<official-title>To amend the Bank Holding Company Act of 1956 to clarify that real estate brokerage activities and real estate management activities are authorized financial activities for financial holding companies and financial subsidiaries of national banks, and for other purposes.</official-title>

<section id="H4DAA1F6B292F4AECA298EB1F7E0989AB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Choice and Competition in Real Estate Act of 2005</short-title></quote>.</text></section> 
<section id="H1DA6F9D8FF67413D8C5214FA545D7262"><enum>2.</enum><header>Clarification that certain real estate activities are financial activities</header> 
<subsection id="H18E6752CBC914713B6842B8349016B40"><enum>(a)</enum><header>In general</header><text>Section 4(k)(4) of the Bank Holding Company Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/12/1843">12 U.S.C. 1843(k)(4)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H6706DE04C43E4CAABD86F535F95FC232"><enum>(J)</enum><text>Engaging in real estate brokerage activities and real estate management activities.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4BC1CD15C41D4D50BB75D9CCFF2778B"><enum>(b)</enum><header>Definitions</header><text>Section 2 of the Bank Holding Company Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/12/1841">12 U.S.C. 1841</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H27999AE1D41A4942A26FED75C45F82EF"><enum>(r)</enum><header>Definitions relating to financial activities</header> 
<paragraph id="HF38A9AA7F1F8404CBC1B3FE59F260051"><enum>(1)</enum><header>Real estate brokerage activity</header><text display-inline="yes-display-inline">The term <term>real estate brokerage activity</term> means any activity that involves offering or providing real estate brokerage services to the public, including—</text> 
<subparagraph id="HE4946131104A4A8FB4DF6DAFC8C651B1"><enum>(A)</enum><text>acting as an agent for a buyer, seller, lessor, or lessee of real property;</text></subparagraph> 
<subparagraph id="HDFB8A2A1504C4A1198B5A199004CD4A4"><enum>(B)</enum><text>listing or advertising real property for sale, purchase, lease, rental, or exchange;</text></subparagraph> 
<subparagraph id="HAC878689859A4EFAAB005BA2E1CB10B0"><enum>(C)</enum><text>providing advice in connection with sale, purchase, lease, rental, or exchange of real property;</text></subparagraph> 
<subparagraph id="H13358EE983C04AE9B100CFE3FD4DBED3"><enum>(D)</enum><text>bringing together parties interested in the sale, purchase, lease, rental, or exchange of real property;</text></subparagraph> 
<subparagraph id="HAF9812AE755D42A3932E5E70F917DB1"><enum>(E)</enum><text>negotiating, on behalf of any party, any portion of a contract relating to the sale, purchase, lease, rental, or exchange of real property (other than in connection with providing financing with respect to any such transaction);</text></subparagraph> 
<subparagraph id="HFCA8E42A77C44A959228C185E2DA127F"><enum>(F)</enum><text>engaging in any activity for which a person engaged in the activity is required to be registered or licensed as a real estate agent or broker under any applicable law; and</text></subparagraph> 
<subparagraph id="H8326B8B8DD0F42E3867D004374EA7C16"><enum>(G)</enum><text>offering to engage in any activity, or act in any capacity, described in subparagraph (A), (B), (C), (D), (E), or (F).</text></subparagraph></paragraph> 
<paragraph id="H46BDCD67D15640DEBA099D98CF5433B3"><enum>(2)</enum><header>Real estate management activity</header><text display-inline="yes-display-inline">The term <term>real estate management activity</term> means any activity that involves offering or providing real estate management services to the public, including—</text> 
<subparagraph id="H71D02E2501E043FE92271B3BD89E5BD5"><enum>(A)</enum><text>procuring any tenant or lessee for any real property;</text></subparagraph> 
<subparagraph id="H41912A3344C246C0A5C9CB392C7CC024"><enum>(B)</enum><text>negotiating leases of real property;</text></subparagraph> 
<subparagraph id="H2699279540AF43EFBBFDF3BE66575693"><enum>(C)</enum><text>maintaining security deposits on behalf of any tenant or lessor of real property (other than as a depository institution for any person providing real estate management services for any tenant or lessor of real property);</text></subparagraph> 
<subparagraph id="HDC26EB09A9B14608B7C9FF24B7EDEF00"><enum>(D)</enum><text>billing and collecting rental payments with respect to real property or providing periodic accounting for such payments;</text></subparagraph> 
<subparagraph id="HF2FBC4E6A9104CACB5D900E09B007F73"><enum>(E)</enum><text>making principal, interest, insurance, tax, or utility payments with respect to real property (other than as a depository institution or other financial institution on behalf of, and at the direction of, an account holder at the institution);</text></subparagraph> 
<subparagraph id="H58323588EEF64AB5988D4777DC19AEC4"><enum>(F)</enum><text>overseeing the inspection, maintenance, and upkeep of real property, generally; and</text></subparagraph> 
<subparagraph id="H325970EE003A42EC90BAD32DBE4E74A8"><enum>(G)</enum><text>offering to engage in any activity, or act in any capacity, described in subparagraphs (A), (B), (C), (D), (E), or (F).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> </section>
