<official-title>To ensure that dwelling units assisted under the rental housing voucher program under section 8 of the United States Housing Act of 1937 comply with housing quality standards.</official-title>

<section id="H967E15A866CD4B56BFC63E6F35815337" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Landlord Accountability Act of 2005</short-title></quote>.</text></section>
<section id="H460B849684BE46D8A038D138313E0B8"><enum>2.</enum><header>Enforcement of housing quality standards</header>
<subsection id="H8F00C567F8AF4B95BAE4A5DAA15032AB"><enum>(a)</enum><header>In general</header><text>Paragraph (8) of section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(8)</external-xref>) is amended—</text>
<paragraph id="H77B6B259CC8C485ABDEF35A8CC12B131"><enum>(1)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph">pha’s</header-in-text></quote> and inserting <quote><header-in-text level="paragraph">phas and housing quality standards</header-in-text></quote>; and</text></paragraph>
<paragraph id="HB1812378162A4669BEF3E1F6B53586C4"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="HB782553DDB28491390256138DEAC003D"><enum>(F)</enum><header>Enforcement of housing quality standards</header>
<clause id="HC6584F709190467D87E753001619B6C"><enum>(i)</enum><header>Determination of noncompliance</header><text>A dwelling unit that is covered by a housing assistance payments contract under this subsection shall be considered, for purposes of this subparagraph, to be in noncompliance with the housing quality standards under subparagraph (B) if—</text>
<subclause id="H2B2FCC87F8C74AA0A9011292114BF1B5"><enum>(I)</enum><text>the public housing agency or an inspector authorized by the State or unit of local government determines upon inspection of the unit that the unit fails to comply with such standards;</text></subclause>
<subclause id="H35305A3C54104B738DD1EA744B41A465"><enum>(II)</enum><text>the agency or inspector notifies the owner of the unit in writing of such failure to comply; and</text></subclause>
<subclause id="H06CF0879F64F4C509C96717DFDE0C0D2"><enum>(III) </enum><text>the failure to comply is not corrected within 90 days after receipt of such notice.</text></subclause></clause>
<clause id="H410E733C3C374235B71E68F0DC83E62C"><enum>(ii)</enum><header>Withholding and release of assistance amounts</header><text>The public housing agency shall withhold all of the assistance amounts under this subsection with respect to a dwelling unit that is in noncompliance with housing quality standards under subparagraph (B). Subject to clause (iii), the agency shall promptly release any withheld amounts to the owner of the dwelling unit upon completion of repairs that remedy such noncompliance.</text></clause>
<clause id="H2BC4A8EA020C4D9DB0325436004B4FE2"><enum>(iii)</enum><header>Use of withheld assistance to pay for repairs</header><text>The public housing agency may use such amounts withheld to make repairs to the dwelling unit or to contract to have repairs made (or to contract with an inspector referred to in clause (i)(I) to make or contract for such repairs), and shall subtract the cost of such repairs from any amounts released to the owner of the unit upon remedying such noncompliance.</text></clause>
<clause id="HEEEFF4457B8D4CF58200334B19CAA925"><enum>(iv)</enum><header>Protection of tenants</header><text>An owner of a dwelling unit may not terminate the tenancy of any tenant or refuse to renew a lease for such unit because of the withholding of assistance pursuant to this subparagraph.</text></clause>
<clause id="H5345559BE8BD409CB3B042D08009BDF"><enum>(v)</enum><header>Termination of lease or assistance payments contract</header><text>If assistance amounts under this section for a dwelling unit are withheld pursuant to clause (ii) and the owner does not correct the noncompliance before the expiration of the lease for the dwelling unit and such lease is not renewed, the Secretary shall recapture any such amounts from the public housing agency.</text></clause>
<clause id="HDDFB83176E5B470CA441B2477764A019"><enum>(vi)</enum><header>Applicability</header><text>This subparagraph shall apply to any dwelling unit for which a housing assistance payments contract is entered into or renewed after the date of the effectiveness of the regulations implementing this subparagraph.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="HF9355A6847244B2DAFA9FF48D089C753"><enum>(b)</enum><header>Regulations</header><text>The Secretary of Housing and Urban Development shall issue any regulations necessary to carry out the amendment made by subsection (a) not later than the expiration of the 12-month period beginning upon the date of the enactment of this Act. Such regulations shall take effect not later than the expiration of the 90-day period beginning upon such issuance.</text></subsection></section>
