<section section-type="section-one" id="H300A7F8B48F24138AC904C274191FE" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Comprehensive Immigration Fairness Act</short-title></quote>.</text></section> 
<title id="H324FC13F03C9411393BF987D197E3449"><enum>I</enum><header>Family reunification and discretionary relief</header> 
<section id="H524BF88DCA9649C093D4DBE74FF77DB8"><enum>101.</enum><header>Permanent application of Section 245<enum-in-header>(i)</enum-in-header></header><text display-inline="no-display-inline">Section 245(i) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255(i)</external-xref>) is amended—</text> 
<paragraph id="H65C9C68F8FFE458FA0E289C9BC006DA1"><enum>(1)</enum><text>by inserting <quote>and</quote> at the end of paragraph (1)(A);</text></paragraph> 
<paragraph id="H0CE24E891BDD4E3BB27371A165005382"><enum>(2)</enum><text>by amending paragraph (1)(B) to read as follows:</text>

<section id="H471F51B66FA44E00A4FFF67F86255EED"><enum>102.</enum><header>Discretionary waiver of inadmissibility based on unlawful presence, failure to attend removal proceedings, and misrepresentations</header> 
<subsection id="HB6350CD4366D43F2BB5D8053982533EE"><enum>(a)</enum><header>In general</header><text>Section 212(i) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(i)</external-xref>) is amended to read as follows:</text> 
<quoted-block act-name="Immigration and Nationality Act" id="H6E38DAB044704B3E95A3941120B73688"> 
<subsection id="HB653C249AAC8495E98CD7DD0FFD1CFB6"><enum>(i)</enum><text>The Secretary of Homeland Security may waive the application of subparagraph (A)(i) or (B), or clause (i) or (ii) of subparagraph (C), of subsection (a)(6) in the case of an immigrant who is the parent, spouse, son, or daughter of a United States citizen or of an alien lawfully admitted to the United States for permanent residence, if it is established to the satisfaction of the Secretary that the refusal of admission to the United States of such immigrant would result in hardship to the immigrant or to such citizen or lawful permanent resident parent, spouse, son, or daughter.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC103119CBE77431B8C3D90664722671D"><enum>(b)</enum><header>Conforming amendments</header><text>Section 212(a)(6) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(6)</external-xref>) is amended—</text> 
<paragraph id="HDD7C0DF5F1B142D3A9B89D00695DE498"><enum>(1)</enum><text>in subparagraph (A), by adding at the end the following:</text>

<subsection id="HF50824C88020420890D2ADB1DBAB9B6E"><enum>(a)</enum><header>In general</header><text>Section 212(d) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)</external-xref>) is amended by adding at the end the following:</text>

<section id="HCC2888B1E0F84EE7B7025D21B5D7EC46"><enum>104.</enum><header>Addressing the problem of visa number backlogs for the family members of citizens and lawful permanent residents</header> 
<subsection id="H5CB73161F32847BC8513E0A917CE5577"><enum>(a)</enum><header>Classes of nonimmigrant aliens</header><text>Section 101(a)(15)(K) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(K)</external-xref>) is amended—</text> 
<paragraph id="H22C9C5131E94409B8486674E588B9FC8"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of clause (ii);</text></paragraph> 
<paragraph id="H61CB599036B246580000EF6033005947"><enum>(2)</enum><text>by adding <quote>or</quote> at the end of clause (iii); and</text></paragraph> 
<paragraph id="H80D69515420D4F0587F8E7F98D54B1DF"><enum>(3)</enum><text>by adding at the end the following:</text>

<subclause display-inline="yes-display-inline" id="H48187BC9174E431285568CB7BE1B00A4"><enum>(I)</enum><text>has concluded a valid marriage with an alien lawfully admitted for permanent residence, is the parent of a citizen of the United States, or is the son or daughter of an alien lawfully admitted for permanent residence or a citizen of the United States; (II) is the beneficiary of a petition to accord immigrant status on the basis of such family relationship that was filed under section 204 by such family member; (III) has waited more than 6 months for the approval of such petition or the availability to the alien of an immigrant visa; and (IV) seeks to enter the United States to await the approval of such petition and the availability to the alien of an immigrant visa;</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H53156824F9964D0EA5B3F3DEDCC54463"><enum>(b)</enum><header>Admission of nonimmigrants</header><text>Section 214(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(d)</external-xref>) is amended—</text> 
<paragraph id="H6F4FFB2942C3422197B9733DBCDF9DF7"><enum>(1)</enum><text>by striking <quote>(d)</quote> and inserting <quote>(d)(1)</quote>; and</text></paragraph> 
<paragraph id="H32807E3FFEF04E728D304F8900B1AD6B"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block id="HE99B25B8F6E042739ED64DA1A6781702"> 
<paragraph indent="up1" id="HCA00D9EC52834C47A436E14A4D1067C"><enum>(2)</enum><text>A visa shall not be issued under the provisions of section 101(a)(15)(K)(iv) until the consular officer has received a petition filed in the United States by the lawful permanent resident or citizen relative of the applying alien and approved by the Secretary of Homeland Security. The petition shall be in such form and contain such information as the Secretary shall, by regulation, prescribe.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HF9B655B174974131BCE93DA2921F2076"><enum>105.</enum><header>Waiver of aggravated felony consequences</header><text display-inline="no-display-inline">Section 101 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block act-name="Immigration and Nationality Act" id="H1C78FB0741884F25B55E7E9D79576E89"> 
<subsection id="H945F12018D0D4FF9936280E532C70045"><enum>(j)</enum><text>For purposes of this Act, and notwithstanding subsection (a)(43), the Secretary of Homeland Security may treat any conviction that did not result in incarceration for more than 1 year as if such conviction were not a conviction for an aggravated felony. This discretion may be exercised for humanitarian purposes, to assure family unity, or when it is otherwise in the public interest.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H53D5B13A58374849B606D09300349474"><enum>106.</enum><header>Age-out protection for children</header> 
<subsection id="H68A45CF3480F4462AD44C3555C45A9E6"><enum>(a)</enum><header>In general</header><text>Chapter 1 of title IV of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note) is amended by adding at the end the following:</text> 
<quoted-block style="traditional" other-style="archaic" act-name="Immigration and Nationality Act" id="HC0033332256A4414A7E14B39DED7435C"> 
<section id="H7E08F9468AA944BEAA4468868898AF61"><enum>408.</enum><header>Age-out protection for children</header> 
<subsection id="H9E0B7A60919B47E18082A02DA57D3522" display-inline="yes-display-inline"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of an application initially to grant a benefit under this Act (other than an application for naturalization) that otherwise would be granted only after a determination that the beneficiary of the application is a child (such as classification as an immediate relative under section 201(b)(2)(A)(i)), if the application is neither approved nor denied (on procedural or substantive grounds) during the 90-day period beginning on the date of the filing of the application, the beneficiary shall be considered to be a child for all purposes related to the receipt of the benefit if the beneficiary was a child on the last day of such 90-day period, and the beneficiary shall not otherwise be prejudiced with respect to such determination by such delay, and shall be considered to be a child under this Act for all purposes related to such application.</text> </subsection> 
<subsection id="HA8EFECEA00CE4A2B9F56EE615473E8BB"><enum>(b)</enum><header>Termination of benefit</header><text>Subsection (a) shall remain in effect until the termination of the 1-year period beginning on the date on which the application described in such paragraph is approved.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3A3B4ADDB8A447E7B97694A8A25C1DA"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> is amended by inserting after the item relating to section 407 the following:</text>

<subsection id="HE094D18711F74C7581AD5578AEA56CF6"><enum>(a)</enum><header>In general</header><text>Section 101(b)(1)(E)(i) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(b)(1)(E)(i)</external-xref>) is amended by striking <quote>a child adopted while under the age of sixteen years</quote> and inserting <quote>a child, under the age of 16 when adoption proceedings were initiated,</quote>.</text></subsection> 
<subsection id="HCBCA44AD69224097A3B3E6BCFD48FDAE"><enum>(b)</enum><header>Special rule for siblings</header><text>Section 101(b)(1)(E)(ii)(III) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(b)(1)(E)(ii)(III)</external-xref>) is amended by striking <quote>adopted while under the age of 18 years</quote> and inserting <quote>under the age of 18 when adoption proceedings were initiated</quote>.</text></subsection></section> 
<section id="H1F0288844490481F897CA89118E6E8BC"><enum>108.</enum><header>Discretionary waiver to admit persons in unusual circumstances</header> 
<subsection id="H2127E55F822B4EF19C99F1C1B020A700"><enum>(a)</enum><header>New general waiver</header><text>Section 212(d) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block act-name="Immigration and Nationality Act" id="H9B9477DE257E46359F9F05000016F3B7"> 
<paragraph id="HC9B2279F31C24AA7B199B18FB30350EB"><enum>(13)</enum><text>The Secretary of Homeland Security may, in the discretion of such Secretary for humanitarian purposes, to assure family unity, or when it is otherwise in the public interest, waive the application of subparagraph (B) or (G) of subsection (a)(6), clause (i) or (ii) of subsection (a)(9)(A), or subsection (a)(9)(B)(i), in unusual circumstances. For purposes of the preceding sentence, an instance of battering or extreme cruelty is deemed to constitute unusual circumstances in the case where it is inflicted on an alien (or a child of an alien) by the alien’s United States citizen or lawful permanent resident spouse, parent, child, son, or daughter.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H0FC36F6F366D46C9963F889796E32F27"><enum>(1)</enum><header>Certain aliens previously removed</header><text>Section 212(a)(9)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(9)(A)</external-xref>) is amended by adding at the end the following:</text>

<title id="H078FB2316A504E2486ADB9D5EEA81DC"><enum>II</enum><header>Earned access to legalization and registry update</header> 
<section id="HCD5E2E56F21B4D7C809B3CB400ABA25D"><enum>201.</enum><header>Adjustment of status on the basis of earned access to legalization</header> 
<subsection id="HAF1610B56AE84FD39C6F00E107E3BB24"><enum>(a)</enum><header>In general</header><text>Chapter 5 of title II of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255 et seq.</external-xref>) is amended by inserting after section 245A the following:</text> 
<quoted-block style="traditional" other-style="archaic" act-name="Immigration and Nationality Act" id="H39A770DAD7CD4F3E86B2EDAE8DBBDB3D"> 
<section id="H4955AC2363B7413EBC504E8578DB3150"><enum>245B.</enum><header>Adjustment of status on the basis of earned access to legalization</header> 
<subsection id="H62A354C97EDE4BCB972995915092C510" display-inline="yes-display-inline"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security may adjust the status of an alien to that of an alien lawfully admitted for permanent residence if the alien—</text> 
<paragraph id="H4393F384508F48A1B313DB89337E8674"><enum>(1)</enum><text>was physically present in the United States for a continuous period of not less than 5 years immediately preceding the date on which this provision was enacted and has maintained continuous physical presence since then;</text></paragraph> 
<paragraph id="HFE1A956BFCFD45D681F2824E2B1CF333"><enum>(2)</enum><text>has at all times been a person of good moral character;</text></paragraph> 
<paragraph id="H9CD62F15E45B4263A8583E9385F7E29D"><enum>(3)</enum><text>has never been convicted of a criminal offense in the United States;</text></paragraph> 
<paragraph id="H5A918C8C80C546AB00D519B3F2B88778"><enum>(4)</enum><text>in the case of an alien who is 18 years of age or older, but who is not over the age of 65, has successfully completed a course on reading, writing, and speaking words in ordinary usage in the English language, unless unable to do so on account of physical or developmental disability or mental impairment;</text></paragraph> 
<paragraph id="H31F6C424609E4876BEE2E636593089D9"><enum>(5)</enum><text>in the case of an alien 18 years of age or older, has accepted the values and cultural life of the United States; and</text></paragraph> 
<paragraph id="H5AAD244F6DFA49EBAC0025657B89C4F2"><enum>(6)</enum><text>in the case of an alien 18 years of age or older, has performed at least 40 hours of community service.</text></paragraph> </subsection> 
<subsection id="H35DBA114A39D458397F016588B4F4175"><enum>(b)</enum><header>Treatment of brief, casual, and innocent absences</header><text>An alien shall not be considered to have failed to maintain a continuous presence in the United States for purposes of subsection (a)(1) by virtue of brief, casual, and innocent absences from the United States.</text></subsection> 
<subsection id="HDA483D3076D94B11BFDFBCB6AB43ED08"><enum>(c)</enum><header>Admissible as immigrant</header> 
<paragraph id="H1008FED9FA0E4E80B6308F2D37ABAD47"><enum>(1)</enum><header>In general</header><text>The alien shall establish that the alien is admissible to the United States as immigrant, except as otherwise provided in paragraph (2).</text></paragraph> 
<paragraph id="H61179D75D6FA4497A6F8107F3BA4DA7F"><enum>(2)</enum><header>Exceptions</header><text>The provisions of paragraphs (5), (6)(A), (6)(B), (6)(C), (6)(F), (6)(G), (7)(A), (9)(B), and (9)(C)(i)(I) of section 212(a) shall not apply in the determination of an alien’s admissibility under this section.</text></paragraph></subsection> 
<subsection id="HFAAFB083EA4C4D9D9786FEECE00AB6C"><enum>(d)</enum><header>Security and law enforcement clearances</header><text>The alien, if over 15 years of age, shall submit fingerprints in accordance with procedures established by the Secretary of Homeland Security. Such fingerprints shall be submitted to relevant Federal agencies to be checked against existing databases for information relating to criminal, national security, or other law enforcement actions that would render the alien ineligible for adjustment of status under this section. The Secretary of Homeland Security shall provide a process for challenging the accuracy of matches that result in a finding of ineligibility for adjustment of status.</text></subsection> 
<subsection id="HBF444E4EE9A044E4BDEC3BAABEA807"><enum>(e)</enum><header>Inapplicability of numerical limitations</header><text>When an alien is granted lawful permanent resident status under this subsection, the number of immigrant visas authorized to be issued under any provision of this Act shall not be reduced. The numerical limitations of sections 201 and 202 shall not apply to adjustment of status under this section.</text></subsection>

<subsection id="HCFE911F442474417AA6D70BABF77004E" display-inline="yes-display-inline"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">The Secretary of Homeland Security may adjust the status of an alien to that of an alien lawfully admitted for permanent residence if the alien is a child at the time of filing the application for such adjustment and establishes that the alien, at such time—</text> 
<paragraph id="H0CB7B6716A184834B436D9E298BC6131"><enum>(1)</enum><text>has been physically present and enrolled in school in the United States for a continuous period of not less than 5 years immediately preceding the date of such application, and during that period has been a person of good moral character;</text></paragraph> 
<paragraph id="H5E4B0CA45701435A9FE154A919A6AB73"><enum>(2)</enum><text>has fully integrated into life in the United States;</text></paragraph> 
<paragraph id="H45469B7193DC48B9A21161AB594E19C"><enum>(3)</enum><text>has learned English or is satisfactorily pursuing a course of study to achieve an understanding of English;</text></paragraph> 
<paragraph id="H75D1C11DE9904EDCBFEB67F4EBBD567"><enum>(4)</enum><text>is successfully pursuing an elementary school, middle school, high school, or college-level education; and</text></paragraph> 
<paragraph id="H0BD342D77533430582B09691E6012D20"><enum>(5)</enum><text>if older than 13 years of age, has performed at least 60 hours of community service.</text></paragraph> </subsection> 
<subsection id="HF4B7CB21987947AAAC539924033EE435"><enum>(b)</enum><header>Treatment of brief, casual, and innocent absences</header><text>An alien shall not be considered to have failed to maintain a continuous presence in the United States for purposes of subsection (a)(1) by virtue of brief, casual, and innocent absences from the United States.</text></subsection> 
<subsection id="H215CF7297FFC4A9782651364522022BD"><enum>(c)</enum><header>Admissible as immigrant</header> 
<paragraph id="HFD40E4C1C35E4E7AA7E7B1C38200848F"><enum>(1)</enum><header>In general</header><text>The alien shall establish that the alien is admissible to the United States as an immigrant, except as otherwise provided in paragraph (2).</text></paragraph> 
<paragraph id="H53C466AFB5984FE09743E7A74AE9E27"><enum>(2)</enum><header>Applicability of certain provisions</header> 
<subparagraph id="H52959EAD04434B64AD2CA2CD877F07D3"><enum>(A)</enum><header>Grounds of inadmissibility not applied</header><text>The provisions of paragraphs (5), (6)(A), (6)(B), (6)(C), (6)(F), (6)(G), (7)(A), (9)(B), and (9)(C) of section 212(a) shall not apply in the determination of an alien’s admissibility under this section.</text></subparagraph> 
<subparagraph id="H91B7A0A58CF84B09A90098487D3805AF"><enum>(B)</enum><header>Waiver of other grounds</header> 
<clause id="HC03583DA25474F8B877C1EA28DD99C99"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), the Secretary of Homeland Security may waive any other provision of section 212(a) in the case of an individual alien for humanitarian purposes, to assure family unity, or when it is otherwise in the public interest.</text></clause> 
<clause id="HB7E2C6FC62E7415EBD9C23ED00BB3BAB"><enum>(ii)</enum><header>Grounds that may not be waived</header><text>The following provisions of section 212(a) may not be waived by the Secretary under clause (i):</text> 
<subclause id="H64EB60B830E7499C813BA2C073DCBB35"><enum>(I)</enum><text>Paragraphs (2)(A) and (2)(B) (relating to criminals).</text></subclause> 
<subclause id="H1E6CFE8A8BA14D7C8C9856A3183E087C"><enum>(II)</enum><text>Paragraph (2)(C) (relating to drug offenses), except for so much of such paragraph as relates to a single offense of simple possession of 30 grams or less of marijuana.</text></subclause> 
<subclause id="H3A56E0001216484CAF7FF5834370CF8C"><enum>(III)</enum><text>Paragraph (3) (relating to security and related grounds).</text></subclause></clause></subparagraph></paragraph></subsection> 
<subsection id="H45DC51C145F54DE3BB6662CD99D105B3"><enum>(d)</enum><header>No numerical limitations</header><text>The numerical limitations of sections 201 and 202 shall not apply to adjustment of status under this section.</text></subsection> 
<subsection id="H796E5D871A2D44FAAB3DE92F9CFF3346"><enum>(e)</enum><header>Confidentiality of information</header><text>Except as provided in this section, neither the Secretary of Homeland Security, nor any other official or employee of the Department of Homeland Security, may—</text> 
<paragraph id="HFC249A5F94C0421091634508F100E9DA"><enum>(1)</enum><text>use information furnished by applicant for an application filed under this section for any purpose other than to make a determination on the application;</text></paragraph> 
<paragraph id="H1324B99CAB654F9F86C61253940186AC"><enum>(2)</enum><text>make any publication whereby the information furnished by any particular applicant can be identified; or</text></paragraph> 
<paragraph id="HE37AD3B02BE440A79D126495B384EB7E"><enum>(3)</enum><text>permit anyone other than the sworn officers and employees of the Department, the applicant, or a representative of the applicant to examine individual applications.</text></paragraph></subsection> 
<subsection id="H7E9770E09B924CE691801FB644FBE69C"><enum>(f)</enum><header>Dissemination of information</header><text>The Secretary of Homeland Security shall broadly disseminate information respecting the benefits which aliens may receive under this section and the requirements to obtain such benefits.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subparagraph id="HB4E58033CA754CB8BCFA058C7332AB08"><enum>(C)</enum><header>Discrimination based on immigration status</header><text>It is an unfair employment practice for any employer, except to the extent specifically authorized or required by law, to discriminate in any term or condition of employment against any individual employed by such employer on the basis of such individual’s immigration status.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H747BB411323148399193A9DA1205FF3B"><enum>(2)</enum><text>in subsection (c)(2), by adding at the end the following: <quote>The Special Counsel shall not disclose to the Secretary of Homeland Security or any other government agency or employee, and shall not cause to be published in a manner that discloses to the Secretary of Homeland Security or any other government agency or employee, any information obtained by the Special Counsel in any manner concerning the immigration status of any individual who has filed a charge under this section, or the identity of any individual or entity that is a party or witness to a proceedings brought pursuant to such charge. The Secretary of Homeland Security may not rely, in whole or in part, in any enforcement action or removal proceeding, upon any information obtained as a result of the filing or prosecution of an unfair immigration-related employment practice charge. For purposes of this paragraph, the term <term>Special Counsel</term> includes individuals formerly appointed to the position of Special Counsel and any current or former employee of the office of the Special Counsel. Whoever knowingly uses, publishes, or permits information to be used in violation of this paragraph shall be fined not more than $10,000</quote>.</text></paragraph></section> 
<section id="H811BC1A5309040BDAABFED00C8CCD73"><enum>302.</enum><header>Department of Labor task force</header><text display-inline="no-display-inline">The Secretary of Labor, in consultation with the Attorney General and the Secretary of Homeland Security, shall conduct a national study of American workplaces to determine the causes, extent, circumstances, and consequences, of exploitation of undocumented alien workers by their employers. As part of this study, the Secretary of Labor shall create a plan for targeted review of federal labor law enforcement in industries with a substantial immigrant workforce, for the purpose of identifying, monitoring, and deterring frequent or egregious violators of wage and hour, anti-discrimination, National Labor Relations Act, and workplace safety and health requirements. Not later than 18 months after the date of the enactment of this Act, the Secretary of Labor shall submit to the Congress a report describing the results of the study and the Secretary’s recommendations based on the study.</text></section> 
<section id="HEF827AB916744DF8B198F7AB37210464"><enum>303.</enum><header>Recruitment of American workers</header><text display-inline="no-display-inline">Section 214 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> is amended—</text> 
<paragraph id="H70782EA83F8F48D0BEBAEC29F66DFE95"><enum>(1)</enum><text>by redesignating subsections (m) (as added by section 105 of <external-xref legal-doc="public-law" parsable-cite="pl/106/313">Public Law 106–313</external-xref>), (n) (as added by section 107(e) of <external-xref legal-doc="public-law" parsable-cite="pl/106/386">Public Law 106–386</external-xref>), (o) (as added by section 1513(c) of <external-xref legal-doc="public-law" parsable-cite="pl/106/386">Public Law 106–386</external-xref>), (o) (as added by section 1102(b) of the Legal Immigration Family Equity Act), and (p) (as added by section 1503(b) of the Legal Immigration Family Equity Act) as subsections (n), (o), (p), (q), and (r), respectively; and</text></paragraph> 
<paragraph id="H7A193B37E0F34B76945667D2A68CC053"><enum>(2)</enum><text>by adding at the end the following:</text>

<paragraph id="HA4AA9A788F6A4FCE00544751A7FA1422" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">No petition to accord employment status under any nonimmigrant classification described in section 101(a)(15) shall be granted in the absence of an affidavit from the petitioner describing the efforts that were made to recruit an alien lawfully admitted for permanent residence or a citizen of the United States before resorting to a petition to obtain a foreign employee. The recruitment efforts must have included substantial attempts to find employees in minority communities. Recruitment efforts in minority communities should include at least one of the following, if appropriate for the employment being advertised:</text> 
<subparagraph id="HF46B25A6C2904B628D8066A8D7FB79A3" indent="up1"><enum>(A)</enum><text>Advertise the availability of the job opportunity for which the employer is seeking a worker in local newspapers in the labor market that is likely to be patronized by a potential worker for at least 5 consecutive days.</text></subparagraph> 
<subparagraph id="H6911E7453BE144DC91A86EE430774659" indent="up1"><enum>(B)</enum><text>Undertake efforts to advertise the availability of the job opportunity for which the employer is seeking a worker through advertisements in public transportation systems.</text></subparagraph> 
<subparagraph id="H92558077FAE0401B92598D7E26CE0001" indent="up1"><enum>(C)</enum><text>To the extent permitted by local laws and regulations, engage in recruitment activities in secondary schools, recreation centers, community centers, and other places throughout the communities within 50 miles of the job site that serve minorities.</text></subparagraph></paragraph> 
<paragraph id="HD3F03E70037A4F61A32755039D9E95DF" indent="up1"><enum>(2)</enum> 
<subparagraph id="HA48C954AB3044DD8BE9024094B5BE4AA" display-inline="yes-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security shall impose a 10 percent surcharge on all fees collected for petitions to accord employment status and shall use these funds to establish an employment training program which will include unemployed workers in the United States who need to be trained or retrained. The purpose of this program shall be to increase the number of lawful permanent residents and citizens of the United States who are available for employment in the occupations that are the subjects of such petitions. At least 50 percent of the funds generated by this provision must be used to train American workers in rural and inner city areas.</text></subparagraph> 
<subparagraph id="H7313447351AC486E91DF1D489D8C0002" indent="up1"><enum>(B)</enum><text>The Secretary of Homeland Security shall reserve and make available to the Secretary of Labor a portion of the funds collected under this paragraph. Such funds shall be used by the Secretary of Labor to establish an <quote>Office to Preserve American Jobs</quote> within the Department of Labor. The purpose of this office shall be to establish policies intended to ensure that employers in the United States will hire available workers in the United States before resorting to foreign labor, giving substantial emphasis to hiring minority workers in the United States.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title> 
<title id="H27B503F7279C4F698F41D2DB36475638"><enum>IV</enum><header>Diversity visas</header> 
<section id="HF75C6384DCF44DE3A2EFD51CDF105AE"><enum>401.</enum><header>Increase in worldwide level of diversity immigrants</header><text display-inline="no-display-inline">Section 201(e) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(e)</external-xref>) is amended by striking <quote>55,000</quote> and inserting <quote>110,000</quote>.</text></section> 
<section id="H28BC56A91FFE4F8CB6B1B289C81EB006"><enum>402.</enum><header>Period designated for application</header><text display-inline="no-display-inline">Section 203(e)(1) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(e)(1)</external-xref>) is amended—</text> 
<paragraph id="H524C79FB7AF648D3008CA3D5664639E3"><enum>(1)</enum><text>by striking <quote>Attorney General</quote> each place such term appears and inserting <quote>Secretary of Homeland Security</quote>; and</text></paragraph> 
<paragraph id="H3EFA9A8D30F24A33B19693C23CBD01A6"><enum>(2)</enum><text>by adding at the end the following: <quote>The Secretary shall provide for a filing system that will permit unlimited filing throughout the entire period designated for the filing of petitions. If an electronic filing system is chosen, the Secretary shall ensure that the computer equipment and software used to accept the filed petitions will have the capacity to accept every application that is submitted during the period designated for filing the petitions. In the event that petitions submitted during the designated period are rejected, the designated period will be extended for an additional 10-day period.</quote></text></paragraph></section></title> 
<title id="H2AD942896E144CBA99CE5100F1975CAA"><enum>V</enum><header>Haitian parity</header> 
<section id="H46AF0872F1DA41F485FE003D06058FF7"><enum>501.</enum><header>Adjustment of status for Haitians</header> 
<subsection id="H1046C78C60D74CAE8182006FB3274E54"><enum>(a)</enum><header>In general</header><text>Chapter 5 of title II of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255 et seq.</external-xref>), as amended by section 202, is further amended by inserting after section 245C the following:</text>

<section id="H881493697FD848259F84797C511BE9C2"><enum>245D.</enum><header>Adjustment of status of certain Haitian nationals</header><text display-inline="yes-display-inline">Notwithstanding the provisions of section 245(c), the status of any alien who is a national or citizen of Haiti, and who has been physically present in the United States for at least one year, may be adjusted by the Secretary of Homeland Security, in the Secretary’s discretion and under such regulations as the Secretary may prescribe, to that of an alien lawfully admitted for permanent residence, if the alien makes an application for such adjustment and the alien is eligible to receive an immigrant visa and is admissible to the United States for permanent residence. Upon approval of such an application for adjustment of status, the Secretary shall create a record of the alien’s admission for permanent residence as of a date 30 months prior to the filing of such an application or the date of the alien’s last arrival into the United States, whichever date is later. The provisions of this Act shall be applicable to the spouse and child of any alien described in this section, regardless of their citizenship and place of birth, if the spouse or child is residing with such alien in the United States.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDF8048827DBB4F30AB1DD7921898ACAD"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>, as amended by section 202, is further amended by inserting after the item relating to section 245C the following:</text>

If bond is to be denied on the ground that the alien’s release would give rise to adverse consequences for national security or national immigration policy, the finding of such adverse consequences shall be based on circumstances pertaining to the individual alien whose release is being considered.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HFA865BB9AB8F444B8CB1F07B5E61CA5E"><enum>503.</enum><header>Elimination of mandatory detention in expedited removal proceedings</header><text display-inline="no-display-inline">Section 235(b)(1)(B)(iii)(IV) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)(1)(B)(iii)(IV)</external-xref>) is amended to read as follows:</text>

<subsection id="H324EEBEC294A4A40935416EC97D8FC7E"><enum>(a)</enum><header>Ground for inadmissibility for document fraud does not apply</header><text>The Haitian Refugee Immigration Fairness Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref> note) is amended in subsections (a)(1)(B) and (d)(1)(D) of section 902 by inserting <quote>(6)(C)(i),</quote> after <quote>(6)(A),</quote>.</text></subsection>

<subparagraph id="H153696BAF09C493199E774257DCF7896"><enum>(B)</enum><header>Application submission by parent</header><text>Notwithstanding paragraph (1)(C), an application under this subsection filed based on status as a child may be filed for the benefit of such child by a parent or guardian of the child, if the child is physically present in the United States on such filing date.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HECDE8B837D834E6FAE3B29D5E91F02E1"><enum>505.</enum><header>New applications and motions to reopen</header> 
<subsection id="H0CD9FAC6E6F742CCB01C2D9E02D750CD"><enum>(a)</enum><header>New applications</header><text>Notwithstanding section 902(a)(1)(A) of the Haitian and Immigrant Fairness Act of 1998, an alien who is eligible for adjustment of status under such Act, as amended by section 504 of this Act, may submit an application for adjustment of status under such Act not later than the later of—</text> 
<paragraph id="HABD54BAEFC864436BF85D3A44915CBAD"><enum>(1)</enum><text>2 years after the date of the enactment of this Act; and</text></paragraph> 
<paragraph id="HAB2A634FE5324FCFBF1D416E21CCF630"><enum>(2)</enum><text>1 year after the date on which final regulations implementing section 504 are promulgated.</text></paragraph></subsection> 
<subsection id="H3A19CC0C89344CF7991D8595A9EEE0B2"><enum>(b)</enum><header>Motions to reopen</header><text>The Secretary of Homeland Security shall establish procedures for the reopening and reconsideration of applications for adjustment of status under the Haitian Refugee Immigration Fairness Act of 1998 that are affected by the amendments under section 504 of this Act.</text></subsection> 
<subsection id="H3BEAA9D42F8942F4B9ADC648530124E7"><enum>(c)</enum><header>Relationship of application to certain orders</header><text>Section 902(a)(3) of the Haitian and Immigrant Fairness Act of 1998 shall apply to an alien present in the United States who has been ordered excluded, deported, removed, or ordered to depart voluntarily, and who files an application under subsection (a), or a motion under subsection (b), in the same manner as such section 902(a)(3) applied to aliens filing applications for adjustment of status under such Act before April 1, 2000.</text></subsection></section> 
<section id="H49A5BD1B7D99419D9FB8D4AE9FB962AE"><enum>506.</enum><header>Sense of Congress regarding temporary protected status for Haitians</header><text display-inline="no-display-inline">It is the sense of the Congress that the Secretary of Homeland Security should be more liberal with respect to Haiti in deciding whether to designate that country for temporary protected status under section 244(b)(1)(A) of the Immigration and Nationality (<external-xref legal-doc="usc" parsable-cite="usc/8/1254">8 U.S.C. 1254(b)(1)(A)</external-xref>). It is the sense of the Congress that this decision has sometimes been made without due regard to the serious threat to personal safety that results from sending Haitians back to Haiti during a period of ongoing armed conflict in that country.</text></section></title> 
<title id="HC54777071516448A004FFD3540EE5475"><enum>VI</enum><header>Liberian refugee relief</header> 
<section id="HDE5DAB99B9AC4355B4DFEEC4A9F07FD"><enum>601.</enum><header>Adjustment of status of certain liberian nationals</header> 
<subsection id="HC52C9BCB39634DD881D3BE54D5F0CA00"><enum>(a)</enum><header>Adjustment of status</header> 
<paragraph id="HB2E7B990B6B64CBD00F5F010B4A4F974"><enum>(1)</enum><header>In general</header><text>Notwithstanding section 245(c) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>, the status of any alien described in subsection (b) shall be adjusted by the Secretary of Homeland Security to that of an alien lawfully admitted for permanent residence, if the alien—</text> 
<subparagraph id="HB7D33B5D427B4A01A63ED08E74184BF9"><enum>(A)</enum><text>applies for such adjustment before April 1, 2005; and</text></subparagraph> 
<subparagraph id="HDAB243184DC64982A0475861B48B473B"><enum>(B)</enum><text>is otherwise eligible to receive an immigrant visa and is otherwise admissible to the United States for permanent residence, except in determining such admissibility the grounds for inadmissibility specified in paragraphs (4), (5), (6)(A), and (7)(A) of section 212(a) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> shall not apply.</text></subparagraph></paragraph> 
<paragraph id="H475E7384E7B749E88C0001F5BCBD54B6"><enum>(2)</enum><header>Relationship of application to certain orders</header><text>An alien present in the United States who has been ordered excluded, deported, removed, or ordered to depart voluntarily from the United States under any provision of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> may, notwithstanding such order, apply for adjustment of status under paragraph (1). Such an alien may not be required, as a condition on submitting or granting such application, to file a motion to reopen, reconsider, or vacate such order. If the Secretary of Homeland Security grants the application, the Secretary of Homeland Security shall cancel the order. If the Secretary of Homeland Security renders a final administrative decision to deny the application, the order shall be effective and enforceable to the same extent as if the application had not been made.</text></paragraph></subsection> 
<subsection id="H5D7830525E994E19B87FDF2052311CF9"><enum>(b)</enum><header>Aliens eligible for adjustment of status</header><text>The benefits provided by subsection (a) shall apply to any alien who—</text> 
<paragraph id="H86D5D00E4B3C468FB7DCD7B4F118C056"><enum>(1)</enum><text>is a national of Liberia; and</text></paragraph> 
<paragraph id="HD05C2234BBB6457D8FC926F0738A2BB"><enum>(2)</enum> 
<subparagraph id="H2146346AAD2A4E42A26113D765B6F2EF" display-inline="yes-display-inline"><enum>(A)</enum><text>who was granted temporary protected status on or after March 27, 1991; or</text> </subparagraph> 
<subparagraph indent="up1" id="H8BA5946B2F1A4931AF12B81533D89DC"><enum>(B)</enum><text>was eligible to apply for temporary protected status on or after March 27, 1991.</text></subparagraph></paragraph></subsection> 
<subsection id="H531501BBDA47408A83BAA2C91FF6ECF8"><enum>(c)</enum><header>Stay of removal</header> 
<paragraph id="H4A51E19DE6964EA19EEEF505FBA043C3"><enum>(1)</enum><header>In general</header><text>The Secretary of Homeland Security shall provide by regulation for an alien subject to a final order of deportation or removal or exclusion to seek a stay of such order based on the filing of an application under subsection (a).</text></paragraph> 
<paragraph id="HFAECE193079D402CA4FD62E7B0BD58E7"><enum>(2)</enum><header>During certain proceedings</header><text>Notwithstanding any provision of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>, the Secretary of Homeland Security shall not order any alien to be removed from the United States, if the alien is in exclusion, deportation, or removal proceedings under any provision of such Act and raises as a defense to such an order the eligibility of the alien to apply for adjustment of status under subsection (a), except where the Secretary of Homeland Security has rendered a final administrative determination to deny the application.</text></paragraph> 
<paragraph id="H37A6ED10E7CC44AC951CA500E2C152BB"><enum>(3)</enum><header>Work authorization</header><text>The Secretary of Homeland Security may authorize an alien who has applied for adjustment of status under subsection (a) to engage in employment in the United States during the pendency of such application and may provide the alien with an <quote>employment authorized</quote> endorsement or other appropriate document signifying authorization of employment, except that if such application is pending for a period exceeding 180 days, and has not been denied, the Secretary of Homeland Security shall authorize such employment.</text></paragraph></subsection> 
<subsection id="H5EB62A7D415642E28781C43F70F6EE47"><enum>(d)</enum><header>Adjustment of status for spouses and children</header> 
<paragraph id="HAE55CE4E130E4E338DEB96835E6414FD"><enum>(1)</enum><header>In general</header><text>Notwithstanding section 245(c) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>, the status of an alien shall be adjusted by the Secretary of Homeland Security to that of an alien lawfully admitted for permanent residence, if—</text> 
<subparagraph id="H5A44234960CE489695A75CB0858025B"><enum>(A)</enum><text>the alien is a national of Liberia;</text></subparagraph> 
<subparagraph id="HF36FF7EA07934102B5DC0653224B2526"><enum>(B)</enum><text>the alien is the spouse, child, or unmarried son or daughter, of an alien whose status is adjusted to that of an alien lawfully admitted for permanent residence under subsection (a), except that in the case of such an unmarried son or daughter, the son or daughter shall be required to establish that they have been physically present in the United States for at least 1 year and is physically present in the United States on the date the application for such adjustment is filed;</text></subparagraph> 
<subparagraph id="HC5FD42075E734C0E953692D0B9D8627C"><enum>(C)</enum><text>the alien applies for such adjustment and is physically present in the United States on the date the application is filed; and</text></subparagraph> 
<subparagraph id="H99FA14B08CB645D0B900479D1F006FCF"><enum>(D)</enum><text>the alien is otherwise eligible to receive an immigration visa and is otherwise admissible to the United States for permanent residence, except in determining such admissibility the grounds for exclusion specified in paragraphs (4), (5), (6)(A), and (7)(A) of section 212(a) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> shall not apply.</text></subparagraph></paragraph> 
<paragraph id="H75FE378A142342A7829BB47B1CB780E3"><enum>(2)</enum><header>Proof of continuous presence</header><text>For purposes of establishing the period of continuous physical presence referred to in paragraph (1)(B), an alien shall not be considered to have failed to maintain continuous physical presence by reason of an absence, or absences, from the United States for any periods in aggregate not exceeding 180 days.</text></paragraph></subsection> 
<subsection id="H3A7615DD5A8E48F3BB2C93B3BD9DAF63"><enum>(e)</enum><header>Availability of administrative review</header><text>The Secretary of Homeland Security shall provide to applicants for adjustment of status under subsection (a) the same right to, and procedures for, administrative review as are provided to—</text> 
<paragraph id="H66FA8A88E8DF48DB9CD8CA09E7CF64D0"><enum>(1)</enum><text>applicants for adjustment of status under section 245 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>; or</text></paragraph> 
<paragraph id="HD414C72F0F2A4338BD1762D0FD624B6B"><enum>(2)</enum><text>aliens subject to removal proceedings under section 240 of such Act.</text></paragraph></subsection> 
<subsection id="H942E639CC26945628C3086170975702F"><enum>(f)</enum><header>Limitation on judicial review</header><text>A determination by the Secretary of Homeland Security as to whether the status of any alien should be adjusted under this section is final and shall not be subject to review by any court.</text></subsection> 
<subsection id="H10A7F24E4C9140D7BE5CD63DDC268B37"><enum>(g)</enum><header>No offset in number of visas available</header><text>When an alien is granted the status of having been lawfully admitted for permanent residence pursuant to this section, the Secretary of State shall not be required to reduce the number of immigrant visas authorized to be issued under any provision of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>.</text></subsection> 
<subsection id="HC4CFE70143AE4BC0B2EC1D183434800"><enum>(h)</enum><header>Application of <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> provisions</header><text>Except as otherwise specifically provided in this section, the definitions contained in the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> shall apply in the administration of this section. Nothing contained in this section shall be held to repeal, amend, alter, modify, effect, or restrict the powers, duties, functions, or authority of the Secretary of Homeland Security in the administration and enforcement of such Act or any other law relating to immigration, nationality, or naturalization. The fact that an alien may be eligible to be granted the status of having been lawfully admitted for permanent residence under this section shall not preclude the alien from seeking such status under any other provision of law for which the alien may be eligible.</text></subsection></section></title> 
<title id="HE426552F51054C36BD5F03DC2EED770"><enum>VII</enum><header>Fairness in asylum and refugee proceedings</header> 
<section id="HD98E2B0423A04175AD3DB77F006B6CE9"><enum>701.</enum><header>Refugee status for unmarried sons and daughters of refugees</header><text display-inline="no-display-inline">Section 207(c)(2) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157(c)(2)</external-xref>) is amended by adding at the end the following:</text>

<section id="H5C4D7CEE380E4F098D3D97E804519936"><enum>702.</enum><header>Asylee status for unmarried sons and daughters of asylees</header><text display-inline="no-display-inline">Section 208(b)(3) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(b)(3)</external-xref>) is amended by adding at the end the following:</text>

<subparagraph id="H632160E7687F47CAA6A374FCD272F406"><enum>(C)</enum><text>When warranted by unusual circumstances or to preserve family unity, the Attorney General may, in the Attorney General’s discretion, consider an unmarried son or daughter of an alien who is granted asylum under this subsection to be a child of the alien for purposes of this paragraph.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H07C349D152FD498893D901B03480F16"><enum>703.</enum><header>Elimination of arbitrary time limits on asylum applications</header><text display-inline="no-display-inline">Section 208(a)(2) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(a)(2)</external-xref>) is amended—</text> 
<paragraph id="HB9E5F2AD2A374861A7C13E08C6C060DC"><enum>(1)</enum><text>by striking subparagraph (B);</text></paragraph> 
<paragraph id="HC4075200F18C47EC874452A1E856A951"><enum>(2)</enum><text>in subparagraph (C), by striking <quote>(D),</quote> and inserting <quote>(C),</quote>;</text></paragraph> 
<paragraph id="HBDF8B95B12824053B9EB57818B0729F6"><enum>(3)</enum><text>in subparagraph (D)—</text>

<section id="HCBD714E771B64EFD9893129618F315AD"><enum>704.</enum><header>Gender-based persecution</header> 
<subsection id="HCC5864D13BA242308EC00CC30F21B16"><enum>(a)</enum><header>Treatment as refugee</header><text>Section 101(a)(42) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(42)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block act-name="Immigration and Nationality Act" id="H607D17F127C3472C8C51B9DA21CAA0DA"> 
<subparagraph id="HF7F3C8381A884BCEAFF0A9008C2057B7"><enum>(C)</enum><text>For purposes of determinations under this Act, a person who establishes that he or she suffered persecution in the past, or has a well-founded fear of persecution, on account of gender shall be considered to have suffered persecution, or to have a well-founded fear of persecution, on account of membership in a particular social group.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HCC3B37A16CEE427CB8796103FE423B4E"><enum>(b)</enum><header>Restriction on removal to country where alien would be threatened</header><text>Section 241(b)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(b)(3)</external-xref>) is amended by adding at the end the following:</text>

<subparagraph id="H7338D0B5B5914C50B821EE86209991F9"><enum>(C)</enum><header>Gender-based persecution</header><text>For purposes of determinations under this paragraph, an alien who establishes that the alien’s life or freedom would be threatened in a country on account of gender shall be considered to have established that the alien’s life or freedom would be threatened in that country on account of membership in a particular social group.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H664726F179E242FFBB7736F993AD29D2"><enum>705.</enum><header>Elimination of arbitrary cap on persons eligible to adjust status from asylees to legal permanent residents</header><text display-inline="no-display-inline">Section 209(b) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1159">8 U.S.C. 1159(b)</external-xref>) is amended by striking <quote>Not more than 10,000 of the</quote> and all that follows through <quote>to adjust</quote> and inserting <quote>Subject to a numerical limitation determined by the President before the beginning of each fiscal year, the Attorney General may adjust, in the Attorney General’s discretion and under such regulations as the Attorney General may prescribe,</quote>.</text></section></title> 
<title id="HC7833A56B0924FA4A0E5A1AFB96BAE39"><enum>VIII</enum><header>Temporary protected status</header> 
<section id="HEE92B39117154426A833B01D4622DCF7"><enum>801.</enum><header>Adjustment of status for certain recipients of temporary protected status</header> 
<subsection id="H4586EF7609394D5ABAE5FA0617E8F37B"><enum>(a)</enum><header>In general</header><text>Section 245 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H3EEAC520FB214E31BCB4BDFF5D020036" display-inline="no-display-inline"> 
<subsection id="H770DBC79613D4A7DB512F2C442CA1AF"><enum>(n)</enum> 
<paragraph id="H44D3D896E40D4E049E00A273765E025D" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">If, in the opinion of the Secretary of the Homeland Security Department, a person granted temporary protected status under section 244—</text> 
<subparagraph id="H426C222109FD42A58D3564A9164445C2" indent="up1"><enum>(A)</enum><text>has been physically present in the United States in that status for a continuous period of at least 5 years;</text></subparagraph> 
<subparagraph id="H7DE6918BAF634E6D851612C96CB1EC31" indent="up1"><enum>(B)</enum><text>has at all times been a person of good moral character;</text></subparagraph> 
<subparagraph id="H23F126B2F9B646B086007BB1E3B9A8C8" indent="up1"><enum>(C)</enum><text>has never been convicted of a criminal offense in the United States;</text></subparagraph> 
<subparagraph id="HD74F688D78A246B58C53D0E22634F558" indent="up1"><enum>(D)</enum><text>in the case of an alien who is 18 years of age or older, but who is not over the age of 65, has successfully completed a course on reading, writing, and speaking words in ordinary usage in the English language, unless unable to do so on account of physical or developmental disability or mental impairment;</text></subparagraph> 
<subparagraph id="H73DC38AC8DC14D70BF67C776E3B0ABAB" indent="up1"><enum>(E)</enum><text>in the case of an alien 18 years of age or older, has accepted the values and cultural life of the United States; and</text></subparagraph> 
<subparagraph id="HD34D7B3643EC43B8B999096965B08457" indent="up1"><enum>(F)</enum><text>in the case of an alien 18 years of age or older, has performed at least 40 hours of community service;</text></subparagraph><continuation-text continuation-text-level="subsection">the Secretary may adjust the status of the alien to that of an alien lawfully admitted for permanent residence.</continuation-text></paragraph> 
<paragraph id="H5024D737332946C389A1698F4415ADC5" indent="up1"><enum>(2)</enum><text>An alien shall not be considered to have failed to maintain a continuous presence in the United States for purposes of subsection (a)(1) by virtue of brief, casual, and innocent absences from the United States.</text></paragraph> 
<paragraph id="H9EDB43D58FF24B2FB9431EFDD6C1234" indent="up1"><enum>(3)</enum> 
<subparagraph id="H75B91FCAFF6843C1B7FF33265E889435" display-inline="yes-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">The alien shall establish that the alien is admissible to the United States as immigrant, except as otherwise provided in paragraph (2).</text></subparagraph> 
<subparagraph id="HC0D2911234B149B7A4AEBF00A97376E1" indent="up1"><enum>(B)</enum><text>The provisions of paragraphs (5), (6)(A), (6)(B), (6)(C), (6)(F), (6)(G), (7)(A), (9)(B), and (9)(C)(i)(I) of section 212(a) shall not apply in the determination of an alien’s admissibility under this section.</text></subparagraph></paragraph> 
<paragraph id="HD62C41B333D74C2DB832C0F6E7DFE2B4" indent="up1"><enum>(4)</enum><text>When an alien is granted lawful permanent resident status under this subsection, the number of immigrant visas authorized to be issued under any provision of this Act shall not be reduced. The numerical limitations of sections 201 and 202 shall not apply to adjustment of status under this section.</text></paragraph> 
<paragraph id="HDF3D8A80D0494155A2BE93D363F685C" indent="up1"><enum>(5)</enum><text>The Secretary of Homeland Security may terminate removal proceedings without prejudice pending the outcome of an alien’s application for adjustment of status under this section on the basis of a prima facie showing of eligibility for relief under this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDF72C618DED9484B9CCF644FC560316B"><enum>(b)</enum><header>Limitation on consideration in the Senate of legislation adjusting status</header><text>Section 244 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>) is amended by striking subsection (h) and redesignating subsection (i) as subsection (h).</text></subsection></section> 
<section id="H5DCD63DF1F0A4F47AF8C383F90B26D00"><enum>802.</enum><header>Foreign State designations</header><text display-inline="no-display-inline">Section 244(b)(1)(C) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a(b)(1)(C)</external-xref>) is amended to change the following phrase <quote>the Attorney General finds that there exist extraordinary and temporary conditions in the foreign state that prevent aliens who are nationals of the state from returning to the state in safety,</quote> so that it reads as follows: <quote>the Secretary of Homeland Security finds that extraordinary and temporary conditions in the foreign state make returning aliens to the state undesirable for humanitarian reasons,</quote>.</text></section> 
<section id="H70D31BBC66474344BD73EFC5F50704E5"><enum>803.</enum><header>Technical correction</header><text display-inline="no-display-inline">Section 244 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>) is amended by striking <quote>Attorney General</quote> each place such term appears and inserting <quote>Secretary of Homeland Security</quote>.</text></section></title>

<section id="HE320188537D74F1D992C911200CCAF4"><enum>901.</enum><header>Physical presence requirement</header><text display-inline="no-display-inline">Section 316(a) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1427">8 U.S.C. 1427</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block act-name="Immigration and Nationality Act" id="HAF139B948D4945F7A2425548D3BFE7BA"><list level="section"><list-item>When warranted by extraordinary circumstances, the Secretary of Homeland Security may reduce, by not more than 90 days, the physical presence requirement described in the preceding sentence.</list-item></list> <after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H39E7C7FFEB974F5C9B46A5C273BCB38C"><enum>902.</enum><header>Absences from the United States</header><text display-inline="no-display-inline">Section 316(b) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1427">8 U.S.C. 1427(b)</external-xref>) is amended—</text> 
<paragraph id="H8DD72692453048E2B92D6145C3008E33"><enum>(1)</enum><text>in the first sentence, by striking <quote>one year</quote> and inserting <quote>18 months</quote>; and</text></paragraph> 
<paragraph id="H49AB58ECC0D04B28BA869384A023740"><enum>(2)</enum><text>in the second sentence, by striking <quote>continuous period of one year</quote> and inserting <quote>continuous period of 18 months</quote>.</text></paragraph></section> 
<section id="H8040B19E5A6A4EFDB35DAD8B2126AD19"><enum>903.</enum><header>Eliminating the widowed immigrant’s 2-YEAR marriage penalty</header><text display-inline="no-display-inline">Section 201(b)(2)(A)(i) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1251">8 U.S.C. 1251(b)(2)(A)(i)</external-xref>) is amended—</text> 
<paragraph id="HCAB01EA3A36C49DDB754FB5C9E171F53"><enum>(1)</enum><text>by striking <quote>for at least 2 years</quote>; and</text></paragraph> 
<paragraph id="H2F7B2042AD514EADBBC73C00517BBB40"><enum>(2)</enum><text>by inserting <quote>, proves by a preponderance of the evidence that the marriage was entered into in good faith and not for the purpose of obtaining an immigration benefit,</quote> after <quote>within 2 years after such date</quote>.</text></paragraph></section> 
<section id="H8A2F87278FCB43DB9D6BE49433022B42"><enum>904.</enum><header>Eliminate the widowed permanent resident’s naturalization penalty</header><text display-inline="no-display-inline">Section 319(a) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1429">8 U.S.C. 1429(a)</external-xref>) is amended by inserting <quote>or, if the spouse is deceased, the spouse was a citizen of the United States,</quote> after <quote>(a) Any person whose spouse is a citizen of the United States,</quote>.</text></section> 
<section id="H741B071D046340EC81557D68D9DC9BA0"><enum>905.</enum><header>Elimination of ban on State and local governments from preventing communications with the Department of Homeland Security</header> 
<subsection id="HB146EB6861E34A4FA3C3DFCD04703041"><enum>(a)</enum><header>In general</header><text>Section 642 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1373">8 U.S.C. 1373</external-xref>) is repealed.</text></subsection> 
<subsection id="H4C37E82D7CF74F47A54DBB07188CE86C"><enum>(b)</enum><header>Verification of eligibility for Federal public benefits</header><text>Section 432 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1642">8 U.S.C. 1642</external-xref>) is repealed.</text></subsection></section> 
<section id="HCE9009DE4B1D4614BA5002E2DAA6393"><enum>906.</enum><header>Elimination of authority to permit State personnel to carry out immigration officer functions</header><text display-inline="no-display-inline">Section 287(g) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1357">8 U.S.C. 1357(g)</external-xref>) is repealed.</text></section></title>
