<official-title>To require the Secretary of Education to revise regulations for student loan deferments with respect to borrowers who are medical or dental residents.</official-title>

<section id="H671F4CCF002E4F9B97D92D008EFF6E77" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Healthcare Student Financial Assistance Act</short-title></quote>.</text></section> 
<section id="H9C598EFF935A4DFAA931D912A81C469"><enum>2.</enum><header>Regulation revision required</header> 
<subsection id="HEB744D09B6B04741B1B6946FC5B233EB"><enum>(a)</enum><header>Action required</header><text>Within 90 days after the date of enactment of this Act, the Secretary of Education shall revise the Department of Education regulations under the Federal Family Education Loan, Federal Direct Student Loan, and Perkins Loan programs with respect to deferment of student loan repayment (34 CFR 674.34, 682.210, 685.204) to comply with the requirements of subsection (b).</text></subsection> 
<subsection id="H75796CB4BD4D4915004BB156AA810019"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">The student loan repayment deferment regulations shall be revised to provide with respect to borrowers who are in post-graduate medical and dental residency and fellowship programs the following:</text> 
<paragraph id="H83755FCDBBD1430C87EE531DB1004F9B"><enum>(1)</enum><text>If a borrower entering such a residency or fellowship program qualifies for deferment under the economic hardship provision, the deferment shall be available for up to 5 years, and the borrower shall not be required to apply annually.</text></paragraph> 
<paragraph id="H7636C5CE1CD343E18042B2C9EE26BF8E"><enum>(2)</enum><text>If the borrower is in such a residency or fellowship program and both is working full-time and has a Federal education debt burden that equals or exceeds 20 percent of the borrower's adjusted gross income, the borrower shall be required, as a condition of the hardship deferment, to demonstrate that the difference between the borrower’s adjusted gross income minus the Federal education debt burden is less than 230 percent (not 220 percent) of the greater of—</text> 
<subparagraph id="H704A8B1E38004ACB8F07FFBD95E3288B"><enum>(A)</enum><text>the annual earnings of an individual earning minimum wage; or</text></subparagraph> 
<subparagraph id="HD83829E8C0EB44E7AC6243D5F379E90"><enum>(B)</enum><text>the official poverty line applicable to a family of two.</text></subparagraph></paragraph> 
<paragraph id="H1411BF52FFEF4F9598ADA95E754032A3"><enum>(3)</enum><text display-inline="yes-display-inline">If a borrower is entering a dental residency or fellowship program in an institution that is, or is affiliated with, an eligible institution for programs under title IV of the Higher Education Act of 1965, the in-school deferment shall be available for the duration of the residency or fellowship program, but may not exceed 5 years.</text></paragraph></subsection></section> 
<section id="HB558ED75E56E4AF887AC2B65E9F7C9CF"><enum>3.</enum><header>Clarification of student deferment</header><text display-inline="no-display-inline">Clause (i) of section 428(b)(1)(M) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1078">20 U.S.C. 1078(b)(1)(M)(i)</external-xref>) is amended by inserting after <quote>residency program</quote> the following: <quote>, and except that the preceding limitation shall not apply to a dental residency program</quote>.</text> </section>
