<legis-type>A BILL</legis-type> 
<official-title>To provide for the collection and maintenance of human cord blood stem cells for the treatment of patients and research, and to amend the Public Health Service Act to authorize the C.W. Bill Young Cell Transplantation Program.</official-title>

<section id="H73F04373885D4C738CED05308228F555" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stem Cell Therapeutic and Research Act of 2005</short-title></quote>.</text></section> 
<section id="H617F36FA6EBE44B781335E8356EC802E"><enum>2.</enum><header>Cord blood inventory</header> 
<subsection id="HDB792AD4BBAA498686C3862D2784CFB7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall enter into one-time contracts with qualified cord blood stem cell banks to assist in the collection and maintenance of 150,000 units of high-quality human cord blood to be made available for transplantation through the C.W. Bill Young Cell Transplantation Program and to carry out the requirements of subsection (b).</text></subsection> 
<subsection id="H7216FFC372A24B1E96830100A7EF8FC5"><enum>(b)</enum><header>Requirements</header><text>The Secretary shall require each recipient of a contract under this section—</text> 
<paragraph id="H2FFCB3B0FB6F4F7883A5534698D336CA"><enum>(1)</enum><text>to acquire, tissue-type, test, cryopreserve, and store donated units of human cord blood acquired with the informed consent of the donor in a manner that complies with applicable Federal and State regulations;</text></paragraph> 
<paragraph id="H700A15ED0B00463AB5083EF3D4004F8D"><enum>(2)</enum><text>to make cord blood units that are collected pursuant to this section or otherwise and meet all applicable Federal standards available to transplant centers for stem cell transplantation;</text></paragraph> 
<paragraph id="H057E394307234AD0B849E27B3DD23DDF"><enum>(3)</enum><text>to make cord blood units that are collected, but not appropriate for clinical use, available for peer-reviewed research;</text></paragraph> 
<paragraph id="H289F732250424E04A368B45F16534FCB"><enum>(4)</enum><text>to submit data in a standardized format, as required by the Secretary, for the C.W. Bill Young Cell Transplantation Program; and</text></paragraph> 
<paragraph id="HD4AC078F6FC34D4595FDCE03D42DD1A4"><enum>(5)</enum><text display-inline="yes-display-inline">to submit data for inclusion in the stem cell therapeutic outcomes database maintained under section 379A of the Public Health Service Act, as amended by this Act.</text></paragraph></subsection> 
<subsection id="H35A299B1414A48F588AE6F08BB00F200"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">To seek to enter into a contract under this section, a qualified cord blood stem cell bank shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may reasonably require. At a minimum, an application for a contract under this section shall include an assurance that the applicant—</text> 
<paragraph id="H46528B250CCC488D9C28E300ECAB4784"><enum>(1)</enum><text>will participate in the C.W. Bill Young Cell Transplantation Program for a period of at least 10 years; and</text></paragraph> 
<paragraph id="H36F529D947B744758CA523F64B3DEA16"><enum>(2)</enum><text>in the event of abandonment of this activity prior to the expiration of such period, will transfer the units collected pursuant to this section to another qualified cord blood stem cell bank approved by the Secretary to ensure continued availability of cord blood units.</text></paragraph></subsection> 
<subsection id="H6C570A856A3642598F357FAD0069D463"><enum>(d)</enum><header>Duration of contracts</header> 
<paragraph id="H8E65B4A80BDA47BBB532BC430646BA9F"><enum>(1)</enum><header>In general</header><text>The Secretary may not enter into any contract under this section for a period that—</text> 
<subparagraph id="H4D69C00AD94A48FD9FBF0962A100D00"><enum>(A)</enum><text>exceeds 3 years; or</text></subparagraph> 
<subparagraph id="HFB1C041B92C242EBA2FC687C7E35CAC9"><enum>(B)</enum><text>ends after September 30, 2010.</text></subparagraph></paragraph> 
<paragraph id="H34C704197E2F461F88FAD3D59E89A1CB"><enum>(2)</enum><header>Extensions</header><text display-inline="yes-display-inline">Subject to paragraph (1)(B), the Secretary may extend the period of a contract under this section to exceed a period of 3 years if—</text> 
<subparagraph id="H19C8EFC1B8184E25B2C3451D3BAD0011"><enum>(A)</enum><text>the Secretary finds that 150,000 units of high-quality human cord blood have not yet been collected pursuant to this section; and</text></subparagraph> 
<subparagraph id="H70DA45E987704557B7FE908D3FC9CD4D"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary does not receive an application for a contract under this section from any qualified cord blood stem cell bank that has not previously entered into a contract under this section or the Secretary determines that the outstanding inventory need cannot be met by the one or more qualified cord blood stem cell banks that have submitted an application for a contract under this section.</text></subparagraph></paragraph></subsection> 
<subsection id="H2968151B4C564BC7A99E9B33704EE046"><enum>(e)</enum><header>Regulations</header><text>The Secretary may promulgate regulations to carry out this section.</text></subsection> 
<subsection id="HA9E674C1D3574E6E93AEAD4F6002F439"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H5C84B40778BD419596E24229493E7C21"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>C.W. Bill Young Cell Transplantation Program</term> means the C.W. Bill Young Cell Transplantation Program under section 379 of the Public Health Service Act, as amended by this Act.</text></paragraph> 
<paragraph id="HC39D4DC2B22D4CA6B79D787F3BFBED4C"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>cord blood donor</term> means a mother who has delivered a baby and consents to donate the neonatal blood remaining in the placenta and umbilical cord after separation from the newborn baby.</text></paragraph> 
<paragraph id="H8780A86BBE9D4FB6AD87C8DECE604D6F"><enum>(3)</enum><text>The term <term>human cord blood unit</term> means the neonatal blood collected from the placenta and umbilical cord.</text></paragraph> 
<paragraph id="HBFA8AAABDF6F493BACE448E029BD0826" display-inline="no-display-inline"><enum>(4)</enum><text>The term <term>qualified cord blood stem cell bank</term> has the meaning given to that term in section 379(b) of the Public Health Service Act, as amended by this Act.</text></paragraph> 
<paragraph id="H9C68561E16B84038B080945BBDFDCC3F"><enum>(5)</enum><text>The term <quote>Secretary</quote> means the Secretary of Health and Human Services.</text> </paragraph></subsection> 
<subsection id="HEC343AB56A7E4B3982937D287E006974"><enum>(g)</enum><header>Authorization of appropriations</header> 
<paragraph id="H7A22F34F7A7C4FC1A4ADE049C72BD51"><enum>(1)</enum><header>Fiscal year 2006</header><text>Any amounts appropriated to the Secretary for fiscal year 2004 or 2005 for the purpose of assisting in the collection or maintenance of human cord blood shall remain available to the Secretary until the end of fiscal year 2006 for the purpose of carrying out this section.</text></paragraph> 
<paragraph id="H273F06633F3042788945FC773B25E6F1"><enum>(2)</enum><header>Subsequent fiscal years</header><text>There are authorized to be appropriated to the Secretary $15,000,000 for each of fiscal years 2007, 2008, 2009, and 2010 to carry out this section. Amounts appropriated pursuant to this paragraph shall remain available for obligation through the end of fiscal year 2010.</text></paragraph></subsection></section> 
<section id="H57C1C499A78A4CAD96AFF8D9C210828C"><enum>3.</enum><header>C.W. Bill Young Cell Transplantation Program</header> 
<subsection id="H8CA18C924A3C4BD0B794B76F7802A0E7"><enum>(a)</enum><header>National Program</header><text>Section 379 of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/274k">42 U.S.C. 274k</external-xref>) is amended—</text> 
<paragraph id="HD9E631491AFD4B0D97D965E9D5E3005F"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">national registry</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">national program</header-in-text></quote>; </text></paragraph> 
<paragraph id="H97755074836A456A87C9F3EB942DA27F"><enum>(2)</enum><text>in subsection (a)—</text> 
<subparagraph id="HBD0F3DC86D924CF0B5D6F5F8CFEAB71"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>The Secretary shall by contract</quote> and all that follows through the end of such matter and inserting <quote>The Secretary, acting through the Administrator of the Health Resources and Services Administration, shall by one or more contracts establish and maintain a C.W. Bill Young Cell Transplantation Program that has the purpose of increasing the number of transplants for recipients suitably matched to biologically unrelated donors of bone marrow and cord blood, and that meets the requirements of this section. The Secretary may award a separate contract to perform each of the major functions of the Program described in paragraphs (1) and (2) of subsection (b) if deemed necessary by the Secretary to operate an effective and efficient system. The Secretary shall conduct a separate competition for the initial establishment of the cord blood functions of the Program. The Program shall be under the general supervision of the Secretary. The Secretary shall establish an Advisory Council to advise, assist, consult with, and make recommendations to the Secretary on matters related to the activities carried out by the Program. The members of the Advisory Council shall be appointed in accordance with the following:</quote>; </text></subparagraph> 
<subparagraph id="HB399454B25964B60B32EA724DD2C7BE"><enum>(B)</enum><text>in paragraph (1), by striking “except that” and all that follows and inserting “except that—</text> 
<quoted-block id="H9CFA2BB736064E7ABBE5DAEC6F0761C8"> 
<subparagraph id="H62AE2C4CAFEB4A2EB7A6D779B670BB4B"><enum>(A)</enum><text>such limitations shall not apply to the Chair of the Advisory Council (or the Chair-elect) or to the member of the Advisory Council who most recently served as the Chair; and</text></subparagraph> 
<subparagraph id="H06FA43E9E77741A3AE5702F500AEAA3D"><enum>(B)</enum><text>1 additional consecutive 2-year term may be served by any member of the Advisory Council who has no employment, governance, or financial affiliation with any donor center, recruitment group, transplant center, or cord blood stem cell bank.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HE9455497692546A8BAEB7C4959F53762"><enum>(C)</enum><text>by amending paragraph (4) to read as follows:</text> 
<quoted-block style="OLC" id="H6B9446165A164E3A941C468C8C1FA8C3" display-inline="no-display-inline"> 
<paragraph id="H6B891BD89D2144C6AC00DD08F44FCE66"><enum>(4)</enum><text display-inline="yes-display-inline">The membership of the Advisory Council—</text> 
<subparagraph id="HE6B88CACCEE24164A325B91800D06FA0"><enum>(A)</enum><text>shall include as voting members a balanced number of representatives including representatives of marrow donor centers and marrow transplant centers, representatives of cord blood stem cell banks and participating birthing hospitals, recipients of a bone marrow transplant and cord blood transplants, persons who require such transplants, family members of such a recipient or family members of a patient who has requested the assistance of the Program in searching for an unrelated donor of bone marrow or cord blood, persons with expertise in blood stem cell transplantation including cord blood, persons with expertise in typing, matching, and transplant outcome data analysis, persons with expertise in the social sciences, and members of the general public; and</text></subparagraph> 
<subparagraph id="HBEECF6E7F6E84FA89C127DF4E4E9011E"><enum>(B)</enum><text>shall include as nonvoting members representatives from the Department of Defense Marrow Donor Recruitment and Research Program operated by the Department of the Navy, the Division of Transplantation of the Health Resources and Services Administration, the Food and Drug Administration, and the National Institutes of Health.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HC737E7C9B3C544D3A65F050207D5E574"><enum>(D)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H7946B400DB1946A182E6DB1FBF818BD9" display-inline="no-display-inline"> 
<paragraph id="H9EA92A6ABE3241C2B46092D7D511E9C4"><enum>(5)</enum><text display-inline="yes-display-inline">Members of the Advisory Council shall be chosen so as to ensure objectivity and balance and reduce the potential for conflicts of interest. The Secretary shall establish bylaws and procedures—</text> 
<subparagraph id="H5BEA89F1864648BB8FE9B9745944CC95"><enum>(A)</enum><text>to prohibit any member of the Advisory Council who has an employment, governance, or financial affiliation with a donor center, recruitment group, transplant center, or cord blood stem cell bank from participating in any decision that materially affects the center, recruitment group, transplant center, or cord blood stem cell bank; and</text></subparagraph> 
<subparagraph id="H22B97FB65D824B5199373D1EE6776E00"><enum>(B)</enum><text>to limit the number of members of the Advisory Council with any such affiliation.</text></subparagraph></paragraph> 
<paragraph id="H90B2DF85026B404093E7D4F141781257"><enum>(6)</enum><text>The Secretary, acting through the Advisory Council, shall submit to the Congress—</text> 
<subparagraph id="H18F084C88FCC454CAAB43700B365C03E"><enum>(A)</enum><text>an annual report on the activities carried out under this section; and</text></subparagraph> 
<subparagraph id="H669EB34074C047AE9FBBF8BD94FDF61"><enum>(B)</enum><text>not later than 6 months after the date of the enactment of the Stem Cell Therapeutic and Research Act of 2005, a report of recommendations on the scientific factors necessary to define a cord blood unit as a high-quality unit.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HDEED4F21F36D4BE199437EDED4339626"><enum>(3)</enum><text>by amending subsection (b) to read as follows: </text> 
<quoted-block style="OLC" id="H501159E7201140FB9E035BB89CEE75BF" display-inline="no-display-inline"> 
<subsection id="H4CB6C22153B44B5CB7C75DD521471FA2"><enum>(b)</enum><header>Functions</header> 
<paragraph id="H17A44A8FDD3F46879D83F8FC6669DD"><enum>(1)</enum><header>Bone marrow functions</header><text>With respect to bone marrow, the Program shall—</text> 
<subparagraph id="H512C303791504642BEAC33F462005BE3"><enum>(A)</enum><text display-inline="yes-display-inline">operate a system for listing, searching, and facilitating the distribution of bone marrow that is suitably matched to candidate patients;</text></subparagraph> 
<subparagraph id="H5DC27FD02E6F48848C811301DC1F1854"><enum>(B)</enum><text>carry out a program for the recruitment of bone marrow donors in accordance with subsection (c), including with respect to increasing the representation of racial and ethnic minority groups (including persons of mixed ancestry) in the enrollment of the Program;</text></subparagraph> 
<subparagraph id="HF79C5609F4334D7CBCBE415486D1DEAD"><enum>(C)</enum><text>maintain and expand medical emergency contingency response capabilities in concert with Federal programs for response to threats of use of terrorist or military weapons that can damage marrow, such as ionizing radiation or chemical agents containing mustard, so that the capability of supporting patients with marrow damage from disease can be used to support casualties with marrow damage;</text></subparagraph> 
<subparagraph id="H00F800C10C47448B8690F2C11D4E2D02"><enum>(D)</enum><text>carry out informational and educational activities in accordance with subsection (c);</text></subparagraph> 
<subparagraph id="HE7154B04E7344CAB801B23C992FF426"><enum>(E)</enum><text>at least annually update information to account for changes in the status of individuals as potential donors of bone marrow;</text></subparagraph> 
<subparagraph id="H0A6B41ADD57243E8873B8B8FB4FF01E4"><enum>(F)</enum><text>provide for a system of patient advocacy through the office established under subsection (d);</text></subparagraph> 
<subparagraph id="H4C0D651B072447470068CDEC13B47210"><enum>(G)</enum><text>provide case management services for any potential donor of bone marrow to whom the Program has provided a notice that the potential donor may be suitably matched to a particular patient (which services shall be provided through a mechanism other than the system of patient advocacy under subsection (d)), and conduct surveys of donors and potential donors to determine the extent of satisfaction with such services and to identify ways in which the services can be improved;</text></subparagraph> 
<subparagraph id="H14E28AF0E9B7487D93B9CCCB892B1C0"><enum>(H)</enum><text>with respect to searches for unrelated donors of bone marrow that are conducted through the system under subparagraph (A), collect, analyze, and publish data on the number and percentage of patients at each of the various stages of the search process, including data regarding the furthest stage reached, the number and percentage of patients who are unable to complete the search process, and the reasons underlying such circumstances; </text></subparagraph> 
<subparagraph id="HF5B52564094D448CAEAE8322DEAD3042"><enum>(I)</enum><text>support studies and demonstration and outreach projects for the purpose of increasing the number of individuals who are willing to be marrow donors to ensure a genetically diverse donor pool;</text></subparagraph> 
<subparagraph id="H4D6AE9E238F74D23869E0004AF18C6F7"><enum>(J)</enum><text>conduct and support research to improve the availability, efficiency, safety, and cost of transplants from unrelated donors and the effectiveness of Program operations; and</text></subparagraph> 
<subparagraph id="HB26052CAFDC8446D000271F5F3F45093" commented="no"><enum>(K)</enum><text>assist qualified cord blood stem cell banks in the Program in accordance with paragraph (3).</text></subparagraph><continuation-text continuation-text-level="paragraph">Subsections (c) through (e) apply with respect to each entity awarded a contract under this section with respect to bone marrow.</continuation-text></paragraph> 
<paragraph id="HF4AD668C3AA54621972F06DC5112C65F"><enum>(2)</enum><header>Cord blood functions</header><text>With respect to cord blood, the Program shall—</text> 
<subparagraph id="H099E684E85DB4036A47BA049186623D0"><enum>(A)</enum><text display-inline="yes-display-inline">operate a system for identifying, matching, and facilitating the distribution of donated cord blood units that are suitably matched to candidate patients and meet all applicable Federal and State regulations (including informed consent and Food and Drug Administration regulations) from a qualified cord blood stem cell bank;</text></subparagraph> 
<subparagraph id="HC9B9B7BAF2E34302895D003D69CC2D79"><enum>(B)</enum><text display-inline="yes-display-inline">allow transplant physicians, other appropriate health care professionals, and patients to search by means of electronic access all available cord blood units listed in the Program;</text></subparagraph> 
<subparagraph id="H6F12B63F3830417DBDC43FD28B22D5E7"><enum>(C)</enum><text>allow transplant physicians and other appropriate health care professionals to tentatively reserve a cord blood unit for transplantation;</text></subparagraph> 
<subparagraph id="H289C1B20BBBC4DD48B7BC368A78B74C3"><enum>(D)</enum><text>support studies and demonstration and outreach projects for the purpose of increasing cord blood donation to ensure a genetically diverse collection of cord blood units; and</text></subparagraph> 
<subparagraph id="HF801EB66581F42EB9EF5479157399FC"><enum>(E)</enum><text display-inline="yes-display-inline">coordinate with the Secretary to carry out information and educational activities for the purpose of increasing cord blood donation and promoting the availability of cord blood units as a transplant option.</text></subparagraph></paragraph> 
<paragraph id="HAC9E4F05762E4812A978127200F191C5"><enum>(3)</enum><header>Single point of access</header><text display-inline="yes-display-inline">If the Secretary enters into a contract with more than one entity to perform the functions outlined in this subsection, the Secretary shall establish procedures to ensure that health care professionals and patients are able to obtain, consistent with the functions described in paragraphs (1)(A) and (2)(A), cells from adult donors and cord blood units through a single point of access.</text></paragraph> 
<paragraph id="H34B96B5DEC9E45FDA19D94F004941D8" display-inline="no-display-inline"><enum>(4)</enum><header>Definition</header><text>The term <term>qualified cord blood stem cell bank</term> means a cord blood stem cell bank that—</text> 
<subparagraph id="H1D6534C56CE343C49C155463FE7ECF2"><enum>(A)</enum><text>has obtained all applicable Federal and State licenses, certifications, registrations (including pursuant to the regulations of the Food and Drug Administration), and other authorizations required to operate and maintain a cord blood stem cell bank;</text></subparagraph> 
<subparagraph id="HC462219EBF87443C9B7BD62ED601E2E9"><enum>(B)</enum><text display-inline="yes-display-inline">has implemented donor screening, cord blood collection practices, and processing methods intended to protect the health and safety of donors and transplant recipients to improve transplant outcomes, including with respect to the transmission of potentially harmful infections and other diseases;</text></subparagraph> 
<subparagraph id="H380591C8229045D68DC9B1245D23B59B"><enum>(C)</enum><text>is accredited by an accreditation body recognized pursuant to a public process by the Secretary;</text></subparagraph> 
<subparagraph id="H82C971E31E3A42E7BCE6930275CB4ED3"><enum>(D)</enum><text>has established a system of strict confidentiality to protect the identity and privacy of patients and donors in accordance with existing Federal and State law; and</text></subparagraph> 
<subparagraph id="H69A46F750D624447AD042E8BA3B29DAB"><enum>(E)</enum><text>has established a system for encouraging donation by a genetically diverse group of donors.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H24D4CBF125DA44468B9D22D69EA2989D"><enum>(4)</enum><text>in subsection (c)—</text> 
<subparagraph id="HAABB78DFACDB4F640056A34E71CF393B"><enum>(A)</enum><text>in paragraph (1), by striking <quote>The Registry shall carry out a program for the recruitment</quote> and inserting <quote>With respect to bone marrow, the Program shall carry out a program for the recruitment</quote>; </text></subparagraph> 
<subparagraph id="H016CE27576454F95BE614892DF05EF01"><enum>(B)</enum><text>in paragraph (2)(A)—</text> 
<clause id="H6A786F07082E4F319E59FC5270BAEAF5"><enum>(i)</enum><text>in the matter preceding clause (i), by striking the first sentence and inserting <quote>In carrying out the program under paragraph (1), the Program shall carry out informational and educational activities, in coordination with organ donation public awareness campaigns operated through the Department of Health and Human Services, for purposes of recruiting individuals to serve as donors of bone marrow and shall test and enroll with the Program potential donors.</quote>; and</text></clause> 
<clause id="H9CC245963B764EC0A47C32F229005F63"><enum>(ii)</enum><text>in clause (ii), by striking <quote>, including providing updates</quote>; and</text></clause></subparagraph> 
<subparagraph id="HD00B0CC0F8EB4BCA924024C427B2CC73"><enum>(C)</enum><text>in paragraph (3), by striking <quote>the availability, as a potential treatment option, of receiving a transplant of bone marrow from an unrelated donor</quote> and inserting <quote>transplants from unrelated donors as a treatment option and resources for identifying and evaluating other therapeutic alternatives</quote>;</text></subparagraph></paragraph> 
<paragraph id="HE73541F570EE4B97AE209EF126239134"><enum>(5)</enum><text>in subsection (d)—</text> 
<subparagraph id="H25E70252289944F9B19F8CD667C01E72"><enum>(A)</enum><text>in paragraph (1), by striking <quote>The Registry shall</quote> and inserting <quote>With respect to bone marrow, the Program shall</quote>; </text></subparagraph> 
<subparagraph id="HE4C0E7C5B8A744328F15751000C48050"><enum>(B)</enum><text>in paragraph (2)(C), by inserting <quote>and assist with information regarding third party payor matters</quote> after <quote>ongoing search for a donor</quote>;</text></subparagraph> 
<subparagraph id="H8AC628D82C3B4C8194D7DD400384A53B"><enum>(C)</enum><text>in subparagraphs (C), (D), and (E) of paragraph (2), by striking the term <term>subsection (b)(1)</term> each place such term appears and inserting <quote>subsection (b)(1)(A)</quote>;</text></subparagraph> 
<subparagraph id="HA97225A37924489F8DDE206662D00084"><enum>(D)</enum><text>in paragraph (2)(F)—</text>

<subparagraph id="HDEA7DB6F885940CC864FED5EEAEEEDDC"><enum>(E)</enum><text>in paragraph (3)(B), by striking <quote>Office may</quote> and inserting <quote>Office shall</quote>;</text></subparagraph></paragraph> 
<paragraph id="HA871F0F67DBE4AA781BD472DB365B0BE"><enum>(6)</enum><text>in the matter preceding paragraph (1) in subsection (e), by striking <quote>the Secretary shall</quote> and inserting <quote>with respect to bone marrow, the Secretary shall</quote>;</text></paragraph>

<paragraph id="H477F5A2949A14FE18417C0F1262974E0"><enum>(8)</enum><text>by amending subsection (g) to read as follows:</text>

<subsection id="HCB5BD4F18EA048DD8E4906F975A91825"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall by contract establish and maintain a scientific database of information relating to patients who have been recipients of stem cell therapeutics product (including bone marrow, cord blood, or other such product) from a biologically unrelated donor.</text></subsection> 
<subsection id="HE2AD197F27BC488DB4B612E984991D83"><enum>(b)</enum><header>Information</header><text>The outcomes database shall include information with respect to patients described in subsection (a), transplant procedures, and such other information as the Secretary determines to be appropriate, to conduct an ongoing evaluation of the scientific and clinical status of transplantation involving recipients of bone marrow from biologically unrelated donors and recipients of a stem cell therapeutics product.</text></subsection> 
<subsection id="H9846795958A449E0B52F3F273DF02225"><enum>(c)</enum><header>Annual report on patient outcomes</header><text>The Secretary shall require the entity awarded a contract under this section to submit to the Secretary an annual report concerning patient outcomes with respect to each transplant center, based on data collected and maintained by the entity pursuant to this section. </text></subsection> 
<subsection id="HFFE414F4F3BB433BA9B5442D22A50034"><enum>(d)</enum><header>Publicly available data</header><text display-inline="yes-display-inline">The outcomes database shall make relevant scientific information not containing individually identifiable information available to the public in the form of summaries and data sets to encourage medical research and to provide information to transplant programs, physicians, patients, entities awarded a contract under section 379 donor registries, and cord blood stem cell banks.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3975B96F174C4699BD2CB97FB6A200B0"><enum>(c)</enum><header>Definitions</header><text>Part I of title III of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/274k">42 U.S.C. 274k et seq.</external-xref>) is amended by inserting after section 379A the following:</text>
