<section id="HF33F75B9B41F4863007684B383A26F1C"><enum>3.</enum><header>References</header><text display-inline="no-display-inline">Except as otherwise expressly provided, wherever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the amendment or repeal shall be considered to be made to a section or other provision of the <act-name parsable-cite="SSA">Social Security Act</act-name>.</text></section> 
<section id="H9220C7629C1A4FEA80D540072066868"><enum>4.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress makes the following findings:</text> 
<paragraph id="H07E1B582C62545CA8065F9D1DEEFDC2"><enum>(1)</enum><text>The Temporary Assistance for Needy Families (TANF) Program established by the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/193">Public Law 104–193</external-xref>) has succeeded in moving families from welfare to work and reducing child poverty.</text> 
<subparagraph id="H40A5115A79C24DF6AAA64CF6215B2EA4"><enum>(A)</enum><text>There has been a dramatic increase in the employment of current and former welfare recipients. The percentage of working recipients reached an all-time high in fiscal year 1999 and continued steady in fiscal years 2000 and 2001. In fiscal year 2003, 31.3 percent of adult recipients were counted as meeting the work participation requirements. All States but one met the overall participation rate standard in fiscal year 2003, as did the District of Columbia and Puerto Rico.</text></subparagraph> 
<subparagraph id="HADDD0198B3FE4D619BDE19323851B607"><enum>(B)</enum><text>Earnings for welfare recipients remaining on the rolls have also increased significantly, as have earnings for female-headed households. The increases have been particularly large for the bottom 2 income quintiles, that is, those women who are most likely to be former or present welfare recipients.</text></subparagraph> 
<subparagraph id="H9D98AB382FCE40E3934B5DA46900572B"><enum>(C)</enum><text>Welfare dependency has plummeted. As of June 2004, 1,969,909 families and 4,727,291 individuals were receiving assistance. Accordingly, the number of families in the welfare caseload and the number of individuals receiving cash assistance declined 55 percent and 61 percent, respectively, since the enactment of TANF. </text></subparagraph> 
<subparagraph id="HB21F1E1C3E624482A8D923DEFBBF20F1"><enum>(D)</enum><text>The child poverty rate continued to decline between 1996 and 2003, falling 14 percent from 20.5 to 17.6 percent. Child poverty rates for African-American and Hispanic children have also fallen dramatically during the past 7 years.</text></subparagraph></paragraph> 
<paragraph id="H33AC0F53FE1A4A6290ECCF5ECFB7843F"><enum>(2)</enum><text>As a Nation, we have made substantial progress in reducing teen pregnancies and births, slowing increases in nonmarital childbearing, and improving child support collections and paternity establishment.</text> 
<subparagraph id="HE025ED37D2A2497596F21FE000E58B66"><enum>(A)</enum><text>The birth rate to teenagers declined 30 percent from its high in 1991 to 2002. The 2002 teenage birth rate of 43.0 per 1,000 women aged 15-19 is the lowest recorded birth rate for teenagers.</text></subparagraph> 
<subparagraph id="HA3E9684C3A1B4E0A8333D85B67C406E4"><enum>(B)</enum><text display-inline="yes-display-inline">During the period from 1991 through 2001, teenage birth rates fell in all States and the District of Columbia, Puerto Rico, Guam, and the Virgin Islands. Declines also have spanned age, racial, and ethnic groups. There has been success in lowering the birth rate for both younger and older teens. The birth rate for those 15-17 years of age has declined 40 percent since 1991, and the rate for those 18 and 19 has declined 23 percent. The rate for African American teens—until recently the highest—has declined the most—42 percent from 1991 through 2002.</text></subparagraph> 
<subparagraph id="H822E3DCAFEEF4724A260B8399FCDD902"><enum>(C)</enum><text>Since the enactment of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, child support collections within the child support enforcement system have grown every year, increasing from $12,000,000,000 in fiscal year 1996 to over $21,000,000,000 in fiscal year 2003. The number of paternities established or acknowledged in fiscal year 2003 (over 1,500,000) includes a more than 100 percent increase through in-hospital acknowledgement programs—862,043 in 2003 compared to 324,652 in 1996. Child support collections were made in nearly 8,000,000 cases in fiscal year 2003, significantly more than the almost 4,000,000 cases having a collection in 1996.</text></subparagraph></paragraph> 
<paragraph id="H6608FDE8D88C4BE0857472FF8AF8597"><enum>(3)</enum><text>The Personal Responsibility and Work Opportunity Reconciliation Act of 1996 gave States great flexibility in the use of Federal funds to develop innovative programs to help families leave welfare and begin employment and to encourage the formation of 2-parent families.</text> 
<subparagraph id="HE7F41982D79A474300D8B0A41DC50831"><enum>(A)</enum><text>Total Federal and State TANF expenditures in fiscal year 2003 were $26,300,000,000, up from $25,400,000,000 in fiscal year 2002 and $22,600,000,000 in fiscal year 1999. This increased spending is attributable to significant new investments in supportive services in the TANF program, such as child care and activities to support work.</text></subparagraph> 
<subparagraph id="H99D65E7A9AE04645A6A0F33CD961E5E0"><enum>(B)</enum><text>Since the welfare reform effort began there has been a dramatic increase in work participation (including employment, community service, and work experience) among welfare recipients, as well as an unprecedented reduction in the caseload because recipients have left welfare for work.</text></subparagraph> 
<subparagraph id="H4DF444C6A2F74725AD3CC096EFD0106E"><enum>(C)</enum><text>States are making policy choices and investment decisions best suited to the needs of their citizens.</text> 
<clause id="H8938F89636684C7A98BBC278471D9BA4"><enum>(i)</enum><text>To expand aid to working families, almost all States disregard a portion of a family’s earned income when determining benefit levels.</text></clause> 
<clause id="H3186DF6873F643BEB99CB8BDE7CB5400"><enum>(ii)</enum><text>Most States increased the limits on countable assets above the former Aid to Families with Dependent Children (AFDC) program. Every State has increased the vehicle asset level above the prior AFDC limit for a family’s primary automobile.</text></clause> 
<clause id="H4A05D634F37E44EF8CC1A777C6ED7EC8"><enum>(iii)</enum><text>States are experimenting with programs to promote marriage and paternal involvement. Over half of the States have eliminated restrictions on 2-parent families. Many States use TANF, child support, or State funds to support community-based activities to help fathers become more involved in their children’s lives or strengthen relationships between mothers and fathers.</text></clause></subparagraph></paragraph> 
<paragraph id="H7CCD68A48D99494A9436FE2B1D3D2E1"><enum>(4)</enum><text display-inline="yes-display-inline">However, despite this success, there is still progress to be made. Policies that support and promote more work, strengthen families, and enhance State flexibility are necessary to continue to build on the success of welfare reform.</text> 
<subparagraph id="H12D8ADB5AC144E45A01D00C878BB1163"><enum>(A)</enum><text display-inline="yes-display-inline">Significant numbers of welfare recipients still are not engaged in employment-related activities. While all States have met the overall work participation rates required by law, in an average month, only 41 percent of all families with an adult participated in work activities that were countable toward the State's participation rate. In fiscal year 2003, four jurisdictions failed to meet the more rigorous 2-parent work requirements, and 25 jurisdictions (States and territories) are not subject to the 2-parent requirements, most because they moved their 2-parent cases to separate State programs where they are not subject to a penalty for failing the 2-parent rates.</text></subparagraph> 
<subparagraph id="H5DF45ECAD4C74D9BBE6B26A1317763F0"><enum>(B)</enum><text display-inline="yes-display-inline">In 2002, 34 percent of all births in the U.S. were to unmarried women. And, with fewer teens entering marriage, the proportion of births to unmarried teens has increased dramatically (80 percent in 2002 versus 30 percent in 1970). The negative consequences of out-of-wedlock birth on the mother, the child, the family, and society are well documented. These include increased likelihood of welfare dependency, increased risks of low birth weight, poor cognitive development, child abuse and neglect, and teen parenthood, and decreased likelihood of having an intact marriage during adulthood.</text></subparagraph> 
<subparagraph id="HDFA1113793DF44D18D785DB54890984B"><enum>(C)</enum><text display-inline="yes-display-inline">There has been a dramatic rise in cohabitation as marriages have declined. It is estimated that 40 percent of children are expected to live in a cohabiting-parent family at some point during their childhood. Children in single-parent households and cohabiting-parent households are at much higher risk of child abuse than children in intact married families.</text></subparagraph> 
<subparagraph id="H792D72ECD01248ED844EA2A96F4021C8"><enum>(D)</enum><text display-inline="yes-display-inline">Children who live apart from their biological fathers, on average, are more likely to be poor, experience educational, health, emotional, and psychological problems, be victims of child abuse, engage in criminal behavior, and become involved with the juvenile justice system than their peers who live with their married, biological mother and father. A child living with a single mother is nearly 5 times as likely to be poor as a child living in a married-couple family. In 2003, in married-couple families, the child poverty rate was 8.6 percent, and in households headed by a single mother the poverty rate was 41.7 percent.</text></subparagraph></paragraph> 
<paragraph id="HA4A9ACEA054E41D9B4BD0059D9F11F00"><enum>(5)</enum><text>Therefore, it is the sense of the Congress that increasing success in moving families from welfare to work, as well as in promoting healthy marriage and other means of improving child well-being, are very important Government interests and the policy contained in part A of title IV of the <act-name parsable-cite="SSA">Social Security Act</act-name> (as amended by this Act) is intended to serve those ends.</text></paragraph></section>

<section id="HA033A5B1001942E2B539020000EDC7F0"><enum>101.</enum><header>Purposes</header><text display-inline="no-display-inline">Section 401(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601(a)</external-xref>) is amended—</text> 
<paragraph id="H8526EAC6CF0141D08C37170029FE2F84"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>increase</quote> and inserting <quote>improve child well-being by increasing</quote>;</text></paragraph> 
<paragraph id="H06A473E7FCF14549924DA43064A3BA17"><enum>(2)</enum><text>in paragraph (1), by inserting <quote>and services</quote> after <quote>assistance</quote>;</text></paragraph>

<paragraph id="H96F65BD9CAFB445F9733466B5F00D1BB"><enum>(1)</enum><text>by striking <quote>1996, 1997, 1998, 1999, 2000, 2001, 2002, and 2003</quote> and inserting <quote>2006 through 2010</quote>; and</text></paragraph>

<subparagraph id="H12F2B9C2612548DCB46DCC4C8B501773"><enum>(A)</enum><header>Authority</header><text>The Secretary shall award competitive grants to States, territories, and tribal organizations for not more than 50 percent of the cost of developing and implementing innovative programs to promote and support healthy, married, 2-parent families.</text></subparagraph> 
<subparagraph id="HD9EDD33F4C9644BC00B1161DC928DFA4"><enum>(B)</enum><header>Healthy marriage promotion activities</header><text>Funds provided under subparagraph (A) shall be used to support any of the following programs or activities:</text> 
<clause id="H1B5DDD79800340AFAAA4E7C04C23BE00"><enum>(i)</enum><text>Public advertising campaigns on the value of marriage and the skills needed to increase marital stability and health.</text></clause> 
<clause id="HB7231325DEA446468609030455623764"><enum>(ii)</enum><text>Education in high schools on the value of marriage, relationship skills, and budgeting.</text></clause> 
<clause id="HB5DC9FAD3CAF417C96338CD198F38BE7"><enum>(iii)</enum><text>Marriage education, marriage skills, and relationship skills programs, that may include parenting skills, financial management, conflict resolution, and job and career advancement, for non-married pregnant women and non-married expectant fathers.</text></clause> 
<clause id="H377CFD6DD4194586AEE02087C37C300"><enum>(iv)</enum><text>Pre-marital education and marriage skills training for engaged couples and for couples or individuals interested in marriage.</text></clause> 
<clause id="HA5B44E99597C4B998CE73E004F5EA93E"><enum>(v)</enum><text>Marriage enhancement and marriage skills training programs for married couples.</text></clause> 
<clause id="H233CD32CDC034B9A8F9CF48E057C2F84"><enum>(vi)</enum><text>Divorce reduction programs that teach relationship skills.</text></clause> 
<clause id="H862EE335EE71455B9D8ECC50A7745F6E"><enum>(vii)</enum><text>Marriage mentoring programs which use married couples as role models and mentors in at-risk communities.</text></clause> 
<clause id="H7009F62031E04C1CB0F9EFE6C68EC8F6"><enum>(viii)</enum><text>Programs to reduce the disincentives to marriage in means-tested aid programs, if offered in conjunction with any activity described in this subparagraph.</text></clause></subparagraph> 
<subparagraph id="H1819D488288D4B12BA912D4B6C1EE771"><enum>(C)</enum><header>Appropriation</header> 
<clause id="H8B5E4C78951E4D03B9218F0022275457"><enum>(i)</enum><header>In general</header><text>Out of any money in the Treasury of the United States not otherwise appropriated, there are appropriated for each of fiscal years 2005 through 2010 $100,000,000 for grants under this paragraph.</text></clause> 
<clause id="HA5452CADC72A4315A631C7B47606A4BC"><enum>(ii)</enum><header>Extended availability of fy2005 funds</header><text>Funds appropriated under clause (i) for fiscal year 2005 shall remain available to the Secretary through fiscal year 2006, for grants under this paragraph for fiscal year 2005.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H1FC24FCF53CB478DB2FAF10C928A276"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall take effect on the date of the enactment of this Act.</text></paragraph></subsection>

<paragraph id="H3E3DE51CCC19495CA531008BD73EED1"><enum>(1)</enum><text display-inline="yes-display-inline">in the paragraph heading, by striking <quote><header-in-text level="paragraph">high performance states</header-in-text></quote> and inserting <quote><header-in-text level="paragraph">employment achievement</header-in-text></quote>; and</text></paragraph>

<clause id="H1012FAB85D06400CA03D5B039EF860C1"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii) of this subparagraph, the Secretary shall determine the amount of the grant payable under this paragraph to an employment achievement State for a bonus year, which shall be based on the performance of the State as determined under subparagraph (D)(i) for the fiscal year that immediately precedes the bonus year.</text></clause> 
<clause id="H039623C98C4F461BB6ADD1C1FF6116B"><enum>(ii)</enum><header>Limitation</header><text>The amount payable to a State under this paragraph for a bonus year shall not exceed 5 percent of the State family assistance grant.</text></clause></subparagraph> 
<subparagraph id="HFA57DED1039F43D691EDE00070425619"><enum>(C)</enum><header>Formula for measuring State performance</header> 
<clause id="H0ECBF113C0E24623A74EADC1241D8563"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), not later than October 1, 2006, the Secretary, in consultation with the States, shall develop a formula for measuring State performance in operating the State program funded under this part so as to achieve the goals of employment entry, job retention, and increased earnings from employment for families receiving assistance under the program, as measured on an absolute basis and on the basis of improvement in State performance.</text></clause> 
<clause id="HF697F1A5B8394661842BA4B156FB6935"><enum>(ii)</enum><header>Special rule for bonus year 2006</header><text>For the purposes of awarding a bonus under this paragraph for bonus year 2006, the Secretary may measure the performance of a State in fiscal year 2005 using the job entry rate, job retention rate, and earnings gain rate components of the formula developed under section 403(a)(4)(C) as in effect immediately before the effective date of this paragraph.</text></clause></subparagraph> 
<subparagraph id="HC214648C06814797BFF6DB8DAAA88369"><enum>(D)</enum><header>Determination of State performance</header><text>For each bonus year, the Secretary shall—</text> 
<clause id="HFC06D64A5B8A443DBD42C0BB6BC4CB19"><enum>(i)</enum><text>use the formula developed under subparagraph (C) to determine the performance of each eligible State for the fiscal year that precedes the bonus year; and</text></clause> 
<clause id="H908E73FF52E341E88FD0AE002411AF7F"><enum>(ii)</enum><text>prescribe performance standards in such a manner so as to ensure that—</text> 
<subclause id="HF957DBBCC17E4B538B89932DA8AC8837"><enum>(I)</enum><text>the average annual total amount of grants to be made under this paragraph for each bonus year equals $100,000,000; and</text></subclause> 
<subclause id="H0F02EC7E6DA04AF2B3A4CBEA95C4824D"><enum>(II)</enum><text>the total amount of grants to be made under this paragraph for all bonus years equals $600,000,000.</text></subclause></clause></subparagraph> 
<subparagraph id="H4C1FFDDC9E284D15871F7BE51FA397D6"><enum>(E)</enum><header>Definitions</header><text>In this paragraph:</text> 
<clause id="H8A87CA4D88364AC08D01C68C9E5741C4"><enum>(i)</enum><header>Bonus year</header><text>The term <term>bonus year</term> means each of fiscal years 2006 through 2011.</text></clause> 
<clause id="H18EAE2053DDA4E5E8104EC2A8EE802"><enum>(ii)</enum><header>Employment achievement State</header><text>The term <term>employment achievement State</term> means, with respect to a bonus year, an eligible State whose performance determined pursuant to subparagraph (D)(i) for the fiscal year preceding the bonus year equals or exceeds the performance standards prescribed under subparagraph (D)(ii) for such preceding fiscal year.</text></clause></subparagraph> 
<subparagraph id="H214363CDD28C46B993575454AF5B891C"><enum>(F)</enum><header>Appropriation</header> 
<clause id="H86C08B44AF134F0DB5D3FA7FACB8D765"><enum>(i)</enum><header>In general</header><text>Out of any money in the Treasury of the United States not otherwise appropriated, there are appropriated for fiscal years 2006 through 2011 $600,000,000 for grants under this paragraph.</text></clause> 
<clause id="HABED5C453B7F4CE7A7C930029B781F2"><enum>(ii)</enum><header>Extended availability of prior appropriation</header><text>Amounts appropriated under section 403(a)(4)(F) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (as in effect before the date of the enactment of this clause) that have not been expended as of such date of enactment shall remain available through fiscal year 2006 for grants under section 403(a)(4) of such Act (as in effect before such date of enactment) for bonus year 2005.[needed?]</text></clause></subparagraph> 
<subparagraph id="H6C36EADBF2364EA78327D884DB15E731"><enum>(G)</enum><header>Grants for tribal organizations</header><text>This paragraph shall apply with respect to tribal organizations in the same manner in which this paragraph applies with respect to States. In determining the criteria under which to make grants to tribal organizations under this paragraph, the Secretary shall consult with tribal organizations.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

<subsection id="H996805464A0E481F8084FE14F00F435"><enum>(b)</enum><header>Establishment of family self-sufficiency plans</header> 
<paragraph id="H7FF92A8B583943BCAE0022CC6214FF8"><enum>(1)</enum><header>In general</header><text>Section 408(b) (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(b)</external-xref>) is amended to read as follows:</text>

<subsection id="H74270602FF9148B2B49322FF6FB6ED0"><enum>(b)</enum><header>Family self-sufficiency plans</header> 
<paragraph id="H03AF6CB4FCA4454A94EE15E861BA0693"><enum>(1)</enum><header>In general</header><text>A State to which a grant is made under section 403 shall—</text> 
<subparagraph id="H5275CB55572044F8A3110084D7048043"><enum>(A)</enum><text>assess, in the manner deemed appropriate by the State, the skills, prior work experience, and employability of each work-eligible individual (as defined in section 407(b)(2)(C)) receiving assistance under the State program funded under this part;</text></subparagraph> 
<subparagraph id="H831D8D72E21F476094ABE760EF3BCA82"><enum>(B)</enum><text>establish for each family that includes such an individual, in consultation as the State deems appropriate with the individual, a self-sufficiency plan that specifies appropriate activities described in the State plan submitted pursuant to section 402, including direct work activities as appropriate designed to assist the family in achieving their maximum degree of self-sufficiency, and that provides for the ongoing participation of the individual in the activities;</text></subparagraph> 
<subparagraph id="HFB815B658A33404DB0C652CB97BE79FB"><enum>(C)</enum><text>require, at a minimum, each such individual to participate in activities in accordance with the self-sufficiency plan;</text></subparagraph> 
<subparagraph id="HF16C7A8337AC4B998D5250F69DC71DC"><enum>(D)</enum><text>monitor the participation of each such individual in the activities specified in the self sufficiency plan, and regularly review the progress of the family toward self-sufficiency;</text></subparagraph> 
<subparagraph id="H6FD55D0B986D4BE886006CDE5FADB953"><enum>(E)</enum><text>upon such a review, revise the self-sufficiency plan and activities as the State deems appropriate.</text></subparagraph></paragraph> 
<paragraph id="H2ABA80516A66485780E635C2914D1D5"><enum>(2)</enum><header>Timing</header><text>The State shall comply with paragraph (1) with respect to a family—</text> 
<subparagraph id="HA0D8364CACA946498EB8A839921FF3FF"><enum>(A)</enum><text>in the case of a family that, as of October 1, 2005, is not receiving assistance from the State program funded under this part, not later than 60 days after the family first receives assistance on the basis of the most recent application for the assistance; or</text></subparagraph> 
<subparagraph id="HFAB7978D69D44747A3FADD3C465B4D8"><enum>(B)</enum><text>in the case of a family that, as of such date, is receiving the assistance, not later than 12 months after the date of enactment of this subsection.</text></subparagraph></paragraph> 
<paragraph id="H83EB60DCF97C4AA78467D8C938A28DB9"><enum>(3)</enum><header>State discretion</header><text>A State shall have sole discretion, consistent with section 407, to define and design activities for families for purposes of this subsection, to develop methods for monitoring and reviewing progress pursuant to this subsection, and to make modifications to the plan as the State deems appropriate to assist the individual in increasing their degree of self-sufficiency.</text></paragraph> 
<paragraph id="H14CF3306A9384F339E14D452375C844E"><enum>(4)</enum><header>Rule of interpretation</header><text>Nothing in this part shall preclude a State from requiring participation in work and any other activities the State deems appropriate for helping families achieve self-sufficiency and improving child well-being.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H6C154DD6501E4E7ABF2D7DF9B3C48E3"><enum>(2)</enum><header>Penalty for failure to establish family self-sufficiency plan</header><text>Section 409(a)(3) (<external-xref legal-doc="usc" parsable-cite="usc/42/609">42 U.S.C. 609(a)(3)</external-xref>) is amended—</text> 
<subparagraph id="H54A031DFD83A4FEDA893A9673BE09E5C"><enum>(A)</enum><text>in the paragraph heading, by inserting <quote>or establish family self-sufficiency plan</quote> after <quote>rates</quote>; and</text></subparagraph> 
<subparagraph id="H4997DD0B7DC3401988CB1531BF7D2700"><enum>(B)</enum><text>in subparagraph (A), by inserting <quote>or 408(b)</quote> after <quote>407(a)</quote>.</text></subparagraph></paragraph></subsection></section>

<subsection id="H5C62E4B9C3FC4A53A77113B4AA595D1D"><enum>(a)</enum><header>Elimination of separate participation rate requirements for 2-parent families</header> 
<paragraph id="H71CD94D3773248AA933C1CEDBBCD0064" display-inline="no-display-inline"><enum>(1)</enum><text>Section 407 (<external-xref legal-doc="usc" parsable-cite="usc/42/607">42 U.S.C. 607</external-xref>) is amended in each of subsections (a) and (b) by striking paragraph (2).</text></paragraph>

<subsection id="H34ED1A86534A47DE99326007EC6C6258"><enum>(b)</enum><header>Calculation of participation rates</header> 
<paragraph id="HF18C30329D4349598492623EB550E024"><enum>(1)</enum><header>Average monthly rate</header><text>For purposes of subsection (a), the participation rate of a State for a fiscal year is the average of the participation rates of the State for each month in the fiscal year.</text></paragraph> 
<paragraph id="H6513175587DE433D898282C64DECF7FC"><enum>(2)</enum><header>Monthly participation rates; incorporation of 40-hour work week standard</header> 
<subparagraph id="H46A5B59E643F4B3BBF234DE493BD04D3"><enum>(A)</enum><header>In general</header><text>For purposes of paragraph (1), the participation rate of a State for a month is—</text> 
<clause id="HDAB4F72137B7479BAA003991DBD020A9"><enum>(i)</enum><text>the total number of countable hours (as defined in subsection (c)) with respect to the counted families for the State for the month; divided by</text></clause> 
<clause id="HA2C7A28149904F8383DF2CD450C08928"><enum>(ii)</enum><text>160 multiplied by the number of counted families for the State for the month.</text></clause></subparagraph> 
<subparagraph id="H5B32C220D640461888DE243F8F8F59F5"><enum>(B)</enum><header>Counted families defined</header> 
<clause id="H2571CB2094C24C9A84C32C57BDBF072"><enum>(i)</enum><header>In general</header><text>In subparagraph (A), the term <term>counted family</term> means, with respect to a State and a month, a family that includes a work-eligible individual and that receives assistance in the month under the State program funded under this part, subject to clause (ii).</text></clause> 
<clause id="H94288E44820F47278B6DED3DB3D4FECE"><enum>(ii)</enum><header>State option to exclude certain families</header><text>At the option of a State, the term <term>counted family</term> shall not include—</text> 
<subclause id="H1A6EA9866F574255B4BC749E52EA869"><enum>(I)</enum><text>a family in the first month for which the family receives assistance from a State program funded under this part on the basis of the most recent application for such assistance; or</text></subclause> 
<subclause id="H8248C828660C4ECBBDF9273C48D0EB50"><enum>(II)</enum><text>on a case-by-case basis, a family in which the youngest child has not attained 12 months of age.</text></subclause></clause> 
<clause id="H90B929784D1341AB80BB4EDD0BFFBE3"><enum>(iii)</enum><header>State option to include individuals receiving assistance under a tribal family assistance plan or tribal work program</header><text>At the option of a State, the term <term>counted family</term> may include families in the State that are receiving assistance under a tribal family assistance plan approved under section 412 or under a tribal work program to which funds are provided under this part.</text></clause></subparagraph> 
<subparagraph id="H0949ABF4407C4816A743019946EE41A1"><enum>(C)</enum><header>Work-eligible individual defined</header><text>In this section, the term <term>work-eligible individual</term> means an individual—</text> 
<clause id="H1AF5C34B8C8D4DDFBB003CC8CB9DA8AD"><enum>(i)</enum><text>who is married or a single head of household; and</text></clause> 
<clause id="H72AB5C04D9234F97803750FA5375A815"><enum>(ii)</enum><text>whose needs are (or, but for sanctions under this part that have been in effect for more than 3 months (whether or not consecutive) in the preceding 12 months or under part D, would be) included in determining the amount of cash assistance to be provided to the family under the State program funded under this part.</text></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H336D5A47B43F4A9C89221635DF3D7DA3"><enum>(c)</enum><header>Recalibration of caseload reduction credit</header> 
<paragraph id="H5D031CA8AF9E46B9B264A7B3D0565BF"><enum>(1)</enum><header>In general</header><text>Section 407(b)(3)(A)(ii) (<external-xref legal-doc="usc" parsable-cite="usc/42/607">42 U.S.C. 607(b)(3)(A)(ii)</external-xref>) is amended to read as follows:</text>

<clause id="HA39488ABB6AF46E7B2B09369E56B7E38"><enum>(i)</enum><text>the amount (if any) of the superachiever credit applicable to the State; or</text></clause> 
<clause id="H419BBF4B9DF04D76B232F7FDF423879B"><enum>(ii)</enum><text>the number of percentage points (if any) by which the minimum participation rate required by subsection (a) for the fiscal year exceeds 50 percent.</text></clause></subparagraph> 
<subparagraph id="H8FDC33EBEC7E419495ED324D81166B22"><enum>(B)</enum><header>Superachiever State</header><text>For purposes of subparagraph (A), a State is a superachiever State if the State caseload for fiscal year 2001 has declined by at least 60 percent from the State caseload for fiscal year 1995.</text></subparagraph> 
<subparagraph id="H8FACE7ADC8B849599301DB1674D113F"><enum>(C)</enum><header>Amount of credit</header><text>The superachiever credit applicable to a State is the number of percentage points (if any) by which the decline referred to in subparagraph (B) exceeds 60 percent.</text></subparagraph> 
<subparagraph id="HEFA385F686F04A1B8690885F13189C60"><enum>(D)</enum><header>Definitions</header><text>In this paragraph:</text> 
<clause id="H43A283F615FA4AE98DCF7C20394D9318"><enum>(i)</enum><header>State caseload for fiscal year 2001</header><text>The term <term>State caseload for fiscal year 2001</term> means the average monthly number of families that received assistance during fiscal year 2001 under the State program funded under this part.</text></clause> 
<clause id="H790174679AF74F3BB0316BCC221B63D5"><enum>(ii)</enum><header>State caseload for fiscal year 1995</header><text>The term <term>State caseload for fiscal year 1995</term> means the average monthly number of families that received aid under the State plan approved under part A (as in effect on September 30, 1995) during fiscal year 1995.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H998B8C4AA56F45180019198161D4001E"><enum>(e)</enum><header>Countable hours</header><text>Section 407 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/607">42 U.S.C. 607</external-xref>) is amended by striking subsections (c) and (d) and inserting the following:</text>

<subsection id="H9B530667CF3F43C29DCD57DC4BC7518D"><enum>(c)</enum><header>Countable hours</header> 
<paragraph id="H192CDC3C14C442109115005FA7ECB29D"><enum>(1)</enum><header>Definition</header><text>In subsection (b)(2), the term <term>countable hours</term> means, with respect to a family for a month, the total number of hours in the month in which any member of the family who is a work-eligible individual is engaged in a direct work activity or other activities specified by the State (excluding an activity that does not address a purpose specified in section 401(a)), subject to the other provisions of this subsection.</text></paragraph> 
<paragraph id="H79F5EAD3A08C4B159C8065A27F1CBC59"><enum>(2)</enum><header>Limitations</header><text>Subject to such regulations as the Secretary may prescribe:</text> 
<subparagraph id="HBEA2B566B90D4C9BB93E6FCBBA5C3FCB"><enum>(A)</enum><header>Minimum weekly average of 24 hours of direct work activities required</header><text>If the work-eligible individuals in a family are engaged in a direct work activity for an average total of fewer than 24 hours per week in a month, then the number of countable hours with respect to the family for the month shall be zero.</text></subparagraph> 
<subparagraph id="H785EEECD5DAF4F5E84CD25BC2CDE6FD3"><enum>(B)</enum><header>Maximum weekly average of 16 hours of other activities</header><text>An average of not more than 16 hours per week of activities specified by the State (subject to the exclusion described in paragraph (1)) may be considered countable hours in a month with respect to a family.</text></subparagraph></paragraph> 
<paragraph id="H3EF328C5174B4091AD716DBBAF4F7D57"><enum>(3)</enum><header>Special rules</header><text>For purposes of paragraph (1):</text> 
<subparagraph id="HB0DC4B02F2384D3A8E8E38B169373CDF"><enum>(A)</enum><header>Participation in qualified activities</header> 
<clause id="H4E38AD767EAA4487865EAE612BDCD0E0"><enum>(i)</enum><header>In general</header><text>If, with the approval of the State, the work-eligible individuals in a family are engaged in 1 or more qualified activities for an average total of at least 24 hours per week in a month, then all such engagement in the month shall be considered engagement in a direct work activity, subject to clause (iii).</text></clause> 
<clause id="HB50F5C21935944DAA6004B14CB54F3C3"><enum>(ii)</enum><header>Qualified activity defined</header><text>The term <term>qualified activity</term> means an activity specified by the State (subject to the exclusion described in paragraph (1)) that meets such standards and criteria as the State may specify, including—</text> 
<subclause id="HC1EF9EEB34614A1D8900D3724D00A504"><enum>(I)</enum><text>substance abuse counseling or treatment;</text></subclause> 
<subclause id="HA2CDDA64E9BB4B08807F9544004C6429"><enum>(II)</enum><text>rehabilitation treatment and services;</text></subclause> 
<subclause id="HD0DEE724FAFE400BA118B6964C78A7A0"><enum>(III)</enum><text>work-related education or training directed at enabling the family member to work;</text></subclause> 
<subclause id="HAE591D58C9B547A7BD664100FDF83D07"><enum>(IV)</enum><text>job search or job readiness assistance; and</text></subclause> 
<subclause id="H179C1B37041C49908C6DB6DE4E1DFCA9"><enum>(V)</enum><text>any other activity that addresses a purpose specified in section 401(a).</text></subclause></clause> 
<clause id="HCBCF45F4429B41C381DF006ECB727E96"><enum>(iii)</enum><header>Limitation</header> 
<subclause id="H502315E935F24C3880202468D0F790AF"><enum>(I)</enum><header>In general</header><text>Except as provided in subclause (II), clause (i) shall not apply to a family for more than 3 months in any period of 24 consecutive months.</text></subclause> 
<subclause id="H213F9832033A4FA593A4F264A69D01E6"><enum>(II)</enum><header>Special rule applicable to education and training</header><text>A State may, on a case-by-case basis, apply clause (i) to a work-eligible individual so that participation by the individual in education or training, if needed to permit the individual to complete a certificate program or other work-related education or training directed at enabling the individual to fill a known job need in a local area, may be considered countable hours with respect to the family of the individual for not more than 4 months in any period of 24 consecutive months.</text></subclause></clause></subparagraph> 
<subparagraph id="H41670025D747488DBF0082F7B96D35D7"><enum>(B)</enum><header>School attendance by teen head of household</header><text>The work-eligible members of a family shall be considered to be engaged in a direct work activity for an average of 40 hours per week in a month if the family includes an individual who is married, or is a single head of household, who has not attained 20 years of age, and the individual—</text> 
<clause id="H75F94AC4AA1C453B858B9D1BB355EC86"><enum>(i)</enum><text>maintains satisfactory attendance at secondary school or the equivalent in the month; or</text></clause> 
<clause id="H40C1D97661454663BE788CEE92B0CB69"><enum>(ii)</enum><text>participates in education directly related to employment for an average of at least 20 hours per week in the month.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H193EC96F498B42A6BC2BE4033CC077AC"><enum>(d)</enum><header>Direct work activity</header><text>In this section, the term <term>direct work activity</term> means—</text> 
<paragraph id="HB334A42CF93449979144F521CF0836EB"><enum>(1)</enum><text>unsubsidized employment;</text></paragraph> 
<paragraph id="HC4C49A86DEDA46CCB2B06F05F967C525"><enum>(2)</enum><text>subsidized private sector employment;</text></paragraph> 
<paragraph id="H82DBE3A7603C4B9C9257007438E04ECF"><enum>(3)</enum><text>subsidized public sector employment;</text></paragraph> 
<paragraph id="HE77A820D01FC4719855204C8248D32D"><enum>(4)</enum><text>on-the-job training;</text></paragraph> 
<paragraph id="HB2E1E255751743ABB1D83DA29D701D00"><enum>(5)</enum><text>supervised work experience; or</text></paragraph> 
<paragraph id="HF0BD51BBE4CA470FBE597BF81FA2B995"><enum>(6)</enum><text>supervised community service.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H44B975448ABB4C88BCEF852DAD6000F4"><enum>(f)</enum><header>Penalties against individuals</header><text>Section 407(e)(1) (<external-xref legal-doc="usc" parsable-cite="usc/42/607">42 U.S.C. 607(e)(1)</external-xref>) is amended to read as follows:</text>

<subparagraph id="HF6909B6747B3445C9D1BFD112E001C1B"><enum>(A)</enum><header>In general</header><text>Except as provided in paragraph (2), if an individual in a family receiving assistance under a State program funded under this part fails to engage in activities required in accordance with this section, or other activities required by the State under the program, and the family does not otherwise engage in activities in accordance with the self-sufficiency plan established for the family pursuant to section 408(b), the State shall—</text> 
<clause id="H9236C21DC7D84F11B4C2F9340073BB0"><enum>(i)</enum><text>if the failure is partial or persists for not more than 1 month—</text> 
<subclause id="H0D7EA7278AAE47769B178F25A7761FE5"><enum>(I)</enum><text>reduce the amount of assistance otherwise payable to the family pro rata (or more, at the option of the State) with respect to any period during a month in which the failure occurs; or</text></subclause> 
<subclause id="H9A61AE9198524E258CA15B81B9219FAE"><enum>(II)</enum><text>terminate all assistance to the family, subject to such good cause exceptions as the State may establish; or</text></subclause></clause> 
<clause id="HEE5C0D157D7C47D395972D9EEFBF357"><enum>(ii)</enum><text>if the failure is total and persists for at least 2 consecutive months, terminate all cash payments to the family including qualified State expenditures (as defined in section 409(a)(7)(B)(i)) for at least 1 month and thereafter until the State determines that the individual has resumed full participation in the activities, subject to such good cause exceptions as the State may establish.</text></clause></subparagraph> 
<subparagraph id="H0280ED70104D428DA38F775F00F1DDC"><enum>(B)</enum><header>Special rule</header> 
<clause id="H5C672C11365C4DF39F9E008F745DE315"><enum>(i)</enum><header>In general</header><text>In the event of a conflict between a requirement of clause (i)(II) or (ii) of subparagraph (A) and a requirement of a State constitution, or of a State statute that, before 1966, obligated local government to provide assistance to needy parents and children, the State constitutional or statutory requirement shall control.</text></clause>

<subclause id="HE7B68B48681C40E1A02D9294CE1D78DF"><enum>(IV)</enum><text>describe the methodology that the State will use to measure State performance in relation to each such objective.</text></subclause></clause>

The report shall include, with respect to each such program, the program name, a description of program activities, the program purpose, the program eligibility criteria, the sources of program funding, the number of program beneficiaries, sanction policies, and any program work requirements.</text></subsection> 
<subsection id="HF59091DC0FF9456281B9CB10B4341DE6"><enum>(c)</enum><header>Monthly reports on caseload</header><text>Not later than 3 months after the end of a calendar month that begins 1 year or more after the enactment of this subsection, each eligible State shall submit to the Secretary a report on the number of families and total number of individuals receiving assistance in the calendar month under the State program funded under this part.</text></subsection> 
<subsection id="H0BF68E374D6F428FB51688AF5C8F7F99"><enum>(d)</enum><header>Annual report on performance improvement</header><text>Beginning with fiscal year 2007, not later than January 1 of each fiscal year, each eligible State shall submit to the Secretary a report on achievement and improvement during the preceding fiscal year under the numerical performance goals and measures under the State program funded under this part with respect to each of the matters described in section 402(a)(1)(A)(v).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HF9D3268FEBE0405DB5633EC2AEB97BED"><enum>(f)</enum><header>Annual reports to Congress by the Secretary</header><text>Section 411(e), as so redesignated by subsection (e) of this section, is amended—</text> 
<paragraph id="HF6A07928A5E64D2EA31B3CEB00A3DDB4"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>and each fiscal year thereafter</quote> and inserting <quote>and by July 1 of each fiscal year thereafter</quote>;</text></paragraph>

<subparagraph id="H5A0AD728AC4243C48BFF4D3966EE521"><enum>(A)</enum><header>In general</header><text>Out of any money in the Treasury of the United States not otherwise appropriated, there are appropriated $102,000,000 for each of fiscal years 2005 through 2010, which shall be available to the Secretary for the purpose of conducting and supporting research and demonstration projects by public or private entities, and providing technical assistance to States, Indian tribal organizations, and such other entities as the Secretary may specify that are receiving a grant under this part, which shall be expended primarily on activities described in section 403(a)(2)(B), and which shall be in addition to any other funds made available under this part.</text></subparagraph> 
<subparagraph id="H0B7BAFC183BD4E8BA111B440E6781680"><enum>(B)</enum><header>Extended availability of FY 2005 funds</header><text>Funds appropriated under this paragraph for fiscal year 2005 shall remain available to the Secretary through fiscal year 2006, for use in accordance with this paragraph for fiscal year 2005.</text></subparagraph></paragraph> 
<paragraph id="H8CAE36F5CB604826AE7FD76209E86F14"><enum>(2)</enum><header>Set aside for demonstration projects for coordination of provision of child welfare and TANF services to tribal families at risk of child abuse or neglect</header> 
<subparagraph id="H7683E85BA8134F0CB5868229198FDC70"><enum>(A)</enum><header>In general</header><text>Of the amounts made available under paragraph (1) for a fiscal year, $2,000,000 shall be awarded on a competitive basis to fund demonstration projects designed to test the effectiveness of tribal governments or tribal consortia in coordinating the provision to tribal families at risk of child abuse or neglect of child welfare services and services under tribal programs funded under this part.</text></subparagraph> 
<subparagraph id="HB7D2507BFB854BEE98DE13FD5D03EDBC"><enum>(B)</enum><header>Use of funds</header><text>A grant made to such a project shall be used—</text> 
<clause id="H49ADC0E21E994F9C887B3941D619E24D"><enum>(i)</enum><text>to improve case management for families eligible for assistance from such a tribal program;</text></clause> 
<clause id="H72A7F7EB17BB43B3A10035E72C82B38"><enum>(ii)</enum><text>for supportive services and assistance to tribal children in out-of-home placements and the tribal families caring for such children, including families who adopt such children; and</text></clause> 
<clause id="H24786ED6BB5A4027A700C1137847CE31"><enum>(iii)</enum><text>for prevention services and assistance to tribal families at risk of child abuse and neglect.</text></clause></subparagraph> 
<subparagraph id="HBEE5642C6C284CAF802B5DBC5D8B4B2E"><enum>(C)</enum><header>Reports</header><text>The Secretary may require a recipient of funds awarded under this paragraph to provide the Secretary with such information as the Secretary deems relevant to enable the Secretary to facilitate and oversee the administration of any project for which funds are provided under this paragraph.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HF0DA4ED4BAC14F0DA0E802BCE551EB93"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall take effect on the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="H42FCD0CDE56F4E629478A3B64214281D"><enum>(b)</enum><header>Funding of studies and demonstrations</header><text>Section 413(h)(1) (<external-xref legal-doc="usc" parsable-cite="usc/42/613">42 U.S.C. 613(h)(1)</external-xref>) is amended in the matter preceding subparagraph (A) by striking <quote>1997 through 2002</quote> and inserting <quote>2006 through 2010</quote>.</text></subsection> 
<subsection id="H96675F914227459A98CE6DFB176FC8B2"><enum>(c)</enum><header>Report on enforcement of certain affidavits of support and sponsor deeming</header><text>Not later than March 31, 2006, the Secretary of Health and Human Services, in consultation with the Attorney General, shall submit to the Congress a report on the enforcement of affidavits of support and sponsor deeming as required by section 421, 422, and 432 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996.</text></subsection> 
<subsection id="H6BDE46F5E6724EA2AD967D3E04B15DD6"><enum>(d)</enum><header>Report on coordination</header><text>Not later than 6 months after the date of the enactment of this Act, the Secretary of Health and Human Services and the Secretary of Labor shall jointly submit a report to the Congress describing common or conflicting data elements, definitions, performance measures, and reporting requirements in the Workforce Investment Act of 1998 and part A of title IV of the <act-name parsable-cite="SSA">Social Security Act</act-name>, and, to the degree each Secretary deems appropriate, at the discretion of either Secretary, any other program administered by the respective Secretary, to allow greater coordination between the welfare and workforce development systems.</text></subsection></section>

The content of the survey should include such information as may be necessary to examine the issues of out-of-wedlock childbearing, marriage, welfare dependency and compliance with work requirements, the beginning and ending of spells of assistance, work, earnings and employment stability, and the well-being of children.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

<paragraph id="H0730A837BD4F4620ACE9D042D800DA44"><enum>(1)</enum><header>In general</header><text>The Comptroller General of the United States shall conduct a study to determine the combined effect of the phase-out rates for Federal programs and policies which provide support to low-income families and individuals as they move from welfare to work, at all earning levels up to $35,000 per year, for at least 5 States including Wisconsin and California, and any potential disincentives the combined phase-out rates create for families to achieve independence or to marry.</text></paragraph> 
<paragraph id="HC04C7A6F89D445E09DE9300FCC13EF6"><enum>(2)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this subsection, the Comptroller General shall submit a report to Congress containing the results of the study conducted under this section and, as appropriate, any recommendations consistent with the results.</text></paragraph></subsection></section>

<subsection id="H940E685C18BB4880AD886E2BDAE712EA"><enum>(a)</enum><header>Findings</header><text>The Congress finds that there is substantial evidence strongly indicating the urgent need to promote and support involved, committed, and responsible fatherhood, and to encourage and support healthy marriages between parents raising children, including data demonstrating the following:</text> 
<paragraph id="H4CF55B1F9C0D4673ABB85481468A332"><enum>(1)</enum><text>In approximately 84 percent of cases where a parent is absent, that parent is the father.</text></paragraph> 
<paragraph id="H0C656E43588347F7B335AE932600037E"><enum>(2)</enum><text display-inline="yes-display-inline">If current trends continue, half of all children born today will live apart from one of their parents, usually their father, at some point before they turn 18.</text></paragraph> 
<paragraph id="H34B783A67C424CBFA619CC2665392BD6"><enum>(3)</enum><text>Where families (whether intact or with a parent absent) are living in poverty, a significant factor is the father’s lack of job skills.</text></paragraph> 
<paragraph id="H6427612BE8C14E2A80DABCDC9FABD44E"><enum>(4)</enum><text>Committed and responsible fathering during infancy and early childhood contributes to the development of emotional security, curiosity, and math and verbal skills.</text></paragraph> 
<paragraph id="HF9C27B482D9E407FAF9F93B445EB62B5"><enum>(5)</enum><text>An estimated 19,400,000 children (27 percent) live apart from their biological father.</text></paragraph> 
<paragraph id="H8FA3AE667B134DB3A07234B32353BBB4"><enum>(6)</enum><text>Forty percent of children under age 18 not living with their biological father had not seen their father even once in the last 12 months, according to national survey data.</text></paragraph></subsection> 
<subsection id="H74F68E8CD717424E9182D4BBB28E1362"><enum>(b)</enum><header>Purposes</header><text>The purposes of this part are:</text> 
<paragraph id="H0B90C942E7BA4747A6B638B24E19BE28"><enum>(1)</enum><text>To provide for projects and activities by public entities and by nonprofit community entities, including religious organizations, designed to test promising approaches to accomplishing the following objectives:</text> 
<subparagraph id="H5B15455E4F6F4848AD33AE57375EA00"><enum>(A)</enum><text>Promoting responsible, caring, and effective parenting through counseling, mentoring, and parenting education, dissemination of educational materials and information on parenting skills, encouragement of positive father involvement, including the positive involvement of nonresident fathers, and other methods.</text></subparagraph> 
<subparagraph id="H501EE50B2AD447A9B1750488B0023C90"><enum>(B)</enum><text>Enhancing the abilities and commitment of unemployed or low-income fathers to provide material support for their families and to avoid or leave welfare programs by assisting them to take full advantage of education, job training, and job search programs, to improve work habits and work skills, to secure career advancement by activities such as outreach and information dissemination, coordination, as appropriate, with employment services and job training programs, including the One-Stop delivery system established under title I of the Workforce Investment Act of 1998, encouragement and support of timely payment of current child support and regular payment toward past due child support obligations in appropriate cases, and other methods.</text></subparagraph> 
<subparagraph id="HCD6D45246D2C446B00E8175158C895D2"><enum>(C)</enum><text display-inline="yes-display-inline">Improving fathers’ ability to effectively manage family business affairs by means such as education, counseling, and mentoring in matters including household management, budgeting, banking, and handling of financial transactions, time management, and home maintenance.</text></subparagraph> 
<subparagraph id="HD2E335B37BA447E2B3FEA009DC05EBD"><enum>(D)</enum><text>Encouraging and supporting healthy marriages and married fatherhood through such activities as premarital education, including the use of premarital inventories, marriage preparation programs, skills-based marriage education programs, marital therapy, couples counseling, divorce education and reduction programs, divorce mediation and counseling, relationship skills enhancement programs, including those designed to reduce child abuse and domestic violence, and dissemination of information about the benefits of marriage for both parents and children.</text></subparagraph></paragraph> 
<paragraph id="HEBFF9BC4DB454808904E3EBE4F7D3356"><enum>(2)</enum><text>Through the projects and activities described in paragraph (1), to improve outcomes for children with respect to measures such as increased family income and economic security, improved school performance, better health, improved emotional and behavioral stability and social adjustment, and reduced risk of delinquency, crime, substance abuse, child abuse and neglect, teen sexual activity, and teen suicide.</text></paragraph> 
<paragraph id="H4BFE3E1C2E8E46D79C590463BEE7B5C7"><enum>(3)</enum><text>To evaluate the effectiveness of various approaches and to disseminate findings concerning outcomes and other information in order to encourage and facilitate the replication of effective approaches to accomplishing these objectives.</text></paragraph></subsection></section> 
<section id="H6E8F8092B7A24B6FA66F578FB19DF150"><enum>442.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part, the terms <quote>Indian tribe</quote> and <quote>tribal organization</quote> have the meanings given them in subsections (e) and (l), respectively, of section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name>.</text></section> 
<section id="HC1FF7747223049628F2EDA534EF4E517"><enum>443.</enum><header>Competitive grants for service projects</header> 
<subsection id="H4E4F70A68C714C14B60853E7725FB200"><enum>(a)</enum><header>In general</header><text>The Secretary may make grants for fiscal years 2006 through 2010 to public and nonprofit community entities, including religious organizations, and to Indian tribes and tribal organizations, for demonstration service projects and activities designed to test the effectiveness of various approaches to accomplish the objectives specified in section 441(b)(1).</text></subsection> 
<subsection id="H2EBD815DADCF4DF3909C982DC5F4D260"><enum>(b)</enum><header>Eligibility criteria for full service grants</header><text>In order to be eligible for a grant under this section, except as specified in subsection (c), an entity shall submit an application to the Secretary containing the following:</text> 
<paragraph id="HD14C0EE316024C8391E551A2A95F7198"><enum>(1)</enum><header>Project description</header><text>A statement including—</text> 
<subparagraph id="HACF10C22193E4AE98C00A02185F59100"><enum>(A)</enum><text>a description of the project and how it will be carried out, including the geographical area to be covered and the number and characteristics of clients to be served, and how it will address each of the 4 objectives specified in section 441(b)(1); and</text></subparagraph> 
<subparagraph id="HE7FBCA4AE4D14C768DE837FAAFA2C500"><enum>(B)</enum><text>a description of the methods to be used by the entity or its contractor to assess the extent to which the project was successful in accomplishing its specific objectives and the general objectives specified in section 441(b)(1).</text></subparagraph></paragraph> 
<paragraph id="HE4493A68698C439AADD600259C004B51"><enum>(2)</enum><header>Experience and qualifications</header><text>A demonstration of ability to carry out the project, by means such as demonstration of experience in successfully carrying out projects of similar design and scope, and such other information as the Secretary may find necessary to demonstrate the entity’s capacity to carry out the project, including the entity’s ability to provide the non-Federal share of project resources.</text></paragraph> 
<paragraph id="HC2B99D29636E4D19BC10AFE11094E715"><enum>(3)</enum><header>Addressing child abuse and neglect and domestic violence</header><text>A description of how the entity will assess for the presence of, and intervene to resolve, domestic violence and child abuse and neglect, including how the entity will coordinate with State and local child protective service and domestic violence programs.</text></paragraph> 
<paragraph id="H5A13C37A522C48F4815EC06E1D0D6D6"><enum>(4)</enum><header>Addressing concerns relating to substance abuse and sexual activity</header><text>A commitment to make available to each individual participating in the project education about alcohol, tobacco, and other drugs, and about the health risks associated with abusing such substances, and information about diseases and conditions transmitted through substance abuse and sexual contact, including HIV/AIDS, and to coordinate with providers of services addressing such problems, as appropriate.</text></paragraph> 
<paragraph id="H6A19AFF32534435C9F4CB97E51AD0200"><enum>(5)</enum><header>Coordination with specified programs</header><text>An undertaking to coordinate, as appropriate, with State and local entities responsible for the programs under parts A, B, and D of this title, including programs under title I of the Workforce Investment Act of 1998 (including the One-Stop delivery system), and such other programs as the Secretary may require.</text></paragraph> 
<paragraph id="HC3D935A2C7714875A1006260A3D6F9A2"><enum>(6)</enum><header>Records, reports, and audits</header><text>An agreement to maintain such records, make such reports, and cooperate with such reviews or audits as the Secretary may find necessary for purposes of oversight of project activities and expenditures.</text></paragraph> 
<paragraph id="HCE8736EE393F47E3AAA2A01037BF31A9"><enum>(7)</enum><header>Self-initiated evaluation</header><text>If the entity elects to contract for independent evaluation of the project (part or all of the cost of which may be paid for using grant funds), a commitment to submit to the Secretary a copy of the evaluation report within 30 days after completion of the report and not more than 1 year after completion of the project.</text></paragraph> 
<paragraph id="H610FCA0BEBD34874B8D72C0017371447"><enum>(8)</enum><header>Cooperation with secretary’s oversight and evaluation</header><text>An agreement to cooperate with the Secretary’s evaluation of projects assisted under this section, by means including random assignment of clients to service recipient and control groups, if determined by the Secretary to be appropriate, and affording the Secretary access to the project and to project-related records and documents, staff, and clients.</text></paragraph></subsection> 
<subsection id="H4E6FC74988C846A7A0FCC669BE9930A5"><enum>(c)</enum><header>Eligibility criteria for limited purpose grants</header><text>In order to be eligible for a grant under this section in an amount under $25,000 per fiscal year, an entity shall submit an application to the Secretary containing the following:</text> 
<paragraph id="H10C8934067234D6C007933A8FC135D6"><enum>(1)</enum><header>Project description</header><text>A description of the project and how it will be carried out, including the number and characteristics of clients to be served, the proposed duration of the project, and how it will address at least 1 of the 4 objectives specified in section 441(b)(1).</text></paragraph> 
<paragraph id="H9159EB80A8B8402BA249985742C4E4C"><enum>(2)</enum><header>Qualifications</header><text>Such information as the Secretary may require as to the capacity of the entity to carry out the project, including any previous experience with similar activities.</text></paragraph> 
<paragraph id="H575D24F7FF0742F28D00E04BC22670F0"><enum>(3)</enum><header>Coordination with related programs</header><text>As required by the Secretary in appropriate cases, an undertaking to coordinate and cooperate with State and local entities responsible for specific programs relating to the objectives of the project including, as appropriate, jobs programs and programs serving children and families.</text></paragraph> 
<paragraph id="H127205157EAA448DBB4C0632BA8CF8D0"><enum>(4)</enum><header>Records, reports, and audits</header><text>An agreement to maintain such records, make such reports, and cooperate with such reviews or audits as the Secretary may find necessary for purposes of oversight of project activities and expenditures.</text></paragraph> 
<paragraph id="HD037B6164D0E431DA842204635F89DB"><enum>(5)</enum><header>Cooperation with secretary’s oversight and evaluation</header><text>An agreement to cooperate with the Secretary’s evaluation of projects assisted under this section, by means including affording the Secretary access to the project and to project-related records and documents, staff, and clients.</text></paragraph></subsection> 
<subsection id="H3287561B5C454CE69CA408B54F308806"><enum>(d)</enum><header>Considerations in awarding grants</header> 
<paragraph id="HE5A1C0DC29F745D4B51496003B3415DC"><enum>(1)</enum><header>Diversity of projects</header><text>In awarding grants under this section, the Secretary shall seek to achieve a balance among entities of differing sizes, entities in differing geographic areas, entities in urban and in rural areas, and entities employing differing methods of achieving the purposes of this section, including working with the State agency responsible for the administration of part D to help fathers satisfy child support arrearage obligations.</text></paragraph> 
<paragraph id="H30199DDEEE774551A389BF6B1834C14B"><enum>(2)</enum><header>Preference for projects serving low-income fathers</header><text>In awarding grants under this section, the Secretary may give preference to applications for projects in which a majority of the clients to be served are low-income fathers.</text></paragraph></subsection> 
<subsection id="H8960C3C043A5446DAC31C415CB82122D"><enum>(e)</enum><header>Federal share</header> 
<paragraph id="H7B9D1FF790644AB6BE1C969D823153B8"><enum>(1)</enum><header>In general</header><text>Grants for a project under this section for a fiscal year shall be available for a share of the cost of such project in such fiscal year equal to—</text> 
<subparagraph id="HF8FA47ED7F21494282BCFD8DFCE0B0D2"><enum>(A)</enum><text>up to 80 percent (or up to 90 percent, if the entity demonstrates to the Secretary’s satisfaction circumstances limiting the entity’s ability to secure non-Federal resources) in the case of a project under subsection (b); and</text></subparagraph> 
<subparagraph id="HE0F9FB4ED3BC4D27A78C4220D5F34C25"><enum>(B)</enum><text>up to 100 percent, in the case of a project under subsection (c).</text></subparagraph></paragraph> 
<paragraph id="H261EF8A7567942F2BA376BC8A01B468D"><enum>(2)</enum><header>Non-federal share</header><text>The non-Federal share may be in cash or in kind. In determining the amount of the non-Federal share, the Secretary may attribute fair market value to goods, services, and facilities contributed from non-Federal sources.</text></paragraph></subsection></section> 
<section id="HD35D071207EB4E3F9D6EA20000A05BB2"><enum>444.</enum><header>Multicity, multistate demonstration projects</header> 
<subsection id="H664EEBB604834D99B4B9A55C61AD75B2"><enum>(a)</enum><header>In general</header><text>The Secretary may make grants under this section for fiscal years 2006 through 2010 to eligible entities (as specified in subsection (b)) for 2 multicity, multistate projects demonstrating approaches to achieving the objectives specified in section 441(b)(1). One of the projects shall test the use of married couples to deliver program services.</text></subsection> 
<subsection id="HF79C5F3F5DC943E086806700D3509500"><enum>(b)</enum><header>Eligible entities</header><text>An entity eligible for a grant under this section must be a national nonprofit fatherhood promotion organization that meets the following requirements:</text> 
<paragraph id="H0BB1DFCEBBFD4725A9C2D92FCB9C6C6E"><enum>(1)</enum><header>Experience with fatherhood programs</header><text>The organization must have substantial experience in designing and successfully conducting programs that meet the purposes described in section 441.</text></paragraph> 
<paragraph id="HF9514573D25542408F1EE26E4B005CD5"><enum>(2)</enum><header>Experience with multicity, multistate programs and Government coordination</header><text>The organization must have experience in simultaneously conducting such programs in more than 1 major metropolitan area in more than 1 State and in coordinating such programs, where appropriate, with State and local government agencies and private, nonprofit agencies (including community-based and religious organizations), including State or local agencies responsible for child support enforcement and workforce development.</text></paragraph></subsection> 
<subsection id="HD1EB167007A94E8D99D9EC44757C904"><enum>(c)</enum><header>Application requirements</header><text>In order to be eligible for a grant under this section, an entity must submit to the Secretary an application that includes the following:</text> 
<paragraph id="H717DAD65343D40588290AB49BA95A4D1"><enum>(1)</enum><header>Qualifications</header> 
<subparagraph id="H69194F2387B641EDBB6900C00BC7B54"><enum>(A)</enum><header>Eligible entity</header><text>A demonstration that the entity meets the requirements of subsection (b).</text></subparagraph> 
<subparagraph id="HE561561AABD0480EBE6BA600E8C8D0BC"><enum>(B)</enum><header>Other</header><text>Such other information as the Secretary may find necessary to demonstrate the entity’s capacity to carry out the project, including the entity’s ability to provide the non-Federal share of project resources.</text></subparagraph></paragraph> 
<paragraph id="H20037106449547ACA0491C5845833CEC"><enum>(2)</enum><header>Project description</header><text>A description of and commitments concerning the project design, including the following:</text> 
<subparagraph id="H2D408BB6D44A4762A48D88170738FF21"><enum>(A)</enum><header>In general</header><text>A detailed description of the proposed project design and how it will be carried out, which shall—</text> 
<clause id="HAB2E0B9DD0DD4FD7806934208FE5DFD2"><enum>(i)</enum><text>provide for the project to be conducted in at least 3 major metropolitan areas;</text></clause> 
<clause id="H291B4ED608AC43FD95F2D1895BEAA639"><enum>(ii)</enum><text>state how it will address each of the 4 objectives specified in section 441(b)(1);</text></clause> 
<clause id="HE3C6957A811A4EBC9278CFFB91361038"><enum>(iii)</enum><text>demonstrate that there is a sufficient number of potential clients to allow for the random selection of individuals to participate in the project and for comparisons with appropriate control groups composed of individuals who have not participated in such projects; and</text></clause> 
<clause id="H832020C2EAA4485EAE79BA39AB6C166C"><enum>(iv)</enum><text>demonstrate that the project is designed to direct a majority of project resources to activities serving low-income fathers (but the project need not make services available on a means-tested basis).</text></clause></subparagraph> 
<subparagraph id="H452963320E1B45D6A6D040AFDE576937"><enum>(B)</enum><header>Oversight, evaluation, and adjustment component</header><text>An agreement that the entity—</text> 
<clause id="H46085F295E784178AD04341912175624"><enum>(i)</enum><text>in consultation with the evaluator selected pursuant to section 445, and as required by the Secretary, will modify the project design, initially and (if necessary) subsequently throughout the duration of the project, in order to facilitate ongoing and final oversight and evaluation of project operation and outcomes (by means including, to the maximum extent feasible, random assignment of clients to service recipient and control groups), and to provide for mid-course adjustments in project design indicated by interim evaluations;</text></clause> 
<clause id="H4C05F83CB2F944A8B06966ECF350065"><enum>(ii)</enum><text>will submit to the Secretary revised descriptions of the project design as modified in accordance with clause (i); and</text></clause> 
<clause id="H62890DBF2F1C44D793E00F9BAAB0063"><enum>(iii)</enum><text>will cooperate fully with the Secretary’s ongoing oversight and ongoing and final evaluation of the project, by means including affording the Secretary access to the project and to project-related records and documents, staff, and clients.</text></clause></subparagraph></paragraph> 
<paragraph id="HB547D21CCEC34171849D117904C24545"><enum>(3)</enum><header>Addressing child abuse and neglect and domestic violence</header><text>A description of how the entity will assess for the presence of, and intervene to resolve, domestic violence and child abuse and neglect, including how the entity will coordinate with State and local child protective service and domestic violence programs.</text></paragraph>

<paragraph id="H67BC8D8EF11E490990B607866CADB3D"><enum>(6)</enum><header>Records, reports, and audits</header><text>An agreement to maintain such records, make such reports, and cooperate with such reviews or audits (in addition to those required under the preceding provisions of paragraph (2)) as the Secretary may find necessary for purposes of oversight of project activities and expenditures.</text></paragraph></subsection> 
<subsection id="HF140952D77EC4D1A8C65FBB71248F02D"><enum>(d)</enum><header>Federal share</header> 
<paragraph id="H678EE6833E7B48B8AB578E77F942E6E"><enum>(1)</enum><header>In general</header><text>Grants for a project under this section for a fiscal year shall be available for up to 80 percent of the cost of such project in such fiscal year.</text></paragraph> 
<paragraph id="H7E8570644E314AF19C0763B476EBBD3"><enum>(2)</enum><header>Non-federal share</header><text>The non-Federal share may be in cash or in kind. In determining the amount of the non-Federal share, the Secretary may attribute fair market value to goods, services, and facilities contributed from non-Federal sources.</text></paragraph></subsection></section> 
<section id="H5C9D4E047CED473BB1C8E0EAECD2B14C"><enum>445.</enum><header>Evaluation</header> 
<subsection id="H433105FA18E54B79A3A9D1261205E42C"><enum>(a)</enum><header>In general</header><text>The Secretary, directly or by contract or cooperative agreement, shall evaluate the effectiveness of service projects funded under sections 443 and 444 from the standpoint of the purposes specified in section 441(b)(1).</text></subsection> 
<subsection id="HAE420D11B3874934932122E9D781965F"><enum>(b)</enum><header>Evaluation methodology</header><text>Evaluations under this section shall—</text> 
<paragraph id="H0DD8D92B06AF48778FE908189F760049"><enum>(1)</enum><text>include, to the maximum extent feasible, random assignment of clients to service delivery and control groups and other appropriate comparisons of groups of individuals receiving and not receiving services;</text></paragraph> 
<paragraph id="H6576B16DD218478799953FE5A8A5C9A4"><enum>(2)</enum><text>describe and measure the effectiveness of the projects in achieving their specific project goals; and</text></paragraph> 
<paragraph id="HD3A428F90AB54E09A8750780A9804B88"><enum>(3)</enum><text>describe and assess, as appropriate, the impact of such projects on marriage, parenting, domestic violence, child abuse and neglect, money management, employment and earnings, payment of child support, and child well-being, health, and education.</text></paragraph></subsection> 
<subsection id="HA8283CFE677641C1A437004BDD2E7F81"><enum>(c)</enum><header>Evaluation reports</header><text>The Secretary shall publish the following reports on the results of the evaluation:</text> 
<paragraph id="H883D4C78F772482584FD09ABC7FCDF9C"><enum>(1)</enum><text>An implementation evaluation report covering the first 24 months of the activities under this part to be completed by 36 months after initiation of such activities.</text></paragraph> 
<paragraph id="H24691592AA8C484E84482E9B7231C835"><enum>(2)</enum><text>A final report on the evaluation to be completed by September 30, 2013.</text></paragraph></subsection></section> 
<section id="H34C6F9B74E764B22834594A0E136B5B6"><enum>446.</enum><header>Projects of national significance</header><text display-inline="no-display-inline">The Secretary is authorized, by grant, contract, or cooperative agreement, to carry out projects and activities of national significance relating to fatherhood promotion, including—</text> 
<paragraph id="H1ABCCFFF2C0B4BAE9F6F4F8CA3057FF3"><enum>(1)</enum><header>Collection and dissemination of information</header><text>Assisting States, communities, and private entities, including religious organizations, in efforts to promote and support marriage and responsible fatherhood by collecting, evaluating, developing, and making available (through the Internet and by other means) to all interested parties information regarding approaches to accomplishing the objectives specified in section 441(b)(1).</text></paragraph> 
<paragraph id="H9D9EAA373C2F4862A7984691DD4B72A"><enum>(2)</enum><header>Media campaign</header><text>Developing, promoting, and distributing to interested States, local governments, public agencies, and private nonprofit organizations, including charitable and religious organizations, a media campaign that promotes and encourages involved, committed, and responsible fatherhood and married fatherhood.</text></paragraph> 
<paragraph id="HD573786EA41E44CF8B6489FE14D241CA"><enum>(3)</enum><header>Technical assistance</header><text>Providing technical assistance, including consultation and training, to public and private entities, including community organizations and faith-based organizations, in the implementation of local fatherhood promotion programs.</text></paragraph> 
<paragraph id="HB3EAA7DC51E2402389F3C856B9DCAF53"><enum>(4)</enum><header>Research</header><text>Conducting research related to the purposes of this part.</text></paragraph></section> 
<section id="HB590B080849541C9A5F7A3E8C17F9B6"><enum>447.</enum><header>Nondiscrimination</header><text display-inline="no-display-inline">The projects and activities assisted under this part shall be available on the same basis to all fathers and expectant fathers able to benefit from such projects and activities, including married and unmarried fathers and custodial and noncustodial fathers, with particular attention to low-income fathers, and to mothers and expectant mothers on the same basis as to fathers.</text></section> 
<section id="H2AF0B37CDF2F409D91CBE81C77D1F2ED"><enum>448.</enum><header>Authorization of appropriations; reservation for certain purpose</header> 
<subsection id="H3015619B9ECF4F98908FCD0900CEAFE5"><enum>(a)</enum><header>Authorization</header><text>There are authorized to be appropriated $20,000,000 for each of fiscal years 2006 through 2010 to carry out the provisions of this part.</text></subsection> 
<subsection id="HD42F57290EC44F9BA3DE003EC761278"><enum>(b)</enum><header>Reservation</header><text>Of the amount appropriated under this section for each fiscal year, not more than 15 percent shall be available for the costs of the multicity, multicounty, multistate demonstration projects under section 444, evaluations under section 445, and projects of national significance under section 446.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HEEF56F829D4B4FC8B53D465EC46EA23"><enum>(b)</enum><header>Inapplicability of effective date provisions</header><text>Section 116 shall not apply to the amendment made by subsection (a) of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H4061B9CA0CA1478B994FDC88B079D26"><enum>(2)</enum><header>Clerical amendment</header><text>Section 2 of such Act is amended in the table of contents by inserting after the item relating to section 116 the following new item:</text>

<section id="H254B21CF0EDE437B8B698F1E549012B7"><enum>120.</enum><header>State option to make TANF programs mandatory partners with One-Stop employment training centers</header><text display-inline="no-display-inline">Section 408 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H9C26575886CA4F9087BE4307E1A98ED2"><enum>(h)</enum><header>State option to make TANF programs mandatory partners with One-Stop employment training centers</header><text>For purposes of section 121(b) of the Workforce Investment Act of 1998, a State program funded under part A of title IV of the <act-name parsable-cite="SSA">Social Security Act</act-name> shall be considered a program referred to in paragraph (1)(B) of such section, unless, after the date of the enactment of this subsection, the Governor of the State notifies the Secretaries of Health and Human Services and Labor in writing of the decision of the Governor not to make the State program a mandatory partner.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H889DACCB8AD449F5A6E5D6CBD661871C"><enum>121.</enum><header>Sense of the Congress</header><text display-inline="no-display-inline">It is the sense of the Congress that a State welfare-to-work program should include a mentoring program.</text></section> 
<section id="H9EC292BA5F104C7390BC5000E8D68538"><enum>122.</enum><header>Extension through fiscal year 2005</header> 
<subsection id="H2BFA3F0F74FC4D109C43D01E63FAC087"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this Act and the amendments made by this Act, activities authorized by part A of title IV of the <act-name parsable-cite="SSA">Social Security Act</act-name>, and by sections 429A, 1108(b), and 1130(a) of such Act, shall continue through September 30, 2005, in the manner authorized for fiscal year 2004, and out of any money in the Treasury of the United States not otherwise appropriated, there are hereby appropriated such sums as may be necessary for such purpose. Grants and payments may be made pursuant to this authority through the fourth quarter of fiscal year 2005 at the level provided for such activities through the fourth quarter of fiscal year 2004, except that in the case of section 403(a)(4) of such Act, the level shall be $100,000,000.</text></subsection> 
<subsection id="HFD3CF11EA0B747609C4564EF2894C903"><enum>(b)</enum><header>Effective date</header><text>Subsection (a) shall take effect on the date of the enactment of this Act.</text></subsection></section></title>

<section id="H2CFCEB8F507148D58FCF56A266C7AFFF"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Caring for Children Act of 2005</short-title></quote>.</text></section> 
<section id="H86F3E020AC6245DFA5A950B77DFA3DE0"><enum>202.</enum><header>Goals</header>

<clause id="H74A7383A0211475C9F29E23C216589F2"><enum>(ii)</enum><text>research and best practices on children’s development, including early cognitive development;</text></clause> 
<clause id="H4347C4EC2D114412B05BF4CCDCA534F3"><enum>(iii)</enum><text>the availability of assistance to obtain child care services; and</text></clause> 
<clause id="HEA7078354F834909B800FE0182B25768"><enum>(iv)</enum><text>other programs for which families that receive child care services for which financial assistance is provided under this subchapter may be eligible, including the food stamp program, the WIC program under section 17 of the <act-name parsable-cite="CNA66">Child Nutrition Act of 1966</act-name>, the child and adult care food program under section 17 of the Richard B. Russell <act-name parsable-cite="NSLA">National School Lunch Act</act-name>, and the medicaid and SCHIP programs under titles XIX and XXI of the <act-name parsable-cite="SSA">Social Security Act</act-name>.</text></clause></subparagraph><after-quoted-block>, and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H8BE9B5519D2440DD9729A29F66D9D800"><enum>(2)</enum><text>by inserting after subparagraph (H) the following:</text> 
<quoted-block id="HBA6BE46FA7344CDD8DA28510EF9AAEF"> 
<subparagraph id="HAA0BD5439B83454AAE6058AA7E31C417"><enum>(I)</enum><header>Coordination with other early child care services and early childhood education programs</header><text>Demonstrate how the State is coordinating child care services provided under this subchapter with Head Start, Early Reading First, Even Start, Ready-To-Learn Television, State pre-kindergarten programs, and other early childhood education programs to expand accessibility to and continuity of care and early education without displacing services provided by the current early care and education delivery system.</text></subparagraph> 
<subparagraph id="H881A1D814EED42348247CFF72D1013B"><enum>(J)</enum><header>Public-private partnerships</header><text>Demonstrate how the State encourages partnerships with private and other public entities to leverage existing service delivery systems of early childhood education and increase the supply and quality of child care services.</text></subparagraph> 
<subparagraph id="H6F6B92FFCE034AE1822547569FDAA363"><enum>(K)</enum><header>Child care service quality</header> 
<clause id="H37CE217996344775B01C1E3F24CEC606"><enum>(i)</enum><header>Certification</header><text>For each fiscal year after fiscal year 2006, certify that during the then preceding fiscal year the State was in compliance with section 658G and describe how funds were used to comply with such section during such preceding fiscal year.</text></clause> 
<clause id="H3E0161ED2D734F249EBDFFF7DA04AAB0"><enum>(ii)</enum><header>Strategy</header><text>For each fiscal year after fiscal year 2006, contain an outline of the strategy the State will implement during such fiscal year for which the State plan is submitted, to address the quality of child care services in the State available to low-income parents from eligible child care providers, and include in such strategy—</text> 
<subclause id="H86E3F87ABCC04392ACED17C6811266F"><enum>(I)</enum><text>a statement specifying how the State will address the activities described in paragraphs (1), (2), and (3) of section 658G;</text></subclause> 
<subclause id="H997C285A297A4DB687348C1C86BFA2B4"><enum>(II)</enum><text>a description of quantifiable, objective measures for evaluating the quality of child care services separately with respect to the activities listed in each of such paragraphs that the State will use to evaluate its progress in improving the quality of such child care services;</text></subclause> 
<subclause id="H042C208D8CDE43F5A0D92DADB61635AC"><enum>(III)</enum><text>a list of State-developed child care service quality targets for such fiscal year quantified on the basis of such measures; and</text></subclause> 
<subclause id="H9BAE25A110E4479C8DC05B009800D7F7"><enum>(IV)</enum><text>for each fiscal year after fiscal year 2006, a report on the progress made to achieve such targets during the then preceding fiscal year.</text></subclause></clause> 
<clause id="HE696C6E0DA9242019E830083F361CB0"><enum>(iii)</enum><header>Rule of construction</header><text>Nothing in this subparagraph shall be construed to require that the State apply measures for evaluating quality to specific types of child care providers.</text></clause></subparagraph> 
<subparagraph id="H28DBEB11AD9E42129CB7E1EDD85E103B"><enum>(L)</enum><header>Access to care for certain populations</header><text>Demonstrate how the State is addressing the child care needs of parents eligible for child care services for which financial assistance is provided under this subchapter who have children with special needs, work nontraditional hours, or require child care services for infants or toddlers.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HD6E7937FCD3F40DD94B26F5C3EC38E2B"><enum>205.</enum><header>Activities to improve the quality of child care</header><text display-inline="no-display-inline">Section 658G of the <act-name parsable-cite="CCDBGA90">Child Care and Development Block Grant Act of 1990</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/9858e">42 U.S.C. 9858e</external-xref>) is amended to read as follows:</text>

<section id="HA03764EABB6D43270037EFCDE8BFFE1"><enum>658G.</enum><header>Activities to improve the quality of child care services</header><text display-inline="no-display-inline">A State that receives funds to carry out this subchapter for a fiscal year, shall use not less than 6 percent of the amount of such funds for activities provided through resource and referral services or other means, that are designed to improve the quality of child care services in the State available to low-income parents from eligible child care providers. Such activities include—</text> 
<paragraph id="HEB33B8DF991F4EE596B187472276DF2"><enum>(1)</enum><text>programs that provide training, education, and other professional development activities to enhance the skills of the child care workforce, including training opportunities for caregivers in informal care settings;</text></paragraph> 
<paragraph id="HF5368F62D8B3445587CD90B3986F4EA0"><enum>(2)</enum><text>activities within child care settings to enhance early learning for young children, to promote early literacy, and to foster school readiness;</text></paragraph> 
<paragraph id="HA56C3B06DE41415A88F690460012BED3"><enum>(3)</enum><text>initiatives to increase the retention and compensation of child care providers, including tiered reimbursement rates for providers that meet quality standards as defined by the State; or</text></paragraph> 
<paragraph id="HB33E114D006D4D28906702CA84CEE5B9"><enum>(4)</enum><text>other activities deemed by the State to improve the quality of child care services provided in such State.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H86F152FAA33F474CB47200F0C2C4E9F8"><enum>206.</enum><header>Report by Secretary</header><text display-inline="no-display-inline">Section 658L of the <act-name parsable-cite="CCDBGA90">Child Care and Development Block Grant Act of 1990</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/9858j">42 U.S.C. 9858j</external-xref>) is amended to read as follows:</text>

<paragraph id="HDF4F3BBCD9B94B4AB2F6BABFE1AA53A4"><enum>(2)</enum><text>Aggregated statistics on the supply of, demand for, and quality of child care, early education, and non-school-hours programs.</text></paragraph> 
<paragraph id="H8F6E11A2A4414C68A1B95BE5139615F6"><enum>(3)</enum><text>An assessment, and where appropriate, recommendations for the Congress concerning efforts that should be undertaken to improve the access of the public to quality and affordable child care in the United States.</text></paragraph></subsection> 
<subsection id="HC4F6EC284B224495834DBDA0A35A197"><enum>(b)</enum><header>Collection of information</header><text>The Secretary may utilize the national child care data system available through resource and referral organizations at the local, State, and national level to collect the information required by subsection (a)(2).</text></subsection></section><after-quoted-block></after-quoted-block></quoted-block></section> 
<section id="HF3EECD271AC2400C9DD52498441831DC"><enum>207.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 658P(4)(B) of the <act-name parsable-cite="CCDBGA90">Child Care and Development Block Grant Act of 1990</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/9858N">42 U.S.C. 9858N(4)(B)</external-xref>) is amended by striking <quote>85 percent of the State median income</quote> and inserting <quote>income levels as established by the State, prioritized by need,</quote>.</text></section>

<subsection id="H6CE2F2C8CDEF4DBC9D611B1099570038"><enum>(a)</enum><header>In general</header><text>Section 457(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/657">42 U.S.C. 657(a)</external-xref>) is amended—</text> 
<paragraph id="H962CBB7C0DB84DFB88BF77AC584CB76C"><enum>(1)</enum><text>in paragraph (1)(A), by inserting <quote>subject to paragraph (7)</quote> before the semicolon; and</text></paragraph> 
<paragraph id="H5D57A5DBF7BA4646A7F2887CE530289"><enum>(2)</enum><text>by adding at the end the following:</text>

<subparagraph id="HFA257C76EC374895B556D0B1A8EE2195"><enum>(A)</enum><text>the State distributes the amount to the family;</text></subparagraph> 
<subparagraph id="HA410A4BC1B4F41CB9ECFDCCBAE58AD4E"><enum>(B)</enum><text>the total of the amounts so distributed to the family during the month—</text> 
<clause id="HA31941720C244E86B4D9CF3EB1A9948D"><enum>(i)</enum><text>exceeds the amount (if any) that, as of December 31, 2001, was required under State law to be distributed to a family under paragraph (1)(B); and</text></clause> 
<clause id="HA93D695B9F2A460A8532D8ACDB7D109D"><enum>(ii)</enum><text>does not exceed the greater of—</text> 
<subclause id="HE323931E2086457CA0096F05391F4FDC"><enum>(I)</enum><text>$100; or</text></subclause> 
<subclause id="H99ACCC85382644409DA7F9AF00FF009C"><enum>(II)</enum><text>$50 plus the amount described in clause (i); and</text></subclause></clause></subparagraph> 
<subparagraph id="HBFB3B9D0E39C42C598D2C4F3582FEB5E"><enum>(C)</enum><text>the amount is disregarded in determining the amount and type of assistance provided to the family under the State program funded under part A.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H2D43AA590D90452E9C4B26ABB6EE1B69"><enum>(b)</enum><header>Applicability</header><text>The amendments made by subsection (a) shall apply to amounts distributed on or after October 1, 2007.</text></subsection></section> 
<section id="H6E0F04F3E2C14A81BE4B00E314D753F"><enum>302.</enum><header>State option to pass through all child support payments to families that formerly received TANF</header> 
<subsection id="H3AB7E84358F84E00B800043EB9DB5C72"><enum>(a)</enum><header>In general</header><text>Section 457(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/657">42 U.S.C. 657(a)</external-xref>), as amended by section 301(a) of this Act, is amended—</text> 
<paragraph id="HC09DC7D706AD415A96E570E48C7E66C2"><enum>(1)</enum><text>in paragraph (2)(B), in the matter preceding clause (i), by inserting <quote>, except as provided in paragraph (8),</quote> after <quote>shall</quote>; and</text></paragraph>

<subsection id="H8655EEEC1A6645EAB3D568B5FCCD2F0"><enum>(a)</enum><header>In general</header><text display-inline="no-display-inline">Section 466(a)(10)(A)(i) (<external-xref legal-doc="usc" parsable-cite="usc/42/666">42 U.S.C. 666(a)(10)(A)(i)</external-xref>) is amended—</text> 
<paragraph id="HD7720CF6C5284AFEABA8CF482131268C"><enum>(1)</enum><text>by striking <quote>parent, or,</quote> and inserting <quote>parent or</quote>; and</text></paragraph>

<section id="HB494CF0271C6471C93AC38A69FE049BF"><enum>304.</enum><header>Mandatory fee for successful child support collection for family that has never received TANF</header> 
<subsection id="H04F93E754F3A4A30ACC66BD5E5802542"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 454(6)(B) (<external-xref legal-doc="usc" parsable-cite="usc/42/654">42 U.S.C. 654(6)(B)</external-xref>) is amended—</text> 
<paragraph id="HC83143FE3475476AB9B0F737E958CBF1"><enum>(1)</enum><text>by inserting <quote>(i)</quote> after <quote>(B)</quote>;</text></paragraph> 
<paragraph id="H5670A9C205ED4227BB128D1289005248"><enum>(2)</enum><text>by redesignating clauses (i) and (ii) as subclauses (I) and (II), respectively;</text></paragraph> 
<paragraph id="HBFB2EA4D1D5A4BEEABEF953750DCFEEA"><enum>(3)</enum><text>by adding <quote>and</quote> after the semicolon; and</text></paragraph> 
<paragraph id="HF190D8166CCF476EBC9207B1232BB982"><enum>(4)</enum><text>by adding after and below the end the following new clause:</text>

<clause indent="up1" id="H9E303EA4B25A415FBD7EFDA0C1691F34"><enum>(ii)</enum><text>in the case of an individual who has never received assistance under a State program funded under part A and for whom the State has collected at least $500 of support, the State shall impose an annual fee of $25 for each case in which services are furnished, which shall be retained by the State from support collected on behalf of the individual (but not from the 1st $500 so collected), paid by the individual applying for the services, recovered from the absent parent, or paid by the State out of its own funds (the payment of which from State funds shall not be considered as an administrative cost of the State for the operation of the plan, and such fees shall be considered income to the program);</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H293204FC9D4A4801B8B6CC2468BFCB21"><enum>(b)</enum><header>Conforming amendment</header><text>Section 457(a)(3) (<external-xref legal-doc="usc" parsable-cite="usc/42/657">42 U.S.C. 657(a)(3)</external-xref>) is amended to read as follows:</text>

<paragraph id="H0416AD283A91463AAA9E415D7108F8A6"><enum>(3)</enum><header>Families that never received assistance</header><text>In the case of any other family, the State shall distribute to the family the portion of the amount so collected that remains after withholding any fee pursuant to section 454(6)(B)(ii).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H483837B6634349F994FD76C97259827B"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on October 1, 2006.</text></subsection></section> 
<section id="HBD73F8A5338446C4B72EBA4976B143F2"><enum>305.</enum><header>Report on undistributed child support payments</header><text display-inline="no-display-inline">Not later than 6 months after the date of the enactment of this Act, the Secretary of Health and Human Services shall submit to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate a report on the procedures that the States use generally to locate custodial parents for whom child support has been collected but not yet distributed. The report shall include an estimate of the total amount of undistributed child support and the average length of time it takes undistributed child support to be distributed. To the extent the Secretary deems appropriate, the Secretary shall include in the report recommendations as to whether additional procedures should be established at the State or Federal level to expedite the payment of undistributed child support.</text></section> 
<section id="H1673E1EA8F7D4817ACC3CF0530B52216"><enum>306.</enum><header>Decrease in amount of child support arrearage triggering passport denial</header>

<title id="H60F94A9D6EBD4AD5924985371212D148"><enum>V</enum><header>Supplemental security income</header> 
<section id="H37751ACDF3794AC28EE58F0562F839FB"><enum>501.</enum><header>Review of State agency blindness and disability determinations</header><text display-inline="no-display-inline">Section 1633 (<external-xref legal-doc="usc" parsable-cite="usc/42/1383b">42 U.S.C. 1383b</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H4A7A4E35C166449A9BBD761849BD8823"><enum>(e)</enum> 
<paragraph display-inline="yes-display-inline" id="HD36C04A3D2CF4553A0A7DC06A46D7729"><enum>(1)</enum><text>The Commissioner of Social Security shall review determinations, made by State agencies pursuant to subsection (a) in connection with applications for benefits under this title on the basis of blindness or disability, that individuals who have attained 18 years of age are blind or disabled as of a specified onset date. The Commissioner of Social Security shall review such a determination before any action is taken to implement the determination.</text></paragraph> 
<paragraph indent="up1" id="H3FEC38F6842E40DAB33D723957040059"><enum>(2)</enum> 
<subparagraph display-inline="yes-display-inline" id="H56399DB33D5C4B548D43F91D53DE35EE"><enum>(A)</enum><text>In carrying out paragraph (1), the Commissioner of Social Security shall review—</text> 
<clause indent="up1" id="H7C54F6E3C060410F89BAC6AD2341C4A9"><enum>(i)</enum><text>at least 20 percent of all determinations referred to in paragraph (1) that are made in fiscal year 2006;</text></clause> 
<clause indent="up1" id="HCA4BD4BD54BE401BABF880BA11689358"><enum>(ii)</enum><text>at least 40 percent of all such determinations that are made in fiscal year 2007; and</text></clause> 
<clause indent="up1" id="H9B45C095B9BA4746ADD6B829F39D6483"><enum>(iii)</enum><text>at least 50 percent of all such determinations that are made in fiscal year 2008 or thereafter.</text></clause></subparagraph> 
<subparagraph indent="up1" id="H4FE951B9C77A468DBB28ACC694BB006F"><enum>(B)</enum><text>In carrying out subparagraph (A), the Commissioner of Social Security shall, to the extent feasible, select for review the determinations which the Commissioner of Social Security identifies as being the most likely to be incorrect.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></title>

<section id="H9DAF99AC4E37492BB8F6718E2C933F4F"><enum>601.</enum><header>Program coordination demonstration projects</header> 
<subsection id="H921B8A820DE84154802227138BD320E4"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to establish a program of demonstration projects in a State or portion of a State to coordinate multiple public assistance, workforce development, and other programs, for the purpose of supporting working individuals and families, helping families escape welfare dependency, promoting child well-being, or helping build stronger families, using innovative approaches to strengthen service systems and provide more coordinated and effective service delivery.</text></subsection> 
<subsection id="H162D33E69E7647E2BD32EAD6BF80C281"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H3E315ED0FF4D408AA6F621F31FCDBA00"><enum>(1)</enum><header>Administering Secretary</header><text>The term <term>administering Secretary</term> means, with respect to a qualified program, the head of the Federal agency responsible for administering the program.</text></paragraph> 
<paragraph id="H81007CC450E1486E8B6FB9D101396E1"><enum>(2)</enum><header>Qualified program</header><text>The term <term>qualified program</term> means—</text> 
<subparagraph id="H3EB3D00FCDB44B36B9EBFE849B3B196"><enum>(A)</enum><text>a program under part A of title IV of the <act-name parsable-cite="SSA">Social Security Act</act-name>;</text></subparagraph> 
<subparagraph id="HAF1F5A452B9F4BEBAECD3F0037F9E2F"><enum>(B)</enum><text>the program under title XX of such Act;</text></subparagraph> 
<subparagraph id="HEFE60C5B93B3421B809592E98C77C164"><enum>(C)</enum><text>activities funded under title I of the Workforce Investment Act of 1998, except subtitle C of such title;</text></subparagraph> 
<subparagraph id="H0B9ACC3AA9D44B4989D1F7C249163756"><enum>(D)</enum><text>a demonstration project authorized under section 505 of the Family Support Act of 1988;</text></subparagraph> 
<subparagraph id="HC647C9FF28CE4FD28FEA763886B6068B"><enum>(E)</enum><text>activities funded under the Wagner-Peyser Act;</text></subparagraph> 
<subparagraph id="H660C16DB36644A42BC2848A4DF8EE846"><enum>(F)</enum><text>activities funded under the Adult Education and Family Literacy Act;</text></subparagraph> 
<subparagraph id="H326B0C7629A84854A47F684D13358F68"><enum>(G)</enum><text>activities funded under the <act-name parsable-cite="CCDBGA90">Child Care and Development Block Grant Act of 1990</act-name>;</text></subparagraph> 
<subparagraph id="H1DBFF6F2DCF34BC5A8BDC2BD004DF758"><enum>(H)</enum><text>activities funded under the <act-name parsable-cite="USHA">United States Housing Act of 1937</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1437">42 U.S.C. 1437 et seq.</external-xref>), except that such term shall not include—</text> 
<clause id="HA5A523B39DC24268938EEE39BEACE000"><enum>(i)</enum><text>any program for rental assistance under section 8 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>); and</text></clause> 
<clause id="H349E37872E9143968B42B7479FB4FD99"><enum>(ii)</enum><text>the program under section 7 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1437e">42 U.S.C. 1437e</external-xref>) for designating public housing for occupancy by certain populations;</text> 
<subclause indent="up2" id="H37802586576C40E09C6222081C3D1EFB"><enum>(I)</enum><text>activities funded under title I, II, III, or IV of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11301">42 U.S.C. 11301 et seq.</external-xref>); or</text></subclause></clause></subparagraph> 
<subparagraph id="HA8CC144523C942F6A54900E80513A588"><enum>(J)</enum><text>the food stamp program as defined in section 3(h) of the <act-name parsable-cite="FSA77">Food Stamp Act of 1977</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012(h)</external-xref>).</text></subparagraph></paragraph></subsection> 
<subsection id="H3A64E8D8CC654DDEBACFE9D863BCBC4"><enum>(c)</enum><header>Application requirements</header><text>The head of a State entity or of a sub-State entity administering 2 or more qualified programs proposed to be included in a demonstration project under this section shall (or, if the project is proposed to include qualified programs administered by 2 or more such entities, the heads of the administering entities (each of whom shall be considered an applicant for purposes of this section) shall jointly) submit to the administering Secretary of each such program an application that contains the following:</text> 
<paragraph id="HA39E8C841A4B4DFD97B501EAC100D95F"><enum>(1)</enum><header>Programs included</header><text>A statement identifying each qualified program to be included in the project, and describing how the purposes of each such program will be achieved by the project.</text></paragraph> 
<paragraph id="HA0BC32B2EA6E40CEAA5EACF33FFA809C"><enum>(2)</enum><header>Population served</header><text>A statement identifying the population to be served by the project and specifying the eligibility criteria to be used.</text></paragraph> 
<paragraph id="HBE81B942F73144ACAE0917EC760086B2"><enum>(3)</enum><header>Description and justification</header><text>A detailed description of the project, including—</text> 
<subparagraph id="H86E64EB024064D66852742BF16619D4F"><enum>(A)</enum><text>a description of how the project is expected to improve or enhance achievement of the purposes of the programs to be included in the project, from the standpoint of quality, of cost-effectiveness, or of both; and</text></subparagraph> 
<subparagraph id="H312D22E8B3C545B4B34209B05C6F7396"><enum>(B)</enum><text>a description of the performance objectives for the project, including any proposed modifications to the performance measures and reporting requirements used in the programs.</text></subparagraph></paragraph> 
<paragraph id="HAF14AC5C6B484FB100B2E91D0096563D"><enum>(4)</enum><header>Waivers requested</header><text>A description of the statutory and regulatory requirements with respect to which a waiver is requested in order to carry out the project, and a justification of the need for each such waiver.</text></paragraph> 
<paragraph id="HC56A35E9241E45068E2BF656041BCBA3"><enum>(5)</enum><header>Cost neutrality</header><text>Such information and assurances as necessary to establish to the satisfaction of the administering Secretary, in consultation with the Director of the Office of Management and Budget, that the proposed project is reasonably expected to meet the applicable cost neutrality requirements of subsection (d)(4).</text></paragraph> 
<paragraph id="HE37C2F449758450F91E10039F0B200D2"><enum>(6)</enum><header>Evaluation and reports</header><text>An assurance that the applicant will conduct ongoing and final evaluations of the project, and make interim and final reports to the administering Secretary, at such times and in such manner as the administering Secretary may require.</text></paragraph> 
<paragraph id="H9819BFCB14914FB09943C507EF5DEACD"><enum>(7)</enum><header>Public housing agency plan</header><text>In the case of an application proposing a demonstration project that includes activities referred to in subsection (b)(2)(H) of this section—</text> 
<subparagraph id="HCD6645E1811A4BBAAC3F4D999FDB297D"><enum>(A)</enum><text>a certification that the applicable annual public housing agency plan of any agency affected by the project that is approved under section 5A of the <act-name parsable-cite="USHA">United States Housing Act of 1937</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1437c-1">42 U.S.C. 1437c–1</external-xref>) by the Secretary includes the information specified in paragraphs (1) through (4) of this subsection; and</text></subparagraph> 
<subparagraph id="H057DAC3A4E5A4203ABB470F4F50224DD"><enum>(B)</enum><text>any resident advisory board recommendations, and other information, relating to the project that, pursuant to section 5A(e)(2) of the <act-name parsable-cite="USHA">United States Housing Act of 1937</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1437c-1">42 U.S.C. 1437c–1(e)(2)</external-xref>, is required to be included in the public housing agency plan of any public housing agency affected by the project.</text></subparagraph></paragraph> 
<paragraph id="HE1A2912623EF4F3B8D00DD513C43AE"><enum>(8)</enum><header>Other information and assurances</header><text>Such other information and assurances as the administering Secretary may require.</text></paragraph></subsection> 
<subsection id="H1AB0B5413B784125B0F65024CB00A41E"><enum>(d)</enum><header>Approval of applications</header> 
<paragraph id="H6E927A5A49804D038CD4D3E4536DF0F1"><enum>(1)</enum><header>In general</header><text>The administering Secretary with respect to a qualified program that is identified in an application submitted pursuant to subsection (c) may approve the application and, except as provided in paragraph (2), waive any requirement applicable to the program, to the extent consistent with this section and necessary and appropriate for the conduct of the demonstration project proposed in the application, if the administering Secretary determines that the project—</text> 
<subparagraph id="H0ACC2719ADCB4122B47559BDFC5CC4E8"><enum>(A)</enum><text>has a reasonable likelihood of achieving the objectives of the programs to be included in the project;</text></subparagraph> 
<subparagraph id="H0106BFEE1D8A49D399CA56D1B934E9C4"><enum>(B)</enum><text>may reasonably be expected to meet the applicable cost neutrality requirements of paragraph (4), as determined by the Director of the Office of Management and Budget; and</text></subparagraph> 
<subparagraph id="HC7DA89E587FC458A00A0C4B66C66DADE"><enum>(C)</enum><text>includes the coordination of 2 or more qualified programs.</text></subparagraph></paragraph> 
<paragraph id="HA0F28CD13CB2460A9509BC30C7DEF322"><enum>(2)</enum><header>Provisions excluded from waiver authority</header><text>A waiver shall not be granted under paragraph (1)—</text> 
<subparagraph id="H5EFC8E556B2145DEAEEB96DAFA27EF0"><enum>(A)</enum><text>with respect to any provision of law relating to—</text> 
<clause id="H222648B732604139BA8CD1187B004050"><enum>(i)</enum><text>civil rights or prohibition of discrimination;</text></clause> 
<clause id="H6FD8147A193C466884CEB30102E6D153"><enum>(ii)</enum><text>purposes or goals of any program;</text></clause> 
<clause id="H5F4D6BD71E51474C9D808596A87C3C60"><enum>(iii)</enum><text>maintenance of effort requirements;</text></clause> 
<clause id="H2443CEC104A543E2A643B11B434DA66E"><enum>(iv)</enum><text>health or safety;</text></clause> 
<clause id="H000B9619871247F881DD17D38871FEBA"><enum>(v)</enum><text>labor standards under the Fair Labor Standards Act of 1938; or</text></clause> 
<clause id="HC52928AF3A9942DEB43FE04F027BE0B8"><enum>(vi)</enum><text>environmental protection;</text></clause></subparagraph> 
<subparagraph id="H5ACC8994B23148FB8E317D366649E3D1"><enum>(B)</enum><text>with respect to section 241(a) of the Adult Education and Family Literacy Act;</text></subparagraph> 
<subparagraph id="HEEFEF98E4E5C4B14B4E1F60030E9B9F"><enum>(C)</enum><text>in the case of a program under the <act-name parsable-cite="USHA">United States Housing Act of 1937</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1437">42 U.S.C. 1437 et seq.</external-xref>), with respect to any requirement under section 5A of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1437c-1">42 U.S.C. 1437c–1</external-xref>; relating to public housing agency plans and resident advisory boards);</text></subparagraph> 
<subparagraph id="HB92352E0361A45BAB6B339943905DD7"><enum>(D)</enum><text>in the case of a program under the Workforce Investment Act, with respect to any requirement the waiver of which would violate section 189(i)(4)(A)(i) of such Act;</text></subparagraph> 
<subparagraph id="H73434FA1F7EC435C99A01C2D7F19BB7"><enum>(E)</enum><text>in the case of the food stamp program (as defined in section 3(h) of the <act-name parsable-cite="FSA77">Food Stamp Act of 1977</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012(h)</external-xref>), with respect to any requirement under—</text> 
<clause id="HE124249C483F4686853CB8DFFBACE855"><enum>(i)</enum><text>section 6 (if waiving a requirement under such section would have the effect of expanding eligibility for the program), 7(b) or 16(c) of the <act-name parsable-cite="FSA77">Food Stamp Act of 1977</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>); or</text></clause> 
<clause id="H897E0AE1737B4C519DECF49230CA6E67"><enum>(ii)</enum><text>title IV of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1601">8 U.S.C. 1601 et seq.</external-xref>);</text></clause></subparagraph> 
<subparagraph id="HA1E9C08A2836418B92DCF96025067A2"><enum>(F)</enum><text>with respect to any requirement that a State pass through to a sub-State entity part or all of an amount paid to the State;</text></subparagraph> 
<subparagraph id="H4A4DF2A76AEC41C09F008D00226B8B84"><enum>(G)</enum><text>if the waiver would waive any funding restriction or limitation provided in an appropriations Act, or would have the effect of transferring appropriated funds from 1 appropriations account to another; or</text></subparagraph> 
<subparagraph id="HCF23826295FA4180A538653DF723E151"><enum>(H)</enum><text>except as otherwise provided by statute, if the waiver would waive any funding restriction applicable to a program authorized under an Act which is not an appropriations Act (but not including program requirements such as application procedures, performance standards, reporting requirements, or eligibility standards), or would have the effect of transferring funds from a program for which there is direct spending (as defined in section 250(c)(8) of the Balanced Budget and Emergency Deficit Control Act of 1985) to another program.</text></subparagraph></paragraph> 
<paragraph id="HB1B84632E2AE4FD2BD51008E3821A2AE"><enum>(3)</enum><header>Agreement of each administering Secretary required</header> 
<subparagraph id="H2DBE354DA87A4AAB95E0745FE3BF748"><enum>(A)</enum><header>In general</header><text>An applicant may not conduct a demonstration project under this section unless each administering Secretary with respect to any program proposed to be included in the project has approved the application to conduct the project.</text></subparagraph> 
<subparagraph id="H59C17BDC17B146D09537059BD79BC9BF"><enum>(B)</enum><header>Agreement with respect to funding and implementation</header><text>Before approving an application to conduct a demonstration project under this section, an administering Secretary shall have in place an agreement with the applicant with respect to the payment of funds and responsibilities required of the administering Secretary with respect to the project.</text></subparagraph></paragraph> 
<paragraph id="HDA59D201DA5D46B3BDD83452A600144D"><enum>(4)</enum><header>Cost-neutrality requirement</header> 
<subparagraph id="HD66BE361FFBD464DA3FE47007F7BE176"><enum>(A)</enum><header>General rule</header><text>Notwithstanding any other provision of law (except subparagraph (B)), the total of the amounts that may be paid by the Federal Government for a fiscal year with respect to the programs in the State in which an entity conducting a demonstration project under this section is located that are affected by the project shall not exceed the estimated total amount that the Federal Government would have paid for the fiscal year with respect to the programs if the project had not been conducted, as determined by the Director of the Office of Management and Budget.</text></subparagraph> 
<subparagraph id="H98D866C006244AA79322B58D68E64A1"><enum>(B)</enum><header>Special rule</header><text>If an applicant submits to the Director of the Office of Management and Budget a request to apply the rules of this subparagraph to the programs in the State in which the applicant is located that are affected by a demonstration project proposed in an application submitted by the applicant pursuant to this section, during such period of not more than 5 consecutive fiscal years in which the project is in effect, and the Director determines, on the basis of supporting information provided by the applicant, to grant the request, then, notwithstanding any other provision of law, the total of the amounts that may be paid by the Federal Government for the period with respect to the programs shall not exceed the estimated total amount that the Federal Government would have paid for the period with respect to the programs if the project had not been conducted.</text></subparagraph></paragraph> 
<paragraph id="HB503EA55644944CCABB4EF811EB402F6"><enum>(5)</enum><header>90-day approval deadline</header> 
<subparagraph id="HE4D154FC6DB64128A0D20C9D4FD18CF"><enum>(A)</enum><header>In general</header><text>If an administering Secretary receives an application to conduct a demonstration project under this section and does not disapprove the application within 90 days after the receipt, then—</text> 
<clause id="H367328FC79CF44759E2EEF023188BE94"><enum>(i)</enum><text>the administering Secretary is deemed to have approved the application for such period as is requested in the application, except to the extent inconsistent with subsection (e); and</text></clause> 
<clause id="HFD00C949854A423485E0AFC512BEF3EE"><enum>(ii)</enum><text>any waiver requested in the application which applies to a qualified program that is identified in the application and is administered by the administering Secretary is deemed to be granted, except to the extent inconsistent with paragraph (2) or (4) of this subsection.</text></clause></subparagraph> 
<subparagraph id="H42183A3197A94085A8AB423F29327C34"><enum>(B)</enum><header>Deadline extended if additional information is sought</header><text>The 90-day period referred to in subparagraph (A) shall not include any period that begins with the date the Secretary requests the applicant to provide additional information with respect to the application and ends with the date the additional information is provided.</text></subparagraph></paragraph></subsection> 
<subsection id="HA0F4786A3311457FBFFADE70A1AE0087"><enum>(e)</enum><header>Duration of projects</header><text>A demonstration project under this section may be approved for a term of not more than 5 years.</text></subsection> 
<subsection id="H8A190567E9F04FDE91AC3412DD1EBF02"><enum>(f)</enum><header>Reports to Congress</header> 
<paragraph id="HB951E5929B9D452EA163716E41FFAAEA"><enum>(1)</enum><header>Report on disposition of applications</header><text>Within 90 days after an administering Secretary receives an application submitted pursuant to this section, the administering Secretary shall submit to each Committee of the Congress which has jurisdiction over a qualified program identified in the application notice of the receipt, a description of the decision of the administering Secretary with respect to the application, and the reasons for approving or disapproving the application.</text></paragraph> 
<paragraph id="H9BF9274CFD5543D88E804D25517FD668"><enum>(2)</enum><header>Reports on projects</header><text>Each administering Secretary shall provide annually to the Congress a report concerning demonstration projects approved under this section, including—</text> 
<subparagraph id="H9B0DD37F448B4BEFAABC8314F213AD06"><enum>(A)</enum><text>the projects approved for each applicant;</text></subparagraph> 
<subparagraph id="HC1C36991CA794C988E5BC083D879BE00"><enum>(B)</enum><text>the number of waivers granted under this section, and the specific statutory provisions waived;</text></subparagraph> 
<subparagraph id="H5BD43496F1194D37A99559ED6FB7BE59"><enum>(C)</enum><text>how well each project for which a waiver is granted is improving or enhancing program achievement from the standpoint of quality, cost-effectiveness, or both;</text></subparagraph> 
<subparagraph id="H511B929DDD3745F5BA2CC868F268275E"><enum>(D)</enum><text>how well each project for which a waiver is granted is meeting the performance objectives specified in subsection (c)(3)(B);</text></subparagraph> 
<subparagraph id="H8EB3C56B4C974D4F96413C443732DA05"><enum>(E)</enum><text>how each project for which a waiver is granted is conforming with the cost-neutrality requirements of subsection (d)(4); and</text></subparagraph> 
<subparagraph id="H713341C4665B4971A7E6EFFDE63B0091"><enum>(F)</enum><text>to the extent the administering Secretary deems appropriate, recommendations for modification of programs based on outcomes of the projects.</text></subparagraph></paragraph></subsection> 
<subsection id="H468D729A621B4D33A85270E5633015F4"><enum>(g)</enum><header>Amendment to <act-name parsable-cite="USHA">United States Housing Act of 1937</act-name></header><text>Section 5A(d) of the <act-name parsable-cite="USHA">United States Housing Act of 1937</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1437c-1">42 U.S.C. 1437c–1(d)</external-xref>) is amended—</text> 
<paragraph id="H220877308EEB4CC9A934AD6F009D6BFB"><enum>(1)</enum><text>by redesignating paragraph (18) as paragraph (19); and</text></paragraph> 
<paragraph id="H140C31E2C07547DF92ECC8C921D70036"><enum>(2)</enum><text>by inserting after paragraph (17) the following new paragraph:</text>

<paragraph id="H821E639BEAAD49F2BF5E62E8A0149576"><enum>(18)</enum><header>Program coordination demonstration projects</header><text>In the case of an agency that administers an activity referred to in section 601(b)(2)(H) of the Personal Responsibility, Work, and Family Promotion Act of 2005 that, during such fiscal year, will be included in a demonstration project under section 601 of such Act, the information that is required to be included in the application for the project pursuant to paragraphs (1) through (4) of section 601(b) of such Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H7FD2E1A59E334FE7A373383FF319FA25"><enum>602.</enum><header>State food assistance block grant demonstration project</header><text display-inline="no-display-inline">The <act-name parsable-cite="FSA77">Food Stamp Act of 1977</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block act-name="Food Stamp Act of 1977" id="H07311F0F94604FE79F61ECA1C4C0C262"> 
<section id="H9949645F202D41F6AE85EA757FFFD8A"><enum>28.</enum><header>State food assistance block grant demonstration project</header> 
<subsection id="HB44B4ECBC6C6482092507D9B1DE276A0"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a program to make grants to States in accordance with this section to provide—</text> 
<paragraph id="H988ABE06B3194E939EA828994E64C404"><enum>(1)</enum><text>food assistance to needy individuals and families residing in the State;</text></paragraph> 
<paragraph id="H402FDCA0582840C699FD1BC3C5D1552"><enum>(2)</enum><text>funds to operate an employment and training program under subsection (g) for needy individuals under the program; and</text></paragraph> 
<paragraph id="HAD502927ABBC4E16970372EED73C0327"><enum>(3)</enum><text>funds for administrative costs incurred in providing the assistance.</text></paragraph></subsection> 
<subsection id="HA35E9A5E4E5449D296E545D0B96C2766"><enum>(b)</enum><header>Election</header> 
<paragraph id="H030ABED8390C48C8A77C85B869F5CECD"><enum>(1)</enum><header>In general</header><text>A State may elect to participate in the program established under subsection (a).</text></paragraph> 
<paragraph id="H340220BC423E4ACC9DDA13DE0037593D"><enum>(2)</enum><header>Election revocable</header><text>A State that elects to participate in the program established under subsection (a) may subsequently reverse the election of the State only once thereafter. Following the reversal, the State shall only be eligible to participate in the food stamp program in accordance with the other sections of this Act and shall not receive a block grant under this section.</text></paragraph> 
<paragraph id="H8360AC6D1EB34C79A81975F2202E5C92"><enum>(3)</enum><header>Program exclusive</header><text>A State that is participating in the program established under subsection (a) shall not be subject to, or receive any benefit under, this Act except as provided in this section.</text></paragraph></subsection> 
<subsection id="H53B67ABF3DFC450F9D00B53F8C111381"><enum>(c)</enum><header>Lead agency</header> 
<paragraph id="H75BD8C71843F470F84E08C6418B1F456"><enum>(1)</enum><header>Designation</header><text>A State desiring to participate in the program established under subsection (a) shall designate, in an application submitted to the Secretary under subsection (d)(1), an appropriate State agency that complies with paragraph (2) to act as the lead agency for the State.</text></paragraph> 
<paragraph id="H068B43DC92FF4DE3A81F7830E00BC85"><enum>(2)</enum><header>Duties</header><text>The lead agency shall—</text> 
<subparagraph id="H78CDEE1DC9814CF0933133BA934436E3"><enum>(A)</enum><text>administer, either directly, through other State agencies, or through local agencies, the assistance received under this section by the State;</text></subparagraph> 
<subparagraph id="H30F278A23A2B40ED936B30AA18D6578F"><enum>(B)</enum><text>develop the State plan to be submitted to the Secretary under subsection (d)(1); and</text></subparagraph> 
<subparagraph id="HB59490456BAD463A0037FE57DFF1D600"><enum>(C)</enum><text>coordinate the provision of food assistance under this section with other Federal, State, and local programs.</text></subparagraph></paragraph></subsection> 
<subsection id="H59E76B984B07488B9416E65967D31C35"><enum>(d)</enum><header>Application and plan</header> 
<paragraph id="H681B230A6F914777BE00086FFE9282D2"><enum>(1)</enum><header>Application</header><text>To be eligible to receive assistance under this section, a State shall prepare and submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary shall by regulation require, including—</text> 
<subparagraph id="HA1F0BDA4134C4EC6002148FAF7955F05"><enum>(A)</enum><text>an assurance that the State will comply with the requirements of this section;</text></subparagraph> 
<subparagraph id="HE92D98C3B92E4517BEF4ADED13005CED"><enum>(B)</enum><text>a State plan that meets the requirements of paragraph (2); and</text></subparagraph> 
<subparagraph id="HF9AF265C70CD4C2BAD57DE949713C4C7"><enum>(C)</enum><text>an assurance that the State will comply with the requirements of the State plan under paragraph (2).</text></subparagraph></paragraph> 
<paragraph id="H6CCC52601C184B55AA476B7C89B83CAF"><enum>(2)</enum><header>Requirements of plan</header> 
<subparagraph id="H6960D6DAA92B461683C5002F76FC71C3"><enum>(A)</enum><header>Lead agency</header><text>The State plan shall identify the lead agency.</text></subparagraph> 
<subparagraph id="H1332AD67743344C4A5B8FD1D4C32B8F7"><enum>(B)</enum><header>Use of block grant funds</header><text>The State plan shall provide that the State shall use the amounts provided to the State for each fiscal year under this section—</text> 
<clause id="HDD586CE26EC74FC2984CAC70AC33F3BF"><enum>(i)</enum><text>to provide food assistance to needy individuals and families residing in the State, other than residents of institutions who are ineligible for food stamps under section 3(i);</text></clause> 
<clause id="HEF2BE3D89D404714A3AEBD96ACBF3DB3"><enum>(ii)</enum><text>to administer an employment and training program under subsection (g) for needy individuals under the program and to provide reimbursements to needy individuals and families as would be allowed under section 16(h)(3); and</text></clause> 
<clause id="H7EC4243FBFA94C15AFDEB7C81FB7C09C"><enum>(iii)</enum><text>to pay administrative costs incurred in providing the assistance.</text></clause></subparagraph> 
<subparagraph id="HE2DDCB11307C4E369FC2ABBB1B6BB79C"><enum>(C)</enum><header>Assistance for entire State</header><text>The State plan shall provide that benefits under this section shall be available throughout the entire State.</text></subparagraph> 
<subparagraph id="H4221A41FE1044FB6AA824711CEC4DA04"><enum>(D)</enum><header>Notice and hearings</header><text>The State plan shall provide that an individual or family who applies for, or receives, assistance under this section shall be provided with notice of, and an opportunity for a hearing on, any action under this section that adversely affects the individual or family.</text></subparagraph> 
<subparagraph id="HD38BA7568FBA4D40B8440079E7003415"><enum>(E)</enum><header>Other assistance</header> 
<clause id="HB83F1A3A5FCE4DD7B599B521846729C3"><enum>(i)</enum><header>Coordination</header><text>The State plan may coordinate assistance received under this section with assistance provided under the State program funded under part A of title IV of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>).</text></clause> 
<clause id="H37761CACBA5A4428954ED4F9FA984733"><enum>(ii)</enum><header>Penalties</header><text>If an individual or family is penalized for violating part A of title IV of the Act, the State plan may reduce the amount of assistance provided under this section or otherwise penalize the individual or family.</text></clause></subparagraph> 
<subparagraph id="H254B658084A44E6AAE08A3A312EC2354"><enum>(F)</enum><header>Eligibility limitations</header><text>The State plan shall describe the income and resource eligibility limitations that are established for the receipt of assistance under this section.</text></subparagraph> 
<subparagraph id="H570D3341AF3149A9B29627BB64F7A7CD"><enum>(G)</enum><header>Receiving benefits in more than 1 jurisdiction</header><text>The State plan shall establish a system to verify and otherwise ensure that no individual or family shall receive benefits under this section in more than 1 jurisdiction within the State.</text></subparagraph> 
<subparagraph id="H57D02619783E46669810FA729D0090E6"><enum>(H)</enum><header>Privacy</header><text>The State plan shall provide for safeguarding and restricting the use and disclosure of information about any individual or family receiving assistance under this section.</text></subparagraph> 
<subparagraph id="HEE844A6BA5AB4476A5FF4631E96EC8B6"><enum>(I)</enum><header>Other information</header><text>The State plan shall contain such other information as may be required by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="HC5EF919F61D445D7A52078127263B41"><enum>(3)</enum><header>Approval of application and plan</header><text>During fiscal years 2006 through 2010, the Secretary may approve the applications and State plans that satisfy the requirements of this section of not more than 5 States for a term of not more than 5 years.</text></paragraph></subsection> 
<subsection id="H2ED81E5E0D0C4A0A0050A901F365B3BC"><enum>(e)</enum><header>Construction of facilities</header><text>No funds made available under this section shall be expended for the purchase or improvement of land, or for the purchase, construction, or permanent improvement of any building or facility.</text></subsection> 
<subsection id="HBEEC04446E5C4A3BA866248E20622114"><enum>(f)</enum><header>Benefits for aliens</header><text>No individual shall be eligible to receive benefits under a State plan approved under subsection (d)(3) if the individual is not eligible to participate in the food stamp program under title IV of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1601">8 U.S.C. 1601 et seq.</external-xref>).</text></subsection> 
<subsection id="HA130E588AEDB436FAFFC16DFE615DB88"><enum>(g)</enum><header>Employment and training</header><text>Each State shall implement an employment and training program for needy individuals under the program.</text></subsection> 
<subsection id="H460E87756A6A44DD84001F6CC66493A6"><enum>(h)</enum><header>Enforcement</header> 
<paragraph id="H506A69BC2AD2484496541B48D65CDB7D"><enum>(1)</enum><header>Review of compliance with State plan</header><text>The Secretary shall review and monitor State compliance with this section and the State plan approved under subsection (d)(3).</text></paragraph> 
<paragraph id="HE487C7DC027A45EFB0DFC066CFFE7871"><enum>(2)</enum><header>Noncompliance</header> 
<subparagraph id="H2D26635432234D38BA5FA02F71F93054"><enum>(A)</enum><header>In general</header><text>If the Secretary, after reasonable notice to a State and opportunity for a hearing, finds that—</text> 
<clause id="HC99F8AF0C2164964A7E5C08B25528C62"><enum>(i)</enum><text>there has been a failure by the State to comply substantially with any provision or requirement set forth in the State plan approved under subsection (d)(3); or</text></clause> 
<clause id="H496DFC10618040B38F4C03A0C273CAB9"><enum>(ii)</enum><text>in the operation of any program or activity for which assistance is provided under this section, there is a failure by the State to comply substantially with any provision of this section, the Secretary shall notify the State of the finding and that no further payments will be made to the State under this section (or, in the case of noncompliance in the operation of a program or activity, that no further payments to the State will be made with respect to the program or activity) until the Secretary is satisfied that there is no longer any failure to comply or that the noncompliance will be promptly corrected.</text></clause></subparagraph> 
<subparagraph id="H94B2A2247FA7495FB6EAFC92D469314"><enum>(B)</enum><header>Other sanctions</header><text>In the case of a finding of noncompliance made pursuant to subparagraph (A), the Secretary may, in addition to, or in lieu of, imposing the sanctions described in subparagraph (A), impose other appropriate sanctions, including recoupment of money improperly expended for purposes prohibited or not authorized by this section and disqualification from the receipt of financial assistance under this section.</text></subparagraph> 
<subparagraph id="HD0C29C4B97B34EDDABB267E479A7D034"><enum>(C)</enum><header>Notice</header><text>The notice required under subparagraph (A) shall include a specific identification of any additional sanction being imposed under subparagraph (B).</text></subparagraph></paragraph> 
<paragraph id="H891E5924BDC24D8382E9C00096EB2391"><enum>(3)</enum><header>Issuance of regulations</header><text>The Secretary shall establish by regulation procedures for—</text> 
<subparagraph id="H8E971DD7233A4E40B4B6CFC4D0D6F348"><enum>(A)</enum><text>receiving, processing, and determining the validity of complaints concerning any failure of a State to comply with the State plan or any requirement of this section; and</text></subparagraph> 
<subparagraph id="H843685E8B9B54BB5AB2BDFFFB1F8DEC2"><enum>(B)</enum><text>imposing sanctions under this section.</text></subparagraph></paragraph></subsection> 
<subsection id="H3296FD2B3D434BE195F9BEBB00006395"><enum>(i)</enum><header>Payments</header> 
<paragraph id="HCD299645DB144774851E033087004FF8"><enum>(1)</enum><header>In general</header><text>For each fiscal year, the Secretary shall pay to a State that has an application approved by the Secretary under subsection (d)(3) an amount that is equal to the allotment of the State under subsection (l)(2) for the fiscal year.</text></paragraph> 
<paragraph id="HC9E88E97ECD54A22B340663F7DE61783"><enum>(2)</enum><header>Method of payment</header><text>The Secretary shall make payments to a State for a fiscal year under this section by issuing 1 or more letters of credit for the fiscal year, with necessary adjustments on account of overpayments or underpayments, as determined by the Secretary.</text></paragraph> 
<paragraph id="HEE1E6ED97DCD4B30ADB4F3C854145355"><enum>(3)</enum><header>Spending of funds by State</header> 
<subparagraph id="H1169C187A72447C2A0996E8958AA3205"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), payments to a State from an allotment under subsection (l)(2) for a fiscal year may be expended by the State only in the fiscal year.</text></subparagraph> 
<subparagraph id="HFD467CE02EBC46FF98B353EF19D3B51D"><enum>(B)</enum><header>Carryover</header><text>The State may reserve up to 10 percent of an allotment under subsection (l)(2) for a fiscal year to provide assistance under this section in subsequent fiscal years, except that the reserved funds may not exceed 30 percent of the total allotment received under this section for a fiscal year.</text></subparagraph></paragraph> 
<paragraph id="H4B2903929B4247048174602C21A1836E"><enum>(4)</enum><header>Provision of food assistance</header><text>A State may provide food assistance under this section in any manner determined appropriate by the State to provide food assistance to needy individuals and families in the State, such as electronic benefits transfer limited to food purchases, coupons limited to food purchases, or direct provision of commodities.</text></paragraph> 
<paragraph id="H507EC0B0A12C4AFFA19BF3CF655D6BB"><enum>(5)</enum><header>Definition of food assistance</header><text>In this section, the term <term>food assistance</term> means assistance that may be used only to obtain food, as defined in section 3(g).</text></paragraph></subsection> 
<subsection id="H351862138A17488ABAE2BCAC116D9E32"><enum>(j)</enum><header>Audits</header> 
<paragraph id="H96DD4C5B3B2C49F48390A958C3FE3337"><enum>(1)</enum><header>Requirement</header><text>After the close of each fiscal year, a State shall arrange for an audit of the expenditures of the State during the program period from amounts received under this section.</text></paragraph> 
<paragraph id="HF4871D8831884CAEADC66084AE59CF00"><enum>(2)</enum><header>Independent auditor</header><text>An audit under this section shall be conducted by an entity that is independent of any agency administering activities that receive assistance under this section and be in accordance with generally accepted auditing principles.</text></paragraph> 
<paragraph id="H2EC88492036548C4B2FEBE199F355500"><enum>(3)</enum><header>Payment accuracy</header><text>Each annual audit under this section shall include an audit of payment accuracy under this section that shall be based on a statistically valid sample of the caseload in the State.</text></paragraph> 
<paragraph id="HDDD2A1A173E94DB785CB37BFDDDAC33C"><enum>(4)</enum><header>Submission</header><text>Not later than 30 days after the completion of an audit under this section, the State shall submit a copy of the audit to the legislature of the State and to the Secretary.</text></paragraph> 
<paragraph id="HE5484559D3A14CD196E922EE5CB6AC00"><enum>(5)</enum><header>Repayment of amounts</header><text>Each State shall repay to the United States any amounts determined through an audit under this section to have not been expended in accordance with this section or to have not been expended in accordance with the State plan, or the Secretary may offset the amounts against any other amount paid to the State under this section.</text></paragraph></subsection> 
<subsection id="H6DECFEDCD26D4FC982202FF28F5D8BE2"><enum>(k)</enum><header>Nondiscrimination</header> 
<paragraph id="HF8159F70E2CD43D4A664B3DE7B00FCE4"><enum>(1)</enum><header>In general</header><text>The Secretary shall not provide financial assistance for any program, project, or activity under this section if any person with responsibilities for the operation of the program, project, or activity discriminates with respect to the program, project, or activity because of race, religion, color, national origin, sex, or disability.</text></paragraph> 
<paragraph id="HF1BC6F7A4715481FBAB478A0D5F1DF64"><enum>(2)</enum><header>Enforcement</header><text>The powers, remedies, and procedures set forth in title VI of the <act-name parsable-cite="CRA64">Civil Rights Act of 1964</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>) may be used by the Secretary to enforce paragraph (1).</text></paragraph></subsection> 
<subsection id="H696F0CA36DC440FF9548683EA6E5198C"><enum>(l)</enum><header>Allotments</header> 
<paragraph id="HA0F57C22DA5A45CC9961BC192E5EC6AF"><enum>(1)</enum><header>Definition of State</header><text>In this section, the term ’State’ means each of the 50 States, the District of Columbia, Guam, and the Virgin Islands of the United States.</text></paragraph> 
<paragraph id="H58A52BEAEA7A4B35ABADF0013CD14C2"><enum>(2)</enum><header>State allotment</header> 
<subparagraph id="HC91AEC2D07CB45D2A319D8F892177C78"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), from the amounts made available under section 18 of this Act for each fiscal year, the Secretary shall allot to each State participating in the program established under subsection (a) an amount that is equal to the sum of—</text> 
<clause id="H2EFA0A42028C41EB95AD34CB3B163C65"><enum>(i)</enum><text>the greater of, as determined by the Secretary—</text> 
<subclause id="H2EE8DE9F6BAA483CBEED51C45D3C91EE"><enum>(I)</enum><text>the total dollar value of all benefits issued under the food stamp program established under this Act by the State during fiscal year 2005; or</text></subclause> 
<subclause id="H194651FE09E14749AD0166D06C0056A6"><enum>(II)</enum><text>the average per fiscal year of the total dollar value of all benefits issued under the food stamp program by the State during each of fiscal years 2003 through 2005; and</text></subclause></clause> 
<clause id="H1D32559F62B04021A762FAA7703EE09C"><enum>(ii)</enum><text>the greater of, as determined by the Secretary—</text> 
<subclause id="H6F790C43785B495683FC9D87AFB7799E"><enum>(I)</enum><text>the total amount received by the State for administrative costs and the employment and training program under subsections (a) and (h), respectively, of section 16 of this Act for fiscal year 2005; or</text></subclause> 
<subclause id="H5732645EBA074F38A0E011002C001461"><enum>(II)</enum><text>the average per fiscal year of the total amount received by the State for administrative costs and the employment and training program under subsections (a) and (h), respectively, of section 16 of this Act for each of fiscal years 2003 through 2005.</text></subclause></clause></subparagraph> 
<subparagraph id="H45C6EE1BF7B04BE48FBE38A57CA6189F"><enum>(B)</enum><header>Insufficient funds</header><text>If the Secretary finds that the total amount of allotments to which States would otherwise be entitled for a fiscal year under subparagraph (A) will exceed the amount of funds that will be made available to provide the allotments for the fiscal year, the Secretary shall reduce the allotments made to States under this subsection, on a pro rata basis, to the extent necessary to allot under this subsection a total amount that is equal to the funds that will be made available.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></title>

<section id="H45EF2A46CFE446DF822141DBFF25ECCB"><enum>701.</enum><header>Extension of abstinence education program</header> 
<subsection id="H91D81218398148549B79A0A51BD4261C"><enum>(a)</enum><header>Extension of appropriations</header> 
<paragraph id="H336CF1F1CCD94CF5B8C77D2102D89463"><enum>(1)</enum><header>In general</header><text>Section 510(d) (<external-xref legal-doc="usc" parsable-cite="usc/42/710">42 U.S.C. 710(d)</external-xref>) is amended in the first sentence by inserting before the period the following: <quote>and for each of the fiscal years 2006 through 2010</quote>.</text></paragraph> 
<paragraph id="H60CB4BF756514370A9212644C6AB1724"><enum>(2)</enum><header>Additional funds for fiscal year 2005</header> 
<subparagraph id="H7BE8A2C10B6B4896BB5BD2A14E77EFF0"><enum>(A)</enum><header>Additional funds</header><text display-inline="yes-display-inline">Activities authorized by section 510 of the Social Security Act shall continue through September 30, 2005, in the manner authorized for fiscal year 2004, and out of any money in the Treasury of the United States not otherwise appropriated, there are hereby appropriated such sums as may be necessary for such purpose, in addition to other amounts appropriated for such purpose for fiscal year 2005. Grants and payments may be made pursuant to this authority through the fourth quarter of fiscal year 2005 at the level provided for such activities through the fourth quarter of fiscal year 2004.</text></subparagraph> 
<subparagraph id="HBF94FC115C624390A109802C6853F60"><enum>(B)</enum><header>Effective date</header><text>Subparagraph (A) takes effect upon the date of the enactment of this Act.</text></subparagraph></paragraph></subsection> 
<subsection id="H24007857DB6E452085CF3BBB5C13F2B9"><enum>(b)</enum><header>Allotment of funds</header><text>Section 510(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/710">42 U.S.C. 710(a)</external-xref>) is amended—</text> 
<paragraph id="H78F373F56DBA4A1AB66DAA7B00B48DA2"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>an application for the fiscal year under section 505(a)</quote> and inserting <quote>, for the fiscal year, an application under section 505(a), and an application under this section (in such form and meeting such terms and conditions as determined appropriate by the Secretary),</quote>; and</text></paragraph> 
<paragraph id="H8E1DDC6F58854FDA975240C00670364"><enum>(2)</enum><text>in paragraph (2), to read as follows:</text>

<subsection id="H09FD7BEC61864F0DA5D7CCCFFABC098"><enum>(c)</enum><header>Reallotment of funds</header><text>Section 510 (<external-xref legal-doc="usc" parsable-cite="usc/42/710">42 U.S.C. 710(a)</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H4B9526E7BBEC41FF9E1D749FA2472367"><enum>(e)</enum> 
<paragraph display-inline="yes-display-inline" id="HF9E1F346FEAF4EE8B9B554D925F457FE"><enum>(1)</enum><text>With respect to allotments under subsection (a) for fiscal year 2006 and subsequent fiscal years, the amount of any allotment to a State for a fiscal year that the Secretary determines will not be required to carry out a program under this section during such fiscal year or the succeeding fiscal year shall be available for reallotment from time to time during such fiscal years on such dates as the Secretary may fix, to other States that the Secretary determines—</text> 
<subparagraph indent="up1" id="HA951B39C4A1F412E9DF9BDC8755F85B"><enum>(A)</enum><text>require amounts in excess of amounts previously allotted under subsection (a) to carry out a program under this section; and</text></subparagraph> 
<subparagraph indent="up1" id="H8E6F4979536143758D3D006FA8F1A642"><enum>(B)</enum><text>will use such excess amounts during such fiscal years.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="HABAFE9F2D5C843B4819DB51B2D33E94F"><enum>(2)</enum><text>Reallotments under paragraph (1) shall be made on the basis of such States’ applications under this section, after taking into consideration the population of low-income children in each such State as compared with the population of low-income children in all such States with respect to which a determination under paragraph (1) has been made by the Secretary.</text></paragraph> 
<paragraph indent="up1" id="H02657FC89FC94B54B171C387E9640B8"><enum>(3)</enum><text>Any amount reallotted under paragraph (1) to a State is deemed to be part of its allotment under subsection (a).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="HDF68FEE3EEA3411C8294035840A6AF63"><enum>(1)</enum><header>Reductions in payments for administrative costs</header><text>Effective for each of the last 2 calendar quarters in fiscal year 2005 and for each calendar quarter in fiscal year 2006, the Secretary shall reduce the amount paid under subsection (a)(7) to each State by an amount equal to 45 percent for calendar quarters in fiscal year 2005, and 80 percent for calendar quarters in fiscal year 2006, of one-quarter of the annualized amount determined for the medicaid program under section 16(k)(2)(B) of the <act-name parsable-cite="FSA77">Food Stamp Act of 1977</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/7/2025">7 U.S.C. 2025(k)(2)(B)</external-xref>).</text></paragraph> 
<paragraph id="H7DEAF11AA778461D8CF1A005557B9E"><enum>(2)</enum><header>Allocation of administrative costs</header><text>None of the funds or expenditures described in section 16(k)(5)(B) of the <act-name parsable-cite="FSA77">Food Stamp Act of 1977</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/7/2025">7 U.S.C. 2025(k)(5)(B)</external-xref>) may be used to pay for costs—</text> 
<subparagraph id="H3F1CB97B3E94478F95FFEA1F446EE8FE"><enum>(A)</enum><text>eligible for reimbursement under subsection (a)(7) (or costs that would have been eligible for reimbursement but for this subsection); and</text></subparagraph> 
<subparagraph id="H9BEAB6E437D046F3AD5D7379F840E29"><enum>(B)</enum><text>allocated for reimbursement to the program under this title under a plan submitted by a State to the Secretary to allocate administrative costs for public assistance programs;</text></subparagraph><continuation-text continuation-text-level="paragraph">except that, for purposes of subparagraph (A), the reference in clause (iii) of that section to <quote>subsection (a)</quote> is deemed a reference to subsection (a)(7) and clause (iv)(II) of that section shall be applied as if <quote>medicaid program</quote> were substituted for <quote>food stamp program</quote>.</continuation-text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

<subsection id="H2A935792807B46C6B64CCD72BD1198B2"><enum>(b)</enum><header>Exception</header><text>In the case of a State plan under part A or D of title IV of the <act-name parsable-cite="SSA">Social Security Act</act-name> which the Secretary determines requires State legislation in order for the plan to meet the additional requirements imposed by the amendments made by this Act, the effective date of the amendments imposing the additional requirements shall be 3 months after the first day of the first calendar quarter beginning after the close of the first regular session of the State legislature that begins after the date of the enactment of this Act. For purposes of the preceding sentence, in the case of a State that has a 2-year legislative session, each year of the session shall be considered to be a separate regular session of the State legislature.</text></subsection></section></title>
