<official-title>To amend title XVIII of the Social Security Act to prohibit disclosure of Social Security numbers on Medicare-related mailings.</official-title>

<section id="H4EB0799EAC79475997815F04E7A99105" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop the Theft of Our Social Security Numbers Act of 2005</short-title></quote>.</text></section> 
<section id="H9211DCA58B2D42E78F79A9176DCC0974"><enum>2.</enum><header>Prohibition of disclosure of social security numbers on medicare-related mailings</header> 
<subsection id="H3361F10248A445F7A6EED4D22C06C4F"><enum>(a)</enum><header>In general</header><text>Section 1874 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395kk">42 U.S.C. 1395kk</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H246DFA74B2EA4F6EBC59C5A602C6E849"><enum>(d)</enum> 
<paragraph id="HBF811E04B81A44D598E4F8A22F3F4687" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">In any case in which an individual's identifying number for purposes of this title is the social security account number issued to such individual for purposes of section 205(c)(2)(A), no officer or employee of the Department of Health and Human Services may include such number—</text> 
<subparagraph id="H7DDBE119CE9A4B239EBE60A5F59F3329" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">as part of any medicare-related mailing to any person, including the mailing of any medicare card that contains such number; or</text></subparagraph> 
<subparagraph id="HA14614042A7E49C19081C916CEE217C6" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">as part of the contents of any tax-related mailing to any person unless—</text> 
<clause id="HD2AE2DCCDDE84558B699F589D1CA9B2"><enum>(i)</enum><text display-inline="yes-display-inline">the contents are in an envelope (or other appropriate wrapper) which is sealed; and</text></clause> 
<clause id="HAF954A336F3B47F4AC2FCEDC42E53D4E"><enum>(ii)</enum><text display-inline="yes-display-inline">such number may not be viewed without opening such envelope (or wrapper).</text></clause></subparagraph></paragraph> 
<paragraph id="HE9800F1E040F4304B5909CCB2FCDF4AE"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of this subsection, the term `medicare-related mailing' means any mailing related to the administration of this title.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H37AA6A074E794CA58E09C717AEAF943"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply to mailings made on or after the first day of the first month beginning after the date of the enactment of this Act.</text></subsection></section>
