<official-title>To amend the Immigration and Nationality Act to modify the requirements for a child born abroad and out of wedlock to acquire citizenship based on the citizenship of the child’s father, and for other purposes.</official-title>

<section section-type="section-one" id="H6AA92C706A744031853992B428055C22" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Father’s Equity Act</short-title></quote>.</text></section> 
<section id="HA8E8F7E0EC97478FA506DE0169C9FFF1"><enum>2.</enum><header>Acquisition of citizenship for children born abroad and out of wedlock to a United States citizen father</header><text display-inline="no-display-inline">Section 309(a) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1409">8 U.S.C. 1409(a)</external-xref>) is amended—</text> 
<paragraph id="H6939F41979174F1D9EC17390F08FCCD1"><enum>(1)</enum><text>in paragraph (2), by adding <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="HD1657A83583E40CF9345A182BAD300F3"><enum>(2)</enum><text>by striking paragraph (3);</text></paragraph> 
<paragraph id="HC34B4FCFE9754452B19BF366FE0682D5"><enum>(3)</enum><text>in paragraph (4), by striking <quote>while the person is under the age of 18 years—</quote> and inserting <quote>at any time—</quote>; and</text></paragraph> 
<paragraph id="H86F9D850BDEF49F3AB2697BAFC40099"><enum>(4)</enum><text>by redesignating paragraph (4) as paragraph (3).</text></paragraph></section> 
<section id="HCA5A5C1442BE4785A83307912BB84057"><enum>3.</enum><header>Clarification regarding deceased parents of children born abroad and out of wedlock</header><text display-inline="no-display-inline">Section 309 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1409">8 U.S.C. 1409</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block act-name="Immigration and Nationality Act" id="H80D8CD2D4F5D43FCA83E00C22F74EA56"> 
<subsection id="H145A26E2654D4869BE54050045525255"><enum>(d)</enum><text>Nothing in this section shall be construed to preclude a person who is a citizen or national of the United States by virtue of a provision of this section from establishing such status under this title after the death of the person’s father, mother, or parents.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HC7A1C4C5B3E44A9CA972E445DBBA5EE5"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply to persons born out of wedlock who are alive on or after the date of the enactment of this Act.</text></section>
