<official-title>To amend titles XVIII and XIX of the Social Security Act to prohibit coverage under the Medicare and Medicaid Programs of sex-enhancing drugs for individuals convicted of a sex offense.</official-title>

<section id="HEFEFB544674644A0AF95689453949EF" section-type="section-one"><enum>1.</enum><header>Prohibition of coverage under the medicare and medicaid programs of sex-enhancing drugs for individuals convicted of a sex offense</header> 
<subsection id="H94568AE613054AB286FCF0FFD123647"><enum>(a)</enum><header>Medicare program</header><text display-inline="yes-display-inline">Section 1860D-2(e)(2)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-102">42 U.S.C. 1395w–102(e)(2)(A)</external-xref>) is amended by adding at the end the following: <quote>Such term also does not include prescription drugs, such as Viagra, used for sex enhancement for any individual who has been convicted of a sex offense, as defined by the Secretary and including rape, sexual assault, and child molestation.</quote>.</text></subsection> 
<subsection id="H26F746D4C1024E94989B1E4E12B8D6A9"><enum>(b)</enum><header>Medicaid program</header><text>The first sentence of section 1905(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended, in the matter following paragraph (28)—</text> 
<paragraph id="HCC19AA3699144B068E018B1B68F684FE"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of subparagraph (A);</text></paragraph> 
<paragraph id="HC5D7383FB2CA4C2291AAE9AEEADC667"><enum>(2)</enum><text>by striking the period at the end of subparagraph (B) and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="HAEF72E381EC44299B2BD1930D19FBB"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="H4A6B4533F6914E7200FE9484C8669462" indent="up1"><enum>(C)</enum><text>any such payments with respect to prescribed drugs, such as Viagra, used for sex enhancement for any individual who has been convicted of a sex offense, as defined by the Secretary under section 1860D–1(e)(2)(A).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HF331360898EF4E308E3141A85BF264AB"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act and shall apply to drugs dispensed after such date.</text> </subsection></section>
