<official-title>To provide that members of the National Guard who served in the counties declared Federal disaster areas in response to the September 11, 2001, terrorist attacks on the United States, and who served under State duty so that they could immediately assist in the response to the terrorist attacks should have that service counted as Federal active duty for purposes of military retirement credit under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/1223">chapter 1223</external-xref> of title 10, United States Code.</official-title>

<section id="HAAC12795CDDF4AFDA21433BFBDF1145" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Military retirement credit for certain service by National Guard members performed while in a State duty status immediately after the terrorist attacks of September 11, 2001</header> 
<subsection id="H6788B2172A204683BB006D517B24BA00"><enum>(a)</enum><header>Retirement credit</header><text display-inline="yes-display-inline">Service of a member of the Ready Reserve of the Army National Guard or Air National Guard described in subsection (b) shall be deemed to be service creditable under <external-xref legal-doc="usc" parsable-cite="usc/10/12732">section 12732(a)(2)(A)(i)</external-xref> of title 10, United States Code.</text></subsection> 
<subsection id="H87E11C42460740FD87B6D87F7100CC54"><enum>(b)</enum><header>Covered service</header><text display-inline="yes-display-inline">Service referred to in subsection (a) is full-time State active duty service that a member of the National Guard performed on or after September 11, 2001, and before October 1, 2002, in any of the counties specified in subsection (c) to support a Federal declaration of emergency following the terrorist attacks on the United States of September 11, 2001.</text></subsection> 
<subsection id="H3EBF4962E3714C25AFCC5D8D7BCAB8CC"><enum>(c)</enum><header>Covered counties</header><text>The counties referred to in subsection (b) are the following:</text> 
<paragraph id="H228CF8735AA04F2FB7EF4A4CD21C6C3"><enum>(1)</enum><text display-inline="yes-display-inline">In the State of New York: Bronx, Kings, New York (boroughs of Brooklyn and Manhattan), Queens, Richmond, Delaware, Dutchess, Nassau, Orange, Putnam, Rockland, Suffolk, Sullivan, Ulster, and Westchester</text></paragraph> 
<paragraph id="H9E8615CA877F4DEDBDD4ECC89E221607"><enum>(2)</enum><text>In the State of Virginia: Arlington.</text></paragraph></subsection> 
<subsection id="HF126198B932D4E8890965B51CE6F95E4"><enum>(d)</enum><header>Applicability</header><text display-inline="yes-display-inline">Subsection (a) shall take effect as of September 11, 2001.</text></subsection></section>
