<official-title>To protect innocent parties from certain fees imposed by depository institutions for dishonored checks, and for other purposes.</official-title>

<section id="H373A030336634939A518F449C78E7500" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Innocent Check Depositor Protection Act</short-title></quote>.</text></section>
<section id="H9801C23AE1CA4E0698EB1923D13C187F"><enum>2.</enum><header>Certain check dishonorment fees prohibited</header>
<subsection id="HF44D202F5E1347A4AD24A5EA953BDBB4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 607 of the Expedited Funds Availability Act (<external-xref legal-doc="usc" parsable-cite="usc/12/4006">12 U.S.C. 4006</external-xref>) (relating to miscellaneous provisions) is amended by adding at the end the following new subsection:</text>

<subsection id="H3B51CF3C3A1E46B28BA696B5A4DF8E44"><enum>(f)</enum><header>Fees on dishonored checks</header>
<paragraph id="H4517B65C9EA34CBB8BE5F90071E07F62"><enum>(1)</enum><header>Receiving depository institution</header><text display-inline="yes-display-inline">In the case of a check drawn on an account at an originating institution which is dishonored by the originating institution due to the lack of sufficient funds in such account to pay the check, a receiving depository institution may not impose any fee on the depositor, in connection with such check, due to such dishonorment. </text></paragraph>
<paragraph id="H58F553D724C34242A1070086AFFE87EB"><enum>(2)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">No provision of this section shall be construed as affecting any intervening depository institution or the costs of the services provided by such depository institution.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HBC914730222C4088A55200948DC2A45B"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by this section shall apply after the end of the 180-day period beginning on the date of the enactment of this Act.</text></subsection></section>
