<official-title>To modify the antitrust exemption applicable to the business of insurance.</official-title>

<section section-type="section-one" id="HFC57CB9421E24D05A3DA4B8A5FC2210" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Insurance Competitive Pricing Act of 2005</short-title></quote>.</text></section> 
<section id="HF811D9C1E8454CBFAF68CC00B549C19F"><enum>2.</enum><header>Amendments</header><text display-inline="no-display-inline">Section 2 of the Act of March 9, 1945 (59 Stat. 34; <external-xref legal-doc="usc" parsable-cite="usc/15/1012">15 U.S.C. 1012</external-xref>), commonly known as the <act-name parsable-cite="MFA">McCarran-Ferguson Act</act-name>, is amended—</text> 
<paragraph id="H0036159D6B1A498F814BD7A2E3BD9DD9"><enum>(1)</enum><text>in subsection (b)—</text> 
<subparagraph id="H0F068BD0860B477AB8E5DCA6D5B92752"><enum>(A)</enum><text>by striking <quote>: Provided, That after June 30, 1948,</quote> and inserting <quote>, except that</quote>,</text></subparagraph> 
<subparagraph id="HD3693BBC61DC49F3B62CAB69858C9C97"><enum>(B)</enum><text>by inserting <quote>section 5 of</quote> after <quote><act-name parsable-cite="CLAY">Clayton Act</act-name>, and</quote>,</text></subparagraph> 
<subparagraph id="HDB6D402FC007498EB9BFBF3CD0D68E54"><enum>(C)</enum><text>by inserting <quote>as such section 5 relates to monopolies, attempts to monopolize, and unlawful restraints of trade,</quote> after <quote>Commission Act, as amended,</quote>, and</text></subparagraph> 
<subparagraph id="H9C62A1D4578C46B1B126838C72D17E7"><enum>(D)</enum><text>by striking <quote>that such business</quote> and all that follows through <quote>law.</quote> and inserting the following:</text> 
<quoted-block style="OLC" id="H4BDF578B2D0E41058BDB4437A42E7DAA" display-inline="no-display-inline"><quoted-block-continuation-text quoted-block-continuation-text-level="subsection">that—</quoted-block-continuation-text> 
<paragraph id="HF5A0517777B342D8000040EE8EB3E7E8"><enum>(1)</enum><text>such business is not regulated by State law; or</text></paragraph> 
<paragraph id="H69556FEC0B9B494C86D2D8EC2A3316D"><enum>(2)</enum><text>the conduct of a person engaged in such business involves—</text> 
<subparagraph id="H2425733BB7A2469E8715B2EF38027F9"><enum>(A)</enum><text>price fixing;</text></subparagraph> 
<subparagraph id="H04D8C33102A741659B7EE35C40335E25"><enum>(B)</enum><text>allocating with a competitor a geographical area in which, or persons to whom, insurance will be offered for sale;</text></subparagraph> 
<subparagraph id="HDEB22C389F4A41500055DA8BAC135B3"><enum>(C)</enum><text>unlawfully tying the sale or purchase of—</text> 
<clause id="HCBD57864127D4B77ACAEAE84672B98DF"><enum>(i)</enum><text>one type of insurance to the sale or purchase of another type of insurance; or</text></clause> 
<clause id="H7FE9D3A9F6FF42A698F835C576305789"><enum>(ii)</enum><text>any type of insurance to the sale or purchase of any other service or product; or</text></clause></subparagraph> 
<subparagraph id="H6C8A55B57D774EEB9B406397004FC309"><enum>(D)</enum><text>monopolizing, or attempting to monopolize, any part of the business of insurance.</text></subparagraph></paragraph><after-quoted-block>, and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H3233993AD3C04C96B62020C1F144F8F4"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block id="HADB3E1C27F0C44C79BC91F230200B71B"> 
<subsection id="H778323FE46CA4628BD29FEB6AB99E193"><enum>(c)</enum><text>The conduct referred to in subsection (b)(2) shall not include making a contract, or engaging in a combination or conspiracy—</text> 
<paragraph id="H91465130F31A438F8B63EED3FCC50AF"><enum>(1)</enum><text>to collect, compile, or disseminate historical loss data;</text></paragraph> 
<paragraph id="H9595CAEF56BD40BEA1255692919C00BC"><enum>(2)</enum><text>to determine a loss development factor applicable to historical loss data; or</text></paragraph> 
<paragraph id="H09A3FCAB8CBE417DA092E822C8247D33"><enum>(3)</enum><text>to perform actuarial services if such contract, combination, or conspiracy does not involve a restraint of trade.</text></paragraph></subsection> 
<subsection id="H33A0CC8F28F1443998A1A1F3B23565FC"><enum>(d)</enum><text>The conduct referred to in subsection (b)(2) shall not include making a contract, or engaging in a combination or conspiracy, to determine a trend factor—</text> 
<paragraph id="H14BD16A1906C4DCC8C47BBF3B11900A0"><enum>(1)</enum><text>during the transition period; and</text></paragraph> 
<paragraph id="H1C09E1B914914491B824D8E2FCF6E908"><enum>(2)</enum><text>in the case of a person with a policyholders’ surplus of less than $10,000,000 or a policyholders’ surplus of less than $100,000,000 and whose direct written insurance premiums for the line of business in question constitutes less than a 2.5 percent share of the total market in the most recently ended 1-year period in every jurisdiction in which the person is engaged in the business of insurance and which is not more than 50 percent owned or controlled by another person engaged in the business of insurance and which does not, together with other persons engaging in such conduct have, in the aggregate, in the then most recently completed 1-year period, 20 percent or more of the relevant market in the line of insurance involved.</text></paragraph></subsection> 
<subsection id="HA16F56730F7345FFB3EE004E532F36EE"><enum>(e)</enum><text>For purposes of this section—</text> 
<paragraph id="H48E7FDAFDF9E4ED5BB88518CC2DB41AE"><enum>(1)</enum><text>the term <term>historical loss data</term> means information respecting claims paid, or reserves held for claims reported, by any person engaged in the business of insurance;</text></paragraph> 
<paragraph id="HCBA82F5BC37049F59B525F404871D5F6"><enum>(2)</enum><text>the term <term>loss development factor</term> means an adjustment to be made to reserves held for losses incurred for claims reported by any person engaged in the business of insurance, for the purpose of bringing such reserves to an ultimate paid basis;</text></paragraph> 
<paragraph id="H25144B81B1A24A828385D8D00063136F"><enum>(3)</enum><text>the term <term>transition period</term> means—</text> 
<subparagraph id="H20A0019239654D8DA5BE85004D4B66D8"><enum>(A)</enum><text>the 4-year period beginning on the effective date of the <short-title>Insurance Competitive Pricing Act of 2005</short-title>, in the case of a person—</text> 
<clause id="H6F4938DD448B4269BB6ED2C89ED0A17F"><enum>(i)</enum><text>that wrote insurance having an aggregate amount of annual premiums less than $20,000,000; and</text></clause> 
<clause id="HFC13CA722A474690B6EAE4370035C65"><enum>(ii)</enum><text>not more than 50 percent of which was owned or controlled by another person engaged in the business of insurance;</text></clause><continuation-text continuation-text-level="subparagraph">in the then most recently ended 1-year period; or</continuation-text></subparagraph> 
<subparagraph id="H6752C0EB7EB648058CED115887D03C88"><enum>(B)</enum><text>the 2-year period beginning on such effective date, in the case of any person to which subparagraph (A) does not apply; and</text></subparagraph></paragraph> 
<paragraph id="HD86440D353C4494C85A5AB17986891AA"><enum>(4)</enum><text>the term <term>trend factor</term> means an adjustment to be made to losses incurred for claims reported by any person engaged in the business of insurance, to reflect a change in inflation or any other change in the estimated loss costs incurred by persons engaged in the business of insurance.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HCD7E61196CC548E8A1AAB3FFE016F62D"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act shall take effect 1 year after the date of the enactment of this Act.</text></section>
