<official-title>To amend title 38, United States Code, to eliminate reductions of basic pay for eligibility for basic educational assistance for veterans under the Montgomery GI Bill.</official-title>

<section id="HCFEDB55877874BCF948FABD831B29100" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Fairness in Veterans Education Act of 2005</short-title></quote>.</text></section> 
<section id="H73684A4FFDC14115B4C717C5D439DB8F"><enum>2.</enum><header>Elimination of reductions of basic pay</header> 
<subsection id="H8DA15A6C219142E3BB1B00CD06F90571"><enum>(a)</enum><header>Repeals</header><text>Sections <external-xref legal-doc="usc" parsable-cite="usc/38/3011">3011(b)</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/38/3012">3012(c)</external-xref> of title 38, United States Code, are each amended by adding at the end the following new sentence: <quote>This subsection shall cease to have effect beginning on the first day of the first month that begins after the date of the enactment of the Fairness in Veterans Education Act of 2005.</quote>.</text></subsection> 
<subsection id="H1489611404454E5D992EB1CFC5D09E24"><enum>(b)</enum><header>Termination of reductions in progress</header><text>Any reduction in the basic pay of an individual referred to in <external-xref legal-doc="usc" parsable-cite="usc/38/3011">section 3011(b)</external-xref> of title 38, United States Code, by reason of such section 3011(b), or of any individual referred to in section 3012(c) of such title by reason of such section 3012(c), as of the date of the enactment of this Act shall cease commencing with the first month beginning after such date, and any obligation of such individual under such section 3011(b) or 3012(c), as the case may be, as of the day before such date shall be deemed to be fully satisfied as of such date.</text></subsection> 
<subsection id="HD1DCD91CF8144C21A5D15E384775DADB"><enum>(c)</enum><header>Conforming amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/3034">Section 3034(e)(1)</external-xref> of title 38, United States Code, is amended in the second sentence by striking <quote>as soon as practicable</quote> and all that follows through <quote>such additional times</quote> and inserting <quote>at such times</quote>.</text></subsection></section>
