<legis-type>A BILL</legis-type> 
<official-title>To amend title XVIII of the Social Security Act to require, as a condition of participation in the Medicare Program, that hospitals make reasonable efforts to contact a family member, specified healthcare agent, or surrogate decisionmaker of a patient who arrives at a hospital emergency department unconscious or otherwise physically incapable of communicating with the attending health care practitioners of the hospital, and for other purposes.</official-title>

<section section-type="section-one" id="H092A58D8D56249D3A51E6F6D7F00B867" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Elaine Sullivan Act</short-title></quote>.</text></section> 
<section id="H810D44940FB94193BDC61BDC39F742CF"><enum>2.</enum><header>Requirement for emergency departments to contact family members, specified healthcare agent, or surrogate decisionmaker of incapacitated patients within 24 hours of arrival at the emergency department</header> 
<subsection id="HB143314B4005409C0081FFD0642B82EA"><enum>(a)</enum><header>In general</header><text>Section 1866(a)(1) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395cc">42 U.S.C. 1395cc(a)(1)</external-xref>) is amended—</text> 
<paragraph id="H65E9B87EA458458C9126768200C84FF"><enum>(1)</enum><text>in subparagraph (U), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="HD582EF120C43414DA228DC8260E0C3D8"><enum>(2)</enum><text>in subparagraph (V), by striking the period at the end and inserting <quote>, and</quote>; and</text></paragraph> 
<paragraph id="H40470B2B3392489DB5D826FC14B2D6C5"><enum>(3)</enum><text>by inserting after subparagraph (V) the following new subparagraph:</text>

<subparagraph indent="up1" id="H0292B1AB841241FDB033901C2F9BE31E"><enum>(W)</enum><text>in the case of a hospital (as defined in section 1861(e)) with an emergency department, to adopt and enforce a policy to ensure compliance with the requirements of subsection (k) (relating to requirements to make reasonable efforts to contact certain individuals in the case of a patient who is unconscious or physically unable to communicate with staff of the hospital).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HEEB2C9D2D9944B46A07D62CB0014FA95"><enum>(b)</enum><header>Requirement to contact family members or other individuals with authority to make health care decisions</header><text>Section 1866 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395cc">42 U.S.C. 1395cc</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H28FBD4C32C364C63A3AF4DD2E9A8964"><enum>(k)</enum> 
<paragraph display-inline="yes-display-inline" id="H15920E35F994466FACC4AF7F53FD580"><enum>(1)</enum> 
<subparagraph display-inline="yes-display-inline" id="H44C13E4F410141AC870744B9F40997B4"><enum>(A)</enum><text>In the case of a hospital (as defined in section 1861(e)) with an emergency department, if any individual arrives at the emergency department requiring medical treatment and is unconscious or otherwise unable to communicate with a health care professional of the department, the hospital shall take reasonable measures (described in paragraph (3)) to identify and contact a person the hospital reasonably believes has the authority to make health care decisions on behalf of the individual.</text></subparagraph> 
<subparagraph indent="up2" id="H7BF96DD025794E80BF7986DAD12D9776"><enum>(B)</enum><text>A person referred to in subparagraph (A) is any of the following:</text> 
<clause id="HCEFED80F4DE94A429000B193B3B993AC"><enum>(i)</enum><text>An immediate family member.</text></clause> 
<clause id="H6CAA8D3E36E14F48A4C38CDD977005F"><enum>(ii)</enum><text>A person authorized to make health care decisions for the individual under a durable power of attorney for health care, recognized under State law (whether by statute or as recognized by the courts of the State).</text></clause></subparagraph></paragraph> 
<paragraph indent="up1" id="H733183C4337A47628D17D804237CD9E0"><enum>(2)</enum> 
<subparagraph display-inline="yes-display-inline" id="H679AF0382F7B42BA96F6CBBA8700CD1"><enum>(A)</enum><text>The hospital shall take the reasonable measures as soon as practicable, but, subject to subparagraph (B), in no case later than the end of the 24-hour period that begins at the point in time that a health care professional of the emergency department of the hospital determines that the individual is unconscious or otherwise unable to communicate.</text></subparagraph> 
<subparagraph indent="up1" id="H14AD8E1F7CB442B78E347673BF1263C1"><enum>(B)</enum> 
<clause display-inline="yes-display-inline" id="HE3796A9E3E4D485482FAF449A7E1C026"><enum>(i)</enum><text>The 24-hour period under subparagraph (A) shall not apply during any period in which the hospital implements a disaster and mass casualty program or a fire and internal disaster program, or during a declared state of emergency (as defined in clause (ii)) or other local mass casualty situation.</text></clause> 
<clause indent="up1" id="H1A141564CB6D4CD999362DB4C8097C82"><enum>(ii)</enum><text>For purposes of clause (i), the term <term>declared state of emergency</term> means an officially designated state of emergency that has been declared by the Federal Government or a State or local government official having authority to declare that the State, county, municipality, or locality is in a state of emergency.</text></clause></subparagraph></paragraph> 
<paragraph indent="up1" id="H1894E65C5E704A86AA64A3A53BF7C3A6"><enum>(3)</enum><text>Reasonable measures referred to in paragraph (1) include the following:</text> 
<subparagraph id="HBA6E1A70DAFC44BF80626DC9DDA7B7C"><enum>(A)</enum><text>Contacting the emergency contact, family member, surrogate decisionmaker, or other health care agent identified from personal effects of the individual.</text></subparagraph> 
<subparagraph id="H7330B99E4A8D4E9200ED15FE60A8E49B"><enum>(B)</enum><text>Examining medical records in the hospital’s possession, including a review of any verbal or written report made by emergency medical technicians or the police with respect to the individual.</text></subparagraph> 
<subparagraph id="H1B7C24291346471FBBD2FA09BDD0B22"><enum>(C)</enum><text>Insofar as actions under subparagraphs (A) and (B) are unsuccessful, contacting the hospital’s social service department or the appropriate local law enforcement agency.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="HABA0321F1D13402DA1B47F5EDDC4EBC3"><enum>(4)</enum><text>The provisions of this subsection do not preempt any State or local law requirement, except to the extent that the requirement directly conflicts with a requirement of this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H32F45D0649E242B69F5FEDBBEB8CE7B"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to hospitals as of the date that is one year after the date of the enactment of this Act.</text></subsection></section> 
<section id="H7F326CB04B2248E5B7BC93EF258E9310"><enum>3.</enum><header>Grant program for the establishment of next of kin registries</header> 
<subsection id="H6D7E53AC44BB4BE0B6AB728615DFE3AC"><enum>(a)</enum><header>In general</header><text>The Secretary of Health and Human Services is authorized to make grants to qualified not-for-profit organizations for the purpose of assisting such organizations to establish and operate voluntary next of kin registries.</text></subsection> 
<subsection id="HDF8931F929DB4D91B28C541B8694EF85"><enum>(b)</enum><header>Next of kin registry described</header><text>A next of kin registry is an electronic search service to help individuals, and family members of those individuals, who are missing, injured, or deceased. A next of kin registry is a free service to the public, health care providers and institutions, and governmental agencies using the search service.</text></subsection> 
<subsection id="HF5431FC5E7744A6784AFFB090099C2E9"><enum>(c)</enum><header>Awarding of grants</header> 
<paragraph id="HAAD5ACCADFB04D4DBF2350B4500FA5F"><enum>(1)</enum><header>Application</header><text>No grant may be made under this section except pursuant to a grant application that is submitted and approved in a time, manner, and form specified by the Secretary.</text></paragraph> 
<paragraph id="H8A1C6F2F97444B5FB48F2FAC7F20FACC"><enum>(2)</enum><header>Limitation on grants</header><text>Only 1 grant may be awarded under this section with respect to any qualified not-for-profit organizations.</text></paragraph></subsection> 
<subsection id="HA4F1357063BF41F7B6F0F803AC19D202"><enum>(d)</enum><header>Terms and conditions</header> 
<paragraph id="H386F55F441E44CA4A319BD99AA2DEFEC"><enum>(1)</enum><header>In general</header><text>Grants under this section shall be made under such terms and conditions as the Secretary specifies consistent with this section.</text></paragraph> 
<paragraph id="H6FE708B7161E4E19BCAE2982902D1B56"><enum>(2)</enum><header>Use of grant funds</header><text>Funds provided under grants under this section may be used for any of the following:</text> 
<subparagraph id="H3562B336B3BA4FADBF8292A590312500"><enum>(A)</enum><text>For purchasing, leasing, and installing computer software and hardware.</text></subparagraph> 
<subparagraph id="H47C813C768BB4E48A530402E40ABBB62"><enum>(B)</enum><text>Making upgrades and other improvements to existing computer software and hardware.</text></subparagraph> 
<subparagraph id="H6169A2CC85E24FDF8862868E58563781"><enum>(C)</enum><text>Providing education and training to eligible staff on the use of technology to implement next-of-kin registries. </text></subparagraph></paragraph> 
<paragraph id="H9E65433A963F44CC91A1F88FA9666317"><enum>(3)</enum><header>Provision of information</header><text>As a condition for the awarding of a grant under this section, an applicant shall provide to the Secretary such information as the Secretary may require in order to—</text> 
<subparagraph id="HE0EF370B91034C6680928FDB5D84F98C"><enum>(A)</enum><text>evaluate the project for which the grant is made; and</text></subparagraph> 
<subparagraph id="H5C19217A49B94E94A80287C8AE7B1D02"><enum>(B)</enum><text>ensure that funding provided under the grant is expended only for the purposes for which it is made.</text></subparagraph></paragraph> 
<paragraph id="HE1F0C869FAA344F5AD26B7B9C4561E89"><enum>(4)</enum><header>Audit</header><text>The Secretary shall conduct appropriate audits of grants under this section.</text></paragraph></subsection> 
<subsection id="H978675727F354EE68E1C00959981772E"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as may be necessary for each of fiscal years 2006 through 2010.</text></subsection></section>
