<section section-type="section-one" id="HE3D961940D1F4094B9F86D5710425916" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Intelligence Authorization Act for Fiscal Year 2006</short-title></quote>.</text></section> 
<title id="H5078392F1B354FAEB8AB3B5F2053A1EF"><enum>I</enum><header>Intelligence activities</header> 
<section id="H2004C1B8B5A34EA2B764438DE186E792"><enum>101.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Funds are hereby authorized to be appropriated for fiscal year 2006 for the conduct of the intelligence and intelligence-related activities of the following elements of the United States Government:</text> 
<paragraph id="HDD5816EDDC304E659426F597A145EF6F"><enum>(1)</enum><text>The Office of the Director of National Intelligence.</text></paragraph> 
<paragraph id="H53065015D0A643138E75B0FF896CAD08"><enum>(2)</enum><text>The Central Intelligence Agency.</text></paragraph> 
<paragraph id="HC06CA60AF65A4B4CBA5BA75BFB8247FE"><enum>(3)</enum><text>The Department of Defense.</text></paragraph> 
<paragraph id="H1B468B2DED91461886AD00979FB3DBB5"><enum>(4)</enum><text>The Defense Intelligence Agency.</text></paragraph> 
<paragraph id="H45CE48FE7903445A925F6B6D7B711EB6"><enum>(5)</enum><text>The National Security Agency.</text></paragraph>

<section id="H56F58B233E084230A7AA2CB174372893"><enum>102.</enum><header>Classified Schedule of Authorizations</header> 
<subsection id="H89DD7CCB01DB4FFB808690B5830018B9"><enum>(a)</enum><header>Specifications of amounts and personnel ceilings</header><text>The amounts authorized to be appropriated under section 101, and the authorized personnel ceilings as of September 30, 2006, for the conduct of the intelligence and intelligence-related activities of the elements listed in such section, are those specified in the classified Schedule of Authorizations prepared to accompany the bill H.R. ____ of the One Hundred Ninth Congress.</text></subsection> 
<subsection id="H1132E0ED07E44A0683194E1710CDF5A4"><enum>(b)</enum><header>Availability of classified Schedule of Authorizations</header><text>The Schedule of Authorizations shall be made available to the Committees on Appropriations of the Senate and House of Representatives and to the President. The President shall provide for suitable distribution of the Schedule, or of appropriate portions of the Schedule, within the executive branch.</text></subsection></section> 
<section id="H0B1348CCD72743DC96B523BC36BBB7B2"><enum>103.</enum><header>Personnel ceiling adjustments</header> 
<subsection id="HF917A6A1861C45A9B60022488D64C1B8"><enum>(a)</enum><header>Authority for adjustments</header><text>With the approval of the Director of the Office of Management and Budget, the Director of National Intelligence may authorize employment of civilian personnel in excess of the number authorized for fiscal year 2006 under section 102 when the Director of National Intelligence determines that such action is necessary to the performance of important intelligence functions.</text></subsection> 
<subsection id="H8F40A73A157B481BA5C826990856B723"><enum>(b)</enum><header>Notice to intelligence committees</header><text>The Director of National Intelligence shall notify promptly the Select Committee on Intelligence of the Senate and the Permanent Select Committee on Intelligence of the House of Representatives whenever the Director exercises the authority granted by this section.</text></subsection></section> 
<section id="H509EEF875E66496EB5001C37E01477C1"><enum>104.</enum><header>Intelligence Community Management Account</header> 
<subsection id="H507B275CD9904CA9B1D9F75BF123233D"><enum>(a)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated for the Intelligence Community Management Account of the Director of National Intelligence for fiscal year 2006 the sum of $_____. Within such amount, funds identified in the classified Schedule of Authorizations referred to in section 102(a) for advanced research and development shall remain available until September 30, 2007.</text></subsection> 
<subsection id="H60405154361741A8B49CE2AA197B6DC7"><enum>(b)</enum><header>Authorized personnel levels</header><text>The elements within the Intelligence Community Management Account of the Director of National Intelligence are authorized __ full-time personnel as of September 30, 2006. Personnel serving in such elements may be permanent employees of the Intelligence Community Management Account or personnel detailed from other elements of the United States Government.</text></subsection> 
<subsection id="H1A0A44EC4CBD4C2E872DE68D7CBD85B1"><enum>(c)</enum><header>Classified authorizations</header> 
<paragraph id="H70E12A5A82264D079177F8000259876C"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">In addition to amounts authorized to be appropriated for the Intelligence Community Management Account by subsection (a), there are also authorized to be appropriated for the Intelligence Community Management Account for fiscal year 2006 such additional amounts as are specified in the classified Schedule of Authorizations referred to in section 102(a). Such additional amounts for advanced research and development shall remain available until September 30, 2007.</text></paragraph> 
<paragraph id="HE0D69B68CEFA4282A44E10D7BE40DD75"><enum>(2)</enum><header>Authorization of personnel</header><text>In addition to the personnel authorized by subsection (b) for elements of the Intelligence Community Management Account as of September 30, 2006, there are also authorized such additional personnel for such elements as of that date as are specified in the classified Schedule of Authorizations.</text></paragraph></subsection> 
<subsection id="H2B79349A9FCE4BF2ABBD67FBC0165467"><enum>(d)</enum><header>Reimbursement</header><text>Except as provided in section 113 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/404h">50 U.S.C. 404h</external-xref>), during fiscal year 2006 any officer or employee of the United States or a member of the Armed Forces who is detailed to the staff of the Intelligence Community Management Account from another element of the United States Government shall be detailed on a reimbursable basis, except that any such officer, employee, or member may be detailed on a nonreimbursable basis for a period of less than one year for the performance of temporary functions as required by the Director of National Intelligence.</text></subsection></section></title> 
<title id="H54C593D529944251BCA627FFEE02C1F0"><enum>II</enum><header>Central Intelligence Agency Retirement and Disability System</header> 
<section id="H4BA9DE4635A44A7EA8E84091D381327D"><enum>201.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated for the Central Intelligence Agency Retirement and Disability Fund for fiscal year 2006 the sum of $_____.</text></section></title> 
<title id="H0BB545315B2E458BB109A07D67959C5F"><enum>III</enum><header>General provisions</header> 
<section id="HA7D84C539454407891FB23FB1920AD32"><enum>301.</enum><header>Increase in employee compensation and benefits authorized by law</header><text display-inline="no-display-inline">Appropriations authorized by this Act for salary, pay, retirement, and other benefits for Federal employees may be increased by such additional or supplemental amounts as may be necessary for increases in such compensation or benefits authorized by law.</text></section> 
<section id="HA23950159A6C4B65B3574C116E1E3D2B"><enum>302.</enum><header>Restriction on conduct of intelligence activities</header><text display-inline="no-display-inline">The authorization of appropriations by this Act shall not be deemed to constitute authority for the conduct of any intelligence activity which is not otherwise authorized by the Constitution or the laws of the United States. </text></section></title>
