<paragraph id="H11A98FCAF358419EA70080EFEA8F142E"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(1)</quote> after <quote>(a)</quote>; and</text></paragraph> 
<paragraph id="H3541F4860E4A417DA752CC673EC78F7"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HA6968DBDB72B4FB884292E64D5EC8160" style="OLC"> 
<paragraph id="HE8D975F5B5884EB497165369FAD7CFA0" indent="up1"><enum>(2)</enum><header>Extension of temporary suspension period</header><text>If the Secretary has reason to believe that a violation that results in a temporary suspension pursuant to paragraph (1) is continuing or will continue after the expiration of the 21-day temporary suspension period described in that paragraph, and the violation will place the health of any animal in serious danger in violation of this Act, the Secretary may extend the temporary suspension period for such additional period as is necessary to ensure that the health of an animal is not in serious danger, as determined by the Secretary, but not to exceed 60 days.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HEA0B3E873CD0438EB31795D0DF25F61"><enum>5.</enum><header>Authority to apply for injunctions</header><text display-inline="no-display-inline">Section 29 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2159">7 U.S.C. 2159</external-xref>) is amended—</text> 
<paragraph id="H3CDCC48F589246FB8F07A324BCF5BEED"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by inserting <quote>or that any person is acting as a dealer or exhibitor without a valid license that has not been suspended or revoked, as required by this Act,</quote> after <quote>promulgated thereunder,</quote>;</text></paragraph> 
<paragraph id="H59FB83FC99AC418A8FF68425806D2048"><enum>(2)</enum><text>in subsection (b), by striking the last sentence; and</text></paragraph> 
<paragraph id="H192E942F90124935AF68F4C240038D12"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HB7D88F872FF7463AA047505734C2E3B6" style="OLC"> 
<subsection id="H43A218BD72F44512AAEDDCFA030D02C"><enum>(c)</enum><header>Injunctions; representation</header> 
<paragraph id="H246F6B1D5A554F54806D7541BD0031A5"><enum>(1)</enum><header>Injunctions</header><text>The Secretary may apply directly to the appropriate United States district court for a temporary restraining order or injunction described in subsection (a).</text></paragraph> 
<paragraph id="H0DBD69B0C8924DED0048D4EB9DEA5525"><enum>(2)</enum><header>Representation</header><text>Attorneys of the Department of Agriculture may represent the Secretary in United States district court in any civil action brought under this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HD38A50B7C281482A9D71F0398C93BB8"><enum>6.</enum><header>Conforming amendment</header><text display-inline="no-display-inline">Section 3 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2133">7 U.S.C. 2133</external-xref>) is amended by striking <quote>: <italic>Provided however</italic>,</quote> and all that follows.</text></section> 
<section id="HDDC93141A4E34543932295F214F4CC56"><enum>7.</enum><header>Effect on State law</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act preempts any State law (including a regulation) that provides stricter requirements than the requirements provided in the amendments made by this Act.</text></section>
