<official-title>To amend title XIX of the Social Security Act to require Medicaid drug utilization review programs to deny coverage of erectile dysfunction drugs for individuals registered (or required to be registered) as sex offenders.</official-title>

<section id="HA04B0D02457F426686448D7725A16D00" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Requiring medicaid drug utilization review programs to deny coverage of erectile dysfunction drugs for individuals registered (or required to be registered) as sex offenders</header> 
<subsection id="H58517B31ACC04F09A7A623E84C003C29"><enum>(a)</enum><header>In general</header><text>Section 1927(g)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-8">42 U.S.C. 1396r–8(g)(2)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="HB873F91AD8E24338A7E840DB96FFFB77"><enum>(E)</enum><header>Denial of coverage of erectile dysfunction drugs for individuals registered (or required to be registered) as sex offenders</header> 
<clause id="H0A2FA0BA1FA34BD8B6B4B50054726963"><enum>(i)</enum><header>In general</header><text>The program shall provide for denying coverage for any erectile dysfunction drug for any individual who is registered (or a person required to register) under section 170101 or 170102 of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/14071">42 U.S.C. 14071</external-xref>, 14072).</text></clause> 
<clause id="HBB31D74F537B425AA968E0C8AE76BDA1"><enum>(ii)</enum><header>Report on enforcement</header><text>Not later than 6 months after the date of the enactment of this subparagraph, each State shall submit to the Secretary a report on specific steps the State has taken under its program to assure the denial of coverage described in clause (i).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC667A02D33AB41318FB5A78320426479"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date of the enactment of this Act and shall apply to the denial of drugs furnished on or after such date.</text></subsection></section>
