2.The Congress finds the following:
(1)Research and development are critical to developing and maintaining a transportation system that meets the goals of safety, mobility, economic vitality, efficiency, equity, and environmental protection.
(2)Federally sponsored surface transportation research and development has produced many successes. The development of rumble strips has increased safety; research on materials has increased the lifespan of pavements, saving money and reducing the disruption caused by construction; and Geographic Information Systems have improved the management and efficiency of transit fleets.
(3)Despite these important successes, the Federal surface transportation research and development investment represents less than one percent of overall government spending on surface transportation.
(4)While Congress increased funding for overall transportation programs by about 40 percent in the Transportation Equity Act for the 21st Century, funding for transportation research and development remained relatively flat.
(5)The Federal investment in research and development should be balanced between short-term applied and long-term fundamental research and development. The investment should also cover a wide range of research areas, including research on materials and construction, research on operations, research on transportation trends and human factors, and research addressing the institutional barriers to deployment of new technologies.
(6)Therefore, Congress finds that it is in the United States interest to increase the Federal investment in transportation research and development, and to conduct research in critical research gaps, in order to ensure that the transportation system meets the goals of safety, mobility, economic vitality, efficiency, equity, and environmental protection.
<enum>I</enum><header>Surface transportation research and development</header>
<section id="HAE0A00893DE3432EA2C1F0C09B14B3E7"><enum>101.</enum><header>Authorization of appropriations</header>
<subsection id="H4D0F8A0AE39F4E729FA64DF9D420A307"><enum>(a)</enum><header>In General</header><text>There are authorized to be appropriated for each of fiscal years 2005 through 2010, to carry out this title and the amendments made by this title (other than sections 108 and 109) and other programs described in subsection (b), the greater of—</text>
<paragraph id="H744CC04911F94408BD618023C626604F"><enum>(1)</enum><text>1.08 percent of the amounts made available in each fiscal year from the Highway Trust Fund; or</text></paragraph>
<paragraph id="H5F0A869FB7E3407A91FF04F6A2A9F72B"><enum>(2)</enum><text>$500,000,000.</text></paragraph></subsection>
<subsection id="H6E9BF8C42509453B9139200127642E11"><enum>(b)</enum><header>Programs</header><text>Of the amount authorized to be appropriated under subsection (a)—</text>
<paragraph id="H6899AFE9E95F4218885B8451E0639CB8"><enum>(1)</enum><text>50 percent shall be for carrying out sections 502, 503, 506, 507, 508, and 510 of title 23, United States Code, section 5113(b) of the Transportation Equity Act for the 21st Century, and section 104(d) of this Act, for each of fiscal years 2005 through 2010, of which—</text>
<subparagraph id="HEB962F70CD0542559FF4AE20E300BBD"><enum>(A)</enum><text>not less than $20,000,000 shall be for the Surface Transportation Environment and Planning Cooperative Research Program under <external-xref legal-doc="usc" parsable-cite="usc/23/507">section 507</external-xref> of title 23, United States Code, for each of those fiscal years;</text></subparagraph>
<subparagraph id="H3A2C5815A02249FE864C4DBC82332AA"><enum>(B)</enum><text>not less than $10,000,000 shall be for advanced exploratory research under <external-xref legal-doc="usc" parsable-cite="usc/23/502">section 502(d)</external-xref> of title 23, United States Code, for each of those fiscal years; and</text></subparagraph>
<subparagraph id="H7D4ECD7EEDDE4513A8FBEB2FE5DBC3C1"><enum>(C)</enum><text>not less than $5,000,000 shall be for the National Multimodal Trends Policy Research Program under section 104(d) of this Act for each of those fiscal years;</text></subparagraph></paragraph>
<paragraph id="H1F898414C37C431296FA227D5781F667"><enum>(2)</enum><text>6.5 percent shall be for carrying out <external-xref legal-doc="usc" parsable-cite="usc/23/504">section 504</external-xref> of title 23, United States Code, for each of fiscal years 2005 through 2010;</text></paragraph>
<paragraph id="H17ACE4907D044C818B5547D2D233C74"><enum>(3)</enum><text>7.5 percent shall be for carrying out <external-xref legal-doc="usc" parsable-cite="usc/49/111">section 111</external-xref> of title 49, United States Code, for each of fiscal years 2005 through 2010, of which not less than $5,000,000 shall be for research and development grants under subsection (i)(2) of such section for each of fiscal years 2005 through 2010;</text></paragraph>
<paragraph id="H46E4A6859C134B038F06DCC0151D67A"><enum>(4)</enum><text>11.5 percent shall be for carrying out <external-xref legal-doc="usc" parsable-cite="usc/49/5505">section 5505</external-xref> of title 49, United States Code, for each of fiscal years 2005 through 2010; and</text></paragraph>
<paragraph id="HAAE7E1A6DF984DE0A527A8F5C8C80331"><enum>(5)</enum><text>24.5 percent shall be for carrying out the Intelligent Transportation Systems Act of 2005 for each of fiscal years 2005 through 2010.</text></paragraph></subsection></section>
<section id="HB859BB995363434FA31F5702BD7EFD14"><enum>102.</enum><header>Goals, principles, and processes</header>
<subsection id="HAD255C72FD4D41059BB3DAA029D4CCFD"><enum>(a)</enum><header>Goals</header><text>The Federal Government shall support surface transportation research and development to help achieve the goals established for the surface transportation system as set forth in the Transportation Equity Act for the 21st Century, including supporting economic vitality, improving safety and security, increasing mobility, protecting and enhancing the environment, improving integration between modes of transportation, promoting efficiency, and emphasizing the preservation of the existing transportation system.</text></subsection>
<subsection id="HC1B4DF5FA673441F9BC8F7F1DB18B65"><enum>(b)</enum><header>Basic principles governing research and development</header>
<paragraph id="H4E380E16009F42B683A9EEA4AD0430A9"><enum>(1)</enum><header>Coverage</header><text>Surface transportation research and development shall include all activities leading to technology development and transfer, as well as the introduction of new and innovative ideas, practices, and approaches, through such mechanisms as field applications, education and training, and technical support.</text></paragraph>
<paragraph id="HA24CEE9CA70D462482753CCFBA660039"><enum>(2)</enum><header>Federal responsibility</header><text>The Federal Government shall fund and conduct surface transportation research and development and technology transfer activities that—</text>
<subparagraph id="H3592EB8263264502AB80B851F8D919C"><enum>(A)</enum><text>are of national significance;</text></subparagraph>
<subparagraph id="H81FFACDDF3EE477184C9D175D8628DC"><enum>(B)</enum><text>support research and development in which there is a clear public benefit, and private sector investment is less than optimal due to market failure;</text></subparagraph>
<subparagraph id="HAFC525BA8A49472083267E2D6226A43"><enum>(C)</enum><text>support research and development that the Secretary determines is critical that is not otherwise being conducted by the public or private sector; or</text></subparagraph>
<subparagraph id="H402C347137DB40FAA221EBE3B8CC95"><enum>(D)</enum><text>support a Federal stewardship role in ensuring that State and local governments use national resources efficiently.</text></subparagraph></paragraph>
<paragraph id="H3D95BDA6C42743FD95886455FA1D00E7"><enum>(3)</enum><header>Role</header><text>Consistent with these Federal responsibilities, the Secretary of Transportation shall—</text>
<subparagraph id="HA17EC7A8256F47D2835BCAD0BF93CC23"><enum>(A)</enum><text>conduct research and development;</text></subparagraph>
<subparagraph id="H447240C3611C4E80A80048018CA1A3F4"><enum>(B)</enum><text>support and facilitate research and development and technology transfer activities by State highway agencies, metropolitan planning organizations, and local governments;</text></subparagraph>
<subparagraph id="H4D3A7719BD2D40EDAE887E459B4DD3F"><enum>(C)</enum><text>share results of completed research and development; and</text></subparagraph>
<subparagraph id="H57A4507F43624E3CB11D82479B81C564"><enum>(D)</enum><text>support and facilitate technology and innovation deployment.</text></subparagraph></paragraph>
<paragraph id="H6FE17D13AAA4432087A067302F30AE37"><enum>(4)</enum><header>Program content</header><text>The surface transportation research and development program shall include—</text>
<subparagraph id="HF0C441E60E564B3B8C333557412B40C0"><enum>(A)</enum><text>fundamental, long-term research;</text></subparagraph>
<subparagraph id="H93058A69D6074297B22544579D2487C0"><enum>(B)</enum><text>research and development aimed at significant research gaps, and emerging issues with national implications; and</text></subparagraph>
<subparagraph id="HC8547346C2AF4CB9A9F2BDB474A5D6AC"><enum>(C)</enum><text>research related to policy and planning.</text></subparagraph></paragraph></subsection>
<subsection id="HC79C3BA5C74E4013950042384D9735AF"><enum>(c)</enum><header>Processes</header>
<paragraph id="H4EAF1950DE744F6289E998CA97E49B57"><enum>(1)</enum><header>Stakeholder input</header><text>Federal surface transportation research and development activities shall address the needs of stakeholders. Stakeholders include States, metropolitan planning organizations, local governments, the private sector, researchers, research sponsors, and other affected parties, including public interest groups.</text></paragraph>
<paragraph id="HFA5033E9B8B74253808FC288EEE6F65B"><enum>(2)</enum><header>Competition and peer review</header><text>Except as otherwise provided in this Act, the Secretary shall award all grants, contracts, and cooperative agreements for research and development under this Act based on open competition and peer review of proposals.</text></paragraph>
<paragraph id="H55C55B3C781E4065B7916EDB8CB8BBE2"><enum>(3)</enum><header>Performance review and evaluation</header><text>To the maximum extent practicable, all surface transportation research and development projects shall include a component of performance measurement and evaluation. Performance measures shall be established during the proposal stage of a research and development project and shall, to the maximum extent possible, be outcome-based. All evaluations shall be made readily available to the public.</text></paragraph></subsection></section>
<section id="HA000F3A34CEB4A99BF35F203D00E494"><enum>103.</enum><header>Transportation research and development strategic planning</header>
<subsection id="H8E062EA0B7704D5B8BBE36979064BAA9"><enum>(a)</enum><header>Amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/508">Section 508</external-xref> of title 23, United States Code, is amended to read as follows:</text>

<section id="H4C23A1A5C278486F8231A8C9C21F72E5"><enum>508.</enum><header>Transportation research and development strategic planning</header>
<subsection id="H35D9831EDB544C19A990795922984C87"><enum>(a)</enum><header>In General</header>
<paragraph id="H252E03FC0C794059BA1F64DCF2777F7F"><enum>(1)</enum><header>Development</header><text>Not later than 1 year after the date of enactment of the <short-title>Surface Transportation Research and Development Act of 2005</short-title>, the Secretary shall develop a 5-year transportation research and development strategic plan to guide Federal transportation research and development activities. This plan shall be consistent with <external-xref legal-doc="usc" parsable-cite="usc/5/306">section 306</external-xref> of title 5, sections <external-xref legal-doc="usc" parsable-cite="usc/31/1115">1115</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/31/1116">1116</external-xref> of title 31, and any other research and development plan within the Department of Transportation.</text></paragraph>
<paragraph id="HCAB7E7344747466D9C0129DFEF2BADB1"><enum>(2)</enum><header>Contents</header><text>The strategic plan developed under paragraph (1) shall—</text>
<subparagraph id="HDB78A21D0C8D469990B6A610BDBA4454"><enum>(A)</enum><text>describe the primary purposes of the transportation research and development program, which shall include, at a minimum—</text>
<clause id="H525D627DC99B4E49A0452F47ACBE7B17"><enum>(i)</enum><text>reducing congestion and improving mobility;</text></clause>
<clause id="H3C246DFF90444BCDB55208B1DF6F7D32"><enum>(ii)</enum><text>promoting safety;</text></clause>
<clause id="H737B6A4BD8DB458A87FE8000EA35C004"><enum>(iii)</enum><text>promoting security;</text></clause>
<clause id="H20EC6A86340C4EBBAAC3E4067C5DE8DD"><enum>(iv)</enum><text>protecting and enhancing the environment;</text></clause>
<clause id="H9B51E8BD5C0642CF92DC61B8F7BD61E8"><enum>(v)</enum><text>preserving the existing transportation system; and</text></clause>
<clause id="H88F542BB4D3D45DBB5CF589647EF003F"><enum>(vi)</enum><text>improving the durability and extending the life of transportation infrastructure;</text></clause></subparagraph>
<subparagraph id="H08DB911B3A764E08813BF81DFFC2838B"><enum>(B)</enum><text>for each purpose, list the primary research and development topics that the Department intends to pursue to accomplish that purpose, which may include the fundamental research in the physical and natural sciences, applied research, technology development, and social science research intended for each topic; and</text></subparagraph>
<subparagraph id="H4EE22C0AE1CA4389B3B64C203BCC622D"><enum>(C)</enum><text>for each research and development topic, describe—</text>
<clause id="HEAB72EFDAD3B41F990DFF5F21B705905"><enum>(i)</enum><text>the anticipated annual funding levels for the period covered by the strategic plan; and</text></clause>
<clause id="H476B77897F3F47ABA5AD57BCE19D243F"><enum>(ii)</enum><text>the additional information the Department expects to gain at the end of the period covered by the strategic plan as a result of the research and development in that topic area.</text></clause></subparagraph></paragraph>
<paragraph id="H741F7961C91A49F6B5DC87CCE87FF86F"><enum>(3)</enum><header>Considerations</header><text>In developing the strategic plan, the Secretary shall ensure that the plan—</text>
<subparagraph id="H6D1E0835AF01495EB2F19C00A5F54F00"><enum>(A)</enum><text>reflects input from a wide range of stakeholders;</text></subparagraph>
<subparagraph id="H5AF49B09CF264475B3F47DB06E66E200"><enum>(B)</enum><text>includes and integrates the research and development programs of all the Department’s operating administrations, including aviation, transit, rail, and maritime; and</text></subparagraph>
<subparagraph id="H19E85CE2939749CDA3DF5CAD5E8C4FEE"><enum>(C)</enum><text>takes into account how research and development by other Federal, State, private sector, and not-for-profit institutions contributes to the achievement of the purposes identified under paragraph (2)(A), and avoids unnecessary duplication with these efforts.</text></subparagraph></paragraph>
<paragraph id="H86873DD36A474CEA9B7C4C9FDC06EC3B"><enum>(4)</enum><header>Performance plans and reports</header><text>In reports submitted under sections <external-xref legal-doc="usc" parsable-cite="usc/31/1115">1115</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/31/1116">1116</external-xref> of title 31, the Secretary shall include—</text>
<subparagraph id="H09C74A48A3134D00B07844455F12F9F9"><enum>(A)</enum><text>a summary of the Federal transportation research and development activities for the previous fiscal year in each topic area;</text></subparagraph>
<subparagraph id="H0D5F91E0BC3F4F7097FC09BF5C19F134"><enum>(B)</enum><text>the amount of funding spent in each topic area;</text></subparagraph>
<subparagraph id="H47AD95C549F94BEFB4AFC7CE37C13FF5"><enum>(C)</enum><text>a description of the extent to which the research and development is meeting the expectations set forth in paragraph (2)(C)(ii); and</text></subparagraph>
<subparagraph id="HAAED8108AB6E49C48F497332425260E9"><enum>(D)</enum><text>any amendments to the strategic plan.</text></subparagraph></paragraph></subsection>
<subsection id="HDE80ED02B28B4740BD001038A58DBB47"><enum>(b)</enum><header>Annual report</header><text>The Secretary shall submit to Congress an annual report, along with the President’s annual budget request, describing the amount spent in the last completed fiscal year on transportation research and development and the amount proposed in the current budget for transportation research and development.</text></subsection>
<subsection id="H80274320FE824BD4AF74D098009211C3"><enum>(c)</enum><header>National Research Council review</header><text>The Secretary shall enter into an agreement for the review by the National Research Council of the details of each—</text>
<paragraph id="H736F757FA9F043D0B9A3DAF5F39FA831"><enum>(1)</enum><text>strategic plan under section 508;</text></paragraph>
<paragraph id="H5FBA0BA05D0040EC84D07752A3464820"><enum>(2)</enum><text>performance plan required under <external-xref legal-doc="usc" parsable-cite="usc/31/1115">section 1115</external-xref> of title 31; and</text></paragraph>
<paragraph id="HBF0E4FF1D453451A80B43472B93CCF66"><enum>(3)</enum><text>program performance report required under <external-xref legal-doc="usc" parsable-cite="usc/31/1116">section 1116</external-xref> of title 31,</text></paragraph><continuation-text continuation-text-level="subsection">with respect to transportation research and development.</continuation-text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H32BFEFCE64884D9F92D1F05339CDF908"><enum>(b)</enum><header>Conforming amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/5">chapter 5</external-xref> of title 23, United States Code, is amended by striking the item related to section 508 and inserting the following:</text>

<subsection id="H66CDD71A85F54CA798BC41ABB9A23B4C"><enum>(a)</enum><header>Surface transportation research and development</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/502">Section 502</external-xref> of title 23, United States Code, is amended—</text>
<paragraph id="H0E8F3AEB1B7A4167B6B7DEEF3821EE63"><enum>(1)</enum><text>in subsection (a)—</text>
<subparagraph id="H17912E651F9F4B65A74829607CDFC7CA"><enum>(A)</enum><text>in paragraph (1), by striking <quote>may</quote> and inserting <quote>shall</quote>; and</text></subparagraph>
<subparagraph id="H1F3BA1AA8D3C4C03BA8391922FE6679D"><enum>(B)</enum><text>by striking subparagraphs (B) and (C) of paragraph (1) and inserting the following:</text>

<subparagraph id="H907FE47EF8CB4CA3898E3CD19CD21DF7"><enum>(B)</enum><text>all phases of transportation planning and development (including construction, transportation system management and operation, modernization, development, design, maintenance, safety, data collection, performance analysis, multimodal assessment, financing, demand forecasting, and traffic conditions);</text></subparagraph>
<subparagraph id="HC5B8B303EB404E24A31942639F35C702"><enum>(C)</enum><text>institutional arrangements and support; and</text></subparagraph>
<subparagraph id="HF6A1138E9B754B17B5FC1CF176B779CB"><enum>(D)</enum><text>the effect of State laws on the activities described in subparagraphs (A), (B), and (C).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H84F6C9A48C7F49EDB77CD1C569733918"><enum>(2)</enum><text>by amending subsection (c) to read as follows:</text>

<subsection id="H22E2BF2AD215431B8DF7E1CF3806B63B"><enum>(c)</enum><header>Contents of research and development program</header><text>The Secretary shall include in surface transportation research, development, and technology transfer programs carried out under this title coordinated activities in the following areas:</text>
<paragraph id="HAAB836E082B94B81A4825F8B9FFE15E9"><enum>(1)</enum><text>Research and development on materials and structures to improve the durability of surface transportation infrastructure and extend the life of pavements and bridges, including, as appropriate—</text>
<subparagraph id="H59AF9C6C6F424A5F8D6B99D0988CB8E8"><enum>(A)</enum><text>development of nondestructive evaluation equipment for use with existing infrastructure facilities and with next-generation infrastructure facilities that use advanced materials;</text></subparagraph>
<subparagraph id="H9E7531C342784354005BDEBA22AD8C65"><enum>(B)</enum><text>standardized estimates, developed in conjunction with the National Institute of Standards and Technology and other appropriate organizations, of useful life under various conditions for advanced materials of use in surface transportation;</text></subparagraph>
<subparagraph id="H2BD177DE967F4DD888C9CFA5C395E7A8"><enum>(C)</enum><text>research on the effects of climate conditions (such as freezing, thawing, and precipitation) on highway construction materials, and development of materials that can withstand climatic conditions; and</text></subparagraph>
<subparagraph id="H0C8C665DFFD243E6BA88A2E7AA00B369"><enum>(D)</enum><text>economic highway geometrics, structures, and desirable weight and size standards for vehicles using the public highways and the feasibility of uniformity in State regulations with respect to such standards.</text></subparagraph></paragraph>
<paragraph id="H1F2CA5CD10534F8F82FB2FDBCB2FAA83"><enum>(2)</enum><text>Research and development on the operation and management of the surface transportation system to improve efficiency, productivity, and safety, including, as appropriate—</text>
<subparagraph id="H31DCD325CAD24882B2002FAC512296B6"><enum>(A)</enum><text>technologies and practices that reduce costs and minimize disruptions associated with the construction, rehabilitation, and maintenance of surface transportation systems, including responses to natural disasters;</text></subparagraph>
<subparagraph id="HC83EF7928ED940DB9674836F6B3DD6CE"><enum>(B)</enum><text>research and system analysis to facilitate and integrate bicycle and pedestrian travel in the transportation system, including within National Parks and in areas adjacent to National Park land;</text></subparagraph>
<subparagraph id="H22A88B9374D44E938FEC1D5C2FAE8323"><enum>(C)</enum><text>development of dynamic simulation models of surface transportation systems for—</text>
<clause id="H7A0E13E0F5A74C1F9BA0953826B0C25D"><enum>(i)</enum><text>predicting capacity, safety, and infrastructure durability problems;</text></clause>
<clause id="H577A37D2DFF2490789BC20F905239972"><enum>(ii)</enum><text>evaluating the extent to which projects are likely to achieve their stated objectives; and</text></clause>
<clause id="HA2246F45D6D44FD28DEAB7ADF34865B2"><enum>(iii)</enum><text>testing the strengths and weaknesses of proposed revisions to surface transportation operations and management programs;</text></clause></subparagraph>
<subparagraph id="H1A83D3A349F0485AA6D7AB29C0D9704C"><enum>(D)</enum><text>improvement of life cycle cost analysis, including—</text>
<clause id="H28190265E113496085C2A356071CECE1"><enum>(i)</enum><text>establishing the appropriate analysis period and discount rates;</text></clause>
<clause id="H2DE329C1B66945A0841B5BE2B395E5D4"><enum>(ii)</enum><text>learning how to value and properly consider use costs;</text></clause>
<clause id="HE249EBAC69D4469FBB33A5877E8C6438"><enum>(iii)</enum><text>determining tradeoffs between reconstruction and rehabilitation; and</text></clause>

<subparagraph id="HC01B2CB80DB049B4826E71A093509368"><enum>(E)</enum><text>research on the effects of climatic conditions (such as freezing, thawing, and precipitation) on the costs of highway construction materials and maintenance;</text></subparagraph>
<subparagraph id="HF1DE49CCA1DC41BCBC203CA6ABC8E8AE"><enum>(F)</enum><text>research, development, and technology transfer related to asset management; and</text></subparagraph>
<subparagraph id="HC03B15AF7D134400BEDD4B9C4285849"><enum>(G)</enum><text>evaluation of traffic calming measures that promote community preservation, transportation mode choice, and safety.</text></subparagraph></paragraph>
<paragraph id="H95D877895B1C47A189F2B4CDFD3FE9AB"><enum>(3)</enum><text>Research, development, and technology transfer to improve safety.</text></paragraph>
<paragraph id="HF86A657C6845451DAE0040BDF51E267B"><enum>(4)</enum><text>Research and development to support the evaluation of how the surface transportation system and individual surface transportation projects meet the goals of the surface transportation system stated in section 102(a) of the <short-title>Surface Transportation Research and Development Act of 2005</short-title>, including, as appropriate—</text>
<subparagraph id="HBC2A9C3176C541D69DB0DCA8707975D1"><enum>(A)</enum><text>development, use, and dissemination of indicators, including appropriate computer programs for collecting and analyzing data on the status of infrastructure facilities, to measure the performance of the surface transportation systems of the United States, including productivity, efficiency, energy use, air quality, congestion, safety, maintenance, and other factors that reflect system performance; and</text></subparagraph>
<subparagraph id="HDD8C0BC03D264940AB770580B7FE7CA"><enum>(B)</enum><text>research on, and dissemination of recommendations and best practices aimed at addressing, nontechnical barriers to technology deployment (such as fragmented local authority, rigid procurement rules, and privacy and liability considerations).</text></subparagraph></paragraph>
<paragraph id="HB2EBE8F966F4418DA2837528ABB8E84D"><enum>(5)</enum><text>To assess how the surface transportation system affects and is affected by social systems, including, as appropriate—</text>
<subparagraph id="H6758EF34259B4CACB8B78BE2797B1A6"><enum>(A)</enum><text>research aimed at understanding how emerging trends (including demographic, economic, and social trends) will affect surface transportation usage and needs;</text></subparagraph>
<subparagraph id="H9466B5922C8747B4844522F5FC5E5891"><enum>(B)</enum><text>research on how land use affects and is affected by surface transportation investments; and</text></subparagraph>
<subparagraph id="H87E6308B043D473CA0F3354758B37F50"><enum>(C)</enum><text>telecommuting and the linkages between transportation, information technology, and community development, and the impact of technological change and economic restructuring on travel demand.</text></subparagraph></paragraph>
<paragraph id="H1387536D62ED4554896C8700B549C1BB"><enum>(6)</enum><text>Environmental research and development, including research described in the Transportation Research Board Special Report 268, entitled <quote>Surface Transportation Environmental Research: A Long-Term Strategy</quote> published in 2002.</text></paragraph>
<paragraph id="HB9358A4024334F7EA5D8E9709E26F04B"><enum>(7)</enum><text>Exploratory advanced research in any of the preceding areas.</text></paragraph>
<paragraph id="H444F4ED303574FA4A8009EF4C5664C7E"><enum>(8)</enum><text>Any other surface transportation research and development topics that the Secretary determines, in accordance with the strategic planning process under section 508, to be critical.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>

<paragraph id="HB3960B9DE1DC4E21A663052F2CFC87B9"><enum>(2)</enum><header>Purpose</header><text>The purpose of the research program under this subsection shall be to achieve breakthroughs in transportation research. Exploratory advanced research should have a broader objective, longer time frame, multidisciplinary nature, and have both a higher risk and a higher potential payoff than for problem-solving research.</text></paragraph>
<paragraph id="HF39AFCC7BCA54EEB9950D4F070301D00"><enum>(3)</enum><header>Workshop</header><text>The Secretary shall convene a workshop with appropriate researchers and policymakers from Federal and State agencies, as well as academic researchers. The purpose of the workshop shall be to determine priority areas of exploratory advanced research and to identify the best way to accomplish this research (such as through federally funded research and development centers or academic researchers). The workshop shall include a diverse group of stakeholders. The Secretary shall make the results of the workshop widely available to the public. The workshop shall be held within 6 months after the date of the enactment of this paragraph.</text></paragraph>
<paragraph id="HC8BD016F604944919BCA5000D81FACC7"><enum>(4)</enum><header>Grant program</header><text>The Secretary may administer a competitive, peer-reviewed grant program to support exploratory advanced research.</text></paragraph>
<paragraph id="HCEC42B9A2D40492A90E2FC3F97C1301B"><enum>(5)</enum><header>Report</header><text>The President’s annual budget request to the Congress shall indicate the amount of funding used in the previous fiscal year, and proposed for the next fiscal year, to support exploratory advanced research under this subsection, including the amount used to support extramural research grants in exploratory advanced research under this subsection.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="HB2B7CF901D084C6CAA2B7219B6D4D112"><enum>(4)</enum><text>in subsection (e)(1), by striking <quote>(105 Stat.</quote> and all that follows through <quote>performance program</quote> and inserting <quote>and the Transportation Equity Act for the 21st Century</quote>;</text></paragraph>
<paragraph id="H2CE34F68A124419F9CD61DF247B55CEB"><enum>(5)</enum><text>by redesignating subsections (f) and (g) as subsections (g) and (h), respectively, and by inserting after subsection (e) the following new subsection:</text>

<paragraph id="HACE64F8A99044746B154F1172D79E800"><enum>(2)</enum><header>Grants, cooperative agreements, and contracts</header><text>Under the program, the Secretary shall make grants and enter into cooperative agreements and contracts to—</text>
<subparagraph id="H3B378BF74D9B4D7B98056600CF88C115"><enum>(A)</enum><text>monitor, material-test, and evaluate test bridges;</text></subparagraph>
<subparagraph id="H5BD0C4D2FF474473A04F98CFA8C4CB4D"><enum>(B)</enum><text>analyze the data obtained in carrying out subparagraph (A); and</text></subparagraph>
<subparagraph id="HD5E56348DA0D474D98F0459E6CF1D93F"><enum>(C)</enum><text>prepare products to fulfill program objectives and meet future bridge technology needs.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>
<paragraph id="H8C01CDB51F2F42C5BAF9B00ADDFFDEA"><enum>(6)</enum><text>in subsection (h)(2), as so redesignated by paragraph (5) of this subsection, by striking <quote>biannual reports</quote> and all that follows through <quote>21st Century</quote> and inserting <quote>previous reports under this subsection</quote>; and</text> </paragraph>

<subparagraph id="H20324758B1E848D6A90707C6938629A"><enum>(A)</enum><text>conduct of highway research and development related to new highway technology;</text></subparagraph>
<subparagraph id="H8DA6066D45164B64AEEC5F9150E02548"><enum>(B)</enum><text>development of understandings, tools, and techniques that provide solutions to complex technical problems through the development of economical and environmentally sensitive designs, efficient and quality controlled construction practices, and durable materials; and</text></subparagraph>

<paragraph id="H00C01865BD7B43F4813C4B00C4EB6F7F"><enum>(1)</enum><header>Establishment</header><text>The organization described in subsection (b)(1) shall establish an advisory board.</text></paragraph>
<paragraph id="HAEFD746DCDA348C68895E5B38F83D384"><enum>(2)</enum><header>Membership</header><text>The advisory board shall be balanced, and shall include—</text>
<subparagraph id="H33B9415A92AF457B938B14FDD05BC47F"><enum>(A)</enum><text>representatives from pubic interest groups representing the environment;</text></subparagraph>
<subparagraph id="H80EAB094599B427D83A560BBDFF6224D"><enum>(B)</enum><text>representatives of State, regional, and local transportation agencies, including metropolitan planning organizations and transit agencies;</text></subparagraph>
<subparagraph id="H79A1D9D46A51470B9D6DD2878FA15717"><enum>(C)</enum><text>representatives of State environmental agencies;</text></subparagraph>
<subparagraph id="H2CBD87369E0F441198ABB1A131C652BC"><enum>(D)</enum><text>transportation and environmental scientists and engineers; and</text></subparagraph>
<subparagraph id="HB9E2C893DE214FC3BADB51315F86AE5"><enum>(E)</enum><text>representatives of Federal agencies, including the Department of Transportation, the Environmental Protection Agency, and the National Science Foundation.</text></subparagraph></paragraph>
<paragraph id="H16069AEDEA3A49E69B9753906CD9FCBC"><enum>(3)</enum><header>Responsibilities</header><text>The advisory board shall—</text>
<subparagraph id="H545173ADD4134B56B2D51E00B643D5E"><enum>(A)</enum><text>develop an annual research and development agenda to carry out research and development activities described in subsection (a)(2);</text></subparagraph>
<subparagraph id="HBE6E2B0A35914305BF6DFB3DD9E960B6"><enum>(B)</enum><text>solicit research proposals to carry out the research and development agenda, and oversee peer review of proposals;</text></subparagraph>
<subparagraph id="H5BE9D3A83774411F8970CE60C6F2D128"><enum>(C)</enum><text>develop project selection criteria through an open and public consultation process with stakeholders; and</text></subparagraph>
<subparagraph id="HEA2F5F2EC41941A381C3A78135BDBB6C"><enum>(D)</enum><text>select projects for funding.</text></subparagraph></paragraph>
<paragraph id="H5551FF01C1094AC6869E742C125130E"><enum>(4)</enum><header>Criteria</header><text>In developing criteria, the advisory board shall give priority to proposals that—</text>
<subparagraph id="H95D00D7F2EFD4DF9AAD39A8A7E176C9"><enum>(A)</enum><text>are designed to develop fundamental knowledge;</text></subparagraph>
<subparagraph id="H692D6BF76C8D48A29B33EE005E953820"><enum>(B)</enum><text>are interdisciplinary and involve partnerships; and</text></subparagraph>
<subparagraph id="H53FFA3627D4843D595C1C91FBAF0078"><enum>(C)</enum><text>include significant matching funds.</text></subparagraph></paragraph></subsection>
<subsection id="HB6D16FA23AC54A989FD3CE8CDCE52823"><enum>(d)</enum><header>Project funding</header><text>In addition to using funds authorized for this section, the organization described in subsection (b)(1) is encouraged to seek and accept additional funding sources from public and private entities.</text></subsection>
<subsection id="H111ABF62185A4BBAB909E239CAE84411"><enum>(e)</enum><header>Annual report</header><text>The organization described in subsection (b)(1) shall prepare and transmit to the Secretary and the Congress an annual report that includes a project summary for every project funded under this section. Each summary shall describe the project, summarize its status and funding levels, and identify sources of funding.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

<paragraph id="H48F80F6CCAAE42E785EF000CAC61D7D"><enum>(2)</enum><header>Contents</header><text>The program to be carried out under this subsection shall include research and development on—</text>
<subparagraph id="H2F2A515ACB4942F49C904BE51972B1FB"><enum>(A)</enum><text>how, and the extent to which, the overall transportation system is meeting the goals set forth in the Transportation Equity Act for the 21st Century, and how to improve evaluation methodologies and performance measures;</text></subparagraph>
<subparagraph id="H81803C9902014EF68D3641E7ACA4E36"><enum>(B)</enum><text>the development of policy analysis tools and methods for use by decisionmakers;</text></subparagraph>
<subparagraph id="H57944637B47442ADB18CC4FE00967406"><enum>(C)</enum><text>the critical factors and major trends affecting the success and performance of the Nation’s transportation system, as well as how such information can be incorporated into national, State, and local decisionmaking;</text></subparagraph>
<subparagraph id="HFC656D06E8F84CDE85113ED6469395D3"><enum>(D)</enum><text>economic, demographic, and social trends that are affecting and are affected by the transportation system, including such topics as—</text>
<clause id="H626BABAE73C940F593D4608FFA4C2C"><enum>(i)</enum><text>economic trends, including international trade and its effects on the transportation of people and goods, rapidly changing information technology, the changing nature of metropolitan economies, diversification of employment sites, and innovations in goods movement;</text></clause>
<clause id="H71516F73F52B4FAF95BAEC2BD3E012C0"><enum>(ii)</enum><text>demographic trends, changing residential patterns, and the aging of the population; and</text></clause>
<clause id="H9F26597703AB471D007BC50070A050B"><enum>(iii)</enum><text>social trends, including income disparity, access of underserved populations to jobs, services and health care, including the needs of low-income, minority, and transit-dependent populations in urban and rural areas, the needs of rural populations, and the effects of new technologies on driver behavior;</text></clause></subparagraph>
<subparagraph id="HEC7EDA6ABFA9455BA97F32CCF3AA27FC"><enum>(E)</enum><text>how institutional factors affect the development and successful deployment of new technologies; and</text></subparagraph>
<subparagraph id="HDCD1CEB9ECAC4B4B809EA5CC45E23E74"><enum>(F)</enum><text>other critical issues identified by the Advisory Board established under paragraph (4).</text></subparagraph></paragraph>
<paragraph id="HDF17277B87FC422BBC7BB100AE57BFF5"><enum>(3)</enum><header>Establishment</header><text>The Secretary shall enter into an arrangement with the National Research Council to establish the advisory board under paragraph (4) and to administer the program.</text></paragraph>
<paragraph id="H7D173ED5B026476E95303C91A5EB4128"><enum>(4)</enum><header>Advisory Board</header>
<subparagraph id="HCCF6D2693B144E16B56C5F64A497631B"><enum>(A)</enum><header>Membership</header><text>A majority of members of the advisory board shall be experts in a broad array of social science fields. Additional members of the advisory board shall be balanced among representatives of Federal, State, and local transportation agencies, other agencies with appropriate expertise, metropolitan planning organizations, transit operating agencies, and environmental and other nonprofit organizations, including representatives of community-based orgainzations.</text></subparagraph>
<subparagraph id="H934753A43E3C4BB7B9EFEAE23B540894"><enum>(B)</enum><header>Responsibilities</header><text>The advisory board shall—</text>
<clause id="H373F136501AA49F69968FDEE6FF82CBE"><enum>(i)</enum><text>develop a detailed research and development agenda, which shall serve as the basis of the annual project solicitation;</text></clause>
<clause id="H842CC5542F8641399CC31F506024A033"><enum>(ii)</enum><text>annually solicit project proposals, through open competition and peer review of research and development proposals; and</text></clause>
<clause id="HB22E061A665D4535A555825400198E16"><enum>(iii)</enum><text>develop project selection criteria, through an open and public consultation process with stakeholders.</text></clause></subparagraph></paragraph>
<paragraph id="H130D25C5BE844AB980564926992609DB"><enum>(5)</enum><header>Dissemination of research and development findings</header><text>The National Research Council and the Department of Transportation shall disseminate research and development findings under this subsection to researchers, practitioners, and decisionmakers.</text></paragraph></subsection>
<subsection id="H83186A917F984BFDA15695BE41C6C3B3"><enum>(e)</enum><header>Road weather research and development program</header>
<paragraph id="HF0B2D3C7D9B54B37B5B043C6BE5D2EF5"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall establish a road weather research and development program to—</text>
<subparagraph id="HFA6FD7B976EC43FC8C42D993231177A6"><enum>(A)</enum><text>maximize use of available road weather information and technologies;</text></subparagraph>
<subparagraph id="HABC842CD2AF140A4B1B366EF02F1C6E6"><enum>(B)</enum><text>expand road weather research and development efforts to enhance roadway safety, capacity, and efficiency while minimizing environmental impacts; and</text></subparagraph>
<subparagraph id="H0F785FAD9EFD4A46A623FC4781F6ECB1"><enum>(C)</enum><text>promote technology transfer of effective road weather scientific and technological advances.</text></subparagraph></paragraph>
<paragraph id="HC4FFC87D24B3459CA39D55601353457C"><enum>(2)</enum><header>Stakeholder input</header><text>In carrying out this subsection, the Secretary shall consult with the National Oceanic and Atmospheric Administration, the National Science Foundation, the American Association of State Highway and Transportation Officials, nonprofit organizations, and the private sector.</text></paragraph>
<paragraph id="H10453B5EBF5A43DBA8005BA45F29E0B9"><enum>(3)</enum><header>Contents</header><text>The program established under this subsection shall solely carry out research and development called for in the National Research Council’s report entitled <quote>A Research Agenda for Improving Road Weather Services</quote>. Such research and development includes—</text>
<subparagraph id="HA7D69D5BE07D48DF85E90000BAEAC833"><enum>(A)</enum><text>integrating existing observational networks and data management systems for road weather applications;</text></subparagraph>
<subparagraph id="H4C72639BBC0F4D2CB173C80E090E3E"><enum>(B)</enum><text>improving weather modeling capabilities and forecast tools, such as the road surface and atmospheric interface;</text></subparagraph>
<subparagraph id="H4E0A5F88C9D742E7A0A500E328B48DA8"><enum>(C)</enum><text>enhancing mechanisms for communicating road weather information to users, such as transportation officials and the public; and</text></subparagraph>
<subparagraph id="H91639EED6BF740A182ECFF1A628C0E5"><enum>(D)</enum><text>integrating road weather technologies into an information infrastructure.</text></subparagraph></paragraph>
<paragraph id="HCFBBA02F656941B08999563CA5975811"><enum>(4)</enum><header>Activities</header><text>In carrying out this subsection, the Secretary shall—</text>
<subparagraph id="HBA71015FFE8441BDADE351BE63770030"><enum>(A)</enum><text>enable efficient technology transfer;</text></subparagraph>
<subparagraph id="HC18288AFFCB04874A9909893DF93F939"><enum>(B)</enum><text>improve education and training of road weather information users, such as State and local transportation officials and private sector transportation contractors; and</text></subparagraph>
<subparagraph id="H8471B86879D14D77AEE50179FBF1FDA"><enum>(C)</enum><text>coordinate with transportation weather research programs in other modes, such as aviation.</text></subparagraph></paragraph>
<paragraph id="HCE0E75B29A254B9A887745C37D005215"><enum>(5)</enum><header>Funding</header><text>In awarding funds under this subsection, the Secretary shall give preference to applications with significant matching funds from non-Federal sources. From the amounts authorized to be appropriated under section 101(b)(1), there shall be available $5,000,000 for carrying out this subsection for each of fiscal years 2005 through 2010.</text></paragraph></subsection></section>

<subparagraph id="H7F9D11B090E34B83A58B5FB57410D546"><enum>(B)</enum><header>Applications</header><text>To receive a grant under this subsection, an entity described in subparagraph (A) shall submit an application to the Secretary. The application shall be in such form and contain such information as the Secretary may require. The Secretary shall select and approve the applications based on open competition and peer review, and on whether the project that is the subject of the grant serves the purpose of the program described in paragraph (2).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>

<subparagraph id="H94440D27EB96425D8E3B7C419CA3AB00"><enum>(D)</enum><text>the reduction of maintenance costs and life-cycle costs of bridges, including the costs of new construction, replacement, or rehabilitation of deficient bridges;</text></subparagraph>
<subparagraph id="H1328D59691604E6ABF0738934B3C8581"><enum>(E)</enum><text>the development of highway bridges and structures that will withstand natural disasters and terrorist attacks;</text></subparagraph>
<subparagraph id="H5AEE08DC2CD04DCB8F00027F90B38300"><enum>(F)</enum><text>the documentation and wide dissemination of objective evaluations of the performance and benefits of these innovative designs, materials, and construction methods; and</text></subparagraph>

<paragraph id="HEFCEA781B1FC4A83B76540FF8915FB7B"><enum>(2)</enum><header>Goals</header><text>The goals of the innovative pavement research and deployment program shall include—</text>
<subparagraph id="H4D14927ADD4C48278B9D0484DFB2FD3C"><enum>(A)</enum><text>the deployment of new, cost-effective innovative designs, materials, and practices to extend pavement life and performance and to improve customer satisfaction;</text></subparagraph>
<subparagraph id="HAEA5178D8055434DB8D4C8F798C37C88"><enum>(B)</enum><text>the reduction of initial costs and life-cycle costs of pavements, including the costs of new construction, replacement, maintenance, and rehabilitation;</text></subparagraph>
<subparagraph id="H42886AA2B04043279583E3BFD6952D7D"><enum>(C)</enum><text>the deployment of accelerated construction techniques, including innovative pavement materials, to increase safety and reduce construction time and traffic disruption and congestion;</text></subparagraph>
<subparagraph id="H27EBE9E2CC604985951EBF6ECD02BD5E"><enum>(D)</enum><text>the deployment of engineering design criteria and specifications for innovative practices, products, and materials for use in highway pavements;</text></subparagraph>
<subparagraph id="HBCF3318EC58343FC9293A485CEBC6EA6"><enum>(E)</enum><text>the deployment of new nondestructive and real time pavement evaluation technologies and techniques;</text></subparagraph>
<subparagraph id="HB62F9BBAD2764D71B66F8E2FFE3CF457"><enum>(F)</enum><text>evaluation, refinement, and documentation of the performance and benefits of innovative technologies deployed to improve life, performance, cost effectiveness, safety, and customer satisfaction;</text></subparagraph>
<subparagraph id="H9FFF7FF5A52A4846AF32AAB8ED3B1141"><enum>(G)</enum><text>effective technology transfer and information dissemination to accelerate implementation of innovative technologies and to improve life, performance, cost effectiveness, safety, and customer satisfaction; and</text></subparagraph>
<subparagraph id="HC6E213D1233D46D2BFFA182C513F3337"><enum>(H)</enum><text>the development of designs and materials to reduce storm water runoff.</text></subparagraph></paragraph>
<paragraph id="HEB883AEFD96846CA0049BCA6A998B900"><enum>(3)</enum><header>Grants, cooperative agreements, and contracts</header>

<subparagraph id="HB860A44C5DA64DA2A34942CD3E3000BE"><enum>(B)</enum><text>the deployment of best practices in training, management, design, and planning.</text></subparagraph></paragraph>

<subsection id="H664A9CD11C594001905B0060E66900AC"><enum>(a)</enum><header>National highway Institute</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/504">Section 504(a)</external-xref> of title 23, United States Code, is amended by striking paragraph (3) and inserting the following:</text>

<subparagraph id="H4ECDF7731FA04037A661D67888BA004F"><enum>(B)</enum><header>Additional courses</header><text>In addition to the courses in the subject matter areas described in subparagraph (A), the Institute, in consultation with State transportation departments and the American Association of State Highway and Transportation Officials, may develop other courses as it considers necessary.</text></subparagraph>
<subparagraph id="HDD9ADB84F5C0414DA34591A46A4E885"><enum>(C)</enum><header>Revision of courses offered</header><text>The Institute shall periodically—</text>
<clause id="H44C43CF07F9540119BB42CA9095CF0F3"><enum>(i)</enum><text>review the course inventory of the Institute; and</text></clause>
<clause id="HABAADC24DA0145B6AF00C1D187A7EA18"><enum>(ii)</enum><text>revise or cease to offer courses based on course content, applicability, and need.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HD2DC65B0A14644F3B599403FE0309B85"><enum>(b)</enum><header>Local technical assistance program</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/504">Section 504(b)</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text>

<subparagraph id="H9EB271DB82B64F4083CD561BDC1765BA"><enum>(B)</enum><header>Tribal technical assistance centers</header><text>The Federal share of the cost of activities carried out by the tribal technical assistance centers under paragraph (2)(D)(ii) of this subsection shall be 100 percent.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HA70ED07B9E0047FE8671B06B6441CF53"><enum>(c)</enum><header>Surface transportation workforce development, training, and education</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/504">Section 504</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text>

<subparagraph id="HA8D1AC66755F4A85BF87D7007300E5CD"><enum>(B)</enum><text>employee professional development;</text></subparagraph>
<subparagraph id="H99BDFE66218D44EAB46B46D46CD7633E"><enum>(C)</enum><text>student internships; or</text></subparagraph>
<subparagraph id="H37978A5152F747C28100983075E4814E"><enum>(D)</enum><text>education outreach activities to develop interest and promote participation in surface transportation careers.</text></subparagraph></paragraph>
<paragraph id="H8A2A85B0D7D84CB78957E858B1D9B73E"><enum>(2)</enum><header>Federal share</header><text>The Federal share of the cost of activities carried out in accordance with this subsection shall be 100 percent.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H6C028DACA26E4B0D85A19F3FDEAF1EC8"><enum>(1)</enum><header>In General</header><text>The Secretary shall establish the Garrett A. Morgan Technology and Transportation Education Program to improve the preparation of students, particularly women and minorities, in science, technology, engineering, and mathematics through curriculum development and other activities related to transportation.</text></paragraph>
<paragraph id="H3DADA7A8AC744C31A5169B9D0039DBBD"><enum>(2)</enum><header>Authorized activities</header><text>The Secretary shall award grants under this subsection on the basis of competitive, peer review. Grants awarded under this subsection may be used for enhancing science, technology, engineering, and mathematics at the elementary and secondary school level through such means as—</text>
<subparagraph id="H7D27C477E80C41889E5CE8C4B2D951B"><enum>(A)</enum><text>internships that offer students experience in the transportation field;</text></subparagraph>
<subparagraph id="HDF77E8F5DFC44A81AF46EDA521201DE0"><enum>(B)</enum><text>programs that allow students to spend time observing scientists and engineers in the transportation field; and</text></subparagraph>
<subparagraph id="H015B26EAF3AC411BBE7442BA63F72CF3"><enum>(C)</enum><text>developing relevant curriculum that uses examples and problems related to transportation.</text></subparagraph></paragraph>
<paragraph id="HCDC79E96E2CF41778915A2BAC80086A7"><enum>(3)</enum><header>Application and review procedures</header>
<subparagraph id="H0002E7B686BC4F959D362CC329A4C700"><enum>(A)</enum><header>In General</header><text>An entity described in subparagraph (C) seeking funding under this subsection shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require. Such application, at a minimum, shall include a description of how the funds will be used and a description of how the funds will be used to serve the purposes described in paragraph (2).</text></subparagraph>
<subparagraph id="H61D25F58AFB54EE4AEFB001236431FB"><enum>(B)</enum><header>Priority</header><text>In making awards under this subsection, the Secretary shall give priority to applicants that will encourage the participation of women and minorities.</text></subparagraph>
<subparagraph id="HF43240AA28E44024B7E5B6413B29409B"><enum>(C)</enum><header>Eligibility</header><text>Local education agencies and State education agencies, which may partner with institutions of higher education, businesses, or other entities, shall be eligible to apply for grants under this subsection.</text></subparagraph></paragraph>
<paragraph id="H968B2D4319E740C6B7C1B3926EA7A62C"><enum>(4)</enum><header>Definitions</header><text>For purposes of this subsection—</text>
<subparagraph id="H8B1E1CBF8C954B03A5643136E0275F00"><enum>(A)</enum><text>the term <term>institution of higher education</term> has the meaning given that term in section 101 of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>);</text></subparagraph>
<subparagraph id="H164E40133F5042EA937FD087A993F65"><enum>(B)</enum><text>the term <term>local educational agency</term> has the meaning given that term in section 9101 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>); and</text></subparagraph>
<subparagraph id="HF0F46265B5284A30A9555E47A269B147"><enum>(C)</enum><text>the term <term>State educational agency</term> has the meaning given that term in section 9101 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></subparagraph></paragraph>
<paragraph id="HF49691385A4240A99DA29800292BBF82"><enum>(5)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary of Transportation to carry out this subsection $500,000 for fiscal year 2006 and such sums as may be necessary thereafter.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="H61A1937163024AE9A4315F5BE14177F3"><enum>107.</enum><header>Bureau of Transportation Statistics</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/111">Section 111</external-xref> of title 49, United States Code, is amended to read as follows:</text>

<section id="H731869D3DF8F44248111E51EC49327AD"><enum>111.</enum><header>Bureau of Transportation Statistics</header>
<subsection id="H92876322094C4450BF577D3106D6DE6F"><enum>(a)</enum><header>Establishment</header><text>There is established in the Department of Transportation a Bureau of Transportation Statistics.</text></subsection>
<subsection id="H4CD25BAE5F9A4C6A8700EF5047E4D96"><enum>(b)</enum><header>Director</header>
<paragraph id="HF86DFE2AEF204B63B5C232E5AB52CD09"><enum>(1)</enum><header>Appointment</header><text>The Bureau shall be headed by a Director who shall be appointed by the President, by and with the advice and consent of the Senate.</text></paragraph>
<paragraph id="H62AB95DF61984CFF8F5D7B885658F9D8"><enum>(2)</enum><header>Qualifications</header><text>The Director shall be appointed from among individuals who are qualified to serve as the Director by virtue of their training and experience in the collection, analysis, and use of transportation statistics.</text></paragraph>
<paragraph id="H0EC3D21895BD4B139ECF008281FB5EF9"><enum>(3)</enum><header>Reporting</header><text>The Director shall report directly to the Secretary.</text></paragraph>
<paragraph id="H8445BB76D08C4881AC78A784501BF28B"><enum>(4)</enum><header>Term</header><text>The term of the Director shall be 5 years. The Director may continue to serve after the expiration of the term until a successor is appointed and confirmed.</text></paragraph></subsection>
<subsection id="H5F04500354784BF08F5CA6B0C1CA45DE"><enum>(c)</enum><header>Responsibilities</header><text>The Director of the Bureau shall serve as the Secretary’s senior advisor on data and statistics, and shall be responsible for carrying out the following duties:</text>
<paragraph id="H78A3DDBB481D49D8870500B0B58DD4E2"><enum>(1)</enum><header>Providing data, statistics, and analysis to transportation decisionmakers</header><text>Ensuring that the statistics compiled under paragraph (5) are designed to support transportation decisionmaking by the Federal Government, State and local governments, metropolitan planning organizations, transportation-related associations, the private sector (including the freight community), and the public.</text></paragraph>
<paragraph id="H4BF42E311D544355AA8CA072DA9B42F0"><enum>(2)</enum><header>Coordinating collection of information</header><text>Working with the operating administrations of the Department to establish and implement the Bureau’s data programs and to improve the coordination of information collection efforts with other Federal agencies.</text></paragraph>
<paragraph id="H17D7F3DBF2F34214993F295C19F4A2C2"><enum>(3)</enum><header>Data modernization</header><text>Continually improving surveys and data collection methods to improve the accuracy and utility of transportation statistics.</text></paragraph>
<paragraph id="H3FD3BA478E544166971EFB37A202EE02"><enum>(4)</enum><header>Encouraging data standardization</header><text>Encouraging the standardization of data, data collection methods, and data management and storage technologies for data collected by the Bureau, the operating administrations of the Department of Transportation, States, local governments, metropolitan planning organizations, and private sector entities.</text></paragraph>
<paragraph id="H24E4DE4B81574781A82BF300B7C4D788"><enum>(5)</enum><header>Compiling transportation statistics</header><text>Compiling, analyzing, and publishing a comprehensive set of transportation statistics on the performance and impacts of the national transportation system, including statistics on—</text>
<subparagraph id="HE5FC7BC55F8F4F44B66F73ECC0FAFFB3"><enum>(A)</enum><text>productivity in various parts of the transportation sector;</text></subparagraph>
<subparagraph id="HA2EBF90DD2EB41DCB42D94713FF60029"><enum>(B)</enum><text>traffic flows for all modes of transportation;</text></subparagraph>
<subparagraph id="H9B1E91F204A04C529116974C8C98F2EE"><enum>(C)</enum><text>other elements of the Intermodal Transportation Database established under subsection (g);</text></subparagraph>
<subparagraph id="H4293B685402448FE92294797E1584E48"><enum>(D)</enum><text>travel times and measures of congestion;</text></subparagraph>
<subparagraph id="HAF2A998D2B6C4F91A5EDCC0E70068E2"><enum>(E)</enum><text>vehicle weights and other vehicle characteristics;</text></subparagraph>
<subparagraph id="HBBC8895BB09946198198B6FB3348DEBB"><enum>(F)</enum><text>demographic, economic, and other variables influencing traveling behavior, including choice of transportation mode, and goods movement;</text></subparagraph>
<subparagraph id="HDFEFF6A78687455A8B6B866F41453BCF"><enum>(G)</enum><text>transportation costs for passenger travel and goods movement;</text></subparagraph>
<subparagraph id="H7620BFBF2D0B451F888E8D1876915E91"><enum>(H)</enum><text>availability and use of mass transit (including the number of passengers served by each mass transit authority) and other forms of for-hire passenger travel;</text></subparagraph>
<subparagraph id="HE46E5D5C00E24FA2A062DA4E775E6E33"><enum>(I)</enum><text>frequency of vehicle and transportation facility repairs and other interruptions of transportation service;</text></subparagraph>
<subparagraph id="H656556D7EC974F7488D277B4CBE6BE54"><enum>(J)</enum><text>safety and security for travelers, vehicles, and transportation systems;</text></subparagraph>
<subparagraph id="H0BC5C1A3DD8F407C8D5877C29815221B"><enum>(K)</enum><text>consequences of transportation for the human and natural environment;</text></subparagraph>
<subparagraph id="H59FC0B5164DA49AE90DEA599003D00E6"><enum>(L)</enum><text>the extent, connectivity, and condition of the transportation system, building on the National Transportation Atlas Database developed under subsection (g); and</text></subparagraph>
<subparagraph id="HBBF90E5742854F87BE1CA6A0244B78B6"><enum>(M)</enum><text>transportation-related variables that influence the domestic economy and global competitiveness.</text></subparagraph></paragraph>
<paragraph id="H988B9D276E67492C88C6456707064551"><enum>(6)</enum><header>National Spatial Data Infrastructure</header><text>Building and disseminating the transportation layer of the National Spatial Data Infrastructure, including coordinating the development of transportation geospatial data standards, compiling intermodal geospatial data, and collecting geospatial data that is not being collected by others.</text></paragraph>
<paragraph id="HA74C2D773E5144F88746B6A545B9CC1"><enum>(7)</enum><header>Issuing guidelines</header><text>Issuing guidelines for the collection of information by the Department of Transportation required for statistics to be compiled under paragraph (5) in order to ensure that such information is accurate, reliable, relevant, and in a form that permits systematic analysis. The Bureau shall review and report to the Secretary of Transportation on the sources and reliability of the statistics proposed by the heads of the operating administrations of the Department to measure outputs and outcomes as required by the <act-name parsable-cite="FPRA93">Government Performance and Results Act of 1993</act-name>, and the amendments made by such Act, and shall carry out such other reviews of the sources and reliability of other data collected or statistical information published by the heads of the operating administrations of the Department as shall be requested by the Secretary.</text></paragraph>
<paragraph id="HB2C0B8AB394E470700C937B19BDD9CDD"><enum>(8)</enum><header>Making statistics accessible</header><text>Making the statistics published under this subsection readily accessible.</text></paragraph></subsection>
<subsection id="HCFDF4D4B1C024F51B567A60097DB2DC"><enum>(d)</enum><header>Information Needs Assessment</header>
<paragraph id="HFA5CDEF0DFC2485A9B8CE05CA192563E"><enum>(1)</enum><header>In General</header><text>Within 60 days after the date of the enactment of the <short-title>Surface Transportation Research and Development Act of 2005</short-title>, the Secretary shall enter into an arrangement with the National Research Council to develop and publish a National Transportation Information Needs Assessment. The Assessment shall be transmitted to the Secretary and the Congress not later than 24 months after such arrangement is entered into.</text></paragraph>
<paragraph id="H590D636DF9214DE6A515A5F500B60017"><enum>(2)</enum><header>Content</header><text>The Assessment shall—</text>
<subparagraph id="HFCBB2B0D973844D39F55C4D44D46EA7"><enum>(A)</enum><text>identify, in priority order, transportation data that is not being collected by the Bureau, Department of Transportation operating administrations, or other Federal, State, or local entities, but is needed to improve transportation decisionmaking at the Federal, State, and local level and to fulfill the requirements of subsection (c)(5);</text></subparagraph>
<subparagraph id="HDBAC3EF0D118473C9EDBF4B5AFC152A8"><enum>(B)</enum><text>recommend whether the data identified in subparagraph (A) should be collected by the Bureau, other parts of the Department, or by other Federal, State, or local entities, and whether any data is a higher priority than data currently being collected;</text></subparagraph>
<subparagraph id="H13BC5740FCB14314B4D1D61AB318633"><enum>(C)</enum><text>identify any data the Bureau or other Federal, State, and local entities is collecting that is not needed;</text></subparagraph>
<subparagraph id="H8621E48FEAFB4DA2B17733C1841BD134"><enum>(D)</enum><text>describe new data collection methods (including changes in surveys) and other changes the Bureau or other Federal, State, and local entities should implement to improve the standardization, accuracy, and utility of transportation data and statistics; and</text></subparagraph>
<subparagraph id="H387731B5A39F4554BEDE03A0724BADB0"><enum>(E)</enum><text>estimate the cost of implementing any recommendations.</text></subparagraph></paragraph>
<paragraph id="H012C98376F65424EBBB9E94369BD9EFB"><enum>(3)</enum><header>Consultation</header><text>In developing the Assessment, the National Research Council shall consult with the Department’s Advisory Council on Transportation Statistics and a representative cross-section of transportation community stakeholders as well as other Federal agencies, including the Environmental Protection Agency, the Department of Energy, and the Department of Housing and Urban Development.</text></paragraph>
<paragraph id="HB215EA8AC66D4B7F00ACCBF31EAFE07F"><enum>(4)</enum><header>Report to Congress</header><text>Not later than 6 months after the National Research Council transmits the Needs Assessment under paragraph (1), the Secretary shall transmit a report to the Committee on Science and the Committee on Transportation and Infrastructure of the House of Representatives, and to the Committee on Environment and Public Works of the Senate, that describes—</text>
<subparagraph id="H7DE9C17E6F124EA98532084D002593FE"><enum>(A)</enum><text>how the Department plans to fill the data gaps identified under paragraph (2)(A);</text></subparagraph>
<subparagraph id="HEE83FA860F0243E4904E3519B600A53"><enum>(B)</enum><text>how the Department plans to stop collecting data identified under paragraph (2)(C);</text></subparagraph>
<subparagraph id="H229A5300A6C747F3BCF9764728DB6D96"><enum>(C)</enum><text>how the Department plans to implement improved data collection methods and other changes identified under paragraph (2)(D);</text></subparagraph>
<subparagraph id="HE64B6A5DD6244C7787FEFA9B4E2D4BC6"><enum>(D)</enum><text>the expected costs of implementing subparagraphs (A), (B), and (C) of this paragraph;</text></subparagraph>
<subparagraph id="H693DA2B062534D8AB524A7A8D6104D04"><enum>(E)</enum><text>any findings of the Needs Assessment under paragraph (1) with which the Secretary disagrees, and why; and</text></subparagraph>
<subparagraph id="HAAAC15E7AC0A4C06B77EF2BBC135CF19"><enum>(F)</enum><text>any proposed statutory changes needed to implement the findings if the Needs Assessment under paragraph (1).</text></subparagraph></paragraph></subsection>
<subsection id="H8B9EB7A796464B5BAFE3142361E457D7"><enum>(e)</enum><header>Intermodal transportation data base</header>
<paragraph id="H00E52955F17D44A590604897FDF1D775"><enum>(1)</enum><header>In General</header><text>In consultation with the Under Secretary for Policy, the Assistant Secretaries, and the heads of the operating administrations of the Department of Transportation, the Director shall establish and maintain a transportation data base for all modes of transportation.</text></paragraph>
<paragraph id="H2044474747324D96B136F13D01C36942"><enum>(2)</enum><header>Use</header><text>The data base shall be suitable for analyses carried out by the Federal Government, the States, and metropolitan planning organizations.</text></paragraph>
<paragraph id="H5EFF3F597E23479C9B1B53B5291B8004"><enum>(3)</enum><header>Contents</header><text>The data base shall include—</text>
<subparagraph id="H3B4D3D9B94FC40BA85DD059D6DDBC14C"><enum>(A)</enum><text>information on the volumes and patterns of movement of goods, including local, interregional, and international movement, by all modes of transportation and intermodal combinations, and by relevant classification;</text></subparagraph>
<subparagraph id="H50D4C79961C9495392EB90CAD33B35F"><enum>(B)</enum><text>information on the volumes and patterns of movement of people, including local, interregional, and international movements, by all modes of transportation (including bicycle and pedestrian modes) and intermodal combinations, and by relevant classification;</text></subparagraph>
<subparagraph id="H56E68FF3396F4E588807036BC6363F2B"><enum>(C)</enum><text>information on the location and connectivity of transportation facilities and services; and</text></subparagraph>
<subparagraph id="H92A790F243F645F883145C2792C70E7"><enum>(D)</enum><text>a national accounting of expenditures and capital stocks on each mode of transportation and intermodal combination.</text></subparagraph></paragraph></subsection>
<subsection id="H094423156FBE452AA6F1F6B122AF9990"><enum>(f)</enum><header>National Transportation Library</header>
<paragraph id="H4061A63E841942F28DA90055E4025963"><enum>(1)</enum><header>In General</header><text>The Director shall establish and maintain a National Transportation Library, which shall contain a collection of statistical and other information needed for transportation decisionmaking at the Federal, State, and local levels.</text></paragraph>
<paragraph id="H50E21AD934F34F71ADAF96E2D60B416"><enum>(2)</enum><header>Access</header><text>The Director shall facilitate and promote access to the Library, with the goal of improving the ability of the transportation community to share information and the ability of the Director to make statistics readily accessible under subsection (c)(8).</text></paragraph>
<paragraph id="H613DAF9F6B984488B2AFCAD63F1551CE"><enum>(3)</enum><header>Coordination</header><text>The Director shall work with other transportation libraries and other transportation information providers, both public and private, to achieve the goal specified in paragraph (2).</text></paragraph></subsection>
<subsection id="H9C2AB57FC9134E34808D823EE1000758"><enum>(g)</enum><header>National transportation atlas data base</header>
<paragraph id="HFEC52727396D45AB993ED51E4F7504D8"><enum>(1)</enum><header>In General</header><text>The Director shall develop and maintain geospatial data bases that depict—</text>
<subparagraph id="HD1BDC9F4C5FE438DAFE3B82864192932"><enum>(A)</enum><text>transportation networks;</text></subparagraph>
<subparagraph id="HD7825A00D34C4BF6A121CC7FE75D5FED"><enum>(B)</enum><text>flows of people, goods, vehicles, and craft over the networks; and</text></subparagraph>
<subparagraph id="H4D548B7799E840DF9D691D3058E25634"><enum>(C)</enum><text>social, economic, and environmental conditions that affect or are affected by the networks.</text></subparagraph></paragraph>
<paragraph id="H92A8990066454BB8BA00F1AE6C526CBA"><enum>(2)</enum><header>Intermodal network analysis</header><text>The data bases shall be able to support intermodal network analysis.</text></paragraph></subsection>
<subsection id="H8B8EA0EA45EE4652BA212030B8D329C7"><enum>(h)</enum><header>Mandatory response authority for freight data collection</header><text>Whoever, being the owner, official, agent, person in charge, or assistant to the person in charge, of any corporation, company, business, institution, establishment, or organization of any nature whatsoever, neglects or refuses, when requested by the Director or other authorized officer, employee or contractor of the Bureau, to answer completely and correctly to the best of his/her knowledge all questions relating to the corporation, company, business, institution, establishment, or other organization, or to records or statistics in his/her official custody, contained in a data collection request prepared and submitted as part of the collection of freight data, shall be fined not more than $500; and if the individual willfully gives a false answer to a question, shall be fined not more than $10,000.</text></subsection>
<subsection id="HBA41D048F2774D499BD66580C04EB606"><enum>(i)</enum><header>Research and development grants</header><text>The Secretary may make grants to, or enter into cooperative agreements or contracts with, public and nonprofit private entities (including State transportation departments, metropolitan planning organizations, and institutions of higher education) for—</text>
<paragraph id="HE591F4329B074A5A88A97D2B86AE8BC0"><enum>(1)</enum><text>investigation of the subjects specified in subsection (c)(5) and research and development of new methods of data collection, standardization, management, integration, dissemination, interpretation, and analysis;</text></paragraph>
<paragraph id="H2F212C9D23CE4680A16781BEBDE3682E"><enum>(2)</enum><text>demonstration programs by States, local governments, and metropolitan planning organizations to harmonize data collection, reporting, management, storage, and archiving to simplify data comparisons across jurisdictions;</text></paragraph>
<paragraph id="HE7A2A6F4FF3E476F91C1D844E1104B20"><enum>(3)</enum><text>development of electronic clearinghouses of transportation data and related information, as part of the National Transportation Library under subsection (f); and</text></paragraph>
<paragraph id="H212F5D13EDF542EA8908C4C2ED91962"><enum>(4)</enum><text>development and improvement of methods for sharing geographic data, in support of the national transportation atlas data base under subsection (g) and the National Spatial Data Infrastructure developed under Executive Order No. 12906.</text></paragraph></subsection>
<subsection id="H7307D702EB3E485794481595EE78A3BE"><enum>(j)</enum><header>Limitations on statutory construction</header><text>Nothing in this section shall be construed—</text>
<paragraph id="H891CCF7C6E904605BA1325BD54F37CA1"><enum>(1)</enum><text>to authorize the Bureau to require any other department or agency to collect data; or</text></paragraph>
<paragraph id="H5A8B0F28B2604923AF7BE026613D6F5"><enum>(2)</enum><text>to reduce the authority of any other officer of the Department of Transportation to collect and disseminate data independently.</text></paragraph></subsection>
<subsection id="H5255227597EB4EBD94422EFB903319D"><enum>(k)</enum><header>Prohibition on certain disclosures</header>
<paragraph id="H2D2E71172FF845198EF6E9EE6693A582"><enum>(1)</enum><header>In General</header><text>An officer or employee of the Bureau may not—</text>
<subparagraph id="H942EE56AD548435CAB23C7F19CB53C75"><enum>(A)</enum><text>make any disclosure in which the data provided by an individual or organization under subsection (c) can be identified;</text></subparagraph>
<subparagraph id="H28AADA34C76C430AA9E95D803537D3D6"><enum>(B)</enum><text>use the information provided under subsection (c) for a nonstatistical purpose; or</text></subparagraph>
<subparagraph id="HC17CBEA70EA94A2BB3BA633836218F44"><enum>(C)</enum><text>permit anyone other than an individual authorized by the Director to examine any individual report provided under subsection (c).</text></subparagraph></paragraph>
<paragraph id="H0985486089024BAEB406907E30BB1FAC"><enum>(2)</enum><header>Prohibition on requests for certain data</header>
<subparagraph id="H163593685D994F918BAE743957483600"><enum>(A)</enum><header>Government agencies</header><text>No department, bureau, agency, officer, or employee of the United States (except the Director in carrying out this section) may require, for any reason, a copy of any report that has been filed under subsection (c) with the Bureau or retained by an individual respondent.</text></subparagraph>
<subparagraph id="HDD06A6A84ED84320BA816920373212E2"><enum>(B)</enum><header>Courts</header><text>Any copy of a report described in subparagraph (A) that has been retained by an individual respondent or filed with the Bureau or any of its employees, contractors, or agents—</text>
<clause id="H8A7119A1F1FE4C6FB8CAAF925BC3D88"><enum>(i)</enum><text>shall be immune from legal process; and</text></clause>
<clause id="HBA8B17CBB7D54058B1A22EDFC24C1333"><enum>(ii)</enum><text>shall not, without the consent of the individual concerned, be admitted as evidence or used for any purpose in any action, suit, or other judicial or administrative proceeding.</text></clause></subparagraph>
<subparagraph id="H82B11AF4E5BD475E80DF39F7001F0034"><enum>(C)</enum><header>Applicability</header><text>This paragraph shall apply only to reports that permit information concerning an individual or organization to be reasonably inferred by direct or indirect means.</text></subparagraph></paragraph>
<paragraph id="HD3F92629705E45F3993C481458B4AC45"><enum>(3)</enum><header>Data collected for nonstatistical purposes</header><text>In a case in which the Bureau is authorized by statute to collect data or information for a nonstatistical purpose, the Director shall clearly distinguish the collection of the data or information, by rule and on the collection instrument, so as to inform a respondent that is requested or required to supply the data or information of the nonstatistical purpose.</text></paragraph></subsection>
<subsection id="HE622C05E6098414DA9C9994B3E42F3BA"><enum>(l)</enum><header>Transportation Statistics Annual Report</header><text>The Director shall transmit to the President and Congress a Transportation Statistics Annual Report which shall include information on items referred to in subsection (c)(5), documentation of methods used to obtain and ensure the quality of the statistics presented in the report, and recommendations for improving transportation statistical information.</text></subsection>
<subsection id="HA90340BBB0164C13972D6D641EBC46A0"><enum>(m)</enum><header>Proceeds of data product sales</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/31/3302">section 3302</external-xref> of title 31, funds received by the Bureau from the sale of data products, for necessary expenses incurred, may be credited to the Highway Trust Fund (other than the Mass Transit Account) for the purpose of reimbursing the Bureau for the expenses.</text></subsection>
<subsection id="H6241DAF521D64C229C75002F1BFA70A3"><enum>(n)</enum><header>Advisory Council on Transportation Statistics</header>
<paragraph id="H80AE66128B4543B884FD4D008CC13486"><enum>(1)</enum><header>Establishment</header><text>The Director of the Bureau of Transportation Statistics shall establish an Advisory Council on Transportation Statistics.</text></paragraph>
<paragraph id="H506BDE68BA854C4E960503FA2937406E"><enum>(2)</enum><header>Function</header><text>It shall be the function of the Advisory Council established under this subsection to—</text>
<subparagraph id="H272E21ECC7A240CCB4F903B5473DC9DC"><enum>(A)</enum><text>advise the Director of the Bureau of Transportation Statistics on the quality, reliability, consistency, objectivity, and relevance of transportation statistics and analyses collected, supported, or disseminated by the Bureau of Transportation Statistics and the Department of Transportation;</text></subparagraph>
<subparagraph id="H8064AB2B3A684C9F863CD68EC7D71897"><enum>(B)</enum><text>provide input to and review the report to Congress under subsection (d)(4); and</text></subparagraph>
<subparagraph id="HB320E245C6444441AA8B1040CDFD9E67"><enum>(C)</enum><text>advise the Director on methods to encourage harmonization and interoperability of transportation data collected by the Bureau, the operating administrations of the Department of Transportation, States, local governments, metropolitan planning organizations, and private sector entities.</text></subparagraph></paragraph>
<paragraph id="H77D996B78E6C4B549B006D3DEDBB701"><enum>(3)</enum><header>Membership</header><text>The Advisory Council established under this subsection shall be composed of not fewer than 15 members appointed by the Director, who are not officers or employees of the United States, including—</text>
<subparagraph id="H448D0014A9A84D6AB22FE8B98BF131EF"><enum>(A)</enum><text>2 members with specific expertise in economics;</text></subparagraph>
<subparagraph id="H6A0C9F4AD62F4314B28D780099F03562"><enum>(B)</enum><text>3 members with expertise in statistics; and</text></subparagraph>
<subparagraph id="H533CE0F296C84D97B93580CC7EE80146"><enum>(C)</enum><text>additional members with expertise in transportation statistics, analysis, or policy.</text></subparagraph><continuation-text continuation-text-level="paragraph">Members shall include representatives of a cross-section of transportation community stakeholders.</continuation-text></paragraph>
<paragraph id="H358863FD739C4CC2AAE3FBD3A2F29401"><enum>(4)</enum><header>Terms of appointment</header>
<subparagraph display-inline="yes-display-inline" id="HA1FCF95D76D54626B3E174E5BB237E99"><enum>(A)</enum><text>Except as provided in subparagraph (B), members shall be appointed to staggered terms not to exceed 3 years. A member may be renominated for one additional 3-year term.</text></subparagraph>
<subparagraph indent="up1" id="H706B4D2EBBE04ECB8FAEB5AB25793112"><enum>(B)</enum><text>Members serving on the Advisory Council on Transportation Statistics as of the date of enactment of the <short-title>Surface Transportation Research and Development Act of 2005</short-title> shall serve until the end of their appointed terms.</text></subparagraph></paragraph>
<paragraph id="H904F7EAF50C64BB98B7375902642492D"><enum>(5)</enum><header>Applicability of <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name></header><text>The <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> shall apply to the Advisory Council established under this subsection, except that section 14 of the <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> shall not apply to such Advisory Council.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HB23C316E7EA74800B741D57E22D182BC"><enum>108.</enum><header>State planning and research</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/23/505">Section 505</external-xref> of title 23, United States Code, is amended to read as follows:</text>

<section id="H839058FDCB2147FD89924934935B88AC"><enum>505.</enum><header>State planning and research</header>
<subsection id="H98E718C8715641728B4F0024D2D8B103"><enum>(a)</enum><header>In General</header><text>Two and a half percent of the sums apportioned to a State for fiscal year 2005 and each fiscal year thereafter under section 104 (other than subsections (f) and (h)) and under sections 105 and 144 shall be available for expenditure by the State, in consultation with the Secretary, only for the following purposes:</text>
<paragraph id="H11BE16DF6D5A4A519E94BE34F4D7D333"><enum>(1)</enum><text>Engineering and economic surveys and investigations.</text></paragraph>
<paragraph id="H6FBAED3337B04253A85CFEB194D68D4B"><enum>(2)</enum><text>The planning of future highway programs and local public transportation systems, the planning of the financing of such programs and systems, including metropolitan and Statewide planning under sections 134 and 135, freight planning, safety planning, transportation systems management and operations planning, transportation-related land use planning, and transportation-related growth management activities within these planning processes, and planning capacity building activities.</text></paragraph>
<paragraph id="H8908BC9CACE44A7797DE8E352C68FC05"><enum>(3)</enum><text>Development and implementation of infrastructure management and traffic monitoring systems, and for asset management.</text></paragraph>
<paragraph id="HD92BCCA7FF31449A81B68C7F197C592D"><enum>(4)</enum><text>Studies of the economy, safety, and convenience of highway, local public transportation, bicycle, and pedestrian systems and the desirable regulation and equitable taxation of their use.</text></paragraph>
<paragraph id="H788F55D949A54B8E920039E95500BE69"><enum>(5)</enum><text>Research, development, and technology transfer activities necessary in connection with the planning, design, construction, management, maintenance, regulation, and taxation of the use of highway, local public transportation, and intermodal transportation systems, including innovative techniques for ensuring representative public input (e.g. deliberative polling).</text></paragraph>
<paragraph id="HD13374C8FA374C81AB7B9EEF3F9B1BF"><enum>(6)</enum><text>Research on the effects of design standards on intermodal coordination, such as the highway-rail interface, and on safe pedestrian access to transit on arterial roads and urban highways.</text></paragraph>
<paragraph id="HE8831A3888C840B7A28CB475B65FABD"><enum>(7)</enum><text>Study, research and development, and training on the engineering standards and construction materials, including accreditation of inspection and testing, for highway, local public transportation, bicycle, pedestrian, and intermodal transportation systems.</text></paragraph></subsection>
<subsection id="HDE179248E93E444DA6408B7CFC82B364"><enum>(b)</enum><header>Minimum expenditures on research, development, and technology transfer activities</header>
<paragraph id="H1C9F8A6B0DDE495E9D27BE727FAC6E1"><enum>(1)</enum><header>In General</header><text>Subject to paragraph (2), not less than 25 percent of the funds appropriated pursuant to subsection (a) to a State for a fiscal year shall be expended by the State for research, development, and technology transfer activities described in subsection (a), relating to highway, public transportation, bicycle, pedestrian, and intermodal transportation systems.</text></paragraph>
<paragraph id="H0B410E7D2C5F41C594088FEAA2E8E753"><enum>(2)</enum><header>Waivers</header><text>The Secretary may waive the application of paragraph (1) with respect to a State for a fiscal year if the State certifies to the Secretary for the fiscal year that the funds described in paragraph (1) are not needed for research, development, and technology transfer and the Secretary accepts such certification.</text></paragraph>
<paragraph id="H87E330B016EF487D8047DB21FDA75E03"><enum>(3)</enum><header>Nonapplicability of Assessment</header><text>Funds expended under paragraph (1) shall not be considered to be part of the extramural budget of the agency for the purpose of section 9 of the <act-name parsable-cite="SBA">Small Business Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>).</text></paragraph></subsection>
<subsection id="H87F9A43BE72C4FA3B546F2C43CDED198"><enum>(c)</enum><header>Minimum expenditures for improving the quality of collection and reporting of strategic surface transportation data</header>
<paragraph id="H5F5D7DB6F65F453699449B2C9B46CD46"><enum>(1)</enum><header>In General</header><text>Subject to paragraph (2), not less than 10 percent of the funds appropriated pursuant to subsection (a) for a fiscal year to a State shall be expended by the State to improve the collection and reporting of strategic surface transportation data to provide critical information about the extent, condition, use, performance, and financing of the Nation’s surface transportation system (including intermodal connectors) for passenger and freight movement.</text></paragraph>
<paragraph id="H321FCDBBFA144FAFA991B318661DE9B5"><enum>(2)</enum><header>Waivers</header><text>The Secretary may waive the application of paragraph (1) with respect to a State for a fiscal year if the State certifies to the Secretary for the fiscal year that the State is collecting and reporting strategic data consistent with quality assurance guidelines developed cooperatively with the States and the Secretary approves such certification.</text></paragraph></subsection>
<subsection id="H7312558E837345A28E2525B30013F5A0"><enum>(d)</enum><header>Federal share</header><text>The Federal share of the cost of a project carried out using funds subject to subsection (a) shall be matched in accordance with section 120(b) unless the Secretary determines that the interests of the surface transportation program would be best served without such matching.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HE060D58C261D4268AD50AE1C58A111F1"><enum>109.</enum><header>Future Strategic Highway Research Program</header>
<subsection id="H5386D2F415C8400B9285FFE91413B262"><enum>(a)</enum><header>Amendment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/5">Chapter 5</external-xref> of title 23, United States Code, is amended by adding at the end the following new section:</text>

<section id="H8AB98B6BE7134DC0A7FDC059DA23330"><enum>509.</enum><header>Future Strategic Highway Research Program</header>
<subsection id="H77CE70244C164A8A9B90F945B033864F"><enum>(a)</enum><header>Establishment</header><text>The Secretary, in consultation with the American Association of State Highway and Transportation Officials, shall establish and support a grant program to be known as the Future Strategic Highway Research Program.</text></subsection>
<subsection id="H81769512D8D04B128111647BA54BC700"><enum>(b)</enum><header>Program</header><text>The program established under this section shall implement the Transportation Research Board Special Report 260, entitled <quote>Strategic Highway Research: Saving Lives, Reducing Congestion, Improving Quality of Life</quote>, which included the following research areas:</text>
<paragraph id="H7F96EF8FF4A949BEB0BD1575001B8500"><enum>(1)</enum><text>Accelerating the renewal of America’s highways.</text></paragraph>
<paragraph id="H805D5CD46A544355B31113E09316CFF7"><enum>(2)</enum><text>Making a significant improvement in highway safety.</text></paragraph>
<paragraph id="HD9CA504D7F2B4F75AD99607941459245"><enum>(3)</enum><text>Providing a highway system with reliable travel times.</text></paragraph>
<paragraph id="H8AF7EDFD4E924D5EA5B7C6E4800CF93"><enum>(4)</enum><text>Providing highway capacity in support of the Nation’s economic, environmental, multi-modal transportation, and social goals.</text></paragraph></subsection>
<subsection id="HB8159EA4F900426CA0B23CB1CC1695FF"><enum>(c)</enum><header>Administration</header><text>The Secretary shall enter into an arrangement with the National Research Council to administer the program established under subsection (a).</text></subsection>
<subsection id="H9D6BD5F5970F48AD975335C000B9EF60"><enum>(d)</enum><header>Period of availability</header><text>Funds set aside to carry out this section shall remain available for the fiscal year for which such funds are made available and the three succeeding fiscal years.</text></subsection>
<subsection id="HF7CBED0E2A4B4AE8909F4E8C7024323C"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary of Transportation from the Highway Trust Fund, for each of fiscal years 2005 through 2010, $75,000,000 to carry out this section.</text></subsection>
<subsection id="H72D47FC074104670BD19A50006C81924"><enum>(f)</enum><header>Program administration</header><text>In carrying out the program under this section, the Secretary, through the agreement with the National Research Council, shall ensure that the selection of awards shall be based on open competition and peer review, and that a balanced group of stakeholders is represented on all committees and panels established to implement the program. Proposals that involve partnerships and include significant matching funds shall be encouraged, although no matching funds are required.</text></subsection>
<subsection id="H051F5FFF82B3437A9BD648D902059243"><enum>(g)</enum><header>Programmatic evaluations</header><text>Within 3 years after the first research and development project grants, cooperative agreements, or contracts are awarded under this section, the Comptroller General shall review the program under this section, and recommend improvements. The review shall assess the degree to which projects funded under this section have addressed the research and development topics identified in the Transportation Research Board Special Report 260, including identifying those topics which have not yet been addressed.</text></subsection>
<subsection id="H9B6CDA76058A4800B7423FE22200A210"><enum>(h)</enum><header>Annual progress and performance report</header><text>The National Research Council shall produce an annual progress and performance report for the program under this section. The report shall summarize the status, funding, and sponsors of all funded projects by the research and development areas specified in subsection (b). The report shall be submitted to the Secretary, to the Committee on Transportation and Infrastructure and the Committee on Science of the House of Representatives, and to the Committee on Environment and Public Works of the Senate.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H259AD2F6350D4731AEE9A923167C7133"><enum>(b)</enum><header>Conforming amendment</header><text>The analysis of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/5">chapter 5</external-xref> of title 23, United States Code, is amended by adding at the end the following new item:</text>

<section id="H323DB97FE42F4EE98DFFEA85553E40A7"><enum>110.</enum><header>University transportation research</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/5505">Section 5505</external-xref> of title 49, United States Code, is amended to read as follows:</text>

<section id="HC54F7A49299D4BF1B78C2EE03747184B"><enum>5505.</enum><header>University transportation research</header>
<subsection id="HF0175042367B4615B953B9CE1F8188CD"><enum>(a)</enum><header>Regional centers</header><text>The Secretary of Transportation shall make grants to nonprofit institutions of higher learning to establish and operate 1 university transportation center in each of the 10 United States Government regions that comprise the Standard Federal Regional Boundary System.</text></subsection>
<subsection id="H261F09D3E15A41AD97E24324DC24F839"><enum>(b)</enum><header>Other centers</header><text>The Secretary shall make 16 grants to nonprofit institutions of higher learning, in addition to grants made under subsection (a), to establish and operate university transportation centers.</text></subsection>
<subsection id="H58CE9BCC21E545A38F7356639DC162A4"><enum>(c)</enum><header>Role of centers</header><text>The role of each center shall be to address transportation management and research and development matters, with special attention to increasing the number of highly skilled individuals entering the field of transportation.</text></subsection>
<subsection id="H368D7BF0BEE84F45A17C35911466FF66"><enum>(d)</enum><header>Selection of grant recipients</header>
<paragraph id="H882F1B12B9914E859DBDBC4F0052FEF"><enum>(1)</enum><header>Applications</header><text>In order to be eligible to receive a grant under this section, a nonprofit institution of higher learning shall submit to the Secretary an application that is in such form and contains such information as the Secretary may require.</text></paragraph>
<paragraph id="HB7CB64E2025842A492B3B2F7A619F4DB"><enum>(2)</enum><header>Selection criteria</header><text>Except as otherwise provided by this section, the Secretary shall select each recipient of a grant under this section through an open competition, peer-reviewed process on the basis of the following:</text>
<subparagraph id="HF14BC921C5FE4A5DB2ABECAD401BE92"><enum>(A)</enum><text>The capability of the recipient to provide leadership in making national and regional contributions to the solution of immediate and long-range transportation problems.</text></subparagraph>
<subparagraph id="H596E78CDB65F449F949C471023EEE7E5"><enum>(B)</enum><text>The recipient’s establishment of a surface transportation program by the date of the award, which encompasses several modes of transportation.</text></subparagraph>
<subparagraph id="HBC58C39BE7C345DD94503EC963ABE109"><enum>(C)</enum><text>The recipient’s demonstrated ability to disseminate results of transportation research and education programs through a statewide or regionwide continuing education program.</text></subparagraph>
<subparagraph id="H29E104DA8086410AB758F2F0A50011D"><enum>(D)</enum><text>The strategic plan the recipient proposes to carry out under the grant.</text></subparagraph></paragraph></subsection>
<subsection id="H92E2C4F7CBD74375829525EAA7200018"><enum>(e)</enum><header>Objectives</header><text>The Secretary shall ensure that each university transportation center receiving a grant under this section shall conduct the following programs and activities:</text>
<paragraph id="H22338ED1813B46C4B9051BCDD9DCD1F6"><enum>(1)</enum><text>Basic and applied research and development that supports the Department’s research and development agenda consistent with <external-xref legal-doc="usc" parsable-cite="usc/23/508">section 508</external-xref> of title 23.</text></paragraph>
<paragraph id="H91D7D019A18340D7A8742B454D1B9781"><enum>(2)</enum><text>An education program that includes multidisciplinary course work, faculty and student participation in research and development, and an opportunity for practical experience.</text></paragraph>
<paragraph id="H1FAB58EC134E4CD7B32EBC61B010C7B3"><enum>(3)</enum><text>An ongoing program of technology transfer that makes research and development results available to potential users in a form that can be implemented, utilized, or otherwise applied.</text></paragraph></subsection>
<subsection id="H2F84A47DC8C74F56B500002E006F5DE7"><enum>(f)</enum><header>Maintenance of effort</header><text>To be eligible to receive a grant under this section, an applicant shall—</text>
<paragraph id="H6F406FDE79B34F65A517CC79B2438995"><enum>(1)</enum><text>enter into an agreement with the Secretary to ensure that the applicant will maintain total expenditures from all other sources to establish and operate a university transportation center and related educational and research and development activities at a level that is at least equal to the average level of those expenditures during the 2 fiscal years before the date on which the grant is provided;</text></paragraph>
<paragraph id="HBF212F7BCFB84734A95472B27E21B32C"><enum>(2)</enum><text>submit to the Secretary an annual report on the projects and activities of the university transportation center for which funds are made available for the fiscal year covered by the report, a description of—</text>
<subparagraph id="H764E514F72484E62B407535DA67D0000"><enum>(A)</enum><text>the educational activities carried out by the center (including a detailed summary of the budget for those educational activities);</text></subparagraph>
<subparagraph id="H06CDFADD2EBF4A12A76059F7655B7EEA"><enum>(B)</enum><text>each research and development project carried out by the center, including—</text>
<clause id="H5CC99F307C014455BA6118E236B42C64"><enum>(i)</enum><text>the identity of the principal investigator working on a research and development project; and</text></clause>
<clause id="HD4D1237280E6445F8D8E0089B0E2C696"><enum>(ii)</enum><text>the overall funding amount for each research and development project (including the amounts expended for the project as of the date of the report); and</text></clause></subparagraph>
<subparagraph id="H4AF1126408084B3884A665C41352FC04"><enum>(C)</enum><text>overall technology transfer and implementation efforts of the center; and</text></subparagraph></paragraph>
<paragraph id="H3C8553CF2DC440DABD53E143B97E5251"><enum>(3)</enum><text>make use of National Research Council, Transportation Research Board, and Transportation Research Information Services online databases for—</text>
<subparagraph id="HF5F498E84B2D42DAA722C3A772268F75"><enum>(A)</enum><text>program development and strategic planning;</text></subparagraph>
<subparagraph id="HD6993E847F2F4375A3DDE4C933CEC5C3"><enum>(B)</enum><text>reporting of activities funded under this section; and</text></subparagraph>
<subparagraph id="H580D262E35FF42C58E1BB9126BF1A3A5"><enum>(C)</enum><text>input and dissemination of results and reports from completed research and development.</text></subparagraph></paragraph></subsection>
<subsection id="H93BC6A450BFF43E195E4B932C03C54D"><enum>(g)</enum><header>Federal share</header><text>The Federal share of the costs of activities carried out using a grant made under subsection (a) is 80 percent of costs, and under subsection (b) is 50 percent of costs. The non-Federal share may include funds provided to a recipient under section 503, 504(b), or 505 of title 23, United States Code.</text></subsection>
<subsection id="H7C29A4D277E94FF499BEEFF384C72B00"><enum>(h)</enum><header>Program coordination</header>
<paragraph id="HD379AB4AA76641709D29FDDCD6664590"><enum>(1)</enum><header>Coordination</header><text>The Secretary shall coordinate the research and development, education, training, and technology transfer activities that grant recipients carry out under this section.</text></paragraph>
<paragraph id="H63122D50CDBD4D238343027D3B6CEB31"><enum>(2)</enum><header>Annual review and evaluation</header><text>At least annually and consistent with the plan developed by the recipient under subsection (f)(2), the Secretary shall review and evaluate programs the grant recipients carry out.</text></paragraph>
<paragraph id="HB0DC8CDEC65E4CA0B71CFB3227351BE3"><enum>(3)</enum><header>Funding limitation</header><text>The Secretary may use not more than 1 percent of amounts made available from Government sources to carry out this subsection.</text></paragraph></subsection>
<subsection id="H0DF3FA05D6C9440BB40070000102F9B9"><enum>(i)</enum><header>Limitation on availability of funds</header><text>Funds made available to carry out this program shall remain available for obligation for a period of 2 years after the last day of the fiscal year for which such funds are authorized.</text></subsection>
<subsection id="H8A6CE18A005845BD87898252246BF6E5"><enum>(j)</enum><header>Transportation education development pilot program</header>
<paragraph id="H48A1BC213519463CA743962C3590904F"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall establish a program to make grants to institutions of higher education that in partnership with industry or State Departments of Transportation will develop, test, and revise new curricula and education programs to train individuals at all levels of the transportation workforce.</text></paragraph>
<paragraph id="HD60B98D440714102B37CC5CE001D0043"><enum>(2)</enum><header>Selection of grant recipients</header><text>In selecting applications for awards under this subsection, the Secretary shall consider—</text>
<subparagraph id="HC1C032B0563848849F001F47AF3C3315"><enum>(A)</enum><text>the degree to which the new curricula or education program meets the specific needs of a segment of the transportation industry, States, or regions;</text></subparagraph>
<subparagraph id="HB952B12D1A8946899CC597E899850203"><enum>(B)</enum><text>providing for practical experience and on-the-job training;</text></subparagraph>
<subparagraph id="H85F6D55276214931BA5C844DB81FE951"><enum>(C)</enum><text>proposals oriented toward practitioners in the field rather than the support and growth of the research community;</text></subparagraph>
<subparagraph id="H21260702816B4118B9FA8D370037C62C"><enum>(D)</enum><text>the degree to which the new curricula or program will provide training in areas other than engineering, such as business administration, economics, information technology, environmental science, and law;</text></subparagraph>
<subparagraph id="H99EDCF79528B45899CD1F3E1D6F31961"><enum>(E)</enum><text>programs or curricula in nontraditional departments which train professionals for work in the transportation field, such as materials, information technology, environmental science, urban planning, and industrial technology; and</text></subparagraph>
<subparagraph id="HCB4CFE1FFCCD4FAC926F13FDFFD945FF"><enum>(F)</enum><text>industry or a State’s Department of Transportation commitment to the program.</text></subparagraph></paragraph>
<paragraph id="H3F9338A123A043A400DC3F601B57E77F"><enum>(3)</enum><header>Authorization of appropriations</header><text>From amounts authorized under section 101(b)(4) of the <short-title>Surface Transportation Research and Development Act of 2005</short-title> for carrying out this section, for each of fiscal years 2005, 2006, 2007, 2008, 2009, and 2010, there shall be available for carrying out this subsection $4,500,000.</text></paragraph>
<paragraph id="H6AB14FC09AB840E3855DB3731F9DBF40"><enum>(4)</enum><header>Limitations</header><text>No individual grant under this subsection shall exceed $750,000 per year. After a recipient has received 3 years of Federal funding under this subsection, Federal funding may equal no more than 75 percent of a grantee’s program costs.</text></paragraph></subsection>
<subsection id="H3E328157D4A8498A9F267400B52BEB06"><enum>(k)</enum><header>National Transportation Security Centers</header>
<paragraph id="HD9C7A414032A4500B1EE004FEB0709B0"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall establish not more than 4 National Transportation Security Centers at institutions of higher education to conduct research, education, and professional training on all aspects of surface transportation security, with emphasis on utilization of intelligent transportation systems, technologies, and architectures.</text></paragraph>
<paragraph id="H1566FEF2B2BF400DABCBBE7DCBCB28E"><enum>(2)</enum><header>Selection criteria</header><text>The Secretary shall make grants using a competitive peer-reviewed procedure that gives priority to—</text>
<subparagraph id="HAE1DD1FDA584495FB6EDD8C4712FD34E"><enum>(A)</enum><text>institutions with a commitment to transportation security issues;</text></subparagraph>
<subparagraph id="H4083F710AC4147949C91007E54D186B7"><enum>(B)</enum><text>proposals that include partnerships with other institutions of higher education, federally funded research and development centers, or other nonprofit laboratories;</text></subparagraph>
<subparagraph id="HCE467C963F2C4D598179FAB67C8B56FD"><enum>(C)</enum><text>proposals to conduct both practical and theoretical research and technical systems analysis; and</text></subparagraph>
<subparagraph id="HD76CA7371FE94970ACA324EF00747EA2"><enum>(D)</enum><text>proposals to develop professional training programs.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H0177149F0D1148C990E8A37F8FBE0374"><enum>111.</enum><header>Intelligent Transportation Systems</header>
<subsection id="H878932A97F854FF9AFC2EDAAA2DD6236"><enum>(a)</enum><header>Amendment</header><text>Subtitle C of title V of the Transportation Equity Act for the 21st Century is amended to read as follows:</text>

<section id="H5F18962BB67C4BCDAD611D5223BF7D94"><enum>5201.</enum><header>Short title</header><text display-inline="no-display-inline">This subtitle may be cited as the <quote>Intelligent Transportation Systems Act of 2005</quote>.</text></section>
<section id="HDD42F7DC3BA04084B2FD3919B8A0B188"><enum>5202.</enum><header>Goals and purposes</header>
<subsection id="HC76D0CA104DD4F9EB1D100FE03276EAE"><enum>(a)</enum><header>Goals</header><text>The goals of the intelligent transportation system program include—</text>
<paragraph id="HE0F5A3F55ADB469DAEA340E6AADE9193"><enum>(1)</enum><text>enhancement of surface transportation efficiency and facilitation of intermodalism and international trade to enable existing facilities to meet a significant portion of future transportation needs, including public access to employment, goods, and services, and to reduce regulatory, financial, and other transaction costs to public agencies and system users;</text></paragraph>
<paragraph id="H72D3084BBB5E445CB8C788C7D8DAD42"><enum>(2)</enum><text>achievement of national transportation safety goals, including the enhancement of safe operation of motor vehicles and nonmotorized vehicles, with particular emphasis on decreasing the number and severity of collisions;</text></paragraph>
<paragraph id="H71A40D5914D7467CA651117EB8D8D8C1"><enum>(3)</enum><text>protection and enhancement of the natural environment and communities affected by surface transportation, with particular emphasis on assisting State and local governments to achieve national environmental goals;</text></paragraph>
<paragraph id="H53CF861C512648FABEE9774BC13546B8"><enum>(4)</enum><text>accommodation of the needs of all users of surface transportation systems, including operators of commercial vehicles, passenger vehicles, motorcycles, and bicycles, and including pedestrians and individuals with disabilities; and</text></paragraph>
<paragraph id="H058EDF8EDFFF496590D4C6CD18E0F7B2"><enum>(5)</enum><text>improvement of the Nation’s ability to respond to security related or other man-made emergencies and natural disasters, and enhancement of national defense mobility.</text></paragraph></subsection>
<subsection id="H8CF7C0CEEF4E479296E5191EF2F728C4"><enum>(b)</enum><header>Purposes</header><text>The Secretary shall implement activities under the intelligent transportation system program to, at a minimum—</text>
<paragraph id="H80402BD30704427AAF3777D818FFADBC"><enum>(1)</enum><text>develop and test emerging technologies to meet the goals described in subsection (a);</text></paragraph>
<paragraph id="H505F156493864465B1BE5099F3F8D395"><enum>(2)</enum><text>expedite deployment and ensure integration and interoperability of proven intelligent transportation systems;</text></paragraph>
<paragraph id="H0FB7A38C3C7D45E1B6AC6D3BA64F8F7F"><enum>(3)</enum><text>analyze the likelihood of utilization of intelligent transportation system technologies by the intended user community;</text></paragraph>
<paragraph id="H9DCF053DD4694EEF928CE119DF22ACF"><enum>(4)</enum><text>ensure that Federal, State, and local transportation officials have adequate knowledge of intelligent transportation systems for full consideration in the transportation planning process;</text></paragraph>
<paragraph id="H48AC7E5067C5422A9900CEA3E0F03E1B"><enum>(5)</enum><text>improve regional cooperation and operations planning for effective intelligent transportation system deployment;</text></paragraph>
<paragraph id="H0FD632F215AB4534BE1DEF7B699D78E7"><enum>(6)</enum><text>promote the innovative use of private resources;</text></paragraph>
<paragraph id="HDC8028C1603946F1B8D938A59D123DF1"><enum>(7)</enum><text>develop a workforce capable of developing, operating, and maintaining intelligent transportation systems; and</text></paragraph>
<paragraph id="H1F7DAF5F446C4C14BF8D19F0D86F126E"><enum>(8)</enum><text>evaluate costs and benefits of intelligent transportation systems projects.</text></paragraph></subsection></section>
<section id="HED352FBBB5624B9FB74EEF5F2636BD59"><enum>5203.</enum><header>General authorities and requirements</header>
<subsection id="HD8EC6D536AED4E45AFCA976B436C164C"><enum>(a)</enum><header>Scope</header><text>Subject to the provisions of this subtitle, the Secretary shall conduct an ongoing intelligent transportation system program to research, develop, and operationally test intelligent transportation systems and advance nationwide deployment of proven systems through research on barriers to deployment as a component of the surface transportation systems of the United States.</text></subsection>
<subsection id="HDF694B20C72B424F9817272E155ED4E2"><enum>(b)</enum><header>Policy</header><text>Intelligent transportation system research, development, operational tests, and deployment projects funded pursuant to this subtitle shall encourage and not displace public-private partnerships or private sector investment in such research and development tests and projects.</text></subsection>
<subsection id="HA7D854B7EE484460A5EF7B8F55C89D4E"><enum>(c)</enum><header>Cooperation with governmental, private, and educational entities</header><text>The Secretary shall carry out the intelligent transportation system program in cooperation with State and local governments and other public entities, the United States private sector, federally funded research and development centers, and colleges and universities, including historically black colleges and universities and other minority institutions of higher education.</text></subsection>
<subsection id="H7CA9DF9C4AEA4E248CF8E890BCC37977"><enum>(d)</enum><header>Consultation with Federal officials</header><text>In carrying out the intelligent transportation system program, the Secretary, as appropriate, may consult with the Secretary of Commerce, the Secretary of the Treasury, the Secretary of Homeland Security, the Administrator of the Environmental Protection Agency, the Director of the National Science Foundation, and the heads of other Federal departments and agencies.</text></subsection>
<subsection id="H707E301A94A74A3C8435125B38FE4191"><enum>(e)</enum><header>Technical assistance, training, and information</header><text>The Secretary shall provide technical assistance, training, and information to State and local governments seeking to implement, operate, maintain, or evaluate intelligent transportation system technologies and services.</text></subsection>
<subsection id="H34B982E9758D4ACAA9EDE11216CF3E2D"><enum>(f)</enum><header>Transportation planning</header><text>The Secretary may provide funding to support adequate consideration of transportation system management and operations within metropolitan and statewide transportation planning processes.</text></subsection>
<subsection id="H85622E00FB664D2592399F4705C76178"><enum>(g)</enum><header>Information clearinghouse</header>
<paragraph id="HC2CE47D715824FD890D317F333A671B5"><enum>(1)</enum><header>In General</header><text>The Secretary shall—</text>
<subparagraph id="HB5040F204883409EAB9287267C37CE79"><enum>(A)</enum><text>maintain a repository for technical and safety data collected as a result of federally sponsored projects carried out under this subtitle; and</text></subparagraph>
<subparagraph id="H2CB17473A5744341A67BFC23369854EF"><enum>(B)</enum><text>make that information (except for proprietary information and data) readily available to all users of the repository.</text></subparagraph></paragraph>
<paragraph id="H8B961C6669424FA7AABFC20069BC1F5C"><enum>(2)</enum><header>Agreement</header>
<subparagraph id="HB0CBD544F71440D0AF66D7D58202F3AE"><enum>(A)</enum><header>In General</header><text>The Secretary may enter into an agreement with a third party for the maintenance of the repository for technical and safety data under paragraph (1)(A).</text></subparagraph>
<subparagraph id="H3D525076451347EEAA1E566331AB5487"><enum>(B)</enum><header>Federal financial assistance</header><text>If the Secretary delegates responsibility under subparagraph (A), the entity to which the responsibility is delegated shall be eligible for Federal financial assistance under this section.</text></subparagraph></paragraph></subsection>
<subsection id="HD63B1875B6F24526AB7124A2D6CFD6AA"><enum>(h)</enum><header>Advisory Committee</header>
<paragraph id="H98236037753A4DCF8BEBD661C489E866"><enum>(1)</enum><header>In General</header><text>The Secretary shall establish an Advisory Committee to advise the Secretary on carrying out this subtitle.</text></paragraph>
<paragraph id="H9FCD0A666C2440F39153D22837823D5B"><enum>(2)</enum><header>Membership</header><text>The Advisory Committee shall have no more than 20 members, be balanced between metropolitan and rural interests, and include, at a minimum—</text>
<subparagraph id="HB6133EFE118D4EF89D9FF34100453BA6"><enum>(A)</enum><text>a representative from a State highway department;</text></subparagraph>
<subparagraph id="H994692D0C3C84A6F9FCBBFD600D6A8A0"><enum>(B)</enum><text>a representative from a local highway department who is not from a metropolitan planning organization;</text></subparagraph>
<subparagraph id="HD76DB0CF176D43528CC3DC1FE1C9BE25"><enum>(C)</enum><text>a representative from a State, local, or regional transit agency;</text></subparagraph>
<subparagraph id="HC428B834F3F54888BCB5B370BD1D9CB1"><enum>(D)</enum><text>a representative from a metropolitan planning organization;</text></subparagraph>
<subparagraph id="H98A548C6DD254717BF00068D9FF56CFD"><enum>(E)</enum><text>a private sector user of intelligent transportation system technologies;</text></subparagraph>
<subparagraph id="HBDC0A4338B674FEC89CE7DC03516EC6"><enum>(F)</enum><text>an academic researcher with expertise in computer science or another information science field related to intelligent transportation systems, and who is not an expert on transportation issues;</text></subparagraph>
<subparagraph id="H618C073E085143E69BCF346483044789"><enum>(G)</enum><text>an academic researcher who is a civil engineer;</text></subparagraph>
<subparagraph id="H4AE67469F8D14B1A912B6CD601F5711F"><enum>(H)</enum><text>an academic researcher who is a social scientist with expertise in transportation issues;</text></subparagraph>
<subparagraph id="H7CD02F98EAD24E1FB77E70F347D825FB"><enum>(I)</enum><text>a representative from a not-for-profit group representing the intelligent transportation system industry;</text></subparagraph>
<subparagraph id="HCDE89375E107453D9D78E6EEE5515467"><enum>(J)</enum><text>a representative from a public interest group concerned with safety;</text></subparagraph>
<subparagraph id="H989C535390A44EEAA8585841426C05D7"><enum>(K)</enum><text>a representative from a public interest group concerned with the impact of the transportation system on land use and residential patterns; and</text></subparagraph>
<subparagraph id="HE43004FA269E4E9A8D86AA8BFDEF2123"><enum>(L)</enum><text>members with expertise in planning, safety, and operations.</text></subparagraph></paragraph>
<paragraph id="H0B72199458D640B7B1AD005571E48013"><enum>(3)</enum><header>Duties</header><text>The Advisory Committee shall, at a minimum, perform the following duties:</text>
<subparagraph id="H84A24C49B52E41278625221F367415CD"><enum>(A)</enum><text>Provide input into the development of the Intelligent Transportation System aspects of the strategic plan under <external-xref legal-doc="usc" parsable-cite="usc/23/508">section 508</external-xref> of title 23, United States Code.</text></subparagraph>
<subparagraph id="HA133897AA21D41CA92BFA43EE017AF5C"><enum>(B)</enum><text>Review, at least annually, areas of intelligent transportation systems research being considered for funding by the Department, to determine—</text>
<clause id="H68A1EABB3D944334A7EB192899090072"><enum>(i)</enum><text>whether these activities are likely to advance either the state-of-the-practice or state-of-the-art in intelligent transportation systems;</text></clause>
<clause id="HBCEFF9FFFCF846FC87C57C5945E39111"><enum>(ii)</enum><text>whether the intelligent transportation system technologies are likely to be deployed by users, and, if not, to determine the barriers to deployment; and</text></clause>
<clause id="H0AF7500E38AA4A53B87E5F4B5582352E"><enum>(iii)</enum><text>the appropriate roles for government and the private sector in investing in the research and technologies being considered.</text></clause></subparagraph></paragraph>
<paragraph id="HEA3C79FE78EB47688213877D42D21F3C"><enum>(4)</enum><header>Report</header><text>Not later than February 1 of each year after the date of enactment of the <short-title>Surface Transportation Research and Development Act of 2005</short-title>, the Secretary shall transmit to the Committee on Science and the Committee on Transportation and Infrastructure of the House of Representatives, and to the Committee on Environment and Public Works of the Senate, a report including—</text>
<subparagraph id="HCDF2AA602530492F9110CF5223BFDF5C"><enum>(A)</enum><text>all recommendations made by the Advisory Committee during the preceding calendar year;</text></subparagraph>
<subparagraph id="HE025CDB52C7642B6BE954367E8ECAC8"><enum>(B)</enum><text>an explanation of how the Secretary has implemented those recommendations; and</text></subparagraph>
<subparagraph id="H7400073635654B1CB3CA5460BA9F6B9"><enum>(C)</enum><text>for recommendations not implemented, the reasons for rejecting the recommendations.</text></subparagraph></paragraph>
<paragraph id="HEBB71EA73D734658AC43006EC3861736"><enum>(5)</enum><header>Applicability of <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name></header><text>The Advisory Committee shall be subject to the <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5 U.S.C. App.).</text></paragraph></subsection>
<subsection id="H5A068F13A9994E178615D0A200D2BEE9"><enum>(i)</enum><header>Evaluations</header>
<paragraph id="HFBED860EEADA4BED9499C02D75A1D780"><enum>(1)</enum><header>Guidelines and requirements</header>
<subparagraph id="H928B1BE882754F06A546B63BC5D384FD"><enum>(A)</enum><header>In General</header><text>The Secretary shall issue guidelines and requirements for the evaluation of operational tests and model deployment projects carried out under this subtitle.</text></subparagraph>
<subparagraph id="H1D8360D507794003A226B05DAF00A9C7"><enum>(B)</enum><header>Content</header><text>Such evaluations shall include specific, quantitative measures to determine whether a technology is meeting its intended goal. To the maximum extent practicable, these measures shall evaluate the outcome of the technology (such as accidents avoided or decreased travel times or travel time variability).</text></subparagraph>
<subparagraph id="H86CFCD380BFE4B25B7FC533E8F35A084"><enum>(C)</enum><header>Objectivity and independence</header><text>The guidelines and requirements issued under subparagraph (A) shall include provisions to ensure the objectivity and independence of the evaluator so as to avoid any real or apparent conflict of interest or potential influence on the outcome by parties to any such test or deployment project or by any other formal evaluation carried out under this subtitle.</text></subparagraph>
<subparagraph id="H86D68DAE2DEA4E32B34B370549FD5751"><enum>(D)</enum><header>Funding</header><text>The guidelines and requirements issued under subparagraph (A) shall establish evaluation funding levels, based on the size and scope of each test or project, that ensure adequate evaluation of the results of the test or project.</text></subparagraph>
<subparagraph id="H7D23F05A70CB4E29B467BAA748AA5706"><enum>(E)</enum><header>Dissemination</header><text>The Secretary shall make readily available through the Internet all information collected through evaluations carried out under this subsection.</text></subparagraph></paragraph>
<paragraph id="HDBBDE64232544469947FB2EF64975B91"><enum>(2)</enum><header>Special rule</header><text>Any survey, questionnaire, or interview that the Secretary considers necessary to carry out the evaluation of any test, deployment project, or program assessment activity under this subtitle shall not be subject to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code.</text></paragraph></subsection></section>
<section id="H86AC7E31B080418DB24F67A0A6261032"><enum>5204.</enum><header>Using information from Intelligent Transportation Systems</header>
<subsection id="H730502C8804842F6813505A980972BAA"><enum>(a)</enum><header>Report</header><text>The Secretary shall prepare a report assessing the value of current and anticipated data collected from intelligent transportation system technologies to determine whether and how that data should be used for real-time traffic management, planning, performance monitoring, program assessment, and policy applications.</text></subsection>
<subsection id="H08AC60D703344B3A8352304B8361CDCD"><enum>(b)</enum><header>Assessment</header><text>In preparing the report under subsection (a), the Secretary should assess—</text>
<paragraph id="H2972F2EE1D2D461DA68D71F6691FE2C0"><enum>(1)</enum><text>the extent to which data should be centralized nationally in support of national planning and goals, what information should be aggregated regionally, and what information should be kept locally;</text></paragraph>
<paragraph id="H94A43F6BDA37474F857722FFCBE2E108"><enum>(2)</enum><text>the need for data standards;</text></paragraph>
<paragraph id="HD56688C7BB02479088DFD852EEA38538"><enum>(3)</enum><text>public and private data sources other than intelligent transportation system data sources (such as roadway characteristics inventories and incident information) that, combined with intelligent transportation system data, would enhance the utility of intelligent transportation system data to decisionmakers, and how these data sources can be merged; and</text></paragraph>
<paragraph id="HBA101536BE6D4A27A19D9DA2D8CCC6E9"><enum>(4)</enum><text>how to make data accessible to users.</text></paragraph></subsection>
<subsection id="H8D27057E235F4D0385BB008E2666754F"><enum>(c)</enum><header>Consultation</header><text>In developing the strategy under this section, the Secretary shall consult with the Bureau of Transportation Statistics and the advisory committee established under section 5203(h).</text></subsection>
<subsection id="HCF89DA6237C34E6DBAA6B0937DD45D72"><enum>(d)</enum><header>Report to Congress</header><text>Not later than 2 years after the date of the enactment of this subsection, the Secretary shall transmit to the Committee on Science and the Committee on Transportation and Infrastructure of the House of Representatives, and to the Committee on Environment and Public Works of the Senate, the report developed under this section.</text></subsection></section>
<section id="HBE46831BBA2145A983C54B006275D393"><enum>5205.</enum><header>National architecture and standards</header>
<subsection id="H15D1F25C268540589BE6DE83D006C76"><enum>(a)</enum><header>In General</header>
<paragraph id="H14DE230F94AB43949FA4D0769B5E2F1D"><enum>(1)</enum><header>Development, implementation, and maintenance</header><text>Consistent with section 12(d) of the National Technology Transfer and Advancement Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/15/272">15 U.S.C. 272</external-xref> note; 110 Stat. 783), the Secretary shall develop, implement, and maintain a national architecture and supporting standards and protocols to promote the widespread use and evaluation of intelligent transportation system technology as a component of the surface transportation systems of the United States.</text></paragraph>
<paragraph id="H816607E1D1E94C77BFAD09409396ACAA"><enum>(2)</enum><header>Goal</header><text>The goal of the national architecture and standards shall be to ensure, whenever it is appropriate, interoperability among, and efficiency of, intelligent transportation system technologies implemented throughout the United States.</text></paragraph>
<paragraph id="H4C8D6561672B4C54BD052792FCA42F50"><enum>(3)</enum><header>Use of standards development organizations</header><text>In carrying out this section, the Secretary may use the services of such standards development organizations as the Secretary determines to be appropriate.</text></paragraph>
<paragraph id="H2AF9AEC6086C426F8DFD83D85C069EB1"><enum>(4)</enum><header>Standard validation</header><text>The Secretary shall ensure that new standards promulgated for intelligent transportation system technologies that are funded by the Department are tested and validated, whenever it is appropriate, and shall ensure that the results of such testing and validation are made publicly available.</text></paragraph></subsection>
<subsection id="H8D68031B3EB94D1DA907EA2500E52072"><enum>(b)</enum><header>Provisional standards</header>
<paragraph id="HF56F9AB6DA484BE296C6ECCEEC934BF8"><enum>(1)</enum><header>In General</header><text>If the Secretary finds that the development or balloting of an intelligent transportation system standard jeopardizes the timely achievement of the objectives identified in subsection (a)(1) and (2), the Secretary may establish a provisional standard after consultation with affected parties, and using, to the extent practicable, the work product of appropriate standards development organizations.</text></paragraph>
<paragraph id="H442BE32166624967B6B6807527B37C7"><enum>(2)</enum><header>Period of effectiveness</header><text>A provisional standard established under paragraph (1) shall be published in the Federal Register and remain in effect until the appropriate standards development organization adopts and publishes a standard.</text></paragraph></subsection>
<subsection id="H025B09E0BAC24B309656DF15F87C9058"><enum>(c)</enum><header>Conformity with national architecture</header>
<paragraph id="H689AB50FB5B54F20834977097FDDCBA3"><enum>(1)</enum><header>In General</header><text>Except as provided in paragraphs (2) and (3), the Secretary shall ensure that intelligent transportation system projects carried out using funds made available from the Highway Trust Fund, including funds made available to deploy intelligent transportation system technologies, conform to the national architecture, applicable standards or provisional standards, and protocols developed under subsection (a).</text></paragraph>
<paragraph id="H6415175C1BBD4D35A692868C2500C5AC"><enum>(2)</enum><header>Secretary’s discretion</header><text>The Secretary may authorize exceptions to paragraph (1) for—</text>
<subparagraph id="H79D5D8C623FD42FAB889532D37D15258"><enum>(A)</enum><text>projects designed to achieve specific research and development objectives outlined in the National ITS Program Plan or the Surface Transportation Research and Development Strategic Plan developed under <external-xref legal-doc="usc" parsable-cite="usc/23/508">section 508</external-xref> of title 23, United States Code; or</text></subparagraph>
<subparagraph id="H584517908BD64BEDA935488608A5EE31"><enum>(B)</enum><text>the upgrade or expansion of an intelligent transportation system in existence on the date of enactment of the Transportation Equity Act for the 21st Century, if the Secretary determines that the upgrade or expansion—</text>
<clause id="H589FD0EB6BA14D39A239126850234711"><enum>(i)</enum><text>would not adversely affect the goals or purposes of this subtitle;</text></clause>
<clause id="H43B44E19141B4C06A99FC108AA66AA6F"><enum>(ii)</enum><text>is carried out before the end of the useful life of such system; and</text></clause>
<clause id="H119132B0067B4DA1803185B9DBDA00CB"><enum>(iii)</enum><text>is cost-effective as compared to alternatives that would meet the conformity requirement of paragraph (1).</text></clause></subparagraph></paragraph>
<paragraph id="H12ED12EFAB344134A7FB68D8E8FF2850"><enum>(3)</enum><header>Exceptions</header><text>Paragraph (1) shall not apply to funds used for operation or maintenance of an intelligent transportation system in existence on the date of enactment of the Transportation Equity Act for the 21st Century.</text></paragraph></subsection></section>
<section id="H57AFA5D20EAA4B46B96F18384C43644D"><enum>5206.</enum><header>Research and development</header>
<subsection id="H2302C3570F034BD6A8F4F6E67460057"><enum>(a)</enum><header>In General</header><text>The Secretary shall carry out a comprehensive program of research, development, and operational tests of intelligent vehicles and intelligent infrastructure systems, as well as research into barriers to their deployment, and other similar activities that are necessary to carry out this subtitle.</text></subsection>
<subsection id="H2834E28362934355822508A1FFB9CB11"><enum>(b)</enum><header>Priority areas</header><text>Under the program, the Secretary shall give higher priority to funding projects that—</text>
<paragraph id="HB733CC12643C4214ADD6736574FD79DF"><enum>(1)</enum><text>are aimed at reducing congestion and improving mobility and efficiency;</text></paragraph>
<paragraph id="H290259C8BF9747EF9002777403F03E01"><enum>(2)</enum><text>are aimed at improving safety;</text></paragraph>
<paragraph id="H4AEB78AFE552438D95E86678360718B"><enum>(3)</enum><text>are aimed at improving security by focusing on responding to security-related emergencies, and preventing such emergencies;</text></paragraph>
<paragraph id="H4D1C7BC8D6034D2AB9C8A1D2D1E4D2EE"><enum>(4)</enum><text>incorporate human factors research, including the science of the driving process;</text></paragraph>
<paragraph id="H19FBD9A3FAC6459C96BB9C00A6E63C7"><enum>(5)</enum><text>develop methods to address nontechnical barriers to the deployment of intelligent transportation system technologies, and the best ways to develop partnerships to successfully deploy intelligent transportation system technologies;</text></paragraph>
<paragraph id="H5174F91E357643FFB8B284A1A8687749"><enum>(6)</enum><text>facilitate the integration of intelligent infrastructure, vehicle, and control technologies;</text></paragraph>
<paragraph id="HC1A2C2870C6F4622B4D27EB0E60064A6"><enum>(7)</enum><text>incorporate research on the impact of environmental, weather, and natural conditions on intelligent transportation systems, including the effects of cold climates;</text></paragraph>
<paragraph id="HE3AB2709D20343B28FD596FAFE8219C3"><enum>(8)</enum><text>utilize interdisciplinary approaches to develop traffic management strategies and tools to address multiple impacts of congestion concurrently;</text></paragraph>
<paragraph id="HD21A71FDBF324ABA9CCD02BEF302AA5"><enum>(9)</enum><text>are aimed at improving the efficiency of goods movement, such as through real-time tracking and management; or</text></paragraph>
<paragraph id="HD613CE3D73CC4EC5B70083B190625894"><enum>(10)</enum><text>facilitate high-performance transportation systems, through methods such as congestion pricing, real-time facility management, rapid emergency response, and just-in-time transit.</text></paragraph></subsection>
<subsection id="H553C483CF1094CD880F976006C03E639"><enum>(c)</enum><header>Operational tests</header><text>Operational tests shall be used to evaluate promising technologies that have not yet been demonstrated. Operational tests conducted under this section shall be designed for the collection of data to permit objective evaluation of the results of the tests, derivation of cost-benefit information that is useful to others contemplating deployment of similar systems, and development and implementation of standards.</text></subsection>
<subsection id="H8F42690A9A5649BBB4F8B7F562410700"><enum>(d)</enum><header>Federal share</header><text>The Federal share of the cost of operational tests and demonstrations under subsection (a) shall not exceed 80 percent.</text></subsection></section>
<section id="H6C5B1F85703D441882EF089FF288D8F2"><enum>5207.</enum><header>Use of funds</header>
<subsection id="H129126EE604A4C9B8064A0C231F76874"><enum>(a)</enum><header>Congestion reduction</header><text>At least <fraction>1/3</fraction> of funds made available under section 5206 for intelligent transportation systems research and development shall be used to research, develop, and operationally test technologies whose primary purpose is to reduce congestion.</text></subsection>
<subsection id="H08FE9658D00D4FA299D36F82AC37B22F"><enum>(b)</enum><header>Outreach and public relations limitation</header>
<paragraph id="H510C0E8BB4CF401BB9DF4F956CC4F12D"><enum>(1)</enum><header>In General</header><text>For each fiscal year, not more than $5,000,000 of the funds made available to carry out this subtitle shall be used for intelligent transportation system outreach, public relations, displays, scholarships, tours, and brochures.</text></paragraph>
<paragraph id="H215F9207892E4ACEAB3D19D8BBCDB09C"><enum>(2)</enum><header>Applicability</header><text>Paragraph (1) shall not apply to intelligent transportation system training or the publication or distribution of research findings, technical guidance, or similar documents.</text></paragraph></subsection>
<subsection id="HEAC2B08A6C694335BEA675B9D1009E17"><enum>(c)</enum><header>Infrastructure development</header><text>Funds made available to carry out this subtitle for operational tests—</text>
<paragraph id="H21C681CF06D74A9B834C236438355B07"><enum>(1)</enum><text>shall be used primarily for the development of intelligent transportation system infrastructure; and</text></paragraph>
<paragraph id="H00825CB335ED43BAABF7F944002B40AF"><enum>(2)</enum><text>to the maximum extent practicable, shall not be used for the construction of physical highway and transit infrastructure unless the construction is incidental and critically necessary to the implementation of an intelligent transportation system project.</text></paragraph></subsection></section>
<section id="H16A63F8BAA294320A59200879461FD6D"><enum>5208.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle, the following definitions apply:</text>
<paragraph id="HEAECE9501FFA4A0E84F66BD3F1D7275"><enum>(1)</enum><header>Intelligent transportation infrastructure</header><text>The term <term>intelligent transportation infrastructure</term> means fully integrated public sector intelligent transportation system components, as defined by the Secretary.</text></paragraph>
<paragraph id="HFBF843F8EA1B43E8A0A21853F5A5B678"><enum>(2)</enum><header>Intelligent Transportation System</header><text>The term <term>intelligent transportation system</term> means electronics, communications, or information processing used singly or in combination to improve the efficiency or safety of a surface transportation system.</text></paragraph>
<paragraph id="HBAB0232E11104C2FA8F281ABFEE751DE"><enum>(3)</enum><header>National architecture</header><text>The term <term>national architecture</term> means the common framework for interoperability adopted by the Secretary that defines—</text>
<subparagraph id="H2ABC0814BBD84F05A11823F56EB1A371"><enum>(A)</enum><text>the functions associated with intelligent transportation system user services;</text></subparagraph>
<subparagraph id="H891672BA72054B1289258541DFD74C81"><enum>(B)</enum><text>the physical entities or subsystems within which the functions reside;</text></subparagraph>
<subparagraph id="H7B38C546420C4EDCA221D33FBB2C67D5"><enum>(C)</enum><text>the data interfaces and information flows between physical subsystems; and</text></subparagraph>
<subparagraph id="HC2A9F81DA7954E30AC8699407151E438"><enum>(D)</enum><text>the communications requirements associated with the information flows.</text></subparagraph></paragraph>
<paragraph id="H02D881389B8B479DBD5B23C3FE4BA2FC"><enum>(4)</enum><header>Standard</header><text>The term <term>standard</term> means a document that—</text>
<subparagraph id="HE657CFF96A5A462EB6F3AB31DDB6FB1B"><enum>(A)</enum><text>contains technical specifications or other precise criteria for intelligent transportation systems that are to be used consistently as rules, guidelines, or definitions of characteristics so as to ensure that materials, products, processes, and services are fit for their purposes; and</text></subparagraph>
<subparagraph id="H2EE4F8F384B54914B4E67CF09F1F0063"><enum>(B)</enum><text>may support the national architecture and promote—</text>
<clause id="HACCB687C6EF1405FB3F6CDA8F5013C1"><enum>(i)</enum><text>the widespread use and adoption of intelligent transportation system technology as a component of the surface transportation systems of the United States; and</text></clause>
<clause id="H4871315D2E764FD6B67724575DBA53B4"><enum>(ii)</enum><text>interoperability among intelligent transportation system technologies implemented throughout the States.</text></clause></subparagraph></paragraph>
<paragraph id="H2797A1E8FD5C4A75BECF64B304B57DD7"><enum>(5)</enum><header>State</header><text>The term <term>State</term> has the meaning given the term under <external-xref legal-doc="usc" parsable-cite="usc/23/101">section 101</external-xref> of title 23, United States Code.</text></paragraph></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="HCF013583BC9E4D659CB95876DA207CB"><enum>(b)</enum><header>Highway safety research and development</header><text>There are authorized to be appropriated from the Highway Trust Fund to the Secretary of Transportation to carry out <external-xref legal-doc="usc" parsable-cite="usc/23/403">section 403</external-xref> of title 23, United States Code, relating to research and development, such sums as may be necessary for each of the fiscal years 2005 through 2010.</text></subsection>

<section id="HD9C6AB46335D44AB8BE427E761848F91"><enum>202.</enum><header>Innovative Practices and Technologies Demonstration and Deployment Program</header>
<subsection id="H7887798DB4854DABA8B53DDC5D99693E"><enum>(a)</enum><header>Establishment</header><text>The Secretary of Transportation shall establish an Innovative Practices and Technologies Demonstration and Deployment Program.</text></subsection>
<subsection id="H559443641B074522A9932FA9DEB125FF"><enum>(b)</enum><header>Program goals</header><text>The goals of the program are to—</text>
<paragraph id="H189CD943CE64465380949D80BC519D89"><enum>(1)</enum><text>demonstrate promising new transit practices and technologies, including new business models for managing and operating transit systems, that may increase ridership, increase accessibility, reduce cost, improve customer satisfaction, and improve safety;</text></paragraph>
<paragraph id="HA31473D6880940E292107E6ECB00FEE9"><enum>(2)</enum><text>evaluate, refine, and document the performance, benefits, and costs of innovative transit practices and technologies; and</text></paragraph>
<paragraph id="H961C675D2CB04EEA915DAF39003D3532"><enum>(3)</enum><text>effectively disseminate information to accelerate deployment of innovative transit practices and technologies.</text></paragraph></subsection>
<subsection id="H0960DA47842C4554A4105411CE46A6B2"><enum>(c)</enum><header>Grants, cooperative agreements, and contracts</header><text>The Secretary may make grants to, or enter into cooperative agreements or contracts with, transit agencies, States, other Federal agencies, universities and colleges, private sector entities, and nonprofit organizations to pay the Federal share of the cost of demonstration and deployment projects concerning innovative practices and technologies.</text></subsection>
<subsection id="H0EAE4A90E26449F19D1DB0222DBDBBDA"><enum>(d)</enum><header>Applications</header><text>To receive a grant, cooperative agreement, or contract under this section, an entity described in subsection (c) shall submit an application to the Secretary. The application shall be in such form and contain such information as the Secretary may require. The Secretary shall select and approve the applications through an open competition based on the following criteria:</text>
<paragraph id="HEE32ADE398DA469A85D7CADC864EBA25"><enum>(1)</enum><text>Whether the project meets the goals of the program.</text></paragraph>
<paragraph id="H235B4EC24CA141B0B7FD70B172346382"><enum>(2)</enum><text>Peer review of the proposal.</text></paragraph>
<paragraph id="HED7349AD514C48558973345E7401D200"><enum>(3)</enum><text>The likelihood that the project will result in more widespread deployment of the practice or technology being proposed.</text></paragraph>
<paragraph id="H875177D9B26E49AB8180FF7663692959"><enum>(4)</enum><text>Preference shall be given to an application that represents a public-private partnership.</text></paragraph></subsection>
<subsection id="HBD54C61B6DCA4C0CB0E8805B5488F4CC"><enum>(e)</enum><header>Technology and information transfer</header><text>The Secretary shall ensure that information about innovative practices and technologies supported under this section is made available to transit agencies, State and local transportation departments, and other interested parties. Information disseminated under this subsection shall include both the costs and benefits of deploying an innovative practice or technology, and shall document—</text>
<paragraph id="H3F190950AB5243008007ADE4C663D76"><enum>(1)</enum><text>best practices for adopting successful practices or technologies; and</text></paragraph>
<paragraph id="H95A4A4433A4544AC8DA2C4E67C207680"><enum>(2)</enum><text>the transferability of these practices and technologies.</text></paragraph></subsection>
<subsection id="HA611B48EFC55470AA054E2F5E3D8D24"><enum>(f)</enum><header>Federal share</header><text>The Federal share of the cost of a project under this section shall be determined by the Secretary.</text></subsection></section>
<section id="HDB5760590C194EA885F1A731984D8D82"><enum>203.</enum><header>National Transit Institute</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/5315">Section 5315</external-xref> of title 49, United States Code, is amended—</text>

<subparagraph id="H1F77DBAF60BA46A7A2BAAEA7A024C3C6"><enum>(A)</enum><text>to conduct competent research and development and investigations into the theoretical or practical problems of urban transportation; and</text></subparagraph>
<subparagraph id="H121F2EF05E844DA2BED47EA1D2504E9C"><enum>(B)</enum><text>to train individuals to conduct further research and development or obtain employment in an organization that plans, builds, operates, or manages an urban transportation system.</text></subparagraph></paragraph>
<paragraph id="H99C64BA97C08486E9650DB9CA723FFE4"><enum>(2)</enum><text>Research and investigations under this subsection include—</text>
<subparagraph id="H3BFA9472E863498EB6A13056E2C21F72"><enum>(A)</enum><text>the design and use of urban public transportation systems and urban roads and highways;</text></subparagraph>
<subparagraph id="H917440A241954182B362C7CF1ED13E10"><enum>(B)</enum><text>the interrelationship between various modes of urban and interurban transportation;</text></subparagraph>
<subparagraph id="H7061F4C703CE45A298688CE3B2E072F0"><enum>(C)</enum><text>the role of transportation planning in overall urban planning;</text></subparagraph>
<subparagraph id="H94C844A732234FC5A862DCA1F79C379D"><enum>(D)</enum><text>public preferences in transportation;</text></subparagraph>
<subparagraph id="H552E39A66998428C9F4B84BF3F10D2EF"><enum>(E)</enum><text>the economic allocation of transportation resources; and</text></subparagraph>
<subparagraph id="HFFF96C617D69476AA93F2CCC059FDA8D"><enum>(F)</enum><text>the legal, financial, engineering, and esthetic aspects of urban transportation.</text></subparagraph></paragraph>
<paragraph id="HC305B6548FBB442CAB002F06F1FB647D"><enum>(3)</enum><text>When making a grant under this subsection, the Secretary shall give preference to an institution that brings together knowledge and expertise in the various social science and technical disciplines related to urban transportation problems.</text></paragraph></subsection>
<subsection id="HCDA05CFA6F6848AD8CB9D9B0867005B7"><enum>(c)</enum><header>Fellowships</header>
<paragraph id="H7EBFB00B98A14AEC914405DC69079550"><enum>(1)</enum><text>The Secretary may make grants to States, local governmental authorities, and operators of public transportation systems to provide fellowships to train personnel employed in managerial, technical, and professional positions in the mass transportation field.</text></paragraph>
<paragraph id="H26C6137450FA402D8437C4B3FF41921B"><enum>(2)</enum><text>A fellowship under this subsection may be for not more than one year of training in an institution that offers a program applicable to the public transportation industry. The recipient of the grant shall select an individual on the basis of demonstrated ability and for the contribution the individual reasonably can be expected to make to an efficient public transportation operation. A grant for a fellowship may not be more than the lesser of $65,000 or 75 percent of—</text>
<subparagraph id="HE69A582AC05E4FE0BBD88CCA676B33C0"><enum>(A)</enum><text>tuition and other charges to the fellowship recipient;</text></subparagraph>
<subparagraph id="HF2007A826BDC479ABB2CE0F91E22CA4"><enum>(B)</enum><text>additional costs incurred by the training institution and billed to the grant recipient; and</text></subparagraph>
<subparagraph id="H902C03474D8B43499767C47BA96005AA"><enum>(C)</enum><text>the regular salary of the fellowship recipient for the period of the fellowship to the extent the salary is actually paid or reimbursed by the grant recipient.</text></subparagraph></paragraph></subsection>
<subsection id="H71A7EB5A2C52479F837DA53BF6BBA9C2"><enum>(d)</enum><header>Other grants</header><text>The Secretary may make grants to State and local governmental authorities for projects that will use innovative techniques and methods in managing and providing public transportation.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
<section id="HF3197EFCAB194805A2C8CEAFC690096"><enum>205.</enum><header>Highway safety research and development</header><text display-inline="no-display-inline">Section 403(a) (Authority of the Secretary) of title 23, United States Code, is amended by adding the following paragraphs at the end:</text>

<paragraph id="H902CD220D4E3452ABB7FD29789D6237B"><enum>(4)</enum><header>Emergency medical services</header><text>In addition to the authority provided under this subsection, the Secretary is authorized to use funds appropriated to carry out this section to enhance coordination among Federal agencies involved with State, local, tribal, and community-based emergency medical services. In exercising this authority, the Secretary may coordinate with State and local governments, the Bureau of Indian Affairs on behalf of Indian tribes, private industry, and other interested parties; collect and exchange emergency medical services data and information; examine emergency medical services needs, best practices, and related technology; and develop emergency medical services standards and guidelines, and plans for the assessment of emergency medical services systems.</text></paragraph>
<paragraph id="H4A4C502018624DD592684E1663BFCF52"><enum>(5)</enum><header>International cooperation</header><text>In addition to the authority provided under this subsection, the Secretary is authorized to use funds appropriated to carry out this section to participate and cooperate in international activities to enhance highway safety by such means as exchanging safety information; conducting safety research and development; and examining safety needs, best practices, and new technology.</text></paragraph>
<paragraph id="HD576F73A577F4171ADD7900A2E722C"><enum>(6)</enum><header>National motor vehicle crash causation survey</header><text>In addition to the authority provided under this subsection, the Secretary is authorized to use funds appropriated to carry out this section to develop and conduct a nationally representative survey to collect on-scene motor vehicle crash causation data.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H8E7C87395D3D4822BD5DC6A794B460E"><enum>206.</enum><header>Motor carrier research and development program</header>
<subsection id="H7B7E9B3BE4DE44499E8ECE23A41C8EF3"><enum>(a)</enum><header>In General</header><text>Title 49, United States Code, is amended by repealing section 31108 and inserting the following new section, to read as follows:</text>

<subsection id="HB9E099C0FDC44448AD4900C2E3CA445"><enum>(a)</enum><header>Research, development, and technology transfer activities</header>
<paragraph id="H475952F7E2D64088B789FD68D45320CA"><enum>(1)</enum><text>The Secretary of Transportation shall establish and carry out a motor carrier research and development program. The Secretary may carry out research, development, technology, and technology transfer activities with respect to—</text>
<subparagraph id="HDFE035352C8B493F84074680EA38D7D"><enum>(A)</enum><text>the causes of accidents, injuries and fatalities involving commercial motor vehicles; and</text></subparagraph>
<subparagraph id="H9D26C29447684947AF644E1B61B892C9"><enum>(B)</enum><text>means of reducing the number and severity of accidents, injuries and fatalities involving commercial motor vehicles.</text></subparagraph></paragraph>
<paragraph id="HACD2FC92534249758215B14346854D0"><enum>(2)</enum><text>The Secretary may test, develop, or assist in testing and developing any material, invention, patented article, or process related to the research and development program.</text></paragraph>
<paragraph id="HFBB653C23DA64A509737BB62789799B2"><enum>(3)</enum><text>The Secretary may use the funds appropriated to carry out this section for training or education of commercial motor vehicle safety personnel, including, but not limited to, training in accident reconstruction and detection of controlled substances or other contraband, and stolen cargo or vehicles.</text></paragraph>
<paragraph id="H163E8D8200774BB49E6E37E2827CCF55"><enum>(4)</enum><text>The Secretary may carry out this section—</text>
<subparagraph id="HD0DBB51E66C347E1A238DF7E401B50FD"><enum>(A)</enum><text>independently;</text></subparagraph>
<subparagraph id="H3FD9947F119142ADA9BDC7856ED4E708"><enum>(B)</enum><text>in cooperation with other Federal departments, agencies, and instrumentalities and federally funded research and development centers; or</text></subparagraph>
<subparagraph id="HD7581EA401464D70A11E3FCB031CE170"><enum>(C)</enum><text>by making grants to, or entering into contracts or cooperative agreements with, any federally funded research and development center, State agency, authority, association, institution, for-profit or non-profit corporation, organization, foreign country, or person.</text></subparagraph></paragraph>
<paragraph id="H76E6B87D22094D32BF42455D79666729"><enum>(5)</enum><text>The Secretary shall use funds made available to carry out this section to develop, administer, communicate, and promote the use of products of research, technology, and technology transfer programs under this section.</text></paragraph></subsection>
<subsection id="HB2DDAFB8DDD54436AE814392EF343551"><enum>(b)</enum><header>Collaborative research and development</header>
<paragraph id="HA56667E4E5344500889DD9F1C15599F6"><enum>(1)</enum><text>To advance innovative solutions to problems involving commercial motor vehicle and motor carrier safety, security, and efficiency, and to stimulate the deployment of emerging technology, the Secretary may carry out, on a cost-shared basis, collaborative research and development with—</text>
<subparagraph id="H0C4EA740B6974C6FBC39EE8467D95527"><enum>(A)</enum><text>non-Federal entities, including State and local governments, foreign governments, colleges and universities, corporations, institutions, partnerships, and sole proprietorships that are incorporated or established under the laws of any State; and</text></subparagraph>
<subparagraph id="H529A6BDE65E741F68E00EA9739A04DC3"><enum>(B)</enum><text>federally funded research and development centers.</text></subparagraph></paragraph>
<paragraph id="H32156722034749A6A1F632B6682DB61C"><enum>(2)</enum><text>In carrying out this subsection, the Secretary may enter into cooperative research and development agreements (as defined in section 12 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3710a">15 U.S.C. 3710a</external-xref>)).</text></paragraph>
<paragraph id="H05F952F003424A13AF49387766828686"><enum>(3)</enum><text>(A) The Federal share of the cost of activities carried out under a cooperative research and development agreement entered into under this subsection shall not exceed 50 percent, except that if there is substantial public interest or benefit, the Secretary may approve a greater Federal share.</text>
<subparagraph indent="up1" id="H9E57A4195A8649479D00613DDDF33233"><enum>(B)</enum><text>All costs directly incurred by the non-Federal partners, including personnel, travel, and hardware or software development costs, shall be credited toward the non-Federal share of the cost of the activities described in subparagraph (A).</text></subparagraph></paragraph>
<paragraph id="HF992DA1698F14F32AD00D81D5500B8EB"><enum>(4)</enum><text>The research, development, or use of a technology under a cooperative research and development agreement entered into under this subsection, including the terms under which the technology may be licensed and the resulting royalties may be distributed, shall be subject to the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3701">15 U.S.C. 3701 et seq.</external-xref>).</text></paragraph>
<paragraph id="HFE1DF178F82446878200F024C2557565"><enum>(5)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/41/3705">Section 3705</external-xref> of title 41, United States Code, shall not apply to a contract or agreement entered into under this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H8AD43FEEDA074A7883AD61CD33DDB8C2"><enum>(b)</enum><header>Conforming amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/311">chapter 311</external-xref> of title 49, United States Code, is amended by revising the item relating to section 31108 to read as follows:</text>

<subsection id="HFDCE0503A7B344068BF8A8E3BE001B70"><enum>(a)</enum><header>In General</header><text>As part of the National Climate Change Technology Initiative and the Climate Change Research Initiative, the Secretary shall establish and carry out a multimodal energy and climate change program to study the relationship of transportation, energy, and climate change.</text></subsection>
<subsection id="HA1F22E76BD7B402D8E54501C13597E65"><enum>(b)</enum><header>Contents</header><text>The program to be carried out under this section shall include, but not be limited to, research and development designed to—</text>
<paragraph id="HCA12B8BA3D544A709027AD5C16A21E99"><enum>(1)</enum><text>identify, develop and evaluate strategies to improve energy efficiency and reduce greenhouse gas emissions from transportation sources; and</text></paragraph>
<paragraph id="H33D6F50C02CC4F12A145A61FE80000CE"><enum>(2)</enum><text>identify and evaluate the potential effects of climate changes on the Nation’s transportation systems, and strategies to address these effects.</text></paragraph></subsection>
<subsection id="HFB0F6CC2FCA34850B2F39DEC05B3D9E"><enum>(c)</enum><header>Project selection</header><text>Activities to be undertaken in this program will be determined by an internal steering committee established by the Secretary of Transportation. This intermodal committee shall include representatives from the Office of the Secretary and operating administrations within the Department of Transportation as designated by the Secretary.</text></subsection>
<subsection id="HDA3E3599BB0E44A58BBDB9EB7D492E4"><enum>(d)</enum><header>Grants, cooperative agreements and contracts</header><text>The Secretary may carry out this program independently or by making grants to, or entering into contracts and cooperative agreements with, a Federal agency, State agency, local agency, authority, association, nonprofit or for-profit corporation, or institution of higher education.</text></subsection>
<subsection id="H6714EED5DECE441389036D8C8D8D53AD"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section, from the Highway Trust Fund and the Airport and Airway Trust Fund, such sums as may be necessary for each of fiscal years 2005 through 2010.</text></subsection></section>
<section id="H5B87CAE54B844AFDB6ED10002748669C"><enum>208.</enum><header>National cooperative freight transportation research and development program</header>
<subsection id="H52FB1E0C26DF49D180668DDB44B131C0"><enum>(a)</enum><header>In General</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/5">Chapter 5</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text>

<section id="HD7922B0D5540437393D574E42BDDD1D6"><enum>510.</enum><header>National cooperative freight transportation research and development program</header>
<subsection id="H00776B81782B47689EF97C05E2A6B725"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish and support a national cooperative freight transportation research and development program. The program shall focus on all forms of freight transportation, including trucking and rail.</text></subsection>
<subsection id="H7315BAE50A74469FADEF81004E945334"><enum>(b)</enum><header>Agreement</header><text>The Secretary shall enter into an arrangement with the National Research Council to support and carry out administrative and management activities relating to the governance of the national cooperative freight transportation research and development program.</text></subsection>
<subsection id="HDF79F546F41C46A09B4345A2F179A73"><enum>(c)</enum><header>Advisory Committee</header><text>The National Research Council shall select an advisory committee consisting of a representative cross-section of freight stakeholders, including the Department of Transportation, other Federal agencies, State transportation departments, local governments, the American Association of State Highway and Transportation Officials and other nonprofit entities (including environmental groups), academia, and the private sector.</text></subsection>
<subsection id="HF3E0C013EA9E417D9EC2095516A2CAE0"><enum>(d)</enum><header>Governance</header><text>The national cooperative freight transportation research and development program established under this section shall include the following administrative and management elements:</text>
<paragraph id="H4B71AF06977E4B059707244427DB1124"><enum>(1)</enum><header>National research and development agenda</header><text>The advisory committee, in consultation with stakeholders, shall recommend a national research and development agenda for the national cooperative freight transportation research and development program. The national research and development agenda shall include a multi-year strategic plan.</text></paragraph>
<paragraph id="H9A775ACD19C94ADD968EAE91CD6BA959"><enum>(2)</enum><header>Stakeholder involvement</header><text>Stakeholders may—</text>
<subparagraph id="HA108204A36E545CFB7269890A4A1EBA"><enum>(A)</enum><text>submit research and development proposals to the advisory committee;</text></subparagraph>
<subparagraph id="H4F7CDFE37D4647F0B64EBEAA74D75B39"><enum>(B)</enum><text>participate in merit reviews of research and development proposals and peer reviews of research and development products; and</text></subparagraph>
<subparagraph id="H1EDD297C7B0B474C8DA610B599A64921"><enum>(C)</enum><text>receive research and development results.</text></subparagraph></paragraph>
<paragraph id="H8823695B3CCE47DFB4A4CD15AD9C1252"><enum>(3)</enum><header>Open competition and peer review of research and development proposals</header><text>The National Research Council shall award research and development contracts and grants through open competition and peer review conducted on a regular basis.</text></paragraph>
<paragraph id="HECEB62B06C924509832C5FFF00882065"><enum>(4)</enum><header>Evaluation of research</header>
<subparagraph id="HA30BEF707AB14BFBAD006CF3B211F06"><enum>(A)</enum><header>Peer review</header><text>Research and development contracts and grants shall allow peer review of the research and development results.</text></subparagraph>
<subparagraph id="H1548ED23A469419B9835EA0664E04C6C"><enum>(B)</enum><header>Programmatic evaluations</header><text>The National Research Council may conduct periodic programmatic evaluations on a regular basis.</text></subparagraph></paragraph>
<paragraph id="HE38CB99B9C9E4352AB0486CDE5B346C8"><enum>(5)</enum><header>Dissemination of research findings</header><text>The National Research Council shall disseminate research and development findings to researchers, practitioners, and decisionmakers.</text></paragraph></subsection>
<subsection id="HA8A2488118F642BDA823F439D6BCD89"><enum>(e)</enum><header>Contents</header><text>The national research and development agenda for the national cooperative freight transportation research and development program required under subsection (d)(1) may include research and development in the following areas:</text>
<paragraph id="H7453D8F31B924520A7005F1E80608C5B"><enum>(1)</enum><text>Techniques for estimating and quantifying public benefits derived from freight transportation projects.</text></paragraph>
<paragraph id="H47F5E2E30F354C13A800A7C833FDF536"><enum>(2)</enum><text>Alternative approaches to calculating the contribution of truck traffic to congestion on specific highway segments.</text></paragraph>
<paragraph id="H63F8A950BA79435681DD374CF196DCD1"><enum>(3)</enum><text>The feasibility of freight villages as a means of consolidating origins and destinations for freight movement.</text></paragraph>
<paragraph id="H6752F815E4814BF3A55970AC4CBB9CB0"><enum>(4)</enum><text>Methods for incorporating estimates of international trade into landside transportation planning.</text></paragraph>
<paragraph id="H58ABBC4D2DFF4939B59DAC5E51FC963D"><enum>(5)</enum><text>The use of technology applications to increase capacity of highway lanes dedicated to truck-only traffic.</text></paragraph>
<paragraph id="H15644EC567C341FDBC7914A62674235C"><enum>(6)</enum><text>Development of physical and policy alternatives for separating car and truck traffic.</text></paragraph>
<paragraph id="HC3595C9D9273436BA59956EDE5376F16"><enum>(7)</enum><text>Ways to synchronize infrastructure improvements with freight transportation demand.</text></paragraph>
<paragraph id="H9E9753FEA7E446FE8B81C90089F7BCDB"><enum>(8)</enum><text>Additional priorities to identify and address the emerging and future research and development needs related to freight transportation.</text></paragraph></subsection>
<subsection id="H604BC442412A4066926000A3F209EE89"><enum>(f)</enum><header>Funding</header>
<paragraph id="HEB93B44785A940E89BF413E4FC4646FD"><enum>(1)</enum><header>Federal share</header><text>The Federal share of the cost of an activity carried out using such funds shall be up to 100 percent, and such funds shall remain available until expended.</text></paragraph>
<paragraph id="HD849FFA6F0244B47B23272DD00CE9224"><enum>(2)</enum><header>Use of non-federal funds</header><text>In addition to using funds authorized for this section, the National Research Council may seek and accept additional funding sources from public and private entities capable of accepting funding from the United States Department of Transportation (Federal Highway Administration, Federal Transit Administration, Federal Railroad Administration, Research and Special Programs Administration, and the National Highway Traffic Safety Administration), states, local governments, nonprofit foundations, and the private sector.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<section id="H844FAC10E68045D5AE6FA800DB5A8E0"><enum>209.</enum><header>Next Generation National Transportation Policy Study Commission</header>
<subsection id="H70FD1B71C9F1495BA88EB0725932C717"><enum>(a)</enum><header>Establishment of Commission</header>
<paragraph display-inline="yes-display-inline" id="HEF0DECF7F1604217B53030AFB718F1D"><enum>(1)</enum><text>The President shall established a Commission to be known as the Next Generation National Transportation Policy Study Commission, in this section referred to as the <quote>Commission</quote>.</text></paragraph>
<paragraph indent="up1" id="H7C6278B4438A43558987D81FAB985CDE"><enum>(2)</enum><text>The Commission shall make a full and complete investigation and study of the transportation needs and of the resources, requirements, and policies of the United States to meet such expected needs. It shall take into consideration all reports on national transportation policy which have been submitted to Congress in the last decade, including all reports referenced in the Intermodal Surface Transportation Efficiency Act of 1991 and the Transportation Equity Act for the 21st Century. It shall also take into consideration the changes in global trade and its impact on the Nation’s economy. It shall evaluate the relative merits of all modes of transportation in meeting our Nation’s transportation needs. It shall take into account the link between transportation and the natural environment. Based on such study, it shall recommend changes to existing policies and any new policies that are most likely to ensure that adequate multimodal transportation systems are in place which will meet the needs for a safe and efficient movement of people and goods and also support and grow the national economy.</text></paragraph></subsection>
<subsection id="H012C9CD8195A48389CD3A64F107C46E"><enum>(b)</enum><header>Membership</header><text>The Commission shall be comprised of 16 members appointed by the President from among individuals who are knowledgeable in transportation activities, including individuals representing State and local governments, metropolitan planning organizations, transportation-related industries, academic and technical institutions, and public interest organizations involved with scientific, regulatory, economic, and environmental transportation activities. The membership of the Commission shall be balanced geographically to the extent consistent with maintaining the highest level of expertise on the Commission. Members shall be appointed for the life of the Commission as follows:</text>
<paragraph id="HFA7F06CC23544C41BFCE4596CEDCDAB"><enum>(1)</enum><text>4 shall be appointed from a list of 8 individuals who shall be recommended by the majority leader of the Senate in consultation with the Chairman of the Committee on Environment and Public Works, and the Chairman of the Committee on Commerce, Science and Transportation, and the Chairman of the Committee on Banking, Housing and Urban Affairs of the Senate.</text></paragraph>
<paragraph id="HAA349F2CE9774809A5D5CCE3766C9638"><enum>(2)</enum><text>4 shall be appointed from a list of 8 individuals who shall be recommended by the minority leader of the Senate in consultation with the ranking member of the Committee on Environment and Public Works, the ranking member of the Committee on Commerce, Science and Transportation, and the ranking member of the Committee on Banking, Housing and Urban Affairs of the Senate.</text></paragraph>
<paragraph id="H708F6BC692F64853A54580EB86B3FC80"><enum>(3)</enum><text>4 shall be appointed from a list of 8 individuals who shall be recommended by the Speaker of the House of Representatives in consultation with the Chairman of the Committee on Transportation and Infrastructure, the Chairman of the Committee on Energy and Commerce, and the Chairman of the Committee on Science of the House of Representatives.</text></paragraph>
<paragraph id="H5801351BB1E74693BAE6DB006581212B"><enum>(4)</enum><text>4 shall be appointed from a list of 8 individuals who shall be recommended by the minority leader of the House of Representatives in consultation with the ranking member of the Committee on Transportation and Infrastructure, the ranking member of the Committee on Energy and Commerce, and the ranking member of the Committee on Science of the House of Representatives.</text></paragraph>
<paragraph id="H353840DD7225420FAA38AC0036CFC472"><enum>(5)</enum><text>Any vacancy which may occur on the Commission shall not affect its powers or functions but shall be filled in the same manner in which the original appointment was made.</text></paragraph></subsection>
<subsection id="HC9772C89C6B44ABDB859EE7426E74162"><enum>(c)</enum><header>Final report</header><text>The Commission shall not later than December 31, 2007, submit to the President and Congress its final report including its findings and recommendations. The Commission shall cease to exist six months after submission of such report. All records and papers of the Commission shall thereupon be delivered to the Archivist of the United States for deposit in the Archives of the United States.</text></subsection>
<subsection id="H4320758EC0DF482EBF610080F0FA1E2B"><enum>(d)</enum><header>Findings and recommendations</header><text>The final report shall include the Commission’s findings and recommendations with respect to the following:</text>
<paragraph id="H241AB85F395C4485BACA1743B3F9835F"><enum>(1)</enum><text>The Nation’s transportation needs, both national and regional, through the year 2025.</text></paragraph>
<paragraph id="H4440992ABF3F43FF89CECA967D9CA1D9"><enum>(2)</enum><text>The ability of our current transportation systems to meet the projected needs.</text></paragraph>
<paragraph id="HA2AFCF8000BC4E26AD8400D5FD608F03"><enum>(3)</enum><text>The proper mix of transportation modes and necessary linkages between modes to meet anticipated needs.</text></paragraph>
<paragraph id="H4E6D0A5BDFA7417B8837ED86026BD55"><enum>(4)</enum><text>Necessary measures and policies to ensure enhancement and protection of the natural environment in transportation decisionmaking.</text></paragraph>
<paragraph id="H67CCD6F74BD0441100C08DDA16BC002B"><enum>(5)</enum><text>Short-term, medium-term, and long-term research, development, and deployment to meet expected needs.</text></paragraph>
<paragraph id="HDDCC1E80890B4FE0BE8100FD621067A8"><enum>(6)</enum><text>The roles of the public and private sectors relative to each mode and the balance between public and private investment.</text></paragraph>
<paragraph id="H4717AB2D7CAC49B2A8DEA7D6D7E21037"><enum>(7)</enum><text>The existing policies and programs of the Federal Government which affect the development of our national transportation system.</text></paragraph>
<paragraph id="H46E7144DF6E0473A969E5FCFF060EC6D"><enum>(8)</enum><text>The new policies required to develop a balanced national transportation system which meets projected needs, accommodates international trade and supports the national economy.</text></paragraph>
<paragraph id="H4F55B54AED364CBAB73F54AB58FB236E"><enum>(9)</enum><text>The adequacy of existing methods to finance transportation and alternative new methods of financing.</text></paragraph></subsection>
<subsection id="H9A49134E5C3C4167945C6705ED091797"><enum>(e)</enum><header>Specific factors to consider</header><text>In developing its findings and recommendations, the Commission shall address the following specific factors:</text>
<paragraph id="HD1416572D80E472EA9908B59FF45E703"><enum>(1)</enum><text>The role of transportation as a critical link to the global economy and trade.</text></paragraph>
<paragraph id="HB8F6CB715ED944A5A2F23CCB75DCC9E"><enum>(2)</enum><text>A balance between the transportation of people and goods.</text></paragraph>
<paragraph id="H6CDB36C77986485199CA252C67000FC"><enum>(3)</enum><text>Improving operations and management of the transportation system to improve efficiency, including asset and information management.</text></paragraph>
<paragraph id="H6D39707CD57A4DE1AED18CA27709AD1C"><enum>(4)</enum><text>The need to address aging infrastructure.</text></paragraph>
<paragraph id="H80269BA7D3DD453E9B6F021746648D00"><enum>(5)</enum><text>The need to address the enhancement and protection of the natural environment.</text></paragraph>
<paragraph id="HA50FD526266048F1A0194E1500C74D86"><enum>(6)</enum><text>The need to address congestion in all modes.</text></paragraph>

<subsection id="H793DF47738B946BB933630427B9E9923"><enum>(f)</enum><header>Recommendations on the roles of Government</header><text>The Commission shall also make recommendations on the roles of the Federal and State governments in—</text>
<paragraph id="H45055889C0014C66BF2205A33EB4BE0"><enum>(1)</enum><text>environmental review of transportation projects;</text></paragraph>
<paragraph id="HE363EBEBEC164C4B81EE50826E39573E"><enum>(2)</enum><text>the provision of intercity passenger rail services;</text></paragraph>
<paragraph id="H202E53BC5825481091E76F205ED4DF77"><enum>(3)</enum><text>financing transportation at international border crossings;</text></paragraph>
<paragraph id="H32CFB70424394DAB8ECA3F30378E3E5E"><enum>(4)</enum><text>facilitating international goods movement to, from and within the United States;</text></paragraph>
<paragraph id="HEF7ABB73FD1E4946928C03C1BC786C6B"><enum>(5)</enum><text>ensuring consistency in data and communications links for and between all modes;</text></paragraph>
<paragraph id="H19E1B422BB1C4862B3136BDA6EBE894"><enum>(6)</enum><text>financing for each mode of transportation; and</text></paragraph>
<paragraph id="HBF261C25EA944EC79306AB8B83A83596"><enum>(7)</enum><text>effectively using transportation networks to enhance the quality of life, protect natural resources and promote sustainable economic growth.</text></paragraph></subsection>
<subsection id="H34A0D403A8D44A4E84F11821FABF1282"><enum>(g)</enum><header>Participation in Commission activities</header>
<paragraph id="HAD557824CCDA4C75B5630079C1B177BE"><enum>(1)</enum><header>Participation of Federal agencies</header><text>The Chairman of the Commission shall request the head of each Federal department or agency with an interest in or a responsibility for national transportation policy to appoint a liaison who shall work closely with the Committee and its staff. Such departments and agencies shall include, but not be limited to, the Department of Transportation, and each of its modal administrations, Office of Management and Budget, Department of Energy, Department of Homeland Security, Environmental Protection Agency, Department of Health and Human Services, Department of Commerce, Department of the Treasury, Department of Defense, Department of Agriculture, National Transportation Safety Board, Surface Transportation Board, and Army Corps of Engineers.</text></paragraph>
<paragraph id="H1977AD1F3EDC499F94B2985795C5026"><enum>(2)</enum><header>Advice from public and private organizations</header><text>In carrying out its duties, the Commission shall seek the advice of various groups interested in national transportation policy including State and local governments, public and private organizations in the fields of transportation and safety, business, education, environment and labor, and the public.</text></paragraph></subsection>
<subsection id="HDCE8838AAF844EA09C184867E78C381C"><enum>(h)</enum><header>Hearings</header><text>The Commission or, on the authorization of the Commission, any Committee of two or more members may, for the purpose of carrying out the provisions of this section, hold such hearings at such times and places as the Commission or such authorized committee may deem advisable.</text></subsection>
<subsection id="H90E340972C5F479D9E011B7043DD56B5"><enum>(i)</enum><header>Compensation</header><text>Members of Congress or other governmental employees shall serve without compensation, but shall be reimbursed for travel, per diem in accordance of the rules of the House of Representatives and Senate, accordingly, or subsistence and other necessary expenses incurred in the performance of the duties vested in the Commission.</text></subsection>
<subsection id="HF634AF4C904D48449663A25CCC61C5C7"><enum>(j)</enum><header>Commission staff</header><text>The Commission is authorized to appoint and fix the compensation of a staff director and such additional personnel as may be necessary to enable it to carry out its functions.</text></subsection>
<subsection id="HDEA653426C9F4EADB1046E9EE9CF734D"><enum>(k)</enum><header>Contracts</header><text>The Commission is authorized to enter into contracts or agreements for studies and surveys with public and private organizations and, if necessary, to transfer funds to Federal agencies from sums appropriated pursuant to this section to carry out such of its duties as the Commission determines can best be carried our in the that manner.</text></subsection>
<subsection id="H4AA498D8F8F746D9AFCDE1926321F49F"><enum>(l)</enum><header>Authorization of appropriations</header>
<paragraph display-inline="yes-display-inline" id="H2FFC087B637C4E48AF0000ACC6734359"><enum>(1)</enum><text>There are authorized to be appropriated from the Highway Trust Fund to carry out this section such sums as may be necessary for each of fiscal years 2005 and 2006.</text></paragraph>
<paragraph indent="up1" id="H972387AAE8ED42E2009D6BC21E8900BF"><enum>(2)</enum><text>Funds authorized by this subsection shall remain available until expended.</text></paragraph></subsection></section>
<section id="H06F1B6B870F14C378ED36C67C65B9E2D"><enum>210.</enum><header>Real-time system management information program</header>
<subsection id="H142305DC82354F779780EF38F7D5B898"><enum>(a)</enum><header>Goals and purposes</header>
<paragraph id="HAD9E5614E2474DC9BBE7FAA1792389F"><enum>(1)</enum><header>Goals</header><text>The goals of the real-time system management information program are to provide the nationwide capability to monitor, in real-time, the traffic and travel conditions of our Nation’s major highways and to widely share that information to improve the security of the surface transportation system, address congestion problems, support improved response to weather events, and facilitate national and regional traveler information.</text></paragraph>
<paragraph id="H5424387456C5406280A38BA1164DB0D1"><enum>(2)</enum><header>Purposes</header><text>The purposes of the real-time system management information program are to—</text>
<subparagraph id="H6953795171424FF3A6C3E3B7ABA5DBFE"><enum>(A)</enum><text>establish a nationwide system of basic real-time information for managing and operating our surface transportation system;</text></subparagraph>
<subparagraph id="H6DC69DA92CA64E5AB871C500A922EB02"><enum>(B)</enum><text>identify longer range real-time highway and transit monitoring needs and develop plans and strategies for meeting those needs; and</text></subparagraph>
<subparagraph id="HC5ACA367AAC04F72BACC01FE1FCA037F"><enum>(C)</enum><text>provide the capability and means to share that data with state and local governments, and the traveling public.</text></subparagraph></paragraph></subsection>
<subsection id="H288CE10ED90D42A8936B82743299C2C2"><enum>(b)</enum><header>Data exchange formats</header><text>Within one year of enactment of this Act, the Secretary shall establish data exchange formats to ensure that the data provided by highway and transit monitoring systems, including statewide incident reporting systems can readily be exchanged across jurisdictional boundaries, facilitating nationwide availability of information.</text></subsection>
<subsection id="HA8E80D2A20814AA69EAC945F002EFB2C"><enum>(c)</enum><header>Statewide incident reporting system</header><text>Within 2 years of enactment of this legislation, each State shall establish a statewide incident reporting system.</text></subsection>
<subsection id="HB9882F4A87D74F778C00A7157C864B6C"><enum>(d)</enum><header>Regional Intelligent Transportation System architecture</header>
<paragraph id="H5DD3A30C39164638A7B2C6C93ECE5763"><enum>(1)</enum><text>As State and local governments develop or update their regional ITS architectures, as specified in <external-xref legal-doc="regulation" parsable-cite="cfr/23/940.9">section 940.9</external-xref> of title 23, Code of Federal Regulations (Regional ITS Architecture), they shall explicitly address their real-time highway and transit information needs and the systems needed to meet those needs. This specific incorporation of information needs should address coverage, monitoring systems, data fusion and archiving, and methods of exchanging or sharing this information.</text></paragraph>
<paragraph id="HA5A156C51CC2434594C3052E009E4D"><enum>(2)</enum><text>States are encouraged to incorporate the data exchange formats developed by the Secretary to ensure that the data provided by highway and transit monitoring systems can readily be exchanged across state and local governments, and with the traveling public.</text></paragraph></subsection>
<subsection id="H58BC595E89F247BE8FF1D68EEF4B01D7"><enum>(e)</enum><header>Definition</header><text>In this section, the term <term>statewide incident reporting system</term> means a statewide system for facilitating the real-time electronic reporting of incidents to a central location for use in monitoring the event, providing accurate traveler information, and responding to the incident as appropriate.</text></subsection>
<subsection id="H2359F87D02C943FC8002D8641DD43804"><enum>(f)</enum><header>Eligibility</header><text>Subject to approval by the Secretary, a State may obligate funds apportioned to it under sections 104(b)(1) and (3) and 505 of title 23, United States Code, for activities relating to the planning of real-time monitoring elements.</text></subsection></section>
<section id="HE0AD929DDA2642AD868E2E7D66EEE1DD"><enum>211.</enum><header>Planning capacity building initiative</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/23/104">Section 104</external-xref> of title 23, United States Code, is amended by inserting after subsection (l) the following:</text>

<subsection id="H543AE2BC6F004EC2A786FFC049D5848D"><enum>(m)</enum><header>Planning capacity building initiative</header>
<paragraph id="H3271732FEF2D46BAB28100047D2FCDD6"><enum>(1)</enum><header>In General</header><text>The Secretary shall establish a planning capacity building initiative to support enhancements in transportation planning, in order to—</text>
<subparagraph id="H01CC117AA1F643449861255FADDF64D"><enum>(A)</enum><text>strengthen metropolitan and statewide transportation planning under sections 134 and 135, and under sections 5303 through 5305 of title 49;</text></subparagraph>
<subparagraph id="HE932575D8997422C971E06458639CE58"><enum>(B)</enum><text>enhance tribal capacity to conduct joint transportation planning under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/2">chapter 2</external-xref> of this title; and</text></subparagraph>
<subparagraph id="HC1EB73075155419D84897D0067A306E7"><enum>(C)</enum><text>participate in the metropolitan and statewide transportation planning programs under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/52">chapter 52</external-xref> of title 49.</text></subparagraph></paragraph>
<paragraph id="H807040AC39024A9A9B96E70045B462B1"><enum>(2)</enum><header>Priority</header><text>The Secretary shall give priority to planning practices and processes that support homeland security planning, performance based planning, safety planning, operations planning, freight planning, and integration of environment and planning.</text></paragraph>
<paragraph id="H97C7010C67294AB4001F64BDD3E9A688"><enum>(3)</enum><header>Use of funds</header><text>Funds authorized for this program may be used for research, program development, information collection and dissemination, and technical assistance. The Secretary may use these funds independently or make grants to, or enter into contracts and cooperative agreements with, a Federal agency, State agency, local agency, federally recognized Indian tribal government or tribal consortium, authority, association, nonprofit or for-profit corporation, or institution of higher education, to carry out the purposes of this subsection.</text></paragraph>
<paragraph id="H77978315A8874323BC58CA0026498151"><enum>(4)</enum><header>Federal share</header><text>The Federal share of the cost of an activity carried out using such funds shall be up to 100 percent, and such funds shall remain available until expended.</text></paragraph>
<paragraph id="HBAE510CD4D6E4394B917CE8652D1E616"><enum>(5)</enum><header>Administration</header><text>This initiative shall be administered by the Federal Highway Administration in cooperation with the Federal Transit Administration.</text></paragraph>
<paragraph id="H7743272FC60B4BC89322C5CE8FDEEDBC"><enum>(6)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated from the Highway Trust Fund such sums as may be necessary to carry out this section for each of fiscal years 2005 through 2010.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
