<official-title>To ensure that State and local law enforcement agencies execute warrants for the arrest of nonviolent offenders only when children are not present, unless overriding circumstances exist.</official-title>

<section display-inline="no-display-inline" id="H9766D8B30697463292FF5513756F4100" section-type="section-one"><enum>1.</enum><header>Issuance of guidelines</header> 
<subsection id="H71A786574F2342C7881C064B31F480E5"><enum>(a)</enum><header>In general</header><text>Upon accepting Federal funds, a State or local law enforcement agency should issue guidelines under which—</text> 
<paragraph id="H54AF5E41F44542BCB6B0E1310052E574"><enum>(1)</enum><text>each warrant for the arrest of a nonviolent offender executed by that agency is executed only—</text> 
<subparagraph id="HB33C87D1E748470D944307003E2C537F"><enum>(A)</enum><text>during a time when, and at a location where, the agency reasonably believes no children are present; or</text> </subparagraph>
<subparagraph id="H2DD08C2B7C5E45A3AC2B1918332D52A9"><enum>(B)</enum><text>in circumstances other than those specified in subparagraph (A), if a court first determines that overriding reasons, in furtherance of the interests of children, exist (such as the interest in apprehending individuals who engage in drug offenses with children or on school grounds); and</text> </subparagraph></paragraph>
<paragraph id="H575ACC5C64DB4529BB43191DEDDF38C4"><enum>(2)</enum><text>relevant counseling is made available to each child who witnesses the execution of an arrest warrant under circumstances other than those specified in paragraph (1)(A).</text> </paragraph></subsection>
<subsection id="HAB21829DFCBF49B1A6BEB300A930C58B"><enum>(b)</enum><header>Definition</header><text>In this section, the term <term>nonviolent offender</term> means a person who has never been convicted of a violent offense, the arrest of whom is sought for a nonviolent offense.</text> </subsection></section>
