<official-title>To establish a program to transfer surplus computers of Federal agencies to schools and nonprofit community-based educational organizations, and for other purposes.</official-title>

<section id="H07AE31E0B23A4FAAA269FAEDD4D00C0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Profiting from Access to Computer Technology (PACT) Act</short-title></quote> or the <quote><short-title>Child PACT Act</short-title></quote>.</text></section> 
<section id="HC069B8ACACD844838F063EE4006D6C71"><enum>2.</enum><header>Protection of potential educationally useful Federal equipment</header><text display-inline="no-display-inline">Each Federal agency shall, to the extent practicable, protect and safeguard potential educationally useful Federal equipment that has been determined to be surplus, so that such equipment may be transferred under this Act.</text></section> 
<section id="HE62CAF849145430F9068704119B5FFAA"><enum>3.</enum><header>Efficient transfer of potential educationally useful Federal equipment</header> 
<subsection id="HAA25A05535B143CA80DA4342E02764AF"><enum>(a)</enum><header>Transfer of equipment to GSA</header><text>Each Federal agency, to the extent permitted by law and where appropriate, shall—</text> 
<paragraph id="H4DBA5997288F4E8EBCC59BB2301EF5D6"><enum>(1)</enum><text>identify potential educationally useful Federal equipment that it no longer needs or such equipment that has been declared surplus in accordance with <external-xref legal-doc="usc" parsable-cite="usc/40/549">section 549</external-xref> of title 40, United States Code;</text></paragraph> 
<paragraph id="HE41E407374CD455DAA33811FF408FB5B"><enum>(2)</enum><text>erase all hard drives and other information storage devices, before transfer under paragraph (3), in accordance with standards in effect under the National Security Agency’s Information Assurance Directorate; and</text></paragraph> 
<paragraph id="H6538CBB6F8794D7FBC6300E13FA746E3"><enum>(3)</enum> 
<subparagraph id="H03C418BE6337471896CF01B08336FE4E" display-inline="yes-display-inline"><enum>(A)</enum><text>transfer the equipment to the Administrator of General Services for conveyance to educational recipients; or</text></subparagraph> 
<subparagraph id="H3B128CA6F6694CD580A6F46E3720DDEF" indent="up1"><enum>(B)</enum><text>transfer the equipment directly to—</text> 
<clause id="H3C0D7681C15341F981C358259333AF45"><enum>(i)</enum><text>an educational recipient, through an arrangement made by the Administrator of General Services under subsection (b); or</text></clause> 
<clause id="HC19994628DFE44D5B71CA74100D1AC6C"><enum>(ii)</enum><text>a nonprofit refurbisher under subsection (d).</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H59D55551B25E4AC596B455F1F47B26A8"><enum>(b)</enum><header>Advance reporting of equipment to GSA</header><text>Each Federal agency shall report to the Administrator of General Services the anticipated availability of potential educationally useful Federal equipment as far as possible in advance of the date the equipment is to become surplus, so that the Administrator may attempt to arrange for the direct transfer from the donating agency to educational recipients.</text></subsection> 
<subsection id="HB36BF2E2C4844E2B947CBC8BCEFA7A7"><enum>(c)</enum><header>Preference</header><text>In carrying out conveyances to educational recipients under this Act, the Administrator of General Services shall, to the extent practicable, give particular preference to educational recipients located in an enterprise community, empowerment zone, or renewal community designated under section 1391, 1400, or 1400E of the Internal Revenue Code of 1986.</text></subsection> 
<subsection id="H216707EA7C5A46C0AC7F7D082BE9A212"><enum>(d)</enum><header>Refurbishment of potential educationally useful equipment</header><text>Potential educationally useful Federal equipment that is not classroom-usable shall be conveyed initially to a nonprofit refurbisher for upgrade before transfer to the educational recipient. The refurbisher shall be responsible for proper disposal of any equipment that cannot be successfully refurbished.</text></subsection> 
<subsection id="HB12DAF14F88844DCB9ECFF75F5EF700"><enum>(e)</enum><header>Lowest cost</header><text>All transfers to educational recipients shall be made at the lowest cost to the recipient permitted by law.</text></subsection> 
<subsection id="H66276CC5537F4320A619B5E1C3969F3F"><enum>(f)</enum><header>Notice of availability of equipment</header><text>The Administrator of General Services shall provide notice of the anticipated availability of potential educationally useful Federal equipment (including nonclassroom-usable equipment) to educational recipients by all practical means, including the Internet, newspapers, nonprofit refurbishers and community announcements.</text></subsection> 
<subsection id="H37338B28C0454F6C9425C964322ED93"><enum>(g)</enum><header>Facilitation by regional federal executive boards</header><text>The regional Federal Executive Boards (as that term is used in part 960 of title 5, Code of Federal Regulations) shall help facilitate the transfer of potential educationally useful Federal equipment from the agencies they represent to recipients eligible under this Act.</text></subsection></section> 
<section id="HE55A0C46E26F463BBB2D1179881BA453"><enum>4.</enum><header>Rulemaking</header><text display-inline="no-display-inline">The Administrator of General Services shall prescribe rules and procedures to carry out this Act.</text></section> 
<section id="H4ABB2C0F15DB488387D7FB15F7B866DF"><enum>5.</enum><header>Effect on other laws</header><text display-inline="no-display-inline">This Act supersedes Executive Order No. 12999 of April 17, 1996.</text></section> 
<section id="H94489D9835CD4BC79EF15305CD73AFED"><enum>6.</enum><header>Rule of construction</header><text display-inline="no-display-inline">This Act may not be construed to create any right or benefit, substantive or procedural, enforceable at law by a party against the United States or its agencies, officers, or employees.</text></section> 
<section id="H86834FE4A3A54CFAB13992D5C218F3A5"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H306A70AF14164E6081E4E78315DEAAC7"><enum>(1)</enum><text>The term <quote>Federal agency</quote> means an Executive department or an Executive agency (as such terms are defined in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/1">chapter 1</external-xref> of title 5, United States Code).</text></paragraph> 
<paragraph id="H6BF0EB323DD341B2A8E88E93A0ACBD5B"><enum>(2)</enum><text>The term <quote>educational recipient</quote> means a school or a community-based educational organization.</text></paragraph> 
<paragraph id="HF8A1C5B0A2744AA8825FE61DF300A6E0"><enum>(3)</enum><text>The term <quote>school</quote> includes a pre-kindergarten program (as that term is used in the Elementary and Secondary Education Act of 1965), an elementary school, a secondary school, and a local educational agency (as those terms are defined in section 9101 of that Act).</text></paragraph> 
<paragraph id="H47A1928B26AF4680B4356F1F463EA891"><enum>(4)</enum><text>The term <quote>community-based educational organization</quote> means a nonprofit entity that—</text> 
<subparagraph id="H83D4348D9D10401C8C13BB1F03B400DD"><enum>(A)</enum><text>is engaged in collaborative projects with schools or the primary focus of which is education; and</text></subparagraph> 
<subparagraph id="HFC00F94BCA3B4CEF93FEA22430E7259D"><enum>(B)</enum><text>qualifies as a nonprofit educational institution or organization for purposes of <external-xref legal-doc="usc" parsable-cite="usc/40/549">section 549(c)(3)</external-xref> of title 40, United States Code.</text></subparagraph></paragraph> 
<paragraph id="HC0E7E0EF3683447EA1767101A2F17138"><enum>(5)</enum><text>The term <quote>potential educationally useful Federal equipment</quote> means computers and related peripheral tools (such as computer printers, modems, routers, and servers), including telecommunications and research equipment, that are appropriate for use by an educational recipient. The term also includes computer software, where the transfer of a license is permitted.</text></paragraph> 
<paragraph id="H9F1DBA4525A64B46912846F4464BC093"><enum>(6)</enum><text>The term <quote>classroom-usable,</quote> with respect to potential educationally useful Federal equipment, means such equipment that does not require an upgrade of hardware or software in order to be used by an educational recipient without being first transferred under section 3(d) to a nonprofit refurbisher for such an upgrade.</text></paragraph> 
<paragraph id="HE0226626B26D49BCAAC7F6B2D00245F"><enum>(7)</enum><text>The term <quote>nonprofit refurbisher</quote> means an organization that—</text> 
<subparagraph id="HA48F30DC142C437EB96300007B55E800"><enum>(A)</enum><text>is exempt from income taxes under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986; and</text></subparagraph> 
<subparagraph id="H504E7C62D01843EEABF4989BEEB79748"><enum>(B)</enum><text>upgrades potential educationally useful Federal equipment that is not yet classroom-usable at no cost or low cost to the ultimate recipient school or community-based educational organization.</text></subparagraph></paragraph></section>
