<official-title>To assist aliens who were transplanted to the United States as children in continuing their education and otherwise integrating into American society.</official-title>

<section section-type="section-one" id="HBBBDF0E664B1443783ACBF5726DD9100" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preserving Educational Opportunities for Immigrant Children Act of 2005</short-title></quote>.</text></section> 
<section id="H942C1EC08B4E4FA7B6D7EF78181D68B0"><enum>2.</enum><header>Findings and purposes</header> 
<subsection id="HC2B24895BC784A08BF1B164FCDEBD08"><enum>(a)</enum><header>Findings</header><text>Congress makes the following findings:</text> 
<paragraph id="HCE3CD251B2F2495289B1D63E3B333F2D"><enum>(1)</enum><text>Many children are brought to the United States at a very young age by parents or other adults to accompany them during the adults’ stay in the United States.</text></paragraph> 
<paragraph id="HDC903AFD99F640BEAA16D5246168A090"><enum>(2)</enum><text>In many such instances, parents or other adults traveling to the United States enter and or remain in this country without benefit of inspection or authorization to be present in the United States.</text></paragraph> 
<paragraph id="H1CF2A75BED264596ABD6FAE70643E8F2"><enum>(3)</enum><text>Many children brought to the United States by parents or other adults arrive in this country without the ability to make independent decisions about where they wish to live. Once in the United States, many such children also are incapable of independent living.</text></paragraph> 
<paragraph id="HDCA690E9BB3A443CB7BF6548CBD0A76B"><enum>(4)</enum><text>Because of the early age at which many children arrive in the United States, as they become older, they become fully integrated into American life, learning English and either losing or never acquiring the language of their native country. At the same time, many lose all ties to relatives in their country of origin or previous country of habitual residence.</text></paragraph> 
<paragraph id="HC270687B0F2D439EAE2B62BDB010955D"><enum>(5)</enum><text>Many such children attend public elementary and secondary schools in the United States. Often, they excel in academics and contribute to both their communities and the families with whom they live.</text></paragraph> 
<paragraph id="H389BB7BC6DFC4625A5E5F48D18A49B05"><enum>(6)</enum><text>Current United States immigration laws do not provide the Attorney General with adequate flexibility to take into account the special humanitarian circumstances in which such transplanted alien children live. Consequently, such children are in danger of being removed to a country they do not know, an eventuality that would cause enormous disruptions in their lives and in the lives of their loved ones.</text></paragraph> 
<paragraph id="HB724783DA5A5448981BFB7F58D1BAC42"><enum>(7)</enum><text>Current immigration laws effectively preclude States and units of local government from providing such children access to State systems of higher education. Consequently, many such children cannot continue their education upon graduating from high school.</text></paragraph></subsection> 
<subsection id="H16EFD6CB3EFC4526A336EEE393374623"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text> 
<paragraph id="H85E7F06014D347B6AB6F6ECB941B11D7"><enum>(1)</enum><text>to provide for aliens who, through no fault of their own, were brought to the United States as children, opportunities to regularize their status in the United States, attend college, and become contributing members of their communities in this country; and</text></paragraph> 
<paragraph id="H89E235FC79FF4F66AC75BA04F5980060"><enum>(2)</enum><text>to repeal certain legislative barriers that impede the ability of such aliens to become fully integrated into United States society.</text></paragraph></subsection></section> 
<section id="HC1C1919C305C457FA0685220DEFD6F08"><enum>3.</enum><header>Definitions</header> 
<subsection id="H530533BB6CAC42E0BEAB1B8601FBF18E"><enum>(a)</enum><header>Transplanted child</header><text>As used in this Act, the term, <quote>transplanted child</quote> means an alien who is described in section 101(a)(51) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (as amended by subsection (b) of this Act).</text></subsection> 
<subsection id="H64D352128329459BBE03106C17C4726C"><enum>(b)</enum><header>Amendment to the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name></header><text>Section 101(a) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block act-name="Immigration and Nationality Act" id="H433BE535DC1C4E05B2701CA054F0061"> 
<paragraph id="H20093C0651C843138C59C1B6E22D4C78"><enum>(51)</enum><text>The term <term>transplanted child</term> means an alien who has been granted cancellation of removal under section 240A(b)(3) or who has pending before the Attorney General an application for cancellation of removal under such section.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H96CC5081084847EE9100BC9398296378"><enum>4.</enum><header>Restoration of State flexibility in providing in-State tuition for college-age alien children</header> 
<subsection id="H9FEA900D520641F8B97D725337F001F"><enum>(a)</enum><header>Restoration</header><text>The Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (division C of <external-xref legal-doc="public-law" parsable-cite="pl/104/208">Public Law 104–208</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1623">8 U.S.C. 1623</external-xref>) is amended by striking section 505.</text></subsection> 
<subsection id="H50FD79862B6842C1A1CE998E0048FC03"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a) shall apply to postsecondary education benefits provided on or after July 1, 1998.</text></subsection></section> 
<section id="HC2DFD0F2D55E4856BE2800F844D4DEAA"><enum>5.</enum><header>Eligibility of transplanted children for public benefits</header><text display-inline="no-display-inline">Section 431(b) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1641">8 U.S.C. 1641(b)</external-xref>) is amended—</text> 
<paragraph id="H9B0947AF1B294703A960CEFDCA67A4B5"><enum>(1)</enum><text>at the end of paragraph (6), by striking <quote>; or</quote> and inserting a semicolon;</text></paragraph> 
<paragraph id="H22B645C575BB4481AE838E68391E32B9"><enum>(2)</enum><text>at the end of paragraph (7), by striking the period and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="H10944D7259B24BCB9472A9008EB8B08F"><enum>(3)</enum><text>by adding after paragraph (7) the following new paragraph:</text>

<paragraph id="H5C846E46E822490DAB629597E4B5E600"><enum>(8)</enum><text>an alien who is a transplanted child, as defined in section 101(a)(51) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HA6B0F251A99D4A7EB3571FCDE565F890"><enum>6.</enum><header>Authority of Attorney General to adjust status of certain children</header> 
<subsection id="H746988A1F7294549A881D8698975432E"><enum>(a)</enum><header>In general</header><text>Section 240A(b) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1229b">8 U.S.C. 1229b(b)</external-xref>) is amended by—</text> 
<paragraph id="H29F384156D234CCA84B6283C22C3AEF5"><enum>(1)</enum><text>redesignating paragraph (3) as paragraph (4); and</text></paragraph> 
<paragraph id="H5BC248BBD329412BABAA52AE2D25CD5F"><enum>(2)</enum><text>inserting after paragraph (2) the following new paragraph:</text>

<paragraph id="H62CB7FF3B70540749E1500E6F31F2CE7"><enum>(3)</enum><header>Special rule for aliens brought to the United States as children</header> 
<subparagraph id="H7B7131B606CE4E66B0CB4866A22BD2B4"><enum>(A)</enum><header>Authority</header><text>Subject to subparagraph (B), the Attorney General may cancel the removal of, and adjust to the status of an alien lawfully admitted for permanent residence, an alien who is inadmissible or deportable from the United States, if the Attorney General determines that—</text> 
<clause id="H9431830E83594AFB94FA2BA315FA4D2B"><enum>(i)</enum> 
<subclause display-inline="yes-display-inline" id="HB44111188F0C4B1EAAD0B0EC23124957"><enum>(I)</enum><text>in the case of an alien who has not attained the age of 18, the alien has been physically present in the United States for a continuous period of not less than 3 years immediately preceding the date of such application and during such period the alien has been a person of good moral character; or</text></subclause> 
<subclause indent="up1" id="H8EFC804AE3CD41E1B07ED02700C2157"><enum>(II)</enum><text>in the case of an alien who is 18 years of age or older, the alien has been physically present in the United States for a continuous period of not less than 5 years immediately preceding the date of such application, including at least 3 years of continuous residence before reaching 18 years of age and during such 5 year period the alien has been a person of good moral character; and</text></subclause></clause> 
<clause id="HB541D0F04C9546D88E919CFFDE1969FE"><enum>(ii)</enum><text>the removal would result in extreme hardship to the alien, the alien’s child, or the alien’s parent.</text></clause></subparagraph> 
<subparagraph id="H61D592523820439889F4288DCD15B3CB"><enum>(B)</enum><header>Restrictions on authority</header><text>The authority of the Attorney General under subparagraph (A) shall not apply to—</text> 
<clause id="H2240A9C2C5F14A0A8F55018BC4284700"><enum>(i)</enum><text>an alien who is inadmissible under section 212(a)(2)(A)(i)(I) or deportable under section 237(a)(2)(A)(i) (relating to crimes of moral turpitude) unless the Attorney General determines that the alien’s removal would result in extreme hardship to the alien, the alien’s child, or (in the case of an alien who is a child) to the alien’s parent; or</text></clause> 
<clause id="H6ECC507C9B094231ACD7A6B5F0091EF8"><enum>(ii)</enum><text>an alien who is inadmissible under section 212(a)(3), or deportable under section 237(a)(2)(D)(i) or 237(a)(2)(D)(ii) (relating to security and related grounds).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H926316E16B8340FFA6FD5DA436A94CEC"><enum>(b)</enum><header>Conforming amendment</header><text>Section 240A(b) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1229b">8 U.S.C. 1229b(b)</external-xref>), is amended in paragraph (4) (as so redesignated by the amendment made by subsection (a)) by striking <quote>paragraph (1) or (2)</quote> each place it appears and inserting <quote>paragraph (1), (2), or (3).</quote>.</text></subsection></section>
